Abstract

The interpretation and the application of the equilibrium principle in competition law raises issues of the philosophy of law, legal theory and legal dogmatic. Based on these issues, then the legal problems, namely: 1) What is the advantages and disadvantages of market structure approach used in the decision of the KPPU to analyze the principle of balance in competition law particularly in price fixing agreement. 2) How is the market structure approach in the KPPU decision, should be developed and used to analyze the principle of balance in competition law particularly in price fixing agreement. To answer the third issue, used the theory: (1) fairness, (2) equity markets, (3) the welfare state in the context of a market economy. This research is based on paradigmatic legal normative hermeneutic approach. The study concluded: 1) The advantages of the approach in the consideration of the legal market structure.KPPU decisions, creating more justice to the parties. The disadvantages of structural analysis approach, namely: the difficulty of proof in writing, setting procedural law clash between the KPPU and the Court of the country, lack of basic legal drafting guidelines that made by the KPPU. 2) In its development, the analysis approach used the Commission's market structure can be used as direct evidence in the form of a letter and stated in Government Regulation and prioritized approach to the analysis of market structure in the KPPU decisions on the prohibition of price fixing.

Abstract

This study aims to see the influence of leadership and organizational culture on the performance of employees at Reza Berawi Class II Auction Officers in Bandar Lampung City. The type of research used in this study is an explanatory research model. The research method used is quantitative. This study used 20 research respondents. There are three variables in this study, namely: 2 independent variables (X1 and X2) and 1 (one) leadership relationship variable (X1) and organizational culture (X2) as independent variables and employee performance (Y) as the dependent variable.Based on the results of data processing, the hypothesis answers are found as follows; there is a leadership influence (X1) on employee performance (Y), with a level of influence (R2) of 44.6%. There is an influence of organizational culture (X2) on employee performance (Y) with a level of influence of 33.9%. There is a joint influence of leadership (X1) and organizational culture (X2) on employee performance (Y), with a level of influence of 53.3%.

Abstract

The influence of motivation and discipline of the Work Productivity of Educational staff in the UIN Raden Intan Lampung This study aims to find out the influence of motivation and discipline of the workplace productivity of educational staffs in the UIN Raden Intan Lampung as well as the partial simultaneously design and research using the survey design in a way to gather information from respondents with the statement (kuisioner) that structured and patterned according to the needs and the title refers to the research and examined the variables that motivation is a variable (X1), variable-disciplinary work (X2) and a variable work productivity (Y). The research was conducted specifically to the educational staffs in the UIN Raden Intan Lampung as many as 71 research respondents. Based on research results obtained significant F value of 0,000 was less than 0.05 level of significance means of discipline and motivation can have a significant effect on the productivity of Educational staffs.The influence that occurred between the motivation and discipline to work simultaneously work productivity (ryxj) with a regression coefficient of 0,681 with a coefficient diterminasinya (r2yxi) of 0.464, or 46.4% variable work productivity is influenced by the motivation and discipline of work. The influence of motivation on the partial work productivity is very significant that this can be seen from the significant value of t the 0,000 amounting to less than 0.05 significance level. Then the influence of the work discipline of the partial work productivity is very significant that this can be seen from the significance of 0,014 earned less than the 0.05 significance level. The conclusions of this study are : 1) work motivation and work diciplinne together to influence on significant to the productivity of education personel at State Islamic University Raden Intan Lampung (2) The influence of the work motivation of the partial work productivity have signeficant effect on labour productivity of labour force in UIN Raden Intan Lampung, (3) The influence of the work discipline of the partial work productivity have signeficant effect on labour productivity of labour force in UIN Raden Intan Lampung

Abstract

Development of human resources is very basic. The relationship between performance at the organizational level and the national level, as well as investment in human resource development is tangible and persuasive. Thus, developing thoughts about the prospects and role of communication in human resource development becomes an important part. The methodology used to comply with this paper is through literature study from various literatures.Communication is a prerequisite for information transfer. Economic underdevelopment is often correlated with limited access to information and learning facilities. The ability to communicate and transfer information and capacity is vital to building a knowledge economy that ensures survival in a global setting. Thus, the availability and development of human resources is important in the context of the socio-economic conditions of the country and the communication of information technology is an important asset for global competitiveness.Besides, information and communication technology is utilized to maintain the environment by managing and monitoring the energy. Therefore, qualified and competent human resource who could create proper application to facilitate society can maintain environmental welfare such as save energy, reduce emission gas, and so on.Effective and quality communication is the core of all HR development. Understanding of communication is important to improve human resources as social capital. The development of human resources in information and communication technology is important for the ability of the people of a nation to promote global competitiveness and become one of the factors of progress of a nation in international arena.

