Abstract

This article investigates the existence of legal disputes among ulama regarding the use of life insurance. Some ulama believe that life insurance is gharar because it insures the human soul, while others believe that there is no difference between conventional life insurance and sharia life insurance. This study uses qualitative descriptive approaches in empirical research to gather data as it occurs in the field, based on the problems that are presented. Interviews and documentation techniques were used to get information from informants on the issue of utilizing life insurance in sharia insurance. The study's findings suggest that Nahdlatul Ulama and Muhammadiyah Ulama view purchasing life insurance as a means of preparing for potential future disasters, reducing their personal risk of financial loss, and honoring their life insurance claims rather than as a means of thwarting Allah SWT's will. Sharia is not a fund intended to reward a person's soul; rather, it is referred to as a contribution fund or compensation fund to make up for losses brought on by calamities that occur.

Abstract

Penelitian ini dilatarbelakangi oleh aktivitas jual beli bumbu masak yang menjual bumbunya tidak sama rata pada saat pengemasan serta tidak sesuai aturan dalam Pasal 22 Undang-Undang No 2 Tahun 1981 tentang Metrologi Legal dalam menakar timbangan atau tidak menggunakan alat ukur yang baku sesuai standar internasional. Tujuan dari penelitian ini agar peneliti dan pembaca dapat mengetahui bagaimana praktik takaran timbangan jual beli bumbu masak di pasar induk Samarinda. Apa yang melatarbelakangi penjual menggunakan alat tersebut untuk menakar bumbu masak. Serta apakah praktik takaran jual beli bumbu masak itu bertentangan dengan Hukum positif. Hasil yang diperoleh dari penelitian ini adalah (1) Praktik takaran timbangan jual beli bumbu masak di pasar induk Samarinda merupakan jual beli bumbu masak yang menggunakan takaran sendok dalam menakar bumbunya, tanpa ditimbang terlebih dahulu, (2) Hal yang melatarbelakangi penjual untuk melakukan transaksi praktik takaran timbangan jual beli bumbu masak ini dikarenkan kurangnya pemahaman pedagang terhadap hukum positif di Indonesia. serta kebiasaan yang selalu dilakukan dan turun temurun oleh penjual bumbu masak di pasar induk Samarinda. Karena praktik takaran timbangan dengan menggunakan takaran sendok dilakukan lebih cepat dan mudah sehingga tidak memakan banyak waktu untuk membungkus serta dengan adanya unsur kepercayaan dan kerelaan antara penjual dan pembeli, (3) Praktik Takaran timbangan jual beli bumbu masak ini bertentangan dengan Pasal 22 Undang-Undang No 2 Tahun 1981 tentang Metrologi Legal, serta dapat diberikan sangsi hukum sesuai ketentuan pidana pada Pasal 32 Undang-Undang No 2 Tahun 1981 Tentang Metrologi Legal.

Abstract

This article discusses online buying and selling, especially contracts. The author found several consumers who carried out the buying and selling. This research aims to find out the practice of paying at the beginning of a transaction in online buying and selling and how Fikih Muamalah reviews this practice. Type of normative, empirical research with qualitative descriptive analysis. The respondents of this research were 21 consumers who made payments in advance for online buying and selling in the Loa Janan Ilir sub-district. The data collection techniques used by the author are observation, interviews, and documentation. The data analysis technique used is data management from interviews, documentation, and literature using qualitative descriptive analysis patterns.The results of this research obtained: first, the practice of payment at the beginning of transactions in online buying and selling in the community in Loa Janan Ilir sub-district is carried out by buyers ordering goods in the online shop application and stating the specifications of the desired goods and making payment immediately in advance according to the stated price. In the visual depiction, it is to be noted that the total cost encompasses not only the item's price but also the shipping charges. Furthermore, it must be noted that the dispatch of the goods in question will be deferred for several days before their shipment. Second, people in Loa Janan Ilir often buy and sell online using greeting contracts. Where payment must be made immediately for something that is still pending. This is permitted by some scholars as long as it does not conflict with Sharia law‟ applicable. However, some scholars do not allow this buying and selling because it is considered detrimental to one party. The seller must state in detail the details of the goods being sold to avoid elements of fraud.

Abstract

Abstrak: This article discusses the perceptions of salted fish business actors regarding the use of chemical preservatives in terms of sharia business law. This research aims to determine the extent of knowledge about chemicals and doing business in accordance with the recommendations of the Islamic religion (Shariah). The type of research used in this research is qualitative research, using an empirical approach. The data collection techniques used were observation, interviews and documentation. And the data analysis technique is carried out in a qualitative descriptive manner, namely describing, explaining and analyzing the results of the research that has been carried out. The results of this research explain the procedures or behavior of business actors in processing salted fish, namely by cleaning the inside of the fish's stomach and washing it with clean water, then soaking it in a container containing salt water for approximately 12 hours, then washing the fish. which has been previously soaked in clean water, as for the use of additional materials such as preservatives, business actors usually do this only during emergency situations, such as when sending out of town over long distances, preservatives are sprayed on the outside of the fish or the cardboard in which the fish is stored to avoid growth. bacteria that can damage the fish, as for doing business in accordance with the recommendations of the Islamic religion (Shariah), business people still don't really understand this, this is because of limited educational background and minimal knowledge about ethics and appropriate business methods. with Sharia Business Law, so that behavior is still found that is not in accordance with Sharia in business practices, there is even a lack of clarity regarding the correct information for making a profit, so things like that are not recommended in sharia business.

