Abstract

OSIS dibentuk berdasarkan surat keputusan kepala sekolah dimana memiliki badan kepengurusan. Siswa-siswa yang terlibat dalam badan kepengurusan OSIS haruslah lulus dari beberapa kriteria dan persyaratan, diantaranya memiliki keterampilan komunikasi dan memiliki jiwa kepimpinan. Komunikasi memiliki pengaruh yang kuat dalam membentuk sikap dan gaya kepemimpinan seseorang dalam suatu organisasi. Siswa harus diberikan pembekalan tentang sikap dan gaya kepemimpinan agar bisa mengarahkan, mengontrol para anggotanya dan bertanggungjawab supaya semua bagian pekerjaan dikoordinasi demi mencapai tujuan perusahaan atau organisasi. Ada beberapa konflik yang timbul seperti adanya misunderstanding antar anggota, faktor struktur tugas maupun struktur organisasi contohnya ketidaksamaan keinginan antara bendahara dan ketua, faktor yang bersifat personal yaitu individu harus membuat keputusan yang menyangkut dirinya dan organisasi, faktor lingkungan seperti tidak adanya dukungan dari lingkungan atau pihak-pihak tertentu, perbedaan pendapat, kumpul tidak lengkap, banyak pengurus yang keluar, terjadi kesenggangan antar anggota, manajemen waktu yang kurang baik dan prestasi menurun.

Abstract

Environmental law enforcement in Indonesia is affected by Law Number 11 of 2020, which was passed to make it easier for investors to make investments in Indonesia by creating jobs.The purpose of this study is to determine the relationship between changes in environmental law enforcement in Indonesia following the passage of the Job Creation Law and changes in administrative penal law.This study employs normative law methods and literature study methods, which are followed by descriptive analysis methods.This study's findings demonstrate that Indonesia's environmental law enforcement has shifted under the Administrative Penal Law No. 32 of 2009, resulting in a regressive and ineffective approach to environmental protection and management.This is due to the fact that, following the passage of the Job Creation Law, most provisions for violations of administrative environment law first apply administrative sanctions.Aside from that, violations of administrative law that have an effect on the environment are the only ones that are eligible for criminal penalties.The characteristics of pollution and environmental damage that did not manifest at the time of the violation but many years later are not taken into account by the amendments to these provisions.

Abstract

The main issue discussed in this study is the extent to which the Supreme Court's power is autonomous in recruiting judges with the status of public officials for judicial organizations under its jurisdiction. Since legislation is the main source of information, this study takes a normative legal approach. The results of the study indicate that the current legal framework is not yet fully capable of regulating, implementing and ensuring the judicial system accurately, as well as the nature and status of judges as public officials. The current system and structure of the recruitment of judges continues to show a lack of transparency and uncertainty regarding the legal rules governing the recruitment of judges with the status of public officials. Existing norms maintain weak legitimacy, as they are not regulated by the Constitution, which establishes an independent judiciary responsible for upholding law and justice. Therefore, in the future it is necessary to adopt new rules and regulations governing the system and procedure for recruiting judges in accordance with the specificity of the position of judges as public officials to ensure the performance and accountability of judicial duties.

Abstract

Regulasi membatasi hanya Otoritas Jasa Keuangan (OJK) yang berwenang untuk mengajukan Penundaan Kewajiban Pembayaran Utang (PKPU) terhadap perusahaan asuransi. Namun, Putusan Nomor 389/Pdt.Sus-PKPU/2020 (PKPU 389) justru mengabulkan permohonan PKPU yang diajukan oleh nasabah pemegang polis. Dengan menggunakan metode normatif terhadap data sekunder, yang dianalisis secara deskriptif kualitatif. Penelitian ini bertujuan untuk menganalisis: (1) justifikasi kewenangan atribusi mengajukan permohonan PKPU terhadap perusahaan asuransi hanya diletakan kepada OJK serta (2) untuk menemukan alasan majelis hakim mengonstruksikan kreditur berwenang untuk mengajukan permohonan PKPU terhadap perusahan asuransi di dalam PKPU 389. Riset ini menemukan PKPU 389 kontradiktif dengan UU Nomor 37/2004 tentang Kepailitan dan Penundaan Kewajiban Pembayaran Utang, UU Nomor 21/2011 tentang Otoritas Jasa Keuangan dan UU Nomor 40/2014 tentang Perasuransian. Tafsir original intens meletakan kewenangan ini hanya kepada OJK sebagai entitas tunggal untuk mengajukan permohonan PKPU terhadap perusahaan asuransi. Implikasi diferensiasi fungsional melalui model unified supervisory, penerapan paradigma national economic walfare state, dan kebutuhan lembaga penyeimbang untuk melindungi disparitas kepentingan adalah causa prima diletakannya monopoli kewenangan pengajuan PKPU terhadap perusahaaan asuransi kepada OJK. Kewenangan ini merupakan atribusi yang diberikan oleh original legislator hanya kepada OJK, sehingga tidak ada subjek yang dapat mengajukan PKPU diluar OJK.