Abstract

The participation of the community and the role of village government in managing the Village Funds initiated in order to build Indonesia through rural or suburbs is the type of fund used for community-based development. Community-based development can be defined as development that refers to community needs, planned, and implemented by the community by maximizing the potential resources (nature, human, institutional, socio-cultural values) that exist and can be accessed by the community local. The participation of the community through the deliberation of development planning in planning the use of the village funds is expected to absorb village funds will eventually really touch the public interest. The purpose of this research is to know and analyze the participation of the community and the role of village government in managing the village funds.The results of the research indicate that: a) Stages of development planning deliberations have indeed been implemented but are still in the phase of collecting problems in the village and summarized in the Village Government Work Plan (namely Rencana Kerja Pemerintah Desa or RKPDesa in Indonesian) and most have not been implemented. b) a large part of the use of the Village Fund is absorbed in the physical development of village infrastructure and infrastructure facilities and only a small percentage of village funds are absorbed in the field of community empowerment and community development.

Abstract

The type of research in this research is descriptive normative research, the approach used is, juridical normative and empirical approaches. Abstract

Financial distress is the stage of financial condition that occurs before bankruptcy or liquidation).Bankruptcy is defined as a failure in running operations to achieve its objectives.The company is considered bankrupt if the rate of return earned by the company is less than the total cost that must be incurred in the long run, therefore, it is necessary to evaluate the performance of the company in managing its capital which is interpreted in thebusiness bankruptcy analysis (bankruptcy prediction), done by predicting the bankruptcy of companies using early warning model (early warning system) This research was conducted at PT.Centra Protenia Prima.Tbk with the aim to know the effect of operating cash flow, likuditas, leverage, profit margin to the condition of financial distress (bankruptcy) by using model Almant Z Score.The results of this study is concluded that operating cash flow has no effect on the condition of financial ditress (bankruptcy) while likuditas, leverage, profit margin effect on financial condition ditress (bankruptcy)

Abstract

Islamic Social Reporting is a form of corporate social responsibility for both internal and external parties, including employees and the environment. This research examines the effect of Islamic cooperative governance and profitability (which is presented with return on assets - ROA) on the disclosure of Islamic Social Reporting. This research uses a purposive sampling method from companies listed on the Jakarta Islamic Index in period of 2014-2018. There are 16 companies that are sampled in this research. This research uses multiple linear regression analysis methods and the results show that the simultaneous size of the company and profitability have a significant effect on Islamic social reporting disclosure.In the other hand, the partially size of company profitability has a positive and significant effect on Islamic social reporting disclosure. This is because a large companies will be able to generate large profits. By gaining the high levels of good profitability, the disclosure of Islamic social reporting will be good as well.

Abstract

Franchise is one form of growing business activity in Indonesia, where the agreement based on principle of freedom of contract. This study aims to analyze of the franchise agreement implementation in contract law perspective, and factors inhibiting and supporting the franchise agreement in the contract law perspective. This research is a qualitative study using a non-doctrinal approach to socio-legal research, in order to get an overview of study subjects to find an ideal reconstruction of the franchise in the contract law perspective. An approach that is non-doctrinal with presumption that the object of the law is interpreted as part of a social sub-system among other social sub-systems. The study also includes three stages, namely the study of philosophy which focuses on literature, study of normative to see how legislation to regulate legal relationships in the franchise business and was associated with the values of philosophy and conducted cross-checking through interviews with actors then do a sociological study to find in-put of justice sought. It concluded that the franchise is a document legal agreement between the franchisor and franchisee (about the rights and obligations). Achievement in the agreement that gives something include the obligations of Franchisor to provide flexibility to run the business without interruption to franchisee for a certain period, the principles of business management following intellectual property rights such as trademarks, logos, patents, and other, which is part of the business concept franchise, for the franchise fee as agreed in the agreed amount. If the agreement between the parties is not carried out for example franchisee does not pay a franchise fee to the franchisor, it may be requested compensation. In an agreement is possible non-performance of the agreement, although the terms of validity of the agreement have been fulfilled. It caused by uncommitment (breach of contract) and coercion or force majeure. Therefore in the agreement, must have a balance between the rights and obligations between both parties that the franchisor and franchisee.

Abstract

The purpose of this study is to examine, whether the Shariah Supervisory Board can improve the performance of Maqosid Shariah on Islamic banking in Indonesia. This study hypothesises that Islamic Banking with implemetation Shariah Supervisory Board and Independent Board of Commissioners have higher performance of maqosid shariah. Performance of maqosid shariah is measured using maqasid syariah with simple addictive weighting method. The study uses 12 Syaria Bank in Indonesia. The paper finds that the multiple position of Shariah Supervisory Board and Independent Board of Commissioners has contributed to the maximum improvement of Shariah Bank Performance, and will to the existing literature on Islamic Bank, business ethics, firms governance. It provides evidence on Syariah Bank in Indonesia
