Abstract

This research is proposed to answer three problem. First, the rules of international law in the protection of the marine environment from oil pollution originating from vessel. Second, efforts were made by the three littoral countries cooperation in preventing, reducing and controlling oil pollution originating from vessel in the Straits of Malacca and Singapore. Third, the role of the government of Indonesia in prevention, reduce and control oil pollution originating from vessel in the Straits of Malacca and Singapore. This research is normative research using qualitative research methods. The research approach using statute approach and case approach. The results of this research shows that international law has been comprehensively regulate the protection of the marine environment from pollution by oil originating ships: the United Nations Convention on the Law of the Sea (UNCLOS) 1982, The International Convention for the Prevention of Pollution from Ship (MARPOL) 73/78, International Convention on Oil Pollution Preparedness 1980, the Civil Liability Convention for Oil Damage (CLC) 1992 and the Convention on the Establishment of an International Fund for Compensation for Oil Pollution Damage (FUND) 1992. Second, Indonesia, Malaysia and Singapore as states bordering the straits cooperate with other stakeholders (user states, user industries, IMO, NGOs) have established a cooperation mechanism in the form of cooperative forums, project coordination committee and the Aids to Navigation Fund. Third, Indonesia through its laws and regulations have ensured the prevention, reduction and control of oil pollution originating from vessel through Act No. 17 of 2008 on Shipping, Government Regulation No. 21 of 2010 on the Protection of Maritime Environment, and Presidential Decree No. 109 in 2006 on Disaster Emergency Due to Oil Spill in the ocean.

Abstract

Program Studi Ilmu Hukum di Universitas Terbuka memberikan peluang kepada siapapun, di manapun, dan kapanpun untuk menemempuh pendidikan tinggi sebagai sarana meningkatkan kompetensi diri dalam bidang hukum. Kurikulum dirancang dan diperbarui sesuai dengan kebutuhan mahasiswa selama studi. Untuk mengukur ketercapaian kompetensi lulusan dalam dunia kerja perlu dilakukan penelurusan melalui tracer studi. Hal ini menjadi tantangan tersendiri karena beragamnya lulusan yang tersebar di seluruh wilayah Indonesia. Dengan metode penelusuran melalui penyebaran kuesioner yang disebar melalui email, aplikasi whatsapp, dan melalui hubungan telepon dilakukan untuk mencapai sampling sebesar 25% dari keseluruhan lulusan. Prodi Ilmu Hukum baru mulai meluluskan pada tahun 2017, hingga 2019 sudah tercatat terdapat 1.402 lulusan yang terjaring dalam tracer study. Berdasarkan hasil yang diperoleh dari penelitian ini, lulusan Prodi Ilmu Hukum bekerja pada bidang hukum dengan presentase lebih dari 90%. Dari keseluruhan lulusan mendapatkan manfaat dengan gelar sarjana hukum, yaitu mendapatkan pekerjaan di bidang hukum atau mendapatkan manfaat atas gelarnya di instansi tempat dia bekerja sebelumnya

Abstract

Seiring dengan semakin berkembangnya transaksi bisnis internasional, arbitrase sebagai salah satu alternative penyelesaian sengketa bisnis telah berkembang secara pesat. Dalam perkembangan tersebut terdapat beberapa tantangan yang dihadapi oleh arbitrase komersial internasional diantaranya dalam menyelesaikan sengketa bisnis multi pihak. Tulisan ini akan mengkaji dua hal utama yaitu permasalahan dalam arbitrase internasional multi pihak serta pengaturan arbitrase multi pihak dalam peraturan di UNCITRAL (United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards), ICSID (International Chamber for Settlement of Investment Dispute) dan ICC (International Chamber of Commerce). Melalui metode penelitian yuridis normatif, disimpulkan bahwa permasalahan arbitrase internasional multi pihak meliputi: proses pencapaian kesepakatan, pelaksanaan prinsip kesetaraan dan kerahasiaan. Baik UNCITRAL (United Nations Convention on the Recognition and Enforcement of Foreign Arbitral Awards), ICSID (International Chamber for Settlement of Investment Dispute) dan ICC (International Chamber of Commerce) telah mengatur hukum formil arbitrase multi pihak terutama dalam hal kekepakatan tentang masuknya pihak lain dan penunjukan arbitrator.

