Abstract

This paper provides an exploration of a range of perspectives and attitudes towards the emergence of Life Skills in the Moroccan Higher Education curricula. We briefly introduce the national context of the Bachelor’s Degree Reform (BDR) of 2019 introducing these skills as well as the international proactive measures to create a new space for well-being policies and assessments.  The focus of the present article is to explore the students and professors’ views on officially integrating such innovative modules within the academic program for the first time. In order to obtain relevant data, a qualitative approach was adopted. The findings suggest that the majority of interviewed university professors were supportive of the aforementioned reform (BDR). The reluctant minority voiced out their concerns over the lack of clarity regarding the teaching and evaluation methodologies for skills in which there has been no proper teacher training yet. On the other hand, the students’ narratives after a six-week experimental Life Skills-based course suggest that the intervention was very successful, and seems to enhance emotional, and psychological health, therefore cultivating their overall Well-being and resilience. In other words, their attitudes were unanimously positive and their perceived impact of the course deeply transformational.

Abstract

The previous movement of Government of Indonesia (GOI) to terminate its expiring Bilateral Investment Treaties (BITs) with many countries does not mean like the end point of rigorous policy. It then leaves a question mark about the legal standing after the concession and how the government establishes a new model to create a balance in BIT. This research is conducted to, firstly, analyze the legal position of government and foreign investor in a terminated BIT. Furthermore, it will discuss how the government can take benefit through learning experience from the previous mistakes in old BITs and the latest development in international investment law. Finally, this study focuses how a balance on BIT can be achieved for both host state and foreign investor. The result of this study shows that the government did not breach any international law procedure in particular by fathoming Vienna Convention on the Law and Treaties and protection for the investor is not diminish immediately due to the existence of survival clause. Further investigation identifies that to obtain a greater benefit following the termination, GOI should develop better balanced provisions in its next BIT model. This effort can be done by taking care of principle of extraterritorial obligation, full protection and security clause, indirect expropriation, and regulatory measure clause, and most importantly how to deal with dispute settlement.

Abstract

Many fields of study, including literary studies, pay a serious attention on the connection between violence and trauma. Responding to such an attention, this article aims to investigate some issues of violence and post-traumatic stress disorder represented in the novel Burial Rites by Hannah Kent. The writing is based on library research. This descriptive-qualitative study applies psychoanalysis theory by Sigmund Freud to analyze the representation of violence and post-traumatic stress disorder in the novel. The findings show that Kent, through Burial Rites, illustrates that the impacts of violence on someone can be both physical and psychological. Kent demonstrates a relationship between violence and post-traumatic stress disorder in the story. It depicts that the violence a person has experienced in life, whether physical or psychological, can cause a mental disorder called post-traumatic stress disorder. The illness can make the sufferers regularly experience fear, nightmares, anxiety, and other things that disturb their mind and soul.

Abstract

The aim of the current study is to examine the validity and reliability of online examinations through undergraduates’ and lecturers’ perceptions and identify the ways in which online examinations can be more focused and effective. To this end, a questionnaire including both qualitative and quantitative inquiries were administered among forty-five undergraduates and fifteen lecturers of three state universities in Sri Lanka. Thematic Analysis and SPSS software were used to analyze qualitative and quantitative data respectively. Findings of the study indicate that 80% of the undergraduates and lecturers preferred traditional examinations to online assessments given its flexibility, validity, and fairness. Majority of the lecturers encountered issues during online examinations, thus they reported the need of improving the methods and strategies of online assessments in a way they measure undergraduates’ performance accurately. Moreover, undergraduates’ social, economic, technological, and psychological issues also hindered the effectiveness of online examination to a considerable extent. The results of online examinations cannot be regarded as valid and reliable because they were unable to evaluate undergraduates’ learning outcomes as accurately as onsite examinations. The study has implications for the undergraduates, test administrators, lecturers, and the university management.

Recently, significant issues have emerged related to the existence of local wisdom synergize with the presence of religion in strengthening the ideology of the Indonesian state based on Pancasila. This is inseparable from the contestation between local culture and outside culture which is expected not to be disturbing because it is deeply rooted in Bali in particular and in the archipelago in general. Bali is taken as an object of study with the consideration of the existence of local wisdom that is quite strong and able to synergize with the dynamics of Hinduism and seems to be able to strengthen the ideological values of Pancasila. Related to this issue in this paper discussed how local culture in this regard the values of local wisdom that already exist can be proven to strengthen the existence of religions that come later which seem to strengthen the ideological values of Pancasila. For more details, the following will be cultivated. First, what is considered a local culture or wisdom that existed before the entry of major religions in the region, second: how the formation of local wisdom values that can accept the influence of these major religions, and thirdly how can it be interpreted that there is a synergistic relationship between local wisdom, religious influence and strengthening of Pancasila values in the context of nation-state building in Indonesia in general.

