Abstract

This article aims to analyze the regulation of the use of underwater drones in international law from the perspective of Indonesian law. This article concludes that the regulation regarding the use of underwater drones that cross national borders has not been specifically regulated both in international law and in national law. Therefore, it is necessary to make special arrangements regarding the use of underwater missiles in terms of attack, spying, and collecting marine data so that foreign countries do not freely operate underwater drones in the territorial sea of ​​other countries and do not violate the right of peaceful passage as regulated. in UNCLOS 1982. In the future, the government needs to strengthen the maritime security system in Indonesian territory and take firm action against persons involved in the entry of foreign military assets into Indonesian territory. Abstract

This research is motivated by the implementation of decentralization in a country that cannot be separated from mineral resources owned by each region. The arrangements of management of mining become an inseparable part in the editorial discussion of the policy directions and thw arrangements of regarding decentralization. The Regions that have the potential for explorative natural resources are faced with a complicated situation and full of pros and cons when discussing about mining in their area. The revised of the act of regional government certainly contributes to the political of decentralized law and the arranggement of mining. The relationship between the central government and regional governments, especially the provinces in mining management based on the Act of Mineral and Coal must receive special attention, because it has a direct orientation towards the perspective of decentralization. To discuss these issues, conducted by normative legal research method with the statute approach. The authority of the central government in managing mineral and coal mining has a paradigm of decentralization that is felt to be getting stronger. Exceptions to government affairs which by acts are determined as central government affairs are the constitutional basis of legislators as the basis for decentralization

Abstract

The problem in question is the independence of supervision of LPSK members. This is related to the mechanism for forming an advisory board and an ethics board that affects the pattern of supervision of LPSK members when it is correlated with the determination of LPSK members who are suspected of committing disgraceful acts. The analytical knife used is independence. The formation of this advisory board and ethics board must go through a selection formed by the President. The reason for the formation of the advisory board and the ethics board must go through a selection mechanism by the selection committee that forms the president, so that the supervision carried out within the LPSK becomes more independent.

Abstract

A state of absence (Afwezigheid), which is a state where a person is not exist at the place of residence for a certain period of time. A person who is declared as afwezigheid results in his position according to the Civil Law being considered as juridical death, this causes their rights and obligations to be potentially deleted. In this modern world with rapidly developing technology make it easy for people to connect with each other, and barriers of communication are not a cause for concern anymore, but there are riot events such as natural disasters that cannot be avoided that can make a person being able to declared as afwezigheid. Afwezigheid has serious implications for the fulfilment of one's rights and obligations, for example in marriage. The marital status of the absent person (Afwezig) has the potential to end and result in the transfer of rights and obligations such as marital property, inheritance and alimony of children, because the person’s status is equivalent to death. Based on the Burgerlijk Wetboek, afwezigheid issues need to go through a process and require a court decision regarding the status or position of an afwezig on ​​a request by the interests. New problems will also arise when the afwezig return when their rights and obligations have been removed and are transferred. As well known, court decisions that have legal force can no longer be contested. Thus, the fate of those the absent person afwezig depends on the court's decision, because until now, there are no rules that explicitly regulate about the afweziheid.

Abstract

State Owned Asset (SOA) utilization is a part of the management of state assets as an alternative in providing income for the state through non-tax state revenue. The implementation of the utilization of SOA is stated in the form of an agreement or contract between the government and the partner which can come from the private sector. This research will analyze the provisions or arrangements of the SOA utilization agreement related to the contract law in Indonesia and the application of freedom of contract in the SOA utilization contracts. The results of this reseatch indicate that the principle of freedom of contract is not absolute and the application of freedom of contract in the SOA utilization agreement is limited by the laws and regulations governing the provisions in the management of SOA. This research was conducted using a normative juridical method through a conceptual approach and a statutory approach. The SOA utilization agreement practically is an implementation of statutory regulations, however, the application of freedom of contract in its application can be seen from the stages of the contract, i.e. the pre-contractual, contractual and post-contractual stages in determining the contents and provisions of the agreement as long as it does not conflict with the provisions of the legislation, decency and public order.

Abstract

Victims of terrorism are not only those affected by terrorist attacks but include those exposed to terrorist ideology. The series of bombings, shootings and stabbings that occurred in the territory of the Republic of Indonesia has resulted in the loss of life regardless of the victim, causing widespread public fear, and property losses, resulting in a wide impact on social, economic, political, and international relations. The method used is Legal Research based on legislation related to each other. The best thing that can be done by the state to maintain the safety and security of citizens from becoming victims of terrorism is to prevent or anticipate that terrorism crimes do not occur. The fulfillment of the rights of victims under Act No. 15 of 2003 at the crisis stage after the crime of terrorism must be taken immediately because the action relates to the safety of the victim. Act No. 5 of 2018 states that the victim of non-criminal terrorism is a person who suffers physical, mental, and/or economic losses resulting from a Terrorism Crime. Victims are direct victims as well as indirect victims of a crime of terrorism. The determination of victims of terrorism can be done directly by investigators, without having to wait for a court decision. Treatment of victims, especially those who must receive medical treatment, psychosocial and psychological rehabilitation.

