Abstract

Waqf development is largely determined by the legal andregulatory certainty Legislation endowments. Therefore, the relevance andcontribution to the socio-political context to meet the objectives of legislation,and its relation to the various activities of the institution of waqf verynoteworthy. Likewise, how the political configuration contribution to theestablishment and improvement of the legal construction that can supportthe implementation of the endowment in order to improve the welfare of thepeople. The government’s role in strengthening the existence of endowmentsby issuing the Law perwakafan has been done; including in Egypt, startingfrom the Act. Egypt No. 10 Year 1911 and Law. Egypt No. 103 1961. Whilein Indonesia, the existence of endowments increasingly getting nowherewith the issuance of Government Regulation No. 28 Year 1977 on LandOwned perwakafan, which contains elements of substance and technicalperwakafan. Issuance of Government Regulation No. 28 In 1977 it createdthe updates are very important in the management of waqf property. Theseregulations provide for the legality of the exchange bolehnya waqf propertyafter obtaining permission from the Ministry of Religion. Other rules thatbring renewal in the management of waqf is a Presidential Instruction No. 1of 1991 concerning Islamic Law Compilation (KHI). Law No. 41 of 2004 onEndowments and PP 42 of 2006 on the Implementation of Law No. 41 of 2004.

Abstract

In the human world created by bringing the elements of intelligence, be it intelligence quotient or spiritual intelligence. This article aims to reveal the financial intelligence of spiritual dimension with the teachings of waqf. Data collection methods used are with documentation of some literature. The results of the study indicate that the economic downturn has resulted in the inability of education to make a person worse in religious knowledge. Low levels of religious understanding can also lead to more vulnerability to misguided teachings and easily provoked by radical ideas. With waqf, the results obtained from waqf funds can be used for operational costs and educational infrastructure facilities so that people can achieve intelligence and spiritual intelligence so it is not easily provoked by radical ideology and misleading teachings.

Abstract

Endowments to save a great potential to be developed into a productive asset, which in the end was not only able to support socio-religious services, but also directed to support the various initiatives and social justice objectives. However, during this endowment has not played a significant role in realizing the benefit, the welfare of the people and social justice. Often heard slogan that endowments can be empowered to address issues of poverty, underdevelopment, poor nutrition, and so on. But there is no clear conceptual framework of how endowments can be developed to be an effective instrument for social change toward a more guarantee the welfare and justice. Abdullah Ahmad an-Na’im proposes transformation and reviewing their philanthropic tradition, in order to develop socio-economic communities, promote the fulfillment of human rights, political administration of justice, and guarantee the autonomy of the community. In addition to an-Na’im proposed above, there are several strategies in the development of productive endowments, among which are: the development of productive endowments through a reinterpretation of the concept of waqf, endowments regulatory legislation, issuance of certificates of endowment money, and productive waqf fund raising strategy.

Abstract

Waqf is one of the teachings of Islam that has been known since the time of the Prophet SAW, precisely in the second year of Hijriyah which began at the time of his prophethood in Medina and marked by the construction of the Quba Mosque. Then followed by the construction of the Nabawi Mosque built on the land of orphans of Bani Najjar. Waqf also occur during the time of Khulafa’ ar-Rasidin and also the companions thereafter to this day in some Muslim countries. Waqf has played important role in Muslim countries, such as Saudi Arabia, Jordan, Egypt, Kuwait and Turkey. In those countries, waqf is not merely in the form of worship related buildings but also in the form of farm field, educational institution, housing, cash, and capital stock.

Abstract

Riba is an exchange of Ribawi elements where there is a difference in timeand/or quantity. The Ribaaawi elements mentioned by the prophet are gold forgold, silver for silver, wheat for wheat, barley for barley, dates for dates, andsalt for salt. By a similar analogy, money is similar to gold and silver whereit is a modern way of exchange. Therefore a contract of exchange between theinsurer and insured contains a Ribawi element, i.e. levels of compensationinvolving varying amounts and time scales.The strict prohibition of interest in Islam is because of the following reasons.(Qaradawi, 2001). Taking of interest implies appropriating aanother person’sproperty without giving them aanything in exchange, because the one whomlends the other one dollar for one dollar plus gets the extra for nothing.Dependent on interest prevent people from working to earn money, sincethe person with one dollar can earn extra dollars through interest either inadvance or on later date without working for it. If it is happen to capital ownerthen they would not invest in the industry, trade and commerce, building andconstruction, as they will get extra earning without necessarily doing all ofthe hard work.Permitting the taking of interest discourages people from doing good toone another. If interest is prohibited in a society, people will lend to each otherwith a good will, expecting back no more then what they have lent. Riba isalso totally prohibited in Islam as because it tends to create unfair or injusticetreatment between one party with another. It also exploits one by the others.In Ribawi economic the rich one tends to get more benefit compares with thepoor one. The gap between the rich one and the poor one is becoming bigger andbigger as Riba have a spiral impact on increasing price for goods.

Abstract

Infaq can not be categorized as the illegal fees, because infaq have a clear legal basis in Islamic Law and Positive Law in Indonesia, in the submission of treasure infaq, givers and receivers infaq only based on sincerity and worship to God, not because of compulsion, and infaq targeted at realize the benefit of the people, while the illegal fees, the giver and the receiver treasure oriented only on personal interests.

Abstract

Zakah is one of the characteristics of the Islamic economic system, because zakah is one of the implementation of the principle of justice in the Islamic economic system. Trade is one form of legal business. The predominantly Muslim village of Mejobo has considerable potential associated with zakat, where the mejobo village has a prominent market commodity in the south of the southern part of the potential Brayung market in which a total of approximately 1000 traders in the Mejobo Village market. Materially the traders gain prosperity through two things: capital turnover and reasonable trade margin. However, in reality the merchants are distributing their zakah directly to mustahiq without going through zakah institution in the form of money every close to Eid al-Fitr. In addition, they also channel their zakah to a person who is not assigned as an amilin or zakah officer but to a person who is trusted to distribute. It is unfortunate if this large potential is not touched optimally by the zakah amil institutions in both the private and government. So it can be ascertained that the prospect of Brayung Desa Mejobo market must be developed maximally so that in addition to the obligation of Muslims to pay zakah, it also affects the social good and reduces the burden of the government.

Abstract

Waqf is one of Islam’s teachings that contain spiritual and material elements. Waqf is defined as something that is given for the usefulness of the people (as a charity) or for purposes related to Islam. This article aims to embrace the concept of waqf from the perspective of history, fiqh, and also macroeconomic perspective. The results show that waqf is one of Islamic teachings and also pre-Islamic teachings in providing their places of worship. From the fiqh perspective, fiqh scholars have explained the concept of waqf in the books of fiqh based on the al-Quran, the hadith and also their ijtihad. The concept of fiqh always undergoes development following the development of human reason. This is because the majority of waqf concepts are based on ijtihad which can change time and place. From the macroeconomic perspective, waqf property plays a role in building the necessary facilities of the community such as places of worship, educational institutions and also health centers. These facilities are believed to improve the quality of Human Resources (Sumber Daya Insani).
