Abstract

An omnibus law into a new diskursus among all these observer , academics , politician , some groups obtained to having an interest to the product of law ( especially in the act of copyright with their new working been ratified by parliament. As a concept that is basically having no roots historical , theoretical , as well as practical in the indonesian legal system , the application of law is considered an omnibus would bring them to various kinds of serious debate if it is associated with the act of regarding the formation of legislation. For, known as, the bill does not set a clause on the concept of an omnibus, law in practice accommodate berbagaimacam kinds of topics and problems into one product, legislation for the legislation we are just following the principle of single, one the act of one particular subject / certain problems. Writer willing to this by asking problems up the theme and 1 ).Why government to use the law to an omnibus who are not known in the indonesian legal system. and 2) How a omnibus law in the indonesian legal system; normative juridical by using the method. Writers strove colaboration these problems and place into normative logic that is in the formation and regulations in indonesia. Abstract

The main topic of discussion in this journal is the application of the parliamentary threshold policy in the political system in Indonesia. The Parliamentary threshold is a minimum vote acquisition threshold that must be met by political parties participating in the elections to be able to place their legislative candidates in parliament. The juridical empirical research method is used for discussion, which includes the effectiveness and impact of the law. This study also aims to provide input or contribution of ideas to the central government in implementing the parliamentary threshold policy on political parties, so as to produce good governance (good governance) that is stable, effective and efficient. Based on the research results, it can be seen that there is a parliamentary threshold debate in the political system in the country regarding the threshold for national vote acquisition for political parties to be included in the calculation and distribution of DPR seats. In formal juridical terms, the parliamentary threshold debate in the party system in Indonesia is conducted based on the law on political parties and democratic principles. The application of the parliamentary threshold in the national political system is expected to be simplified. Simplifying the number of political parties in Indonesia needs to be done as an effort to improve the quality of political parties so that they can make better contributions to the development of national politics. In addition, party simplification is also carried out in order to facilitate political governance in parliament and to increase the effectiveness and efficiency of democratic and political processes both in parliament and in government. Therefore, simplifying the party is an alternative solution in improving the quality of democracy and government stability, which in the end is for the welfare of the people.

Abstract

Abstract

Law enforcement against narcotics crimes continues to be improved considering the number of cases from year to year is increasing. What is a factor in the increasing number of cases of drug crimes that are getting faster is also triggered by the development of information technology, where communication between users, dealers, and suppliers can easily take place via the internet. Therefore, to prevent and eradicate narcotics crimes in Indonesia in general, it can be done with three approaches, namely a philosophical approach, a sociological approach, and a religious approach.

Abstract

Whereas the establishment of an alternative institution for dispute resolution in the financial services sector seems to want to reduce BPSK's authority by reinforcing the boundaries between banking/non-banking consumers and other consumers that BPSK had not previously distinguished in resolving submitted disputes. However, the existence of this LAPS creates dualism in consumer dispute resolution. Moreover, the regulation regarding the LAW ERA NO.2/TH.16/OCTOBER 2016: CONSUMER DISPUTE SETTLEMENT BY THE CONSUMER DISPUTE SETTLEMENT AGENCY (BPSK) AND ALTERNATIVE DISPUTE SETTLEMENT AGENCY IN THE FINANCIAL SERVICES SECTOR (LAPS-SJK) 197 absolute authority/competence for settlement the dispute is not explicitly regulated. Until now, there are still many consumers who prefer BPSK as dispute resolution because the procedure is considered clearer and provides more protection, one of which is the application of a tiered dispute resolution mechanism. Likewise, business actors are reluctant to choose LAPS-SJK as an alternative for consumer dispute resolution and prefer to settle disputes by consensus/family deliberation. If consensus/peace is not reached, dispute resolution through the district court is the last option that will be taken by business actors to resolve disputes with consumers because it is more certain

