Abstract

Studi ini mengkaji tentang tinjauan hukum islam terhadap aturan adat pernikahan di Desa Air Merah Kecamatan Malin Deman Kabupaten Mukomuko. Permasalahannya adalah pelaksanaan, sanksi, maksud dan tujuan serta bagaimana tinjauan hukum Islam terhadap aturan adat pernikahan di Desa Air Merah Kecamatan Malin Deman Kabupaten Mukomuko. Penelitian ini merupakan penelitian lapangan. Data yang diperoleh melalui wawancara semi terstruktur dan dokumentasi. Setelah data terkumpul diolah dengan cara kualitatif dan dianalisis dengan cara reduksi data, penyajian data dan simpulan. penelitian ini menemukan hasil pertama pelaksanaan aturan adat pernikahan ini yaitu batanyu (melamar), proses mamak rumah, proses kepala kaum, mufakat senek (kecil) dan mufakat gedang (besar), ndaon, makan gedang dan akad nikah, barak, mecak punjong dan asam basu. Kemudian sanksi adat bagi yang melangsungkan akad nikah di KUA yaitu bagi perempuan membayar denda uang ke adat sejumlah Rp. 900.000 dan bagi laki-laki harus nuhuk (mengikuti) kaum dengan membayar uang ke adat sejumlah Rp. 450.000. Kedua tujuan dan maksud adanya aturan adat pernikahan ini adalah 1) mengumumkan pernikahan dan menjaga nama baik kaum dan keluarga dari aib, 2) untuk melestarikan adat di Desa Air Merah, dan 3) memberikan efek jera bagi para pelaku yang melanggar dan tindakan preventif (pencegahan) bagi masyarakat lainnya. Ketiga tinjauan hukum Islam terhadap aturan adat pernikahan di Desa Air Merah Kecamatan Malin Deman Kabupaten Mukomuko dibagi menjadi dua bentuk yaitu 1) bagi masyarakat yang ekonominya mampu, maka aturan adat pernikahan tersebut boleh dijalankan 2) bagi masyarakat yang ekonominya tidak mampu, maka aturan adat pernikahan tersebut tidak boleh dijalankan.

Abstract

This paper aims at explaining the background of the persistence of Pulang ka Bako marriage in Lasi area and its correlation to family resilience. This research is field research. The Minangkabaunese still carry out the tradition of Pulang ka Bako marriage (marrying the daughter of father’s female sibling) in Minangkabau community, especially in Lasi area. This marriage is considered the ideal type of marriage in Minangkabau. The data sources were obtained from the result of interview with married couples, traditional leaders, and religious leaders. The collected data were then reduced, presented, and concluded. This result showed that the background of Pulang ka Bako marriage was the community’s understanding that this type of marriage can guarantee the development and maintenance of inheritance, kinship social relations, and preservation of traditions and customs. This tradition can build family resilience in the terms of economic and social, and it strengthens cultural resilience as well. From the perspective of maqashid al-sharia, Pulang ka Bako marriage does not only bring benefit to the individual but also to the family. Besides fulfilling the elements of hifzun nasl (preserving offspring), hifzul mal (managing assets), and hifzul 'irdh (maintaining honor), Pulang ka Bako also fulfills the elements of tahqiqul sakn wal mawaddah wa rahmah (realizing the sense of peace, love, and compassion) and tanzimul janibul mali (managing family finances). It can be concluded that Pulang ka Bako type of marriage has fulfilled the objectives of Islamic law and is capable of being one of the solutions to family resilience issues.

Abstract

This study examines the phenomenon of al-liwath in the paradigm (Philosophy of Pancasila), the Precepts of the Almighty Godhead, and in Islamic Law. The problem is whether or not liwath contradicts the first pancasila, violates pancasila or not and aims to find out the legal position of al-liwath in terms of Islamic law. From these problems arises the question of how the Philosophical View of Pancasila, the First Precept on the al-liwath Phenomenon in Indonesia and how the Islamic Law View on the al-liwath Phenomenon. This research is library research. Data is obtained through secondary sources (data) with primary material. After the data is collected, it is processed by reviewing with the author's research. Next, the data is narrated descriptively. The results are discussed with the theories put forward. The study found that Pancasila serves as the highest source of law in Indonesia. Indonesia does not allow behavior that is contrary to the noble values of Pancasila, because the Unitary State of the Republic of Indonesia is a legitimate state based on Pancasila and the 1945 Constitution. All people of the Unitary State of the Republic of Indonesia have faith and devotion to God Almighty by adhering to moral and ethical values, noble morals, and noble national personality. In Islamic law, Allah Almighty forbids all unnatural actions because it has wisdom that is very beneficial for humans in thinking. Liwath or homosexual acts are forbidden by sharia and are more heinous than adultery. The punishment for homosexuality is dissenting among jurisprudence scholars, among others: Absolute Suicide, Sanction Equivalent to Zina and Subject to Ta' zir Law.

