Abstract

The aftermath of the Arab Spring was leaving a great turnover for many countries as the regime changed, so does Egypt. As one of the most influential countries both in the Middle East and North Africa, Egypt's domestic politics is quite dynamics since immemorial time, from numerous kingdoms, West colonialism until republic under the authoritarian regime in this modern days. For once, the dynamics of politics itself comes from the grass-root level whichever reached the top such as al-Ikhwan al-Muslimun or Muslim Brotherhood and Salafi Movements which caught people’s attention, not only in Egypt but the entire world. Both basically have religious intentions as it is considered Islamic movements except for their differences in political experience, religious interpretation and manners overpower contestation. Although Egypt currently is controlled by a military coup regime that tends to perpetuate the power, the Brotherhood and Salafi Movements which likewise spread to many countries still lurking and it might be consolidating the power to turn back the democracy to Egyptian who suffer from authoritarian style regime ever since the establishment of the nation after independence from British colonialism. This paper is aimed to describe the policy of the Islamic movement in Egypt which is based on religious intention and the interaction with politics and democratic goal from the nature of establishment,  during the Arab Spring and the prospect for Muslim Brotherhood and Salafi Movements as the unrest recently occured.

Abstract

Marriage combines the husband-wife relationship and unifies two families of different ethnicities, cultures, and backgrounds. The consent of the wali is a significant function of the family, particularly the prospective bride's family. Marriage requires the permission of the wali because it is null and void without it. In actuality, the wali of the prospective bride may be hesitant to marry off the woman under his supervision for various reasons, both Shar'i and non-Shar'i. As a result, the prospective bride must apply to the Religious Court for wali adhal for the marriage to occur. This qualitative research employs a normative legal approach, which examines legal norms found in laws and regulations, judge judgments, and other legal sources. According to the findings of this study, wali adhal cases are currently evaluated by voluntary trials or unilaterally. However, because it is unilaterally assessed and there is no opponent, fulfilling the legal purpose of building integrative justice in this examination requires considerable effort. Therefore, wali adhal cases must be examined using a contentious trial.

Abstract

ABSTRAKMasalah penyalahgunaan narkoba masih menjadi beban besar dalam penanganan kasus kriminal di Indonesia, terutama dengan adanya tuduhan terjadinya penyimpangan yang dilakukan oleh aparat kepolisian dalam pelaksanaan penyidikan. Penelitian ini ditujukan untuk menganalisis bagaimana diskresi digunakan oleh Penyidik Polri dalam kasus penyalahgunaan narkotika, faktor-faktor yang mempengaruhi, dan upaya penataan ulang yang diperlukan agar penggunaan diskresi menjadi lebih baik. Penelitian ini merupakan gabungan dari penelitian hukum empiris dan normatif, sementara analisis datanya menggunakan metodologi kualitatif dan kuantitatif. Kajian empiris dilakukan dengan mewawancarai Penyidik Polri, Klien Rehabilitasi Wajib, dan Anggota Tim Asesmen Terpadu. Sedangkan kajian normatif mengacu pada norma dan tolok ukur batasan diskresi yang diatur dalam Kitab Undang-Undang Hukum Acara Pidana (KUHAP) dan Undang-Undang Kepolisian, konsep teoritis tentang diskresi dan pendapat ahli hukum. Hasil studi menunjukkan bahwa penggunaan diskresi masih kurang tepat karena belum sesuai dengan ketentuan yang diatur dalam KUHAP dan Undang-Undang Kepolisian, kondisi tersebut dipengaruhi oleh berbagai faktor, baik internal maupun eksternal. Untuk mengatasi masalah ini, diperlukan rekonfigurasi yang menyeluruh agar penggunaan diskresi oleh Penyidik POLRI lebih baik. Penelitian ini bertujuan untuk mengidentifikasi faktor kunci yang menyebabkan kesalahan dalam penggunaan diskresi, serta memberikan rekomendasi untuk perbaikan praktik tersebut. ABSTRACTThe issue of drug abuse remains a significant challenge in handling criminal cases in Indonesia, exacerbated by alleged irregularities among police officers during investigations. This study investigates the discretion exercised by Police Investigators in drug abuse cases, examining influencing factors and proposing reconfiguration efforts for improved discretion usage. Employing a combination of empirical and normative legal research methods, data analysis involves both qualitative and quantitative approaches. Empirical research involves interviews with Police Investigators, Mandatory Rehabilitation Clients, and Integrated Assessment Team Members, while normative analysis refers to legal frameworks such as the Criminal Procedure Code (KUHAP) and the Police Act, alongside theoretical concepts and legal expert opinions on discretion. Findings reveal inadequate discretion in employment, diverging from legal provisions, influenced by internal and external factors. Addressing this, a comprehensive reconfiguration is essential to enhance Police Investigators' discretion usage. The study aims to pinpoint key factors contributing to discretion misuse and offer recommendations for its improvement, emphasizing alignment with legal norms and procedural requirements.

