Abstract

The regional tax was the source income the areal that important to finance the implementation of autonomy of the area. Then area must have the authority and the capacity to dig up sources of finance self, manage and used finance personally that really adequate to finance the implementation of the government. But each government stage could only collect the tax that was mainteed to authority. It's mean to avoid the existence of the overlap or the struggle for the authority in the tax collection againts the community.Kata Kunci : Pajak Daerah, Pendapatan Asli Daerah

Abstract

This study aimed to describe the functional dialectic between Jaw and power authorities. The result: (1) the authoricy is a conception of social relations between the two parties or two institutions that are each influences, dominating or exploitative; (2) legal characteristics can be viewed from the authorities that form, and substance of the work in organizing the community; (3) functional dialectic between Jaw and state power authorities gave birth to two patterns of relationships, which is identical to the rule of Jaw and vice versa. Finally, the 'state' as a sovereign authority through the institutionalization of formal institutions should be able to put laws autonomous in accordance with the principles of human rights, in order to avoid 'trade off between the rule of law.

Abstract

History records that the adopted child and the adoption has been known for a long time ago. This adoption can occur due to personal and social interests, such as not having children because of infertility or other reasons, or aimed to assist and uplift the community as a result of the economic downturn. Legal adoption both in Arabia as well as other places such as China and even in Indonesia has a long history, and even in the Arab lands once canceled, While in the prevailed Ducth Colonial law period to Indonesia, no law of adoption.

Abstract

The usual legal system of civil law often require an expensive cost, a complicated and takes long time to complete a case. The demand to resolve small civil case through special legal system is increase. Gugatan sederhana (adopted from Small Claims Court) is an alternative legal system provided in the district court to settle the civil case that are more accessible and effective in maintaining legal rights for justice seekers. The empowerment of gugatan sederhana starts in the district court because it is the first level court to go to resolve the civil case faced by justice seekers.

Abstract

Products responsive law charade tin the drafting process is participatory, in terms absorbing the participation of individual social groups and individuals in society, to absorb the community's aspirations on a large scale so that cristalitafion various communities will vie with each other, and limit the space for governments to make the interpretations that is too much determined by the vision and his own political power, in the model of responsive law, good law should offer something more than merely procedural justice. A good law must be competent and fair, such a law should be able to recognize the public desires that have commitedto the achievement of substantive justice. To create a responsive law caracter, with the main strategy of political reform (because the law is a political product) by creating a democratic government. Administering the state also needed a good spirit, as contained in the 'Pembukaan UUD1945'. Besides needing a single paradigm is released defication (positivistic) that had been adopted, and made the Pancasila as the basic for development of national law, as well as the implementation base on the paradigm of progressive law in orderto achieve substantive justice

Abstract

Abstract Using of communal land by private enterprise has been also creating disputes in West Sumatra. The disputes are started from the unprocedure land procurement process. According to the law of land procurement in Indonesia, for getting land, a private enterprise should contact the land owners (or traditional communities) as the subject of communal land for making contract directly. As a matter of fact, they have got the land from the Local Government not from the people. The communities protested to the corporate activities on their land. Beside that, the private enterprises have got agrement with communities, but they did not follow it, for instance building plasma plantation for the communities. Key Word: disputes of communal land Abstrak Penggunaan tanah ulayat oleh para investor di Sumatera Barat, seringkali menimbulkan sengketa. Hal ini disebabkan karena penggunaannya tidak sesuai dengan yang seharusnya. Menurut hukum pertanahan di Indonesia, penggunaan lahan oleh para investor harus berhadapan langsung dengan pemilik tanah atau masyarakat adat sebagai pemilik hak ulayat dengan melaksanakan perjanjian. Pada kenyataannya, para investor justru langsung mendapatkan tanah tersebut melalui Pemerintah. Akibatnya masyarakat sebagai pemilik mengajukan protes atas kegiatan investor di atas tanah mereka yang kemudian hal ini memicu timbulnya sengketa tanah ulayat. Kata Kunci : sengketa tanah ulayat

Abstract

Kewajiban negara di bawah CEDAW, antara lain, adalah untuk menghilangkan diskriminasi terhadap perempuan dalam perkawinan menurut Pasal 16 dan menjamin hak-hak perempuan pedesaan menurut pasal 14. Penelitian ini mencoba untuk menemukan diskriminasi terhadap perempuan dalam hukum adat perkawinan  Nias dan kewajiban Negara berdasarkan Konvensi CEDAW.  Hasil penelitian menunjukkan bahwa persyaratan dan pelaksanaan Nias perkawinan hukum adat telah melanggar UU Perkawinan di Indonesia dan berdampak pada adanya diskriminasi terhadap hak-hak perempuan dalam perkawinan.

Abstract

Sebagai aturan dasar atau pokok penyelenggaraan negara, tentu Undang-Undang Dasar Negara Republik Indonesia Tahun 1945 memuat norma hukum yang menjadi dasar bagi pembentukan landasan operasional agar tujuan dan cita hukum negara Indonesia dapat tercapai. Dengan kata lain, norma hukum yang terkandung dalam pasal-pasal Undang-Undang Dasar menjadi tiang pancang bagi sistem peraturan perundang-undangan di Indonesia. Peran Undang-Undang Dasar yang krusial, sangat tidak memungkinkan bagi pembentuk Undang-Undang atau peraturan perundang-undangan untuk mengandalkan ratio legis yang terputus dari pemahaman makna knstruksi norma hukum Undang-Undang Dasar itu sendiri. Hanya saja, dalam praktiknya kompromi politik cenderung menjadi tumpuan utama untuk menuangkan norma hukum dalam Undang-Undang Dasar di Undang-Undang. Inilah yang diyakini sebagai pembuka pintu masalah bagi miskonsepsinya sistem peraturan perundang-undangan di Indonesia.

Abstract

This research aims to determine the prospects of persons with disabilities protection against discriminatory behavior in Semarang. The research method is normative using the laws approach (statutory approach), and the conceptual approach (conceptual approach). Results of the study found that the government of Semarang have prospects in providing protection and fulfillment of the rights of persons with disabilitas of discriminatory behavior. Constitution of the Republic of Indonesia Act1945 does not set a specific reference on Disability, but set firmly and clearly regarding non- discrimination, equality before the law, and the right to receive equal treatment before the law throughout Indonesia.

Abstract

Abstract: National Commission on Violence Against Women (Komnas Perempuan) is an independent national institution that function to promote and protect women's rights. Institutional existence of Komnas Perempuan still contain many flaws and does not show the characteristics as effective human rights institution. Therefore the institutional of Komnas Perempuan should be arranged to strengthen the function in the protection of human rights in Indonesia, especially women's rights. Keyword: National Commission on Violence Against Women, effective, institutional Abstrak: Komisi Nasional Anti Kekerasan terhadap Perempuan (Komnas Perempuan) adalah institusi nasional independen HAM yang berfungsi memajukan dan melindungi hak-hak perempuan. Eksistensi kelembagaan Komnas Perempuan masih mengandung banyak kelemahan dan tidak memperlihatkan ciri sebagai institusi nasional HAM yang efektif. Oleh karena itu kelembagaan Komnas Perempuan harus ditata untuk memperkuat perlindungan HAM di Indonesia khususnya hak-hak perempuan. Kata Kunci: Komnas Perempuan, efektif, kelembagaan
