Abstract

Abstract: Based on the background, the formulation of the problem is: How is the legality of the act of receiving tax receipts by Land Titles Registrar (PPAT) as a public official and How juridical implications of PPAT who receive tax and income tax of Acquisition of Land and Building Rights (PPHTB) from taxpayers. The method used to examine these issues is normative legal research using a statute approach to examine legislation relating to legal issues under review. Based on the results of the research, the results obtained that the legality of accepting tax receipts by PPAT as public officials actually still does not exist, in other words has not established a definite rule that regulates the act of receiving tax receipts by PPAT. Then about juridical implication to PPAT which accept tax day income tax and BPHTB from taxpayer is even though the act have not have legal legality but its implementation still included in legitimate category because that action depart from habit that have been accepted and accepted by society. As long as there is no rule of law to realize the legality of this act then as long as it is also this habit will continue, although there is no guarantee of legal protection for this act but as long as it does not cause harm to anyone then considered not a problem Abstrak: Tujuan penulisan ini adalah mendeskripsikan legalitas perbuatan menerima kuasa menyetor pajak oleh Pejabat Pembuat Akta Tanah (PPAT) selaku pejabat umum dan implikasi yuridis terhadap PPAT yang menerima penitipan Pajak Penghasilan (PPh) dan Bea Perolehan Hak Atas Tanah dan Bangunan (BPHTB) dari wajib pajak. Metode yang digunakan untuk meneliti permasalahan tersebut adalah penelitian hukum normatif dengan menggunakan pendekatan perundang-undangan (statute approach) untuk menelaah peraturan perundang – undangan yang terkait dengan isu hukum yang sedang dikaji. Legalitas perbuatan menerima kuasa menyetor pajak oleh PPAT selaku pejabat publik sesungguhnya masih belum ada, dengan kata lain belum dibentuk suatu aturan pasti yang mengatur tentang perbuatan menerima kuasa menyetor pajak oleh PPAT. Kemudian tentang Implikasi yuridis terhadap PPAT yang menerima penitipan pajak PPh dan BPHTB dari wajib pajak adalah meskipun perbuatan tersebut belum memiliki legalitas hukum namun pelaksanaannya masih termasuk dalam kategori sah sebab perbuatan tersebut berangkat dari kebiasaan yang berlaku selama ini dan diterima oleh masyarakat. Selama belum ada aturan hukum untuk mewujudkan legalitas dari perbuatan ini maka selama itu pula kebiasaan ini akan terus berlanjut, walaupun tidak ada jaminan perlindungan hukum atas perbuatan ini tetapi selama tidak menimbulkan kerugian bagi siapapun maka dianggap tidak masalah DOI : http://dx.doi.org/10.17977/um019v2i12017p018

Abstract

The purpose of this paper is to build a model realignment curriculum courses of study materials Citizenship in Higher Education to be optimized to develop character in the students obey the law. Character is rooted in the principle of the Deity, Humanity, Unity, Democracy and Justice. These characters can only be fulfilled if every law-abiding citizen. To achieve this required observance of exemplary education providers. Structuring the curriculum in this first formulate the vision, mission and goals of citizenship course, determine the profiles and the formulation of competence and competence synchronize efforts with the study material. Citizenship material substance awareness and observance of the law is derived from the principle of divinity, humanity, unity, democracy and justice and includes the study of God’s law, the law of Nature and the ethical and legal principles of the positive law of Indonesia. Positive law in question is the contextual Regulations Invite occurring in the community / region / town and village. Structuring the study material of citizenship in the legal aspect is emphasized in addition to the legal knowledge, content, attitudes and behavioral patterns of law, but also the values of law / Act. So the emphasis on stransfer legal value and not solely the transfer of legal knowledge. Abstract