Abstract

UMKM berperan penting terhadap “green economic growth” karena berkontribusi besar terhadap aktivitas ekonomi dan jejak lingkungan baik dalam lingkup nasional maupun dalam lingkup global. Di tengah pandemi global, UMKM sangat penting untuk pemulihan ekonomi mengingat besarnya kontribusinya terhadap sektor tenaga kerja. Pandemi, di sisi lain, meningkatkan kesadaran untuk lebih peduli dengan lingkungan. Riset menunjukkan semakin banyak pengusaha yang mengalihkan fokus mereka untuk berinvestasi di sector lingkungan, salah satunya adalah mitra abdimas kami, yaitu PT.Akademi Inovasi Indonesia (PT.AVIN). PT.AVIN merupakan UKM yang bergerak di bidang penyediaan bahan baku herbal yang didapatkan dari limbah lingkungan industri dan rumah tangga serta tumbuhan-tumbuhan herbal, seperti daun-daun kering. Kehadiran PT.AVIN yang bergerak di bidang green business perlu diapresiasi. Namun, keterbatasan modal ataupun sarana prasarana seringkali menghambat kemajuan UMKM untuk berinovasi. Permasalahan yang dihadapi oleh mitra diantaranya alat penunjang produksi yang masih tradisional, belum memiliki izin P-IRT, UKOT dan IEBA, serta tidak mempunyai merek dan label kemasan yang memadai. Dalam program pengabdian masyarakat ini, kami memberikan solusi atas beberapa kendala tersebut diantaranya memberikan bantuan sarana prasarana berupa mesin pengering makanan dan memberikan sosialisasi terkait perizinan perusahaan serta pelatihan desain label. Sebagai tindak lanjut dari kegiatan abdimas ini, mitra disarankan segera mengajukan izin P-IRT, UKOT dan IEBA sebagai bentuk keseriusan dalam pengembangan bisnis.

Abstract

As part of social rights, the fulfillment and the protection of the right to higher education is guaranteed through positive state action. The State is responsible for developing and maintaining an education system and educational institutions for everyone without discrimination. The State ensures the fulfillment of the right of education, including higher education, which must respond to students' needs different social and cultural conditions. Migrant workers are one of the groups with special needs for higher education. The lack of availability and accessibility (distance and time) of higher education in the destination country leads to the neglect of the migrant workers' more elevated education rights. Migrant workers have equal rights with other Indonesian citizens to get the right to non-discrimination education. This study addresses the protection of the right to higher education for Indonesian migrant workers in Hong Kong. Through a normative juridical approach, this research discusses the right to higher education, the guarantee of the right to higher education for migrant workers in international treaties, and the effort of Universitas Terbuka to fulfill requests to higher education for Indonesian Migrant Worker the higher education through distance learning for Indonesia migrant workers who are Universitas Terbuka's students in Hong Kong.

Abstract

Violence in the world of education is a shared responsibility, not only the responsibility of the school but the community (parents) also have an important role in preventing violence in the world of education. The problem of bullying is a problem that often occurs in educational institutions and at SMA Dharma Karya there is still bullying between students, although the bullying does not amount to serious cases, but students' understanding of bullying is very necessary so that students know the dangers of these actions. the. The implementation of activities was carried out with initial coordination, then the socialization was carried out on June 9 2023 and monitoring of activities was carried out on August 22 2023. The results of the socialization on bullying prevention among Dharma Karya High School students showed that 75 people had experienced bullying, 102 people felt that they were not. have experienced bullying.
