Abstract

Tulisan ini dilatarbelakangi adanya kesaksian testimonium de auditu atau istifadhah di Mahkamah Syar’iyah Bireuen. Dalam peraturan saksi yang tidak melihat secara langsung tidak dibenarkan dalam hukum acara perdata tetapi di Mahkamah Syar’iyah Bireuen dibolehkan dan menggunakan keterangan saksi tersebut sebagai landasan untuk menetapkan sebuah putusan. Berdasarkan hal tersebut, penelitian ini bertujuan untuk menjelaskan prosedur pembuktian saksi testimonium de auditu di Mahkamah Syar'iyah Bireuen dalam perkara itsbat nikah dan mengkaji penerapan saksi testimonium de auditu dalam perkara itsbat nikah di Mahkamah Syar'iyah Bireuen. Hasil penelitian, prosedur pembuktian saksi testimonium de auditu dalam perkara itsbat nikah di Mahkamah Syar'iyah Bireuen sama dengan pemeriksaan saksi-saksi lainnya. Mahkamah Syar’iyah Bireuen akan memeriksa syarat formil dan materil untuk membuat penetapan permohonan diterima atau tidak. Majelis hakim atau ketua hakim menanyakan kepada saksi tentang identitas yang meliputi nama, umur, pekerjaan, tempat tinggal, hubungan saksi dengan para pihak, dan apakah ada hubungan keluarga, perkawinan ataupun hubungan kerja, setelah itu semua di periksa seperti biasa mulai dari sumpah saksi sampai keterangan saksi dikonfirmasi terlebih dahulu kepada para pihak.Penerapan saksi testimonium de audituini juga dalam perkara itsbat nikah di Mahkamah Syar'iyah Bireuen tidak otomatis ditolak sehingga tidak ada nilainya sama sekali, karena dapat diterima sebagai alat bukti dengan menganalisis dasar eksepsional untuk dapat diterimanya dengan mempertimbangkan sejauh mana kualitas dan nilai kekuatan pembuktiannya yang melekat pada keterangan saksi de auditu tersebut, dasar penerimaannya dengan mengambil alih beberapa sumber hukum yang digunakan oleh majelis hakim dalam memeriksa dan membuat putusan baik dalam hukum perdata maupun hukum Islam.Disarankan kepada Mahkamah Syariah Bireuen selain tetap berpegang pada aturan yang berlaku berkaitan dengan saksi juga melihat kepada kasus-kasus yang terjadi dalam masyarakat sehingga keadilan, kepastian dan kemamfatan hukum terjadi.Selain ini Mahkamah Syariah Bireuen juga memperhatikan prosedur seorang boleh dijadikan saksi.

Abstract

Women have achievements and changes in the business sector, including maintaining sustainable food security. On the other hand, the frequent absence of female farmers from agricultural development programs reflects the injustice and inequality in Indonesia between males and females. Performing daily the entire farming process, from seed preparation to planting and maintenance, and even harvesting.  Collaboration is the vehicle for improving women's skills and participation in the agricultural sector. Women farmers' roles and contributions in the coffee farming sector must be considered. The research aims: (1) to strengthening graduates in the sustainable agriculture sector at Malikussaleh University (2) to Graduates' contribution to improving women's skills to study farming for the private sector coffee agricultural and technology at Malikussaleh University. This study used the qualitative method—descriptive data in written or oral words from people and observed behavior. The results showed that one of the reasons low participation of women in cooperatives is limited land ownership had caused woman farmers not eligible to register as cooperative members. Only one person is counted from each household/family and represented by the father/husband. This research provides recommendations on improving women's role and contribution in the agricultural sector by improving their participation in the coffee sector.

Abstract

The Nagoya Protocol is instrumental in the implementation of access and benefit sharing (ABS) in countries with biodiversity. There are however, weaknesses in the implementation of ABS, this includes the wide geographical spread of biodiversity and the difficulty in determining the benefitting owner of a certain area. Indonesia as a country blessed with biodiversity, has ratified the Nagoya Protocol through Act No. 11 of 2013, prepared amendment draft for the Patent Act and has further  prepared Draft Act on Genetic Resources. In the implementation of the Nagoya Protocal and ABS, Indonesia could refer to India’s experience in applying ABS and adapt such to accord itself with the Indonesian people’s background. Protokol Nagoya menjadi sarana dalam pelaksanaan access and benefit sharing (ABS) bagi negara-negara penyedia keanekaragaman hayati. Di dalam penerapan ABS terdapat kelemahan-kelemahan seperti tersebarnya keanekaragaman hayati dalam geografis yang luas dan sukarnya menentukan pemilik sebagai penerima keuntungan. Indonesia sebagai negara mega keanekaragaman hayati, telahmeratifikasi Protokol Nagoya melalui Undang-Undang Nomor 11 Tahun 2013, menyiapkan drafamandemen Undang-Undang Paten dan menyiapkan Rancangan Undang-Undang Sumber Daya Genetik. Dalam penerapan Protokol Nagoya dan ABS tersebut, Indonesia dapat mengacu dari pengalamanIndia dalam menerapkan ABS dengan menyesuaikan dengan latar belakang masyarakat Indonesia.

