Abstract

Protection Rules that apply to workers As the fulfillment of inherent core rights & there are those regulated in the constitution contained in one of the articles in the 1945 Constitution, due to the entry into force of employers as if accepting legalization, implementing outsourcing practices without paying attention to things that are stopped by the law. The primary reason for outsourcing for companies is to increase business concentration because operational activities have been delegated to other parties. This study will analyze the main main conflicts that are in sync with the title using the scope of the problem that is currently happening, as described above using a normative juridical approach. laws and regulations in this study. The data obtained are included in the form of a concept model which will be the primary basis for analyzing. As for the writing of this scientific paper, the method used to analyze the data has been taken using a descriptive (non-statistical) method. Legislation that contains the content of manpower as the basis for steps to regulate the lower limit of workers' salaries to create and for the welfare of workers in North Sumatra Province. it is not working properly. The role of laws and regulations on how to set the lower limit of wages cannot help workers to achieve labor sufficiency.

Abstract

Memikirkan penyalahgunaan dan peredaran narkotika mengharuskan pemerintah memikirkan cara menanggulangi permasalahan tersebut. Pemerintah telah mengeluarkan Undang-Undang No. 5 Tahun 1997 tentang Psikotropika dan Undang-Undang Nomor 35 Tahun 2009 tentang Narkotika. Dengan demikian hadirnya Undang-Undang ini dapat menekan sekecil-kecil penyalahgunaan narkotika. Penyalahgunaan narkotika adalah masalah besar bagi Indonesia karena dapat merusak generasi penerus bangsa, masyarakat, Ketahanan Nasional Indonesia. Apalagi jika terjadi dikalangan penegak hukum yaitu polisi maupun anggota militer dimana mereka ini adalah komponen utama dalam pertahanan Negara dan merupakan alat Negara yang bertugas mempertahankan, melindungi dan mempertahankan, serta memelihara keutuhan dan kedaulatan Negara. Penulis menggunakan metode library research atau kajian pustaka. Riset kajian kepustakaan ini adalah melakukan penelitian dari buku-buku perpustakaan, majalah, jurnal dan artikel dan sumber dari internet yang relevan dengan masalah yang dibahas.

Abstract

In the eradication and prevention of money laundering, notaries should have taken part in informing such crimes. This is due to the notary being a Gate Keeper who can minimize the chance of obscuring the origin of the wealth that comes from a crime enjoyed by the perpetrator. Government Regulation number 43 of 2015 concerning Informing Parties in the Prevention and Eradication of Money Laundering Crimes emphasized that professionals such as notaries must inform if there are suspicious transactions involving their clients. Based on such regulation, the notary has a share where they must participate to minimize and prevent the occurrence of this money laundering crime.

Abstract

This paper written to analyze the consequence of the new provision in Minister of Agrarian and spatial planning/Head of National Land Agency regulation number 16 in 2021 which changes chapter 111. The new provision stipulate that the deed of inheritance rights should be made by a notary located at the inheritor domicile when they died. Based on the new provision, if the inheritance are land rights or ownership rights to the apartment units, the Notary who has the authority to made the deed of inheritance rights is the one who domiciled in the Inheritor Domicile not the one who domiciled where the lands are located. This research is conducted to find out if there are any legal problem because of the new provisions.

Abstract

This study examines the appropriateness of making a notary nameplate who is active in the capital market in order to carry out his position. The research method in this thesis is normative juridical, namely by library research, with a statutory approach. type of descriptive research, which helps in strengthening hypotheses in order to help strengthen old theories or in formulating new theories. The data used is secondary data consisting of primary legal materials in the form of the notary position law, financial services authority regulations (OJK) and the Notary Code of Ethics (KEN), secondary legal materials in the form of journals and articles as well as supporting books on the position of a notary and tertiary legal materials. In the results of this study, it was found that there was an ethical violation if the notary listed on his name board that he was a capital market notary. In addition, it is also seen as less effective in supporting the notary profession which is an honorable profession that cannot promote itself (officium nobile). Building connections with fellow capital market supporting professions is recommended so that they can carry out activities in the capital market apart from being registered as a notary in the capital market.

