Abstract

AbstractThe granting of autonomy to the regions is intended to provide democratic space and public participation. Legal certainty in the administration of regional government specifically related to taxes is very crucial, especially for economic development, as it affects the investment climate. Any discrepancy between regional and central policies is seen as an obstacle in optimizing investment performance in the regions. The Government has proposed a Bill on General Provisions and Tax Facilities for Strengthening the Economy or also known as the Omnibus Bill on Taxation which regulates, among other things, regional tax and levy. The method used in this study is the type of legal research (normative) and carried out by examining library materials or secondary data in the form of various legal references, including primary, secondary, and tertiary materials. A descriptive technique is used in analyzing legal materials that have been collected. Writer opines that the Omnibus Bill is expected to provide business certainty, in the hope that it can increase investment. However, the discussion of the Omnibus Bill must be carefully done. There has to be a certainty and clarity of the intervention procedures of the central government so that it is carried out in a clear legal corridor.  AbstrakPemberian otonomi kepada daerah dimaksudkan untuk memberikan ruang demokrasi dan partisipasi masyarakat. Kepastian hukum dalam penyelenggaraan pemerintahan daerah merupakan hal yang sangat penting terutama dalam pembangunan di bidang ekonomi karena hal tersebut mempengaruhi iklim investasi. Adanya ketidaksinkronan kebijakan daerah dengan pusat dinilai sebagai hambatan dalam optimalisasi kinerja investasi di daerah. Pemerintah telah mengajukan Rancangan Undang-Undang Ketentuan Umum dan Fasilitas Perpajakan Untuk Penguatan Perekonomian atau RUU Omnibus Perpajakan yang salah satunya mengatur tentang pajak daerah dan retribusi daerah. Metode yang digunakan dalam penelitian ini adalah jenis penelitian hukum (normatif) dan dilakukan dengan menelaah bahan pustaka atau data sekunder berupa berbagai acuan hukum, baik bahan hukum primer, sekunder, maupun tersier. Teknik deskriptif digunakan dalam menganalisis bahan hukum yang telah dikumpulkan. Penulis berpendapat bahwa Omnibus Law Perpajakan dapat memberikan kepastian berusaha sehingga investasi semakin meningkat. Namun demikian, pembahasan RUU Omnibus Law harus dilakukan dengan cermat dan hati-hati. Harus ada kepastian dan kejelasan prosedur intervensi dari pemerintah pusat sehingga pelaksanaannya berada dalam koridor hukum yang jelas.

Abstract

Copyright is a part of Intellectual Property Rights whose existence must receive legal protection. The same is the case with other creations, especially those produced through digital media which are copyright works that must be protected. However, in reality there are still many people who do not understand about this protection, and many people are not responsible for using a copyrighted work without the author's permission. This of course is very detrimental to the creator as the original owner of the work by violating the exclusive rights of the creator. Some of the main issues that will be discussed in this research are copyright protection of digital works, namely digital painting as one of the works that should be protected as well as several legal remedies that can be taken against infringement of the exclusive rights of the author. This type of research is normative legal research with analytical descriptive research type and the problem approach used is a normative approach with a normative juridical approach. The results of the research and discussion conclude that legal protection for digital painting is implicitly regulated in Law Number 28 of 2014 concerning Copyright. Starting from the protection of the creator's exclusive rights to legal remedies that the creator can take.AbstrakHak cipta merupakan salah satu bagian dari Hak Kekayaan Intelektual yang keberadaannya harus mendapat perlindungan hukum. Sama hal nya dengan ciptaan-ciptaan lainnya khususnya terhadap ciptaan yang dihasilkan melalui media digital yang merupakan salah satu karya cipta yang harus dilindungi. Akan tetapi, pada kenyataannya masih banyak masyarakat yang belum paham mengenai perlindungan ini, serta banyak orang yang tidak bertanggung jawab memanfaatkan suatu karya cipta tanpa seizin pencipta. Hal tersebut tentu saja sangat merugikan pencipta sebagai pemilik asli dari ciptaan tersebut dengan dilanggarnya hak eksklusif dari si pencipta. Beberapa pokok permasalahan yang akan dibahas di dalam penelitian ini adalah tentang perlindungan hak cipta terhadap karya digital yaitu digital painting sebagai salah satu ciptaan yang seharusnya dilindungi serta beberapa upaya hukum yang dapat dilakukan terhadap pelanggaran atas hak eksklusif pencipta. Jenis penelitian ini yaitu penelitian hukum normatif dengan tipe penelitian deskriptif analitis dan pendekatan masalah yang digunakan yaitu pendekatan normatif dengan tipe pendekatan yuridis normatif. Hasil dari penelitian dan pembahasan menyimpulkan bahwa perlindungan hukum terhadap digital painting ini secara tersirat telah diatur di dalam Undang-Undang Nomor 28 Tahun 2014 tentang Hak Cipta. Mulai dari perlindungan terhadap hak eksklusif pencipta hingga upaya hukum yang dapat dilakukan oleh pencipta.

