Abstract

Tujuan dari penelitian ini adalah menganalisis hambatan hukum dalam penyelesaian sengketa investasi melalui arbitrase, serta mengetahui peran prinsip keadilan dalam penyelesaian sengketa investasi melalui arbitrase. Metode penelitian yang digunakan dalam penulisan adalah metode hukum normatif. Penelitian hukum normatif dilakukan dengan cara studi pustaka terhadap bahan hukum primer, seperti  peraturan perundang-undangan dan bahan hukum sekunder, seperti buku teks dan jurnal hukum yang berkaitan dengan tema yang ditulis penulis. Arbitrase merupakan alternatif dalam menyelesaikan perselisihan investasi, dimana pihak-pihak yang terlibat sepakat untuk menyelesaikan sengketa di luar pengadilan negara. Dalam konteks ini, artikel tersebut menggarisbawahi perlunya perbaikan regulasi dan praktik arbitrase guna memastikan pengakuan dan penegakan prinsip keadilan dengan baik. Upaya seperti peningkatan transparansi dalam proses arbitrase, jaminan independensi dan netralitas arbitrator, serta memberikan akses yang adil bagi semua pihak yang terlibat dapat membantu meningkatkan kepercayaan dan legitimasi penyelesaian sengketa investasi melalui arbitrase.

Abstract

The development of e-commerce business highlights the rapid use of Click-Wrap Agreements alongside advances in information technology. However, debates over the validity of Click-Wrap Agreements as electronic contracts often arise. This research adopts a normative approach using secondary data. Electronic contracts are recognized by Indonesian law, as stipulated in Article 18 paragraph (1) of the ITE Law. Consequently, when consumers agree to Click-Wrap Agreements by clicking the 'click' button, both parties are bound and must adhere to the terms of the agreement under the law. Therefore, the regulation regarding the validity of Click-Wrap Agreements and their implications on the rights and obligations of e-commerce users need attention within the existing regulatory framework.

Abstract

The purpose of this research is to provide a juridical analysis of electronic agreements from the legal perspective of “Law as A Tool Of Social Engineering” coined by Roscoe Pound. This article emphasizes on a normative juridical research with a statutory approach, empirical approach, and case study approach to comprehend electronic agreements and the law that regulates it as norms implemented in society. The type of data analyzed in this article are primarily secondary data from books, previous studies, journals related to electronic agreements, and Indonesian laws concerning electronic agreements. Previous survey found that more than 660 thousand electronic agreements were signed in early 2018, which is 159 percent higher than the previous period, indicating that the use of electronic agreements continue to increase and expand to various sectors in Indonesia. Therefore, the Indonesian law system must have an explanatory approach regarding this phenomena of technological advancement, specifically about electronic agreements. Several regulations researched and analyzed in this research disclose the importance of law related to electronic agreements, one of which is providing legal protection for the interests of the parties in electronic agreements. Supported by the legal perspective of “Law as A Tool Of Social Engineering” coined by Roscoe Pound, the existence of laws or regulations, in this case specifically regarding electronic agreements, functions as a law that can maintain the stability and balance of conflicting interests in society. Furthermore, the legal perspective of “Law as A Tool Of Social Engineering” sees the laws related to electronic agreements direct human attitudes to react to changes in society, in this case related to the technological advances that offers electronic agreements, so that people understand that agreements signed electronically have the same validity and binding force as conventional agreements signed physically. One of the striking parts of intellectual property rights is patents related to inventions in technological developments which are very important nowadays considering the existence of strong technological developments. In relation to patents, what is striking is the protection of patents currently in effect in Indonesia. Basically, this has been regulated in Law Number 13 of 2016 concerning Patents.

Abstract

Based on the research results, it can be concluded that collateral objects that are not bound by mortgage rights can basically still be used as collateral in a loan agreement or credit guarantee. However, in practice, if there is a default, the execution of the collateral object is difficult because it has to go through litigation or a court suit which takes a long process and harms the creditor in the end. So that the collateral object should be tied to the guarantee institution to provide strong executorial confiscation powers. Likewise with acts of default committed in this case carried out by creditors who are late in fulfilling their obligations to pay debts as agreed. However, in this case the District Court which decided the case exceeded the limits of its authority.

Abstract

The criminal determination legislation policy in Law no. 12 of 2012 concerning Higher Education is a part of the stages of crime prevention in the field of higher education which is expected to be able to provide clear directions for law enforcement officials at the application and execution stages of a crime by providing complete sentencing rules. However, it turns out that the criminal provisions in the law are only an incomplete or partial set of tools in the context of tackling criminal acts in the field of higher education. This can be seen from the many juridical problems in the law, including the absence of juridical qualifications, corporate criminal responsibility issues and so on. For this reason, in the future it is necessary to update the existing criminal provisions formulation policy in the Higher Education Law.Keywords: Criminal Law Policy; Formulation; Juridical Issues

Abstract

Perkembangan teknologi sangat marak terjadi di era digitalisasi, banyak perusahaan yang mengembangkan bisnisnya dengan mengikuti trend zaman salah satunya dengan menerapkan teknologi blockchain pada smart contract. Teknologi ini merupakan turunan dari Cryptocurrency yang saat ini menjadi trend mata uang dalam bidang perdagangan aset. Sistem blockchain pada Cryptocurrency tersebutlah yang menarik smart contract untuk dapat dirancang bekerja sendiri melalui teknologi blockchain dengan menggunakan bahasa pemrograman yang diterjemahkan kedalam bahasa hukum. Tujuan penelitian ini adalah untuk menganalisis Legalitas Penggunaan Teknologi blockchain Terhadap smart contract Sebagai Produk hukum di Era Digital dan mengetahui Efektivitas Teknologi blockchain Terhadap smart contract pada Perjanjian Bisnis Antar Perusahaan Indonesia. Pada penelitian ini kami menggunakan metode penelitian yuridis normatif yang berfokus pada aturan-aturan hukum yang berlaku terkait dengan legalitas dan efektivitas dari penggunaan Teknologi blockchain pada smart contract. Sehingga, dari penelitian ini dapat disimpulkan bahwa potensi blockchain terhadap smart contract sangat besar mengingat efisiensi dan kepraktisan teknologi ini juga dapat menghemat biaya transaksi. Namun dalam penerapannya teknologi ini masih perlu beradaptasi agar dapat berjalan beriringan dengan teknologi yang ada dan dapat mudah diterima langsung oleh masyarakat serta mempunyai jaminan lebih secara hukum dalam penerapannya.

Abstract

Globalisasi membuat banyak sekali dampak kepada setiap sektor kehidupan,salah satunya terhadap sektor keuangan. Pinjaman online sudah banyak digunakan oleh masyarakat umum karena sistemnya yang sangat efisien.peranan kontrak perjanjian dalam pinjaman online juga dilakukan online (E-Contract) yang disetujui oleh Debitur dengan E-Sign. Dalam hal ini, diperhatikan bagaimana perlindungan hukum mengenai system E-Sign itu dilakukan dan keabsahannya dalam E-Contract yang berisikan klausa-klausa baku perjanjian dalam system pinjaman online yang dilakukan.