Abstract

The forest management based on deep local wisdom has existed in the history of the Aceh community since the reign of Sultan Iskandar Muda. That is by applying the Forest Customary Law through the Forest Pawang Customary Institution. This Customary institution has a very important and strategic role in educating and inviting forest communities to be involved in forest management based on local wisdom. This service activity aims to increase understanding with village apparatus and traditional institutions in forest management based on local wisdom. This service is carried out through socialization and legal counseling in North Aceh District, namely: Sawang, Nisam, Langkahan, Pirak Timu, Paya Bakong and Geuredong Pasee sub-districts, because these districts still have high forest intensity. The results of this activity have provided an understanding for gampong apparatus and customary institutions in forest management and built an intensive communication network between village apparatus, traditional institutions and the district leadership meeting so that they can work together in protecting and conserving the forest. It is recommended to the village apparatus and customary institutions to immediately form the Forest Pawang Customary Institution and Village Qanun regarding forest management.

Abstract

Pasal 38 ayat (1)-(4) Undang-Undang Hak Cipta, menyebutkan bahwa negara wajib menginventarisasi, menjaga, dan memelihara ekspresi budaya tradisional dan penggunaan ekspresi budaya tradisional harus memperhatikan nilai-nilai yang hidup dalam masyarakat pengembannya. Pentingnya perlindungan hukum terhadap karya cipta sebagai pemberdayaan potensi yang dimiliki oleh daerah untuk mengembangkan sumber daya lokal demi peningkatan kesejahteraan masyarakat khususnya di Kabupaten Aceh Utara. Penelitian ini bertujuan untuk mengetahui perlindungan hukum terhadap hak cipta kerajinan tangan motif Aceh sebagai ekspresi budaya tradisonal, serta hambatan yang dihadapi dan  upaya meminimalisir hambatan dalam perlindungan hak cipta kerajinan tangan motif Aceh sebagai ekspresi budaya tradisonal di Kabupaten Aceh Utara. Penelitian ini menggunakan jenis penelitian yuridis empiris, pendekatan kualitatif, Sumber data  primer dan data sekunder. Analisis data secara kualitatif. Perlindungan hukum terhadap hak cipta kerajinan tangan motif Aceh sebagai ekspresi budaya tradisonal di Kabupaten Aceh Utara belum maksimal, karena tidak adanya peraturan pelaksanaan dari pemerintah Aceh terkait ekspresi budaya tradisisional dan Sikap apatis masyarakat dan Pemerintah dalam perlindungan hukum terhadap hak cipta kerajinan tangan motif Aceh sebagai ekspresi budaya tradisonal di Kabupaten Aceh Utara. Adapun upaya Perlindungan Hukum Meminimalisir terhadap hak cipta kerajinan tangan motif Aceh sebagai ekspresi budaya tradisonal di Kabupaten Aceh Utara, yaitu dokumentasi terhadap sejumlah kebudayaan yang tersebar di wilayah Aceh Utara dan enggelar  suatu  perhelatan atau  festival  kebudayaan, meskipun kegiatan tersebut dilakukan belum secara menyeluruh dan belum terkoordinasi dengan baik antar pihak terkait.

Abstract

Socialization and legal counseling on the Tuha Peut Traditional Institution in dispute resolution in Sawang District are part of community service activities. The background of this activity is that in the Qanun of Customary Institutions, Tuha Peut is one of the customary institutions that has the authority to settle disputes between members of a community of a village. In Sawang Subdistrict, Aceh Utara District, there are still many customary disputes that have not been resolved by customary settlement in the village and many have been reported by the community to the police. This is also due to the lack of knowledge of the Tuha Peut Customary Institution in resolving disputes at the village level. This socialization and legal counseling was carried out by presenting the material and continued with a discussion of questions and answers and swearing back. The results of socialization and legal counseling in Sawang District found that the results of the feedback provided by participants experienced an increase in understanding of the role of the Tuha Peut Traditional Institution in dispute resolution. The implementation of this activity received a good response from the Tuha Peut Customary Institution, because they increased their knowledge and they rarely got activities like this.

