Abstract

Zakat is one of the main components in the Islamic economic system, it becomes a driving engine for the balance between the rich and the poor. His position is increasingly needed when faced with socio-economic problems that are not in favor of the poor. As social control, zakat does not make excessive differences between rich people and poor people, it makes wealth not only revolves around rich people, as mentioned in the QS. Al-Hasyr verse 7. So beneficial zakat is that the Caliph Abu Bakr fought those who did not want to pay zakat.The problems of zakat that are faced today are very complex, starting from the presence of some people who do not want to pay zakat, the distribution of zakat that has not been neatly arranged to the problem of fiqh regarding the development and ijtihad for productive zakat models. This last issue is the subject of this paper.Productive zakat is to make zakat money not only consumptive in the sense that it is immediately consumed, but zakat assets are used for business capital in order to alleviate poverty for zakat mustahik. With this venture capital, it is hoped that the zakat mustahik will one day become a muzaki.The zakat management strategy carried out by BAZ Sukabumi City is in the form of "loans" of capital and revolving funds for zakat mustahik, namely the poor who are in the Sukabumi City area. This program received enthusiastic response from weak groups in this region. From the observations made, it is concluded that this productive zakat model is very useful for zakat mustahiq so that it is hoped that in the future it can continue to be developed.

Abstract

Sharia Management in the Practice of Paying Employees of Sharia Companies (Case Study of PT. Asuransi Takaful Umum). Shari'ah management is a management based on the provisions of Allah Ta'ala. The focus of the problem in this research is how to form employee wages with sharia management that is able to support the strategy of PT. General Takaful Insurance in achieving the stated targets. The approach used in this research is descriptive analytical method, through library research and observation.The results of observations about the wages of employees at PT Asuransi Takaful General indicate that the wage program run by the company is a wage program that is determined based on a mutual agreement between the company and employees with reference to the verses of the Qur'an and the Hadith of the Prophet. Shari'ah management has been applied in the practice of wages at PT ATU. This is proven by the implementation of the Collective Labor Agreement (PKB) which is an agreement between the company management and employees based on the Qur'an and Al-Hadith.The wage law for employees in the Islamic view is to save the interests of both parties between the company and the employee, between the employer and the worker. Wages are determined by not oppressing each other, but by being honest and fair with each other between the company and employees. Each employee will be rewarded according to what he does in the production process. Likewise with Takaful employees, if they are productive, they will get wages as compensation according to their productivity. The suitability of sharia management in providing wages to PT ATU employees can be seen clearly from the types of wages provided such as overtime pay when working hours, health benefits, transportation allowances, meal allowances, etc. All types of wages are in accordance with Islamic teachings in their determination. In practice at PT ATU in the wage component there is still no education allowance, housing allowance and expertise allowance.

Abstract

In the midst of the growing trend of Islamic economics, it is necessary to have an in-depth study of this system. Is it true that it is just a religious norm? Or just following a spiritual trend that has recently been on the rise.Indeed, the Islamic economic system is different from other economic systems, it is not the result of the adoption of a socialist system that fights for pseudo-equality rights. It is also very different from the capitalist system which gives property rights to individuals freely. The Islamic economic system is a system based on divine values ​​and built on general principles for the implementation of all economic activities.The capitalist economic system is based on the freedom of individuals to own various wealth on this earth without any restrictions, this has an effect on the inequality of the social system, the rich getting richer and the poor getting poorer. In addition, various social problems appeared, such as the landlords and slaves, the end of this system was the revolt of the workers who demanded their rights as human beings. If the capitalist system protects the interests of the bourgeoisie, the socialist system fights for equal rights for all citizens. The similarity they want is equality in all rights and eliminating ownership rights to a material object. In this case, every individual is not allowed to have material rights except those that are his necessities of life. All economic systems are governed by the State. In this system, it seems that they are defending the workers, but in essence this system is a protector for leaders and dignitaries to exploit the wealth of the people.The Islamic economic system has methods and principles that are different from other economic systems, it gives ownership rights to an object, but there are standard rules so that wealth is not only among the rich. The mechanism used is the existence of zakat law. Some of the wealth that is needed by the people is managed by the state and may not be owned by individuals. From here, the Islamic economic system becomes a comprehensive economic system and will suitably be applied anytime and anywhere.