Abstract: every society in Indonesia have local wisdom as reflection of values and characters which is followed by their community. Particularly in Javanese people, life philosophy as local wisdom has so many varieties. One of them is nrimo philosophy. Nrimo is believed as character of Javanese people for living in the world. Javanese people believe that after working hard, nrimo is what should to do (to be grateful for they have done whatever the result are given by God). On this paper, author will describe (1) the concept of Javanese nrimo philosophy, (2) the values contained in nrimo philosophy, and (3) Javenese nrimo philosophy related to first principle of Pancasila, Belief in the one and only GodAbstrak: setiap masyarakat Indonesia memiliki kearifan lokal sebagai cerminan dari nilai dan karakter yang dianut oleh masyarakat itu. Pada masyarakat Jawa khususnya, kearifan lokal yang berupa filosofi hidup banyak sekali ragamnya. Salah satu filosofi hidup yang diyakini oleh mayarakat Jawa adalah nrimo. Nrimo, diyakini sebagai karakter masyarakat Jawa dalam menjalani hidup. Abstract

Abstract: This paper aims to describe the process of compensation in the procurement of land for the public interest in the expansion of Sentani Airport, the legal implication that Ondofolo is not involved in the process of providing compensation for the procurement of land for public purposes, and the correct way of putting the role or position of Ondofolo in procurement of land for the just public interest. The study used a sociological juridical approach. The process of providing compensation in the procurement of land for public purposes in the expansion of a sentani airport involves ondofolo. The legal implications if Ondofolo not involved in the process of compensation for land acquisition for public purposes is a violation of the provisions of Article 43 of Law No. 21 of 2001 on Special Autonomy for Papua which has resulted in the validity of the decision of the government in acquiring the land. The role of Ondofolo in the procurement of land for the public interest is limited to affect the behavior of people in order to work together in realizing mutually agreed objectives for the creation of justice and the guaranteed rights of indigenous peoples both customary and constitutional of the Republic of Indonesia as long as it does not violate the rules applicable Abstrak:Tulisan ini bertujuan untuk mendeskripsikan proses pemberian ganti rugi dalam pengadaan tanah untuk kepentingan umum dalam perluasan Bandar Udara Sentani, implikasi hukum jika Ondofolo tidak dilibatkan dalam proses pemberian ganti rugi atas pengadaan tanah untuk kepentingan umum,  dan cara yang benar dalam meletakkan peran atau posisi Ondofolo dalam pengadaan tanah bagi kepentingan umum yang berkeadilan. Kajian menggunakan pendekatan  yuridis sosiologis. Pproses pemberian ganti rugi dalam pengadaan tanah untuk kepentingan umum dalam perluasan bandar udara sentani melibatkan ondofolo. Implikasi hukum jika Ondofolo tidak dilibatkan dalam proses pemberian ganti rugi atas pengadaan tanah untuk kepentingan umum adalah pelanggaran terhadap ketentuan Pasal 43 UU Nomor 21 Tahun 2001 tentang Otonomi Khusus Papua yang mengakibatkan tidak sahnya keputusan pemerintah dalam pengadaan tanah tersebut.  Peran Ondofolo dalam pengadaan tanah untuk kepentingan umum adalah sebatas mempengaruhi tingkah laku orang-orang supaya dapat bekerja sama dalam mewujudkan tujuan yang disepakati bersama demi terciptanya keadilan dan terjaminnya hak-hak masyarakat adat baik secara adat maupun secara konstitusional Republik Indonesia selama tidak melanggar aturan yang berlakuDOI : http://dx.doi.org/10.17977/um019v2i12017p064

Abstract

The concept of freedom is a form of analysis on how the free word was present and exist as a tangible manifestation of the contemporary world in the face of uncertainty. Humans really want to look for its existence as a creature. Existentialism tried to leave the path of light that human nature is the existence in the world. Is a self-proclaimed Sartre the existentialist philosophy of abiding by its main slogan, "Man is condemned to be free", and therefore "existence precedes essence". Discussion of existentialism is related to the phenomenon of the elimination of religion column in the National Identity Card in Jakarta. Policy toward the National Identity Card would try to analyze the concept of freedom of Sartre's existentialism using conflict as an epistemological approach Sartre's existentialism. Abstract