Abstract

Some Muslims have stood up against health protocols for burying COVID-19 corpses. This research aimed to investigate the initial occurrence of this resistance in society, the contributing factors to the resistance, and the implications of the resistance. To date, most studies on resistance focused on social perspectives, but this research probed into the discourse of resistance during COVID-19 from the perspective of legal transformation, especially in Islamic law or fiqh. This study employed a qualitative approach supported by data obtained from printed and electronic media, and informants. The analysis revealed that public resistance to the burial which complied to health protocols was not only embodied in rhetorics or values but made apparent in their attitude. This study concludes that public resistance sucessfully reformed the law by bringing about the new fiqh regarding the burial practice. Since the community might not readily understand and accept this neq fiqh, we advised the government and related institutions to take intensive approaches to introduce this transformation to public.

Abstract

Studi ini mengakaji tentang Tinjauan Hukum Islam Terhadap Pembagian Warisan Sama Rata di Desa Bumi Mulya, Kecamatan Logas Tanah Darat, Kabupaten Kuantan Singingi, Provinsi Riau. Dari permasalahan tersebut muncul pertanyaan: (1) Apa yang menjadi pertimbangan masyarakat membagi warisan sama rata di desa Bumi Mulya?  (2) Bagaimana pandangan hukum kewarisan Islam terhadap pertimbangan masyarakat yang membagi warisan secara sama rata di desa Bumi Mulya?.  Penelitian ini adalah penelitian lapangan (field research) yang bersifat deskriptif dengan pendekatan kualitatif yaitu penelitian yang memahami tentang apa kejadian fenomena dilapangan, kemudian menganalisa data dengan metode tringulasi sumber. Hasil dari penelitian ini adalah Pertimbangan masyarakat Desa Bumi Mulya menerapkan pembagian warisan sama rata adalah berdasarkan kesepakatan para ahli waris dengan tujuan mencegah terjadinya perselisihan antar ahli waris dikemudian hari, selain itu terdapat  faktor lainnya seperti adat dan budaya turun menurun serta minimnya pengetahuan masyarakat tentang pembagian warisan dalam Islam. Tinjauan Hukum Islam terhadap pertimbangan yang digunakan oleh masyarakat Desa Bumi Mulya dalam menerapkan pembagian warisan sama rata di dalam Islam dibolehkan, dengan mengikuti ketentuan-ketentuan yang berlaku di dalamnya, yakni setiap ahli waris harus mengetahui bagian dari masing-masing ahli waris sebelum harta warisan dibagikan sebagaimana yang terdapat di dalam KHI Pasal 183.

Abstract

This research examines the efforts made by the Nagari Traditional Council (KAN) Salimpaung Tanah Datar Regency in fostering the Sakinah family. The problem is the efforts made by the Nagari Traditional Meeting Institution (KAN) Salimpaung, Tanah Datar Regency in fostering the Sakinah family. The purpose of this discussion is to find out and explain what forms of efforts and impacts are caused by the Salimpaung Village Adat (KAN) Kerapatan Adat (KAN) policy, as well as to analyze how Islamic Law reviews the efforts and impacts of the Salimpaung Nagari Traditional Village (KAN) policy in realizing the Sakinah family, Mawaddah, and Rahmah. Data was obtained through interviews and documentation, then the data was narrated descriptively. The results achieved are that KAN Salimpaung has made efforts to create a Sakinah, Mawaddah and Rahmah family. The forms of effort referred to are: (1) Implementation of Pre-Wedding Guidance (Screening) for Prospective Bride and Groom Couples, (2) Making Pre-Marriage Guidance a Requirement for Processing Marriage Permits by Niniak Mamak, and (3) Implementation of Guidance and Coaching Post Wedding. That the efforts to create a Sakinah, Mawaddah and Rahmah family carried out by KAN Salimpaung have an impact, namely: (1) Implementation of Pre-Marital Guidance (Screening) can provide provisions for prospective bride and groom couples to prepare an ideal household (2) Maintaining and strengthening friendship and family relationships (3) Providing an illustration that the provisions of the Salingka Nagari Custom, especially the provisions of the Salimpaung KAN in the field of marriage are in line with the provisions of Islamic law, and (4) Mutually strengthening the Duties and Functions of Religious Counselors in the Office of Religious Affairs (KUA ) with the Duties and Functions of Angku Ampek Pasukuan. Efforts to create a family that is Sakinah, Mawaddah and Rahmah, as has been done by KAN Salimpaung, are in line with the goals of marriage in the Shari'a itself. That Islamic law has noble ideals behind the existing marriage law, namely to create a family that is happy, eternal, peaceful, peaceful and full of love and affection, which are termed Sakinah, Mawaddah and Rahmah, which is basically in line with the aim of carrying out various efforts by KAN Salimpaung.