Abstract

Islam is not a religion that only has a vertical dimension between a servant and his Lord, it is a way of life that regulates all aspects of human life, including the relationship between a human being and another human being. Including Islam regulates how a human being maintains the existence of his life in the world. One of the main goals of Islam is hifdz al-mal, which is to protect property, which is the right of every human being. From here Islam gives freedom for humans to seek wealth as a tool to fulfill their lives. Islam gives a very high appreciation in work. The basic principle in Islam is to do a job that is valuable and useful, and vice versa, work that is useless and brings harm is declared as a forbidden job and even considered an ally of Satan. This can also be seen in the many verses of the Qur'an and Hadith that call on a Muslim to work.The verse of the Qur'an that regulates ethics in work is the word of Allah ta'ala in QS. Al-Anfaal: 27 "O you who believe, do not betray Allah and the Messenger (Muhammad) and (also) do not betray the mandates entrusted to you, while you know". In this verse it is stated that among the ethics that must be considered for people who work are being trustworthy and professional, namely carrying out the tasks that have been assigned to them with full responsibility. In addition, the hadiths of the Prophet which commanded to work in a lawful way and stay away from all forms of unlawful things are very numerous, including his words, "There are three signs of hypocrisy; when he speaks he lies, when he makes a promise he breaks it, and when he is given a message he betrays."

Abstract

Sharia Tourism is a term used by the Ministry of Tourism and Creative Economy, Republic of Indonesia, to the tour program based on the values of the Islamic sharia. The program was launched in December 2012 as the implementation of Law no. 10 of 2009 concerning about tourism, that tourism was organized by upholding the principle of religious norms and cultural values of the nation. West Java as one of the sharia-tourist destinations has rich tourism potential that can be developed with the values of Islamic sharia. Among these attractions are the Kampung Dukuh and Kampung Naga, Tasikmalaya. The tourism potentials that exist in these both locations are tourism of nature, local traditions, pilgrimage tourism, traditional art, and historical tours. However, initial observations that researcher did, indicated these potentials did not yet discover optimally. The apropriate strategies are needed to develope the sharia tourism in these both Kampung Dukuh and Kampung Naga. This research will formulate the strategy of sharia-based tourism development in Kampung Dukuh and Kampung Naga. The goal is to identify the potential of tourism there, analyzing internal and external environment, and determine the development strategy of both traditional village as a sharia tourist attraction. The data in this study were obtained through the method of participant observation, in-depth interviews and documentation. This study is explorative; formulate programs based on internal conditions and external conditions in both sites. The results showed that the strength of Sharia tour in Kampung Dukuh and Kampung Naga include the value of the local community and religious ritual, pilgrimage tourism, unique architecture, natural beauty that lies in the mountainous region, good roads, easy access (to Kampung Naga), and the strategic position. While the weakness of Kampung Dukuh and Kampung Naga include lack of hygiene and environmental sustainability, lack of availability of tourist transport (to Kampung Dukuh), the lack of tourism facilities, the lack of parking space, still lack of toilet facilities for public, unavaillable manager of the attraction, unmaximum promotional efforts, and the unavailability of Tourist Information Center. Based on the analysis of these strengths and weaknesses, I formulate four development strategies that can be applied, namely product development strategy, promotion strategy development, sustainable tourism strategy, and the strategy of human resource development (HRD) based on the values of the Islamic Sharia.

Abstract

Akad Ijarah merupakan akad yang banyak digunakan di perbankan syariah, hal ini karena fee (ujrah) pada akad ijarah menjadi solusi bagi bunga yang ada di perbankan konvensional. Hampir seluruh bank syariah di Indonesia menerapkan akad ini, termasuk Bank Muamalah Indonesia. Bagaimana implementasi akad ijarah di bank Mumalah Indonesia? Penelitian ini menggunakan pendekatan kualitatif dengan data yang diperoleh secara langsung dari kantor cabang Bogor. Observasi dan wawancara serta studi dokumen dilakukan untuk mendapatkan gambaran yang valid mengenai obyek penelitian. Penelitian ini menunjukan bahwa akad ijarah di Bank Muamalah Indonesia diaplikasikan dalam bentuk produk layanan khususnya dalam pembiayaan dan jasa rumah tangga lainnya yang sangat diperlukan oleh masyarakat. Ujrah (fee) yang dikenakan kepada nasabah dihasilkan dari negosiasi dengan bank. Sebagian besar nasabah merasa puas dengan akad ini karena terhindar dari transaksi yang mengadung riba.

Abstract

Indonesia is a vast nation which has abundant cultural heritage, the effort to preserve it had been done to protect the cultural heritage. However, damage to the cultural heritage objects continue to occur. One reason is because of religious elements. Worry makes people commit shirk is one reason. Damage to objects of cultural heritage took place in Muslim countries for the same reason, Iraq, Syria, Afghanistan and Saudi Arabia is a country with a high damage cultural heritage. How Islam regards the protection of cultural heritage? Fiqh as an element of Islamic law has a dynamic and flexible nature, one of the very nature is friendly to tradition and culture. The concept of fiqh Nusantara provides solutions in damage to the cultural heritage objects. The legal basis for the protection of cultural heritage is; customs and 'urf Muslims in Indonesia, kindness, collective ijtihad and deductive analogy. Finally fiqh cultural heritage is an element of Islamic law that protects objects of cultural heritage.