Abstract

Promoter is the concept of professionalism of the National Police, the main policy of the Promoter is the prevention of illicit traffic and narcotics abuse in Lampung Province. The research problem that will be discussed in this paper is how the efforts of the Lampung Police Narcotics Unit in overcoming illicit trafficking and drug abuse in the Lampung Regional Police jurisdiction and what are the inhibiting factors in overcoming illicit trafficking and drug abuse in the jurisdiction of Polda Lampung. Juridical normative and empirical research methods, using secondary and primary data, obtained from library research and field studies and data analysis with qualitative juridical analysis. Based on the results of research and discussion, it is known that the efforts of the Lampung Polda Narcotics Unit in overcoming illicit trafficking and drug abuse in the Lampung Regional Police jurisdiction are carried out in 3 (three) ways of pre-emptive, preventive and repressive efforts in overcoming illicit trafficking and drug abuse. Inhibiting factors including legal factors, law enforcement factors and the lack of informants are inhibiting factors because very few people are willing to be police informants. The suggestion that the writer can convey is that the Lampung Police Narcotics Unit should optimize guidance to the community in efforts to combat illicit traffic and drug abuse and it is hoped that the Lampung Police Narcotics Unit will improve coordination between elements of the criminal justice system, so as to provide positive synergy in efforts to combat illicit trafficking and abuse. drugs in the jurisdiction of the Lampung Regional Police will be achieved very well.

Abstract

The commitment of individual maintenance or personnel guaranntor often leads to rights removal of the personal guarantor so that an offense from the personal guarantor leads to bankruptcy. In some cases, for example in the case that happened to PT Hardy, the position of the personal guarantee which was initially intended as a guarantor that the debtor would pay off all his debts to the creditor, then his position could change to become like the main debtor who could be sued to be responsible for debt repayment without having to do confiscated in advance of the bankruptcy assets owned by the main debtor. The main problem to be examined is how the position of the board of directors who act as a personal guarantee issue in the bankruptcy of a limited company. The purpose of writing this journal is to analyze the legal position of the directors who act as personal guarantees in the event of bankruptcy. This journal is a normative juridical research, with a statute approach and a case approach. This journal analyzes that it has not been specifically regulated in the Indonesian Bankruptcy Law, the position of the Personal Guarantor or individual guarantor in the event of bankruptcy. This journal also finds that Personal Guarantor can turn into a debtor and be bankrupt when the guarantee agreement states explicitly that the guarantor  has given up his privileges while the main debtor cannot fulfill his agreement which can make the guarantor a debtor and can be filed for bankruptcy against him. In a Limited Company, the Board of Directors as a personnel officer who has been declared to have lost the right to dominate and take care of his wealth which is included in bankruptcy property and it can be confiscated if it has been decided by the commercial Court.