Abstract

Corruption is one of the most widespread and chronic crimes in Indonesia. Therefore, handling corruption is a very important priority for law enforcement. Perpetrators of corruption are not only individuals but also corporations. The crime is done for the benefit of the corporation itself. Today corruption committed by corporations have started to be a concern of law enforcement officials even though the implementation is not yet optimal. This paper discusses the assets recovery as a fundamental principal in criminal punishment against a corrupt corporation. This research is using a dogmatic legal method by analyzing legal materials. From the research conducted it can be concluded that law enforcement of criminal acts of corruption carried out by corporations should be prioritized in the asset recovery principal and not only aiming to punish criminal offenders. So it is recommended to law enforcement officials to use asset recovery approach in handling corruption cases committed by corporations, including in pairing the indictment with money laundering regime.

Abstract

The background of this study begins with a reflective question about why in one family Indonesian people of different religions can live in harmony and support each other as a family. Whereas in the social context of religious relations today faces a tense situation in which people of different religions are suspicious of each other and hostile to each other. This study tries to focus on the case of Javanese families who have the foundation of the value of living in harmony in one family with different religions from an axiological perspective. Based on the interpretation approach to social phenomena that are the focus of the study. The results of this study explain that the foundation of the value of harmony of Javanese people lies in the value of harmony, which is an integral principle of value in which Javanese who wants to live a harmonious life must maintain harmony not only with others but also with the surrounding nature. Therefore, many studies have shown that Javanese life always tries to maintain ‘equilibrium’ as a manifestation of life. The axiological dimension of the living value of Javanese harmony when meeting with external values occurs tug-of-war and it is not uncommon to negate each other and contest each other. In some cases, it is proven that the value of living in harmony can support a harmonious family life, getting along well with mutual respect, affection, and mutual help among family members.

Abstract

This article aims to explain how the involvement and success of the Persatoean Arab Indonesia (PAI) in integrating Arab-Hadrami society into a part of the Indonesian nation. PAI was originally a social organization founded in Semarang in 1934. But along the way, this organization turned into a political organization because of the demands of its time. This article uses historical research methods in four steps, i.e., heuristics, verification, interpretation, and historiography. The main source in this article is the personal archive of A. R. Baswedan, organizational archives of Persatoean Arab Indonesia (PAI), and Koempoelan Toelisan Gerakan al-Irsjad. While the supporting sources come from contemporaneous newspapers, e.g., Pewarta Arab, Insaf, Matahari, Al-Ma’arif, ad-Dahna, Hadhramaut dan Aliran Baroe, as well as secondary sources derived from books, journals, and other scientific articles relevant to this topic. The results showed that: (1) Persatoean Arab Indonesia (PAI) was founded as a solution to reconcile the opposition among sayidi and non-sayid groups that divided the Arab-Hadrami community in the Dutch East Indies. Along the way, PAI then gained the support of the two conflicting groups; (2) PAI succeeded in integrating the Arab-Hadrami community into part of the Indonesian nation. Although at first the Indonesianized of this organization was doubtful, with its various programs, PAI managed to attract sympathy from nationalists and the Indonesian people that they were part of this nation.

Abstract

Islam is the religion of peace and harmony as its name suggested by Allah. It is rooted in purity, submission, and obedience. Historically, modern researchers claim Islam is 1400 years old; the youngest religion in the world which was introduced by Prophet Muhammad (PBUH) in 610 A.D. But Muslims believe that this is the oldest and first entered the religion of the world and stepped onto this world with Hadrat Adam (A.S) And Hadrat Hawa (A.S). Contrary to this, Islam has also seen many twists and turns due to its followers and critics. Its original teachings are somehow forgotten by Muslims and misconstrued by other religions. This religion of peace is frequently questioned on ‘peace’ and ‘tolerance’ and is always misunderstood and misinterpreted by the ‘west’, specifically. In recent times, Islam is commonly pigeonholed with ‘extremism’ and ‘terrorism’ and Muslims with ‘terrorists’ and extremists’; without feeling any need to find the truth. Although Islam is the center for spirituality and humanity in real, its general perception is the opposite to it. The purpose of this study is to find out the similarities and differences between the two big religions of the world (as portrayed in scholarly specific poetries) to provide some core similarities in philosophical teachings/understandings. This comparative study has been designed between the works of the two legendary figures of the Islamic & Christian world i.e., Maulana Rumi and Geoffrey Chaucer, respectively. Maulana Rumi is majorly known as a phenomenal Sufi poet/scholar of the 13th century and Chaucer is considered ‘the father of English literature’ and belongs from the 14th century. This qualitative comparison is embedded in the similarities in religion, tolerance, honesty, truth, love, and humanity. It suggests that both poets have used the concept of tolerance as a policy to discover the ‘self’, ‘spirit’, and ‘liberalism’. This study provides evidence based on Islam that peace and tolerance are the soul and blood of this religion. It is also a defense of the evidence that these renowned poets are far more inclusive than most early modern poets of toleration.