Abstract

A In the implementation of the registration of land rights to former customary property, one of the documents needed in the registration is a Land Certificate issued by the Village Head. In terms of granting land certificates, sometimes problems arise in the community. Where the provision of the letter is not in accordance with the ownership or physical control of the former customary land controlled by the community. For example, the land area is not suitable and sometimes the letter is not given to people who are entitled to receive a land certificate, as proof of land ownership or control of land that was previously owned by adat. This study uses a type of empirical juridical research with a research location in Kabupaten Kupang, NTT, regarding the analysis of land certificates issued by the village head. The population and sample used purposive sampling technique with the types and sources of data obtained from primary data and secondary data. The technique of collecting Legal Materials uses Field Research. Furthermore, the collected legal materials are then analyzed qualitatively descriptively. Land Certificate issued by the Village Head The Village Head is a valid evidence. The Village Head is given a direct mandate by law to issue a Land Certificate in accordance with the location of the former customary land object owned by the community for various purposes, for example for registration of Property Rights certificates to the National Land Agency (BPN) according to Circular No. 9/SE /VI/2013 concerning Certificate of Ex-Indigenous Land. In addition, for the purpose of buying and selling land based on Government Regulation Number 24 of 1997 concerning Land Registration. As well as proof of the temporary ownership rights for the former customary land object if the community has not had time to register it with the National Land Agency. For the purpose of buying and selling or transferring rights to former customary land, the legal force of a land certificate issued by the Village Head, in the event that this land sale and purchase transaction is based on Government Regulation Number 24 of 1997 concerning Land Registration, will have more legal force if it is known by the The sub-district head as the official making the land deed, with a legal basis based on the Elucidation of Article 7 paragraph (2) and Article 39 paragraph (1) letter (b) number (1) and number (2) Government Regulation Number 24 of 1997 can be categorized as the basis for the rights proposed as completeness of the requirements for the application for land rights.

Abstract

The granting of property rights to flat units in Indonesia for foreign nationals is a legal reform in Indonesia that has many pros and cons. This study was conducted to describe the status of rights received by foreign citizens who wish to own an apartment unit in Indonesia and also the impact of the enactment of regulations for granting the status of ownership rights to flat units to foreign citizens in Indonesia. This study uses a normative juridical method. The conclusion in this study is that foreign citizens are given ownership rights to flat units on land with building rights or use rights on state land; or right to use building or right to use land with management rights. According to Law No. 11 of 2020 concerning Job Creation, Ownership rights to flat units are ownership rights to separate individual flat units with shared rights to shared parts, shared objects, and shared land. The positive impact of granting ownership rights to flat units to foreign nationals is the increase in foreign investment in Indonesia, advances in technology and human resources as well as increasing interest in doing business in Indonesia.

Abstract

Small Claims Court is a mechanism for settling disputes quickly so examined in small claims court are certainly cases that simple. In Article 1 number 1 of the Supreme Court Regulation Number 2 of 2015 it is stated that the Settlement of Simple Lawsuits is defined as "the procedure for examining a civil lawsuit with a material claim value of a maximum of Rp. 200 million which is settled with simple procedures and proof". In addition to the provisions regarding the value of the lawsuit, of course there are other conditions for a case to be resolved through a small claim court. The research method uses normative juridical research, namely examining the application of the small claim court in civil procedural law in Indonesia. The type of research used in this research is descriptive analytical, namely legal research that observes the facts of a legal event in themechanism small claim court and then analyzes it. The results of the study show that the principles in civil procedural law in Indonesia are simple, fast and low cost. So far, this principle has not been implemented effectively because in practice the settlement of civil disputes always takes a long time and costs a lot of money. Meanwhile, in the settlement of a simple lawsuit, the maximum limit for the value of the material claim has been determined and the case submitted must be against the law or breach of contract, while in the settlement of cases through civil procedural law the material claim is not determined, and the case submitted does not have to be unlawful and tortuous.

Abstract

Efforts to provide legal protection for workers/labourers in an employment relationship are a follow-up to the enforcement of human rights. The acknowledgment of equality before the law between employers and workers/labourers is a juridical consequence of the meaning contained in Article 27 of the 1945 Constitution, so Iman Soepomo (1985: 7) wrote, "that juridically the relationship between workers and employers in carrying out work relations have the same position, in the sense that they can exercise freely. This unequal position between workers/ laborers and employers often creates conflicts, employers provide/issue policies or regulations which according to their considerations are good and accepted by workers/laborers. However, sometimes workers/laborers have different views from employers, so the result is predictable, it will lead to conflicts or disputes; which is in the Act. No. 13 of 2003 concerning Manpower is called the Industrial Relations Dispute. With this, research will be conducted on what are the factors that underlie the disputing parties in choosing the pattern of compulsory dispute resolution as an option in resolving industrial relations disputes. So to find out the factors that underlie the disputing parties in determining the pattern or method of compulsory settlement as a way of resolving their industrial relations disputes.