Abstract

ABSTRAKStudi tentang hak asasi manusia (HAM) terus berkembang, dengan advokasi yang menjangkau periode sejarah hingga masa kontemporer karena isu-isu HAM yang terus berlanjut di berbagai negara, khususnya Indonesia dan Amerika Serikat (AS). Aktivis HAM Muslim secara signifikan telah memengaruhi kesadaran masyarakat dan pemerintahan untuk menegakkan HAM. Studi ini berfokus pada nilai-nilai Islam yang diterapkan dalam strategi advokasi, kendala-kendala yang dihadapi aktivis HAM Muslim, serta persamaan dan perbedaan prinsip dan strategi advokasi yang ada pada aktivis HAM dari non-Muslim. Tujuan dari studi ini yakni untuk menganalisis cerminan nilai-nilai Islam dalam strategi advokasi aktivis HAM Muslim Indonesia dan Amerika dari tahun 1964 sampai 2020. Menggunakan purposive sampling dan analisis data deskriptif kualitatif, studi ini mengidentifikasi advokasi aktivis Munir Said Thalib, Abdurrahman Wahid, Malcolm X, Muhammad Ali, dan Linda Sarsour. Berdasarkan analisis pendekatan nilai-nilai Islam, maka sebagian besar strategi advokasi aktivis HAM Muslim di Indonesia dan Amerika yang meliputi taktik persuasi, strategi pemodelan, strategi litigasi, dan strategi pendidikan sama-sama menerapkan nilai Islam seperti kejujuran, keadilan, kerja sama, kerja keras, dan ketertiban sosial. Meskipun menghadapi berbagai hambatan, ketekunan para aktivis HAM Muslim pada akhirnya membawa hasil yang positif. Nilai-nilai Islam yang tercermin dalam strategi advokasi para aktivis HAM Muslim tidak bertentangan dengan nilai-nilai kemanusiaan dan sosial yang dianut oleh aktivis HAM non-Muslim dan masyarakat secara global. ABSTRACTThe study of human rights continues to evolve, with advocacy spanning historical periods to contemporary times due to persistent human rights issues in various countries, particularly Indonesia and the United States (US). Muslim human rights activists have significantly influenced societal awareness and governance to uphold human rights. This study focused on Islamic values dominate advocacy strategies, obstacles faced by Muslim human rights activists, and the similarities and differences in the principles and strategies of advocacy compared to non-Muslim human rights activists. The study aims to analyze the influence of Islamic values reflected in the advocacy strategies of Indonesian and American Muslim human rights activists from  1964 to 2020. Using purposive sampling and descriptive qualitative data analysis, the study identifies the advocacies of Munir Said Thalib, Abdurrahman Wahid, Malcolm X, Muhammad Ali, and Linda Sarsour. Based on the analysis of the Islamic values approach, most of the advocacy strategies of Muslim human rights activists in Indonesia and America, which include persuasion tactics, modeling strategies, litigation strategies, and education strategies, equally apply Islamic values such as honesty, justice, cooperation, hard work, and social order. Despite numerous obstacles, the perseverance of Muslim human rights activists ultimately leads to positive outcomes. Islamic values reflected in the advocacy strategies of Muslim human rights activists are not contradictory to the humanitarian and social values embraced by non-Muslim human rights activists and society globally.