Abstract

Pemerintah nampaknya harus bekerja rebih keras, mengingat dalam UUD 1945 pasal 34 yang berbunyi “fakir miskin dan anak terlantar dipelihara oleh Negara”. Artinya sesungguhnya mereka yang hidup terlantar (termasuk anak jalanan, gelandangan dan pengemis) juga harus menjadi perhatian negara. Ironisnya pemerintah seolah angkat tangan dalam menangani anak jalanan. Yang akan dikaji Bagaimana Implementasi Peraturan Daerah Kota Palembang Nomor 12 Tahun 2013 tentang Pembinaan Anak Jalanan, Gelandangan dan Pengemis Kota Palembangn dan Apa saja faktor penduduk dan penghambat pembinaan Anak Jalanan, Gelandangan dan Pengemis di Kota Palembang. Metode penelitian Yuridis Empiris. Hasil pembahasan dalam penjangkauan dan pembinaan anak jalanan, gelandangan dan pengemis harus mengikuti prosedur dan aturan yang berlaku dikarenakan dari Kesejahteraan Sosial Anak. Selanjutnya dalam Pasal 8 Perahran Daerah Kota palembang Nomor 12 Tahun 2013 tentang Anak Jalanan, Gelandangan dan pengemis Kota Palembang menerangkan bahwa jangka waktu penampungan sementara hasil penjangkauan dapat dilaksanakan paling lama 4 (empat) bulan. Namun pengembalian anak jalanan, gelandangan dan pengemis dilakukan setelah orang tua atau keluarga asal dinilai siap untuk menerima bagi Anak Jalanan, Gelandanagn dan Pengemis untuk kembali. Implementasi faktor pendukung dan faktor penghambat. Simpulannya berdasarkan implementasi terhadap peraturan daerah kota Palembang Nomor 12 Tahun 2013 tentang pembinaan anak jalanan, gelandangan dan pengemis sudah menurun sejak peraturan daerah ini ditetapkan. Kemudian diharapkan kedepan Pemerintah dapat mengupayakan peningkatan ketersediaan sarana dan prasarana agar implementasi terhadap peraturan daerah ini dapat berjalan lebih maksimal.

Abstract

The determination of the dispensation for underage marriages is still based on considerations in accordance with the Marriage Law, namely limiting the minimum age of marriage to 19 (nineteen) years for both men and women. This study discusses issues regarding judges' considerations and the legal consequences of determining marriage dispensation for minors based on the Pringsewu Religious Court Decision Number: 62/Pdt.P/2020/PA.PRW. This study uses a normative juridical approach and an empirical juridical approach. Collecting data by field studies and literature studies. Data analysis was carried out in a qualitative juridical manner, namely the analysis was carried out descriptively. The dispensation for underage marriages needs to be tightened in more detail, so that the public is more aware and aware of the more negative impacts than the positive impacts that will arise on children who engage in underage marriages physically, mentally, and socially.

Abstract

People with disabilities still find it difficult to find and find work because they are considered less productive and unable to work. However, every human being has human rights including the right to get a job. According to the ASN Law Article 61 of Law Number 5 of 2014 concerning State Civil Apparatus explains that because every Indonesian citizen has the same opportunity to apply to become a Civil Servant (PNS) after fulfilling the requirements. This study uses a normative study with qualitative descriptive analysis focused on library research and analysis of the preparation of written data. The author finds that the government's role is through policies and program realizations whose direction is not only supervision in sanctioning employers but also developing the quality and placement of workers with disabilities, opening up a special labor market and promoting all stakeholders to provide recruitment. Nevertheless, the role of the central government in realizing the obligations of international and national human rights legal instruments has not complied with the provisions comprehensively because special regulations relating to employment still have discrimination provisions, the absence of government technical regulations on employment disability, lack of regulations and policy measures to encourage private sector employment

Abstract

The crime of sexual abuse of minors is not something that can be considered a small and unimportant problem. This problem is very important, the victims are minors, where children as the nation's buds and the next generation of the nation's ideals must be considered, protected and guarded from all actions that can harm them. Therefore, not only his family plays an active role but all levels of society play an active role in paying attention, protecting, and protecting him. The type of research used by the author is qualitative research, namely the author conducts research with the intention of being able to understand the phenomenon of what is experienced by the object or research subject. In this study, to find out the information contained in books, as well as articles related to existing problems. In the study used by the author is a normative study (Library Research). In this paper, it can be concluded that the enforcement of criminal law in cases of criminal acts of obscenity is regulated in the child protection law article 17 paragraph 2 which states that "every child who is a victim or perpetrator of sexual violence or who is in conflict with the law is kept secret. In Law Enforcement Efforts, crime prevention can be divided into repressive, preventive, and pre-emptive efforts. Efforts to protect children need to be continuously pursued in order to maintain the welfare of children, considering that children are one of the valuable assets for the progress of a nation in the future. The quality of protection for children should have the same degree or level as protection for adults, because everyone has the same position before the law (equality before the law).