Abstract

Grab is a company that provides various services, including food delivery services, also known as Grab Food. Chick Chick Fried Chicken Samarinda is one of the merchants registered with the Grab Food service and has successfully attracted public interest. Chick Chick Fried Chicken Samarinda applies different prices at each branch. However, this price difference only applies to the Grab Food service. Meanwhile, for offline purchases, there is no price difference between branches. So, this difference creates a price difference at each Chick Chick Fried Chicken Samarinda branch on the Grab Food application. So, this research aims to find out: 1) contract practices for Grab Food services at Chick Chick Fried Chicken Samarinda, 2) factors that cause price differences in Grab Food services at Chick Chick Fried Chicken Samarinda, and 3) how Islamic law views price differences at Grab Food service at Chick Chick Fried Chicken Samarinda. This type of research is normative-empirical research using a conceptual approach (conceptual approach) related to the concept of price in Islam. The research method used is qualitative, where the data analysis is descriptive-analytic. The results of this research explain that the contract practices between Grab Food and Chick Chick Fried Chicken Samarinda use the contracts of ijarah, samsarah, salam, istishna', wakalah, wakalah bil ujrah, qardh, and buying and selling. The contract transaction mechanism on the Grab Food service is included in the multi-contract mujtami'ah type. Factors influencing the price difference for Grab Food services at Chick Chick Fried Chicken Samarinda are administration fees (said) to PT. Grab Indonesia is 20% (twenty percent), and there is a margin discount from promotions held by Chick Chick Fried Chicken Samarinda and the implementation of cross subsidies for each branch. According to Islamic law, the price difference applied by Chick Chick Fried Chicken Samarinda to the Grab Food service is permissible, because it is done based on mutual consent and there is no coercion between the two.

Abstract

Artikel ini bertujuan untuk mengetahui praktik penerapan denda pada sewa-menyewa mobil dengan akad yang belum dijelaskan pada saat proses penyewaan mobil. Jenis penelitian yang digunakan adalah jenis penelitian empiris-normatif, dengan menggunakan metode kualitatif serta menggunakan pendekatan socio legal research. Subjek penelitian ini adalah PT Adi Sarana Armada tbk (Assa Rent) sedangkan sumber data penelitian yaitu observasi, wawancara, dan dokumentasi. Teknik analisis data dilakukan dengan cara pengumpulan, reduksi, penyajian, dan verifikasi data. Hasil penelitian ini menunjukkan bahwa pada praktik penerapan denda yang diterapkan PT Adi Sarana Armada tbk (Assa Rent) kepada costumernya dengan kesepakatan perjanjian secara tertulis dari para pihak, maka kesepakatan itu menimbulkan kekuatan mengikat sebagaimana layaknya undang-undang. Assa Rent mempunyai kebijakan dan mekanisme aturan diterapkannya denda bagi costumer lalai atau melanggar perjanjian sewa-menyewa yang telah disepakati. Sementara itu, jika ditinjau dari pandangan fikih muamalah penerapan denda pada sewa-menyewa rental mobil ini diperbolehkan sebagaimana dalam kompilasi hukum ekonomi syariah pasal 36, sanksi atau denda dapat diberikan kepada orang yang ingkar janji serta dikenakannya hukuman berupa denda didasarkan pada prinsip ta’zir yaitu bertujuan agar costumer lebih disiplin dalam melaksanakan kewajibannya, mencegah terjadinya pelanggaran, memberikan efek jera, dan menjaga keadilan sebagaimana juga telah sesuai dengan prinsip-prinsip fikih muamalah.

Abstract

Artikel ini bertujuan untuk mengetahui proses produksi yang dilakukan dan menganalisis kesadaran hukum pelaku usaha terhadap higiene dan sanitasi proses produksi ikan asap. Jenis penelitian ini adalah deskriptif kualitatif, dengan menggunakan pendekatan yuridis empiris. Subjek penelitian ini adalah pelaku usaha ikan asap, sedangkan objek penelitian ini mengenai kesadaran pelaku usaha terhadap higiene dan sanitasi proses produksi ikan asap. Teknik pengumpulan data dilakukan menggunakan observasi, wawancara, dan dokumentasi. Proses produksi ikan asap dimulai dengan mempersiapkan alas, tungku, dan api untuk dipanaskan, kemudian proses pemotongan perut ikan, membersihkan ikan lalu langsung pada proses pengasapan yang memakan waktu 7-12 jam untuk hasil yang maksimal. Hasil penelitian yang didapatkan bahwa pelaku usaha ikan asap masih kurang menyadari penerapan prinsip higiene dan sanitasi dalam proses produksi ikan asap, hal ini dikarenakan indikator pengetahuan pelaku usaha terkait higiene dan sanitasi hanya sebatas mengetahui berdasarkan pengetahuan yang ada dalam dirinya, sehingga pemahaman dan penerapan perilaku hukum terhadap higiene sanitasi belum memenuhi syarat, pelaku usaha juga tidak mempunyai sertifikat laik higiene sanitasi dan nomor induk berusaha, yang artinya belum memenuhi indikator kesadaran hukum karena kurangnya sikap hukum. Berdasarkan hasil penelitian yang ada, pelaku usaha belum memenuhi hak konsumen yang tercantum dalam pasal 4 ayat (1) Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen, hak konsumen untuk mendapatkan keamanan, kenyamanan, dan keselamatan dalam mengkonsumsi barang dan jasa, yang artinya dalam hal ini konsumen harus mendapatkan produk yang bersih, aman terjaga dari kontaminasi, dan menghindari kerugian bagi konsumen.