Abstract: The purposes of this study was to describe and analyze implementation learning together models to improve students' civic skills. Methods used in this research was the qualitative approach with naturalistic inquiry methods. Data collection techniques such as interviews, observation, and documentation. The results showed that implementation learning together models can improve students' civic skills is think critically and participate actively. Students' have the intellectual skills to identifying, describing, explaining, analyzing problems, evaluating, and taking and defending opinion that with grasp of the sovereignty people and system government in Indonesia. Students' also have the participation skills in the interacting, monitoring, and influencing in the group. The improvement from the standpoint of civics education is one of the components that should be embodied in the formation of the smart and good citizenAbstrak: Tujuan dari kajian ini adalah mendeskripsikan implementasi model learning together untuk meningkatkan kemampuan kewarganegaraan siswa. Metode yang digunakan dalam kajian ini adalah pendekatan kualitatif dengan metode inquiry naturalistik. Teknik pengumpulan data seperti wawancara, observasi, dan dokumentasi. Hasil menunjukkan bahwa penerapan pembelajaran bersama model dapat meningkatkan kemampuan berprestasi siswa berpikir kritis dan berpartisipasi aktif. Siswa memiliki kemampuan intelektual untuk mengidentifikasi, menjelaskan, menganalisis masalah, mengevaluasi, dan mengambil serta mepertahankan pendapat tentang pemahaman kedaulatan rakyat dan sistem pemerintahan di Indonesia. Siswa juga memiliki kemampuan partisipasi dalam berinteraksi, memantau, dan mempengaruhi kelompok tersebut. Abstract

Abstract: Indonesia is a multicultural country. There are various religions, tribes, cultures and customs. This diversity is a necessity that must be lived as a force in building the country. However, the diversity is tested by various discriminatory events. One is the freedom to worship religious minorities in the midst of a particular religion. The establishment of places by minority religions in various regions continues to reap the controversy. Maturity of the thinking of the majority becomes an important part in realizing the balance of social relations. Therefore, this article tries to realize a new idea of Fiqh HAM. The results of the Qur'anic conception are poured in the idea of human rights fiqh that seeks to build equal rights of worship for citizens. Fiqh HAM is expected to create public awareness to respect and respect the activities of minority worship Abstrak: Indonesia merupakan negara multikultural. Terdapat berbagai agama, suku, budaya dan adat istiadat. Keberagaman ini merupakan sebuah keniscayaan yang harus dijalani sebagai kekuatan dalam membangun negara. Namun, keberagaman itu seolah diuji dengan berbagai peristiwa diskriminasi. Salah satunya adalah kebebasan beribadah kaum minoritas agama di tengah mayoritas suatu agama tertentu. Pendirian rumah ibadah oleh agama-agama minoritas di berbagai daerah terus menuai kontroversi. Pendewasaan pemikiran umat mayoritas menjadi bagian penting dalam mewujudkan keseimbangan hubungan sosial. Oleh karena itu, Artikel ini mencoba untuk mewujudkan gagasan baru mengenai Fikih HAM. Hasil konsepsi Al-Quran tersebut dituangkan dalam gagasan fiqih HAM yang berupaya untuk membangun kesetaraan hak beribadah bagi warga negara. Abstract