Abstract

Until now there has not been an in-depth and comprehensive of spatial planning based on local wisdom as strengthening the specificity of the Aceh region based on Law Number 11 Year 2016 concerning Aceh Government and Qanun No. 4 of 2003 concerning the Mukim Government. The purpose of this study is to analyze the local wisdom of spatial planning for sustainable settlements in Aceh. This research is a normative-supported empirical law study. The results showed that in the preparation of the Rencana Tata Ruang Wilayah (RTRW) the Mukim/mukim was not involved. In fact, information regarding the RTRW documents was never shared with the Imeum Mukim. The results of research in the residential areas of Aceh Besar, Pidie Jaya and North Aceh districts found that generally Mukims submitted the same complaints where Mukim was not informed or involved in the preparation of the RTRW in their area. Mukim’s authority is only limited to the resolution of disputes arising among the residents of the village in the Mukim region.

Abstract

Undang-Undang No. 22 tahun 2009 tentang lintas lalu lintas dan angkutan jalan dalam Pasal 1 ayat 32: “ketertiban lalu lintas dan angkutan jalan adalah hal waktu lintas berlalu yang berlangsung secara lancar berdasarkan atas hak dan kewajiban setiap pemakai jalan”. Berkaitan dengan kecelakaan lalu lintas dapat dilakukan penanganan terhadap masalah kecelaka.an “lalu lintas dengan strategi kead.ilan restoratif. Metode penelitian dengan menggunakan metode penelitian hukum Yuridis normatif melalui cara melakukan penelitian deskriptif analisis. Salah satu yang dilakukan dengan pengumpulan data melalui riset kepustakaan dan melakukan wawancara. Hasil penelitian: pertama;Faktor penyebab terjadinya pelanggaran lalu lintas salah satunya yang tingkat pemahaman dan kontribusi warga belum tercerahkan, pemahaman hukum yang masih rendah serta sarana dan prasarana jalan yang masih belum mencukupi. kedua, Hambatan tindakan “kepolisian menerapkan “keadilan restoratif” terhadap pelaku pelanggaran lalu lintas di Polres Lhokseumawe menggunakan pendekatan keadilan dalam perkara “lalu di mana lintas keadilan restoratif (keadilan restoratif) dianggap lebih adil, dibandingkan dengan penyelesaian melalui mekanisme mekanisme.Ketiga, Upaya Kepolisian dalam menerapkan restorative justice terhadap pelaku pelanggaran lalu lintas dengan menggunakan konsep dan prinsip-prinsip restorative justice dimana yakni, terdapat perbaikan atas korban yang mengalami penderitaan akibat kejahatan dengan cara melakukan penyelamatan, memberikan kepada korban ganti rugi, memberikan kerja sosial kepada pelaku dan hal lainnya. Abstract

This study discusses the handling of corruption crimes that have been handled by the Central Aceh District Attorney with the formula for the problem: (1) how is the arrangement for prosecuting the confiscation of the property of the accused perpetrators of corruption which allegedly originates from the proceeds of criminal acts of corruption based on Law Number 20 of 2001 Regarding the Eradication of Criminal Acts of Corruption, and (2) what is the legal procedure for confiscation of assets of perpetrators of corruption as determined by the Prosecutor's Office. This type of research is normative-empirical law research (applied law research), the data source is a direct source (primary data) or data obtained from indirect sources (secondary data). The method of collecting data is through document or literature research techniques (library research) and field research techniques (field research). Based on the results of the study, the authors conclude: (1) The mechanism for prosecuting the confiscation of the defendant's property from a criminal act of corruption is carried out by two mechanisms, namely criminal instruments (criminal charges) and civil instruments (civil lawsuits). (2) The process carried out by the Prosecutor in prosecuting the confiscation of the assets of the defendant in a criminal act of corruption is regulated through the Regulation of the Prosecutor's Office of the Republic of Indonesia Number 7 of 2020. (3) The obstacles faced by the prosecutor in prosecuting the confiscation of the defendant's property resulting from a criminal act of corruption consist of assets resulting from the act of corruption. corruption crimes are obscured or transferred to other parties, corruption assets are exhausted, assets are pledged to other parties, the perpetrators of corruption crimes have died, assets resulting from corruption crimes have been transported abroad.