Abstract

Legal issues, including the criminal acts of corruption which are still widely committed by the State Civil Service (ASN) at this time are no longer a matter of formal legality, regarding the proper interpretation and application of articles of statutory regulations, but rather move to the direction of using the law as a means to participate in shaping a new life order or in accordance with current conditions. Law and society are closely related. Therefore, it is necessary to use social science or legal sociology to analyze and study legal issues, one of which is the structural functionalism theory to study law enforcement in Indonesia. The purpose of this study is to determine the analysis of corruption cases conducted by ASN in Indonesia using structural functionalism theory. In this study is a normative juridical research. The approach taken in this paper is a conceptual approach. This research is a library research. The result of this research is that the criminal act of corruption committed by ASN can be studied using structural functionalism theory as a science of legal sociology. According to the structural functionalism theory, if one of the elements in the structure does not function, the law will not work or be unstable. ASN is an element or implementing structure (government). Judging from the structural functionalism theory, acts of corruption by ASN make the law not function properly. Besides that, there is also a system and emphasis in studying structural functionalism, there is an AGIL paradigm in the structural theory of functionalism. It can be seen that the act of corruption by ASN has made ASN unable to perform its function properly in providing public services or is dysfunctional, and the law becomes unstable.AbstrakPersoalan-persoalan tentang hukum, tidak terkecuali tindak pidana korupsi yang masih banyak dilakukan oleh Aparatur Sipil Negara (ASN) pada saat ini tidak lagi merupakan persoalan tentang legilitas formal, tentang penafsiran serta penerapan pasal-pasal peraturan perundang-undangan secara semestinya, melainkan bergerak ke arah penggunaan hukum sebagai sarana untuk turut membentuk tata kehidupan yang baru atau sesuai dengan kondisi saat itu. Hukum dan masyarakat memiliki keterkaitan erat. Oleh karena itu dibutuhkan pemanfaatan ilmu sosial atau sosiologi hukum untuk menganalisis dan mengkaji persoalan-persoalan hukum, salah satunya pada teori funsionalisme struktural untuk mengkaji penegakan hukum di Indonesia. Tujuan dalam penelitian ini adalah untuk menegtahui analisis kasus korupsi yang dilakukan ASN di Indonesia menggunakan teori fungsionalisme struktural. Dalam penelitian ini merupakan penelitan yuridis normatif. Pendekatan yang dilakukan dalam tulisan ini adalah pendekatan konseptual. Penelitian ini merupakan penelitian kepustakaan (Library Research).  Hasil dari penelitian ini adalah Tindak pidana korupsi yang dilakukan oleh ASN dapat dikaji menggunakan  teori fungsionalisme struktural sebagai ilmu sosiologi hukum. Menurut teori fungsionalisme struktural jika salah satu elemen dalam struktur tersebut tidak berfungsi maka hukum tidak akan berjalan atau tidak stabil. ASN merupakan elemen atau struktur  pelaksana (pemerintah). Dikaji dari teori fungsionalisme struktural tindakan korupsi yang dilakukan ASN menjadikan hukum tidak berfungsi dengan baik. Selain itu juga terdapat sistem dan penekanan dalam mempelajari fungsionalisme struktural, terdapat paradigma AGIL dalam teori struktural fungsionalisme ini. Dapat terlihat bahwa tindakan korupsi yang dilakukan ASN tersebut menjadikan ASN tidak dapat melakukan fungsinya dengan baik dalam melakukan pelayanan publik atau terdapat disfungsional, serta hukum menjadi berjalan tidak stabil.

Abstract

The Financial Services Authority (OJK) in carrying out the regulatory function has regulated peer to peer lending in POJK No.77 / POJK.01/ 2016 (POJK LPMUBTI), but in the POJK LPMUBTI does not regulate the use of third parties or debt collector when collecting loans to consumers. This is only regulated in the Code of Conduct created by AFPI and there are still infringement by third parties or debt collectors peer to peer lending to consumers when collecting loans to consumers. This research is to analyse the regulation of the use of third parties or debt collectors in peer to peer lending when collecting loan to consumers and dispute resolution that can be done by consumers against debt collectors who commit unlawful acts in collecting loans. The method used in this article is normative juridical approach, which focuses on examining the implementation of written legal regulations and literatures. The results of this research shows that the Financial Services Authority has not yet regulated about the regulation of the use of debt collectors in peer to peer lending, it is only regulated in the Code of Conduct prepared by AFPI, so that it does not have a legal position thereby causing legal uncertainty. And it also shows that consumers can do dispute resolution in two steps, first complaint through the peer to peer lending providers and the second is through litigation process or non litigation process such as through the Alternative Dispute Resolution Institution (LAPS) provided by the OJK.

Abstract

Narcotics crime in Indonesian is very often discussed because the impact can be physical, mental health, emotional, attitude in society and can damage the younger generation, besides that the type of narcotics crime is a problem that continues to spread in various countries. Republic of Indonesia as a country based on the law of existence to achieve a better life in society. If someone does something which is a crime, then someone will be punished. However, during the sentence there was a reduction in the sentence or remission. In correctional institutions, remission is regulated in the Correctional Law of 1995 Article 14 Paragraph 1 regarding the rights of prisoners in item (i). The purpose of this study was to determine how the implementation of the mechanism for granting remission rights to narcotics prisoners. The method used is descriptive qualitative research method with normative legal research. Data collection techniques with literature study. The results showed that the implementation of the provision of remission rights still has problems, namely regarding the provision of Justice Collaborator as a term and condition of Law No. 99/2012.