Abstract

Sirri marriage is again a hot issue in Indonesia, this surfaced when the proposed Draft Law (RUU) on the Material Law of the Religious Courts on Marriage or popularly known as the Siri Marriage Bill, which threatened the perpetrators of unregistered marriage with criminal sanctions, namely the various punishments, ranging from 6 months to three years, and fines from Rp. 6 million to Rp. 12 million. This bill invites pros and cons, those who agree think that this is a progress because according to them, sirri marriages often only harm women and have a negative impact on the offspring of sirri marriages. Meanwhile, the opposing parties argue that this bill will actually direct people to legalize adultery.In classical fiqh studies, sirri marriage is a marriage that is carried out without a guardian or witness, while the current definition of sirri marriage is more meaningful marriage which is carried out only according to their respective religions without being recorded in front of the Office of Religious Affairs. If sirri marriage is interpreted in the first sense, the scholars agree that marriage is invalid without a guardian and witness. As for sirri marriages that are carried out in Islam but are not recorded by KUA officials, most scholars consider them valid.This is where the problem arises regarding unregistered marriages in Indonesia, if this bill has been passed, the perpetrators of unregistered marriages will be subject to fines or imprisonment. Carrying out a marriage legally according to Islamic law as regulated in Article 2 paragraph (1) of Law Number 1 of 1974 is the embodiment of obedience to Allah and His Messenger in the matter of marriage. Meanwhile, implementing Article 2 paragraph (2) concerning marriage registration is a form of obedience to the leader. However, even though the rules of Allah and His Messenger as well as humans are very good, there will still be those who violate these rules. The proof is that there are still many Muslims who marry without being recorded, even though it is for the benefit of all parties, while that benefit is the goal of syara' (maqashid al-syari'ah).So from here, it is appropriate for those who carry out unregistered marriages because of financial problems, they must be assisted in carrying out their itsbat marriage to the Religious Courts by litigating for free (free). Meanwhile, those who perform unregistered marriages for other reasons, are recommended to perform itsbat nikah. If they don't want to, then they should be given sanctions both administratively and with criminal sanctions that can be a deterrent.

Abstract

Islamic law is a perfect legal system, it regulates all aspects of human life, from state issues to individual and family problems. In family matters, it has been regulated in detail regarding the distribution of inheritance, each family member who becomes the heir has determined its share. However, not all families are blessed with children, so some married couples take a child to be adopted as an adopted child. What is the position of adopted children in Islamic law? And does he get an inheritance from his adoptive parents? The syar'i texts sourced from the Qur'an and Sunnah are not found explicitly regarding inheritance for adopted children, but implicitly the spirit of Islam always protects every child who still needs protection and care. Therefore, Islamic jurists have formulated a mandatory will for adopted children. Mandatory wasat is a will that is determined by an imam (head of state) for the inheritance of someone who has adopted children who still need care. The amount of a mandatory will as a will in general is not more than 1/3 of the total inheritance. Some of the conditions related to the implementation of the mandatory will is that the adopted child still needs money for his daily needs.

Abstract

Sharia Tourism is a term used by the Ministry of Tourism and Creative Economy of the Republic of Indonesia for tourism programs based on Islamic Sharia values. This program was launched in mid December 2012 as the implementation of Law no. 10 of 2009 concerning Tourism. West Java as a sharia tourist destination has the potential for tourism objects that can be developed according to Islamic sharia values, namely Kampung Dukuh and Kampung Naga. The tourism potential that exists at these two locations is in the form of natural tourism, local traditions, pilgrimage tours and historical tours.This study formulates a strategy for developing sharia-based tourism in Kampung Dukuh and Kampung Naga. The aim is to identify the potential of sharia tourism in Kampung Dukuh and Kampung Naga, analyze the internal and external environment and determine the development strategy of the two traditional villages as sharia tourist attractions. The data in this study were obtained through participatory observation methods, interviews and documentation.The results show that the strength of sharia tourism in Kampung Dukuh and Kampung Naga includes community religious values ​​and rituals, pilgrimage tourism objects, unique architecture, natural beauty of the mountains, good road access (Kampung Naga). Meanwhile, the weaknesses of Kampung Dukuh and Kampung Naga include the lack of transportation availability (Kampung Dukuh), lack of tourism facilities, lack of available parking space (Kampung Dukuh), lack of toilet facilities, not maximal promotion, and unavailability of Tourist Information Center (Kampung Dukuh). Based on the analysis of strengths and weaknesses, four development strategies that can be applied are formulated, namely product development strategies, promotion development strategies, sustainable tourism strategies and Human Resources (HR) development strategies based on Islamic Sharia values.