Abstract

Data mengatakan Indonesia merupakan negara yang kaya akan sumber daya alam, bahkan menjadi negara dengan sumber daya alam paling melimpah di dunia. Perspektif kekayaan intelektual, potensi-potensi itu merupakan produk yang dapat dilindungi berdasarkan kepemilikan komunal indikasi geografis. Setelah meratifikasi beberapa perjanjian internasional, terutama Persetujuan TRIPs, Indonesia berkewajiban memiliki regulasi yang memberikan perlindungan kepada indikasi geografis. Pada beberapa regulasi yang pernah ada, pemerintah daerah diberikan kewenangan sebagai pemohon saat pendaftaran sebuah produk sebagai indikasi geografis di kementerian. Faktanya, peran pemerintah daerah kurang optimal, terutama bila dilihat dari potensi yang dimiliki, ditambah regulasi sifatnya tidak imperatif. Penelitian ini bersifat normative dengan pendekatan perundang-undangan. Dari hasil kajian yang sudah dilakukan, didapati hasil bahwa kedudukan pemerintah daerah dalam Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis tidak imperatif mengatur secara spesifik kedudukan pemerintah daerah, sehingga dengan yang melimpah hanya sedikit yang didaftarkan akibat kurangnya kontribusi pemerintah daerah.

Abstract

This research discusses the legal force of binding sale and purchase agreements under the hands made by the parties without witnesses and only waarmarking by a notary. The research method used is the analytical descriptive method, a research method that reveals problems, analyzes a problem, examines, and interprets it into conclusions and suggestions in a systematic way so that it is easy to understand. Normative Juridical approach method, namely legal research that uses secondary data sources such as principles the doctrines in the science of law. The results of the study can be concluded that the underhand Sale and Purchase Agreement (PPJB) is a form of agreement between two parties who agree to bind themselves, which is made jointly. Even though PPJB under the hand can be made freely by the parties who want to make an agreement, it may not violate the provisions of Article 1320 of the KUHPerdata. PPJB made before an authorized official and PPJB made privately have the same legal force. PPJB under the hand made by the parties without witnesses and only waarmarking by a notary, the strength of proof is only between the parties. If the parties do not deny and acknowledge the signature in the agreement, then the PPJB under the hand has perfect power as an authentic deed.

Abstract

Mahkamah Konstitusi yang bertujuan untuk menegakan dan melindungi hak-hak konstitusional warga negara dan perlindungan HAM. Salah satunya hak kebebasan beragama yang dijamin oleh konstitusi dan beberapa regulasi tentang HAM. Subtansi pada UUD 1945 pasal 28I ayat (1) dijelaskan bahwa hak beragama bersifat mutlak bagi setiap individu, maka semestinya berlaku secara universal dan non diskriminasi. Ditengah maraknya kekerasan yang mengatasnamakan agama mendorong terjadinya judicial review terhadap UU No.1/PNPS/1965 tentang Pencegahan Penyalahgunaan dan/atau Penodaan Agama. Undang-Undang ini yang akhirnya dianggap bertentangan dengan jaminan kebebasan hak beragama yang tidak bisa dikurangi dalam keadaan apapun. Demikian juga ketika Mahkamah Konstitusi menolak seluruh permohonan. Sehingga pasca putusan Mahkamah Konstitusi konsepsi hak beragama Indonesia menjadi lebih jelas. Namun bagi yang tidak setuju dengan keputusan Mahkamah Konstitusia berargumen bahwa UU No.1/PNPS/1965 menjadi alat untuk membenarkan kekerasan atas nama agama.

Abstract

Indonesia telah terpilih menjadi Anggota Tidak Tetap Dewan Keamanan Perserikatan Bangsa-Bangsa (Anggota Tidak Tetap DK PBB) pada periode 2019-2020. Hal ini merupakan salah satu prestasi yang luar biasa, mengingat Indonesia dipercaya oleh negara-negara anggota PBB untuk menjadi salah satu anggota dari Organ Utama PBB yang memiliki tugas untuk menjaga perdamaian dan keamanan dunia. Wilayah Laut Tiongkok Selatan (LTS) merupakan wilayah yang tengah menjadi sengketa antara negara-negara sekitar yang merasa memiliki klaim atas wilayah tersebut. Sengketa ini telah menjadi perhatian dunia dimana ketegangan-ketegangan sikap yang ditunjukkan oleh negara-negara tersebut semakin hari semakin mencemaskan dalam stabilitas keamanan di wilayah tersebut. Berbagai provokasi dan kebijakan luar negeri dari masing-masing negara dilakukan untuk memenangkan klaim atas wilayah tersebut. Indonesia sebagai Anggota Tidak Tetap DK PBB memiliki salah satu kewajiban untuk ikut serta dalam menyelesaikan sengketa internasional atas wilayah LTS tersebut yang di klaim oleh negara-negara. Indonesia dapat menjadi pihak penengah untuk memberikan sudut pandang lain dalam menyelesaikan sengketa tersebut secara damai. Tujuan dari penelitian ini adalah untuk mengkaji keterlibatan Indonesia dalam upaya menyelesaikan sengketa di wilayah LTS berdasarkan United Nations Convention on the Law of the Sea 1982 (UNCLOS 1982). Metode yang digunakan dalam penelitian ini yaitu penelitian hukum normatif. Penelitian ini dilakukan dengan cara meneliti dan mengkaji bahan-bahan pustaka yang telah dikumpulkan oleh tim peneliti. Bahan pustaka yang diteliti dan dikaji terdiri atas bahan primer, bahan sekunder, dan bahan tersier. Pencarian data dilakukan dengan studi pustaka atau studi dokumen dan keseluruhan data yang diperoleh akan dianalisis secara kualitatif.
