Abstract

Since firstly transmitted in Java and became a major religion, about 700 years agoor even more, Islam has met with many older cultures and traditions that had been existed hundreds of years before, and grew so far with numerous model of synthesises. Universal values of Islam met with local genius. The universal messages of Islam, interacting with diverse etnicity and particularvalue, had created some new sytheses. The universal value did not pass away. Vice versa, it constantly adhereable and penetrated into the traditional way of life. Indeed, Islam manifested and transformed to be a new colour one: being localized in a new society. The new entity, on eventually, addopted by their socialite in particular, and their member of community in general. This is the fact that we can say to the javanesemoslem community, and will be discussed in the article. It is islamic virtues in the new tradition. The present article, however, will focuse on the religious ethics and the certain figure in the community, DamardjatiSupadjar, and give more specific attention through his concept of individuality (self) and sociality, notably “self-recognition”. The contain is results of bibliographic research. The main method of this article is philosophical interpretation and description.

Abstract

In this paper, I contend that Sufism is only preoccupied with initiating new disciples and performing emotive religious rituals. By focusing on Naqshbandi-Haqqani, I argue that Sufi group actively involves in propagating its teaching to the general public. I also argue that Sufi movement actively involves in public campaign, along with other Muslim groups with similar religious outlook, to respond the perceived growing influence of Salafism and political Islamism among Indonesian Muslims. It represents contemporary public face of Sufism and Sufi activism in Indonesia. At the heart of the argument of this chapter is to examine collective efforts to maintain Sunni orthodoxy (Ahlus Sunnah wal Jamaah) as a dominant religious norm, reclaim Sufism as a legitimate voice within Sunni orthodoxy and general Muslim community, oppose to Salafism and political Islamism, and rationalise Sufism to academic community in Indonesia. This chapter will demonstrate that active propagation through the internet plays a significant role in generating new Islamic consciousness with greater appreciation toward Sufi tradition among Indonesian Muslims. Sufism contributes not only to shape public religious discourse/morality, influence consuming patterns of urban upper-middle class Muslims, but also maintain moderate and peaceful Islam in Indonesia.

Abstract

Islam in Indonesia is culturally very different from that in the Middle East, particularly related to a tradition of greater freedom for women in public places. In Indonesia, there are many women entering public and political arena and even women are seeking and achieving unprecedented power and influence in public life. However, there are some barriers from religion and culture that give burdens to women to express their political views and to involve in public life. Very often women who want to enter politics find that the political and public environment is not conducive to their participation. This paper discusses cultural, religious, and political factors of the difficulties faced by Indonesian Muslim women to participate freely in public and political lives. This paper looks at how women’s status in cultural and social structure influences the involvement of women in political activities. This study is a philosophical investigation of the value of culture, religion, and politics to Indonesian women in democratic practices. With the use of intensive reading of books and other information sources, together with policy document analysis, the study aims to explore the problems and possibilities of putting the visions of democracy into practice in contemporary Indonesian women, to explore the nature of culture, religion, and politics in Indonesia in influencing women’s political activism, and to understand both the status of Muslim women and the dynamics of Muslim societies in Indonesia. This paper concludes that women are still under-represented in public and political institutions in Indonesia. The long struggle of women’s movement for equal rights has not been easy due to the cultural and religious reasons.

Abstract

The aim of this study is to find exact formulation of the offense of adultery. Problems in the research: 1) how Indonesian muslim society understand and act toward adultery, 2) why muslimsociety solve adultery without taking 284 Criminal Code, 3) why reconstruction of adultery law is needed, The research designs are qualitative tradition, constructivism paradigm, socio legal methodology, while its approaches are hermeneutics, philosophy and phenomenological approach. Its analyzing data technique are inductive analysis through data reduction and triangulation. The results show that Indonesian muslimsociety in sanctioning toward people committing intercourse without any legal marriage. In sanctioning is based on local custom and Islamreligion believed by major local community, with its priority on justification principle, between human as individual and as social creatures, and its justification between the victim’s need and the actor’s importance. The conclusion is that adultery criteria based on society is every intercourse without legal marriage, in accordance of religion and state, both is done by heterogeneous gender or homogenous gender. The value on 284 Criminal Code clause does not suit on the believed value by society since it only protects marriage institution. Meanwhile, in the values of Islamreligion, ones whom are protected is not only marriage institution but also the values of sexual moral society, so muslimsociety does not use 284 Criminal Code clause to take an action toward adultery actor. In progressive law, if law has problem therefore it needs to be reconstructed, and it is not the people to be insisted in adopting toward the law, then 284 Criminal Code clause must be reconstructed, because it is not effective and cannot create proper justice for Indonesian society. In the concept of Legal Pluralism, to reconstruct the clause must based on religious law, local custom and state Law, to create perfect justice.
