Abstract

From the history of Islamic conquest to various parts of the world, Indonesia was one of the countries that was visited on the journey and the struggle to spread the monotheistic religion. With the entry of Islam into Indonesia, there was an encounter with all forms of Middle Eastern / Arabic culture, especially Islam with the archipelago, and naturally the encounter experienced acculturation with the culture in Indonesia. Indonesia as a country also has its own indigenous culture. Portraits of indigenous Indonesian culture can now be found in inland-inland areas such as the Tengger people found on Sukapura on the slopes of Mount Bromo near Tasar Malang, Samin communities in Blora, Central Java, Baduwi communities in southern Banten, Kubu communities in southern Sumatra and Jambi, Baliage communities in Tenganan Pegringsing Karang Asem in Bali, and the Toraja community in Central Sulawesi, the Dayak tribe consisting of Oloot, Olonaju, and Manyansiyung in the interior of Borneo, and the Asmat tribe in Irian Jaya. All of them still hold the original culture with several forms such as animism, dynamism, veteism, and shammanism. The arrival of Islam to Indonesia in the First Century H / VII-VIII M resulted in this nation experiencing cultural acculturation between Middle Eastern culture and Indonesian culture. The evidence of acculturation can be felt in several aspects, including language, literature, arts and education.

Abstract

In the history of the development of Islamic thought since a long time ago there had been a split which was an embodiment of the words of the Messenger of Allah: Will this people be divided into 73 groups all in hell except one, then asked: who are they O Messenger of Allah? The Prophet replied: they are those who follow my Sunnah and the Sunnah of my best friend. (HR. At-Tirmidzy). From these hadiths and various political upheavals in Islam after the death of the Prophet Muhammad, then various systems of Islamic theological thought emerged. This shift of political thought to the religious thought system gave rise to the Khawarij, Shi’a, Sunni (Gahl as-Sunnah wal al-Jamaah), Murji’ah, and Mu’tazilah. His findings have a different paradigm of thinking about theological thought, even their religious thought systems are made as claims of justification for their respective political decisions.

Abstract

Marriage guardianship is something that is very important and is one of the pillars of marriage. Because the existence of a wali will determine whether a marriage is valid or not. There are two types of guardians in marriage, namely guardians nasab and guardians of judges. Guardianship or guardian in this marriage cannot be separated from nasab or hereditary problems, because with a legal marriage the aim is to maintain the nasab properly, regularly and uninterruptedly. In determining the marriage guardian, the headman has a very important role, which can determine whether a person can be guardian or not, and a marriage is with the guardian nasab or guardian judge. This research is a normative juridical research, with descriptive research type. The method of data collection is done by examining primary, secondary and tertiary legal materials and by making questionnaires to the princes by random means. The method used is descriptive qualitative analysis. The results showed that the prelates were in the same trusteeship issue with the determination of different guardians. The head of the District Aagama Affairs Office stipulates with the guardians of nasab while the other head of the District Office of Religious Affairs determines with the guardians of judges, there is even a determination of trustees based on the results of deliberations between the headman, bride and parents, according to the conscience and awareness of the parties. This can occur because the Marriage Law has not yet explicitly stipulated the determination of guardians, so the princes set it with understanding.

Abstract

The modern era is a time of development of the positivism philosophy. Modern world life is based on the paradigm of positivism thinking. The paradigm of positivism thinking believes that all science is mathematical which is characterized by objective, measurable, scientific, rational and universal thinking patterns. These four ways of thinking have brought modern civilization to the triumph of science. On the other side, a civilization based on the modern paradigm experiences various kinds of humanitarian problems. The paradigm of modern thinking is not suitable when it is associated with social problems including the education. Jurgen habermas, a Frankfurt school figure, offers solutions to overcome social problems that cannot be overcome by modern paradigms. Habermas developed a critical theory that had been put forward by the previous generation of Frankfrut figures. The theory he offered was a critical theory of emancipation and a theory of communicative action. Emancipatory critical theory and communicative action theory are able to answer problems in the world of education that cannot be answered by the positivistic thinking paradigm.