Abstract

Persons with disabilities are often referred to as people with disabilities in everyday language, the life of persons with disabilities is also not like normal people on a daily basis, often the rights of persons with disabilities are abused by certain elements of society either intentionally or unintentionally. Often the facilities built for persons with disabilities are also used by normal people so that many people with disabilities still have their rights not fulfilled. Therefore, the importance of monitoring facilities and infrastructure, both public and special facilities for people with disabilities, so that they do not feel marginalized and the importance of normal public awareness to prioritize things for people with disabilities. It can be said that the needs for facilities and infrastructure for persons with disabilities must be more special compared to normal people in general, both in terms of facilities, treatment and actions. However, persons with disabilities must also have the same rights as other normal people. Prisoners are entitled to other rights in accordance with Article 11 of Law No. 12 of 1995 concerning Penalties if associated with prisoners with disabilities, the special rights that will be given when persons with disabilities are serving a sentence in a correctional institution are listed in Article 37 of Law Number 8 of 2016 concerning Persons with Disabilities.AbstrakPenyandang disabilitas kerap kali disebut dengan orang yang cacat dengan bahasa sehari-hari, kehidupan penyandang disabilitas juga tidak seperti masyarakat normal pada sehari-harinya, seringkali hak-hak penyandang disabilitas ini disalah gunakan oleh oknum-oknum masyarakat tertentu entah dengan sengaja maupun tidak sengaja. Seringkali juga fasilitas-fasilitas yang dibangun untuk para penyandang disabilitas ini dipakai oleh masyarakat normal sehingga para penyandang disabilitas masih banyak yang belum terpenuhi haknya. Maka dari itu, pentingnya pengawasan sarana dan prasarana baik fasilitas umum maupun khusus untuk para penyandang disabilitas ini supaya mereka tidak merasa terpinggirkan dan pentingnya juga kesadaran masyarakat normal untuk lebih mendahulukan sesuatu hal untuk kaum penyandang disabilitas. Dapat dikatakan kebutuhan sarana prasarana penyandang disabilitas harus lebih spesial dibandingkan dengan masyarakat normal pada umumnya, baik dari segi fasilitas, perlakuan, dan tindakan. Namun penyandang disabilitas juga harus mempunyai hak yang sama dengan masyarakat normal lainnya, Narapidana berhak mendapatkan hak-hak lain sesuai dengan Pasal 11 Undang-undang No. 12 Tahun 1995 tentang Pemasyarakatan jika dikaitkan dengan narapidana penyandang disabilitas maka hak-hak khusus yang akan diberikan ketika penyandang disabilitas menjalani hukuman di Lembaga Pemasyarakatan yakni tercantum dalam Pasal 37 Undang-undang Nomor 8 Tahun 2016 tentang Penyandang Disabilitas.

Abstract

Klien yang dalam masa  pembimbingan di Balai Pemasyarakatan ialah seseorang yang telah melalui proses peradilan dan telah diputus oleh Hakim di pengadilan yang memiliki kekuatan hukum tetap. Berdasarkan putusan pengadilan itulah Balai Pemasyarakatan berwenang dan berkewajiban melaksanakan bimbingan pada klien pemsayarakatan. Tujuan diadakan bimbingan kegiatan kerja agar ketika klien keluar dari Balai Pemasyarakatan mereka memilki kemampuan yang dapat dikembangkan serta dapat memenuhi kebutuhan mereka dan tidak mengulangi kesalahan, sehingga memberikan kesempatan kepada klien agar mendapatkan suatu pekerjaan atau kemampuan bekerja. Balai Pemasyarakatan adalah suatu sarana untuk melaksanakan bimbingan klien Pemasyarakatan. Bapas mempunyai tugas dan fungsi menyelenggarakan pembimbingan klien pemasyarakatan. Berkaitan pada masalah yang dihadapi saat ini adalah pandemi Covid-19, pihak Bapas terhambat dan terpaksa memberhentikan sementara kegiatan kerja tersebut agar mengurangi penyebaran virus Covid-19 dengan melakukan aktivitas yang berkerumun yang biasa dilaksanakan di Bapas.

Abstract

Taxes are the main source of state revenue in their function as budgetair and as a tool to regulate in the social and economic fields in their function as a regulator, which based on the collection agency is divided into central taxes and regional taxes. One form of regional tax at the provincial level is the title transfer tax for motorized vehicles, which on January 3, 2020, by the Governor of DKI Jakarta, is given a non-taxable incentive for the transfer of ownership of Battery-Based Electric Motor Vehicles for Road Transportation. By using a juridical-normative approach through the theory of legal validity, it can be seen that the issuance of Gubernatorial Regulation 3/2020 is contrary to Act 28/2009 but is harmonized with Presidential Regulation 55/2019 which is a follow-up to the provisions of Article 17 paragraph (1) The Governor's Regulation, as well as through the theory of the welfare state it is understood that the issuance of a statutory regulation must also consider the burden of the government's responsibility in providing for the needs of its people, including by ensuring that people can live in an environment that has good air quality. So in this case, the consistency of the government in harmonizing laws and regulations is needed which is also followed by the participation of local society in supporting government programs to improve the quality of life of the people in their areas.