the rights and freedom of religion is a constitutional right of citizens as guaranteed by the constitution. However, conflict, violence and prohibition on the right is still prevalent in various regions in Indonesia, only one is against followers of Syi’ah in Sampang. These events drove Tajul Muluk be convicted by Sampang District Court’s Decision No.69/Pid.B/2012/PN.Spg. This event seemed to signal that the state is unable to protect the constitutional rights of citizens to believe in and follow a religion. Even countries participated as an actor against the rise of violence and a rejection of the Syi’ah community in Sampang. Abstract: This Study discusses the legislation ratios of Constitutional Court Decision Number 69/PUU-XIII/2015 and its legal implications on the authority of a notary in the establishment of a marriage certificate after the Constitutional Court Decision Number 69/PUU-XIII/2015 concerning the marriage agreement that can be made after the marriage (a study of a notary in East Jakarta). The results of this study are what is the basis of the legislation ratio of the Constitutional Court (MK) issued Decision of the Constitutional Court (MK) Number 69/PUU-XIII/2015 on the making of marriage agreements that can be made not only before the marriage but can also be made after the marriage throughout the period of marriage and its legal implications to the authority of notary in the making of the deed of marriage agreement after the Decision of the Constitutional Court Number 69/PUU-XIII/2015, because the Constitutional Court's decision is final and binding, a notary must respect and execute Decision of the Constitutional Court Number 69/PUU-XIII/2015 concerning the marriage agreement made by the parties may be made after the marriage and must be valid by the competent marriage official or notary publicAbstrak: Kajian ini membahas mengenai rasio legis Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 dan implikasi hukumnya terhadap kewenangan notaris dalam pembuatan akta perjanjian kawin pasca Putusan Mahkamah Konstitusi Nomor 69/PUU-XIII/2015 tentang perjanjian kawin yang bisa dibuat setelah terjadinya perkawinan (studi pada notaris di wilayah Jakarta Timur). Abstract

Abstract: This article is motivated by issues attitude and character of citizenship among the younger generation which is very alarming. The understanding of democracy that one result of excessive democratic freedoms. Disorientation attitude and character citizenship (civic disposition) experienced by almost all elements of the nation thus eliminating the identity of the nation and much of the value-milai democracy. Pesantren Daarut Tauhid as modern schools also provide planting of democratic values among his students. The data were taken with the study documentation, observations, interviews, and the active participation of researchers in the field. The results of this study found: democracy education should be introduced in educational institutions schools, for boarding institutions are educational institutions which make the process of developing the potential of learners (students). Through the process of democratic education will produce a democratic man.For students develop civic disposition, pendidikkan process conducted in schools in various ways; 1) exemplary; 2) exercise and habituation; 3) educate through ibrah (taking lessons); 4) educate through mauidzah (advice); 5) educate through discipline; and 6) educate targib wa tahzid (inducements and threats) Abstrak: Artikel ini dilatarbelakangi oleh persoalan sikap dan watak kewarganegaran di kalangan generasi muda yang sangat memprihatinkan. Pemahaman terhadap demokrasi yang salah mengakibatkan kebebasan berdemokrasi yang kebablasan. Disorientasi sikap dan watak kewarganegaraan (civic disposition) hampir dialami oleh seluruh elemen bangsa sehingga menghilangkan jati diri anak bangsa dan jauh dari nilai-milai demokrasi. Pesantren Daarut Tauhid sebagai pesantren modern juga memberikan penanaman nilai-nilai demokrasi dikalangan para santrinya. Data dalam penelitian ini diambil dengan studi dokumentasi, observasi, wawancara, dan partisipasi aktif peneliti dilapangan. Hasil dari penelitian ini ditemukan: Pendidikan demokrasi hendaknya dikenalkan di lembaga pendidikan pesantren, karena lembaga pesantren merupakan lembaga pendidikan yang melakukan proses mengembangkan potensi peserta didik (santri). Melalui proses pendidikan demokrasi akan menghasilkan manusia yang demokratis.Untuk  mengembangkan civic disposition santri, proses pendidikkan yang dilakukan di pesantren dengan berbagai cara yaitu; 1) keteladanan; 2) latihan dan pembiasaan; 3) mendidik melalui ibrah (mengambil pelajaran); 4) mendidik melalui mauidzah (nasehat); 5) mendidik melalui disiplin; dan 6) mendidik targib wa tahzid (bujukan dan ancaman) DOI : http://dx.doi.org/10.17977/um019v2i12017p075