Abstract

This study aims to determine the activities of document management of legal products in legal counseling activities at the Bureau of Law and Human Rights at the Regional Secretariat of the Riau Islands Province. The method used is qualitative research with a study approach. Data collection techniques were carried out through observation and literature study. Data analysis techniques were carried out using data analysis techniques according to Miles and Huberman, namely Data Reduction, Data Display and Conclusion Drawing. The results showed that the activities of managing legal product documents at the Bureau of Law and Human Rights of the Regional Secretariat of the Riau Islands Province followed the rules of documentation which included recording which included activities of formulation, organization which included preparation and storage activities as well as socialization which included extension and socialization activities. Based on the results of the study, it can be concluded that the management of legal product documents at the Bureau of Law and Human Rights of the Regional Secretariat of the Riau Islands Province has been carried out in accordance with the rules of documentation.

Abstract

Digital literacy is widespread and often addresses key issues. To educate students on digital literacy, it is necessary to develop reading skills, read the content carefully, and then use digital literacy to understand the content. This activity aims to improve the digital literacy skills of teenagers, especially at SMAN 2 Koto Pariaman. The formulation of activity forms, activity stages, and evaluation are the three stages that become the method of implementing PKM activities. The assessment results show that the level of understanding of members about continuing education is very high, and they have awareness about the risks involved in the web and virtual entertainment, as shown by the consequences of the poll of 83.3% related to negative substances on the Web. However, the evaluation results showed that the majority of participants only used the internet to communicate, play games, and use social media, so they did not understand digital literacy regarding the use of the internet for science.

Abstract

Both positive and negative effects arise as a result of social media's widespread use and its ever-increasing rate of development. The positive effect is that it becomes simpler for data to circle among people in general, structure assessments, online business, etc. Moreover the adverse consequences, for example, criticize, dangers, slander, the development of negative sentiments and what is famous today is disdain discourse and digital tormenting. The prevention of bullying and hate speech for SMAN 2 Bukittinggi students, particularly those in grade 10, will be examined in this paper. This action expects to help members to bring issues to light since the beginning about the need to try not to menace in day to day existence. Partners will learn about the dangers and effects of bullying themselves through this service project. The execution of this action got a positive reaction from accomplices where the action members from accomplices were happy with the data and schooling conveyed. In addition, the implementation activities of both the socialization and education that were carried out were games and brief quizzes about preventing bullying and hate speech. At SMAN 2 Bukittinggi, this activity was carried out offline. The objective of these games and quizzes is to gain an in-depth understanding of each partner's awareness of the dangers posed by bullying and hate speech.

Abstract

Trade Facilitation Agreement WTO merupakan langkah maju yang penting dalam sistemperdagangan internasional dan memberikan harapan baru bagi relevansi WTO. TFA adalahperjanjian multilateral pertama sejak pembentukan WTO pada tahun 1995 dan mencakupinisiatif baru untuk membantu negara-negara berkembang membangun kapasitas sambil jugamenangani masalah peraturan di antara anggota WTO. TFA harus ditafsirkan dengan benar,ini adalah kombinasi dari langkah-langkah peningkatan kapasitas, fokus pada peningkatanteknologi dan persyaratan politik, termasuk kebijakan masing-masing negara, yangdiperlukan untuk mengelola perdagangan luar negeri. Kehadiran asam lemak trans jugadiduga dapat mengurangi biaya perdagangan lintas batas, sekaligus meningkatkanperdagangan dengan negara berkembang dan memungkinkan anggota WTO untuk mengelolaarus perdagangan dengan lebih baik melalui proses harmonisasi dan regulasi politik. Artikelini mengkaji tentang teori hukum dan asas serta aturan yang berkaitan dengan hukum daganginternasional dengan menggunakan metode analisis normatif kualitatif. Penulis menganalisispermasalahan yang berkaitan dengan pengoperasian perjanjian fasilitasi perdagangan didalam WTO dan implementasinya di Indonesia.
