Abstract

This study aimed to provide an overview of the values that have been constructed the national character which found in the local culture of Kee'rja Banyau. The method used qualitative with a case study approach, data collected through observation, interviews, documentation. The findings indicate that local cultural values such as Kee‘rja Banyau could be a source of maintaining the social integrity of a society which later became the forerunner of the embedded philosophy of life as part of the national identity. This is because in the local there are some national character values such as tolerance, friendliness or communicative, caring for the environment, social care and responsibility.

Abstract

The purpose of this study was to provide an overview of state defense education carried out in Titian Teras H. Abdurrahman Sayoeti Jambi Senior High School through civic education and special curriculum. State defense education that is implemented in the school is carried out to shape the spirit and spirit of patriotime of students or young people in the face of the times and globalization. This study uses a qualitative approach. Data was obtained through interviews, and observations of teachers and students from Titian Teras H. Abdurrahaman Sayoeti Jambi Senior High School. The results showed that the state defense education implemented in Titian Teras H. Abdurrahman Sayoeti Jambi Senior High School had a function in growing and strengthening the values of patrotism in students. Education defends the country teaches about love for the homeland, the spirit of struggle, nationalism, patriotism and excellent physical endurance. The material provided includes insight into nationalism, line marching, time discipline, long march and leadership. Thus education in defense of the state has a positive contribution in shaping students who have a spirit of patriotism from an early age.

Abstract

Writing this scientific article discusses the urgency of the Mahkamaha Constitution to issue a legal fatwa in the formulation of laws. Based on the idea that the making of laws which constitute the rules of implementing the constitution, constitutional questions are not impossible to emerge at the time of the formation of laws by state legislatures, because the norms of constitutional material are abstract in nature. Therefore an alternative effort is needed, namely the submission of questions to the Constitutional Court regarding the norms of the articles of the Constitution, which relate to the laws to be made / form. Through these questions, a fatwa or legal consideration was issued from the Constitutional Court, so that the DPR and the President did not appear different interpretations in fulfilling the original intent of the constitution and meeting the constitutional rights of citizens. The writing of scientific articles uses empirical juridical research methods. The results of this scientific article are the legal fatwa of the Constitutional Court as the theoretical implications of the authority to examine the constitutionality of laws against the 1945 Constitution of the Republic of Indonesia can be based on a commitment to prevent acts of state administration which are not in accordance with the constitution as the highest state law. In addition, constitutional testing of the draft law through interpretation of the constitution constitutes control between state institutions (cheks and balances) to realize the ideals of a democratic legal state that prioritizes constitutional supremacy.

Abstract

the purpose of the author of this article is to discuss the meaning of propriety and reason- ableness in Article 74 paragraph (2) of Law Number 40 of 2007 concerning Limited Liability Compa- nies (UUPT) on a corporate social responsibility agreement in the distribution. The method uses normative legal studies with legislative approaches, concepts, and case studies. The propriety meaning is conformity based on balance, meaning that it must fulfill the element of conformity with the situation or the balance between the company’s ability to risk the activities of the company. Fairness is interpreted as something that should or should be done based on the order and the appropriate rules. Compliance and reasonableness are viewed from the point of view of the amount that is spent on the company’s CSR must be in proportion and not contrary to the provisions of the legislation. Compliance and reasonableness are related to the number, objectives, and form of the agreement.

Abstract

This study aimed to explain the effect of educational interactions on students' self-concept in studying at YP Unila Bandar Lampung High School. The method used a quantitative approach with a descriptive design because the objectives and study were explained and described. Based on the existing analysis, it was found that 68% had an effect, this meant that educative interaction between students and teachers had an effect on self-concept, because if communication was built by teachers and students both students would not be reluctant or afraid to express their opinions to the teacher on the basis of self-concept good too. Meanwhile, it was also found that 72% of students had a good self-concept which meant the effect of changes that remained on their achievements would bring an attitude towards themselves. This also mean that the student's self-concept could change if there are influences from other people who are trusted and that influence matches his will.

Abstract

This article aims to discuss the role of kiai in building voter participation. The method used is a qualitative approach. Data collection using observation, interviews, and observations. Analysis uses an interactive model. The results of the study show that scholars have 3 (three) roles in politics, namely as political political patrons, political elites, and political mediators. Kiai as political patrons become a reference in making political choices. Kiai are active political elites in the management of political parties and mass mobilization. Kiai as political mediators mediate in political conflicts.

Abstract

This study aimed to examine the relationship between the values of Pancasila in shaping a sense of citizenship in teenagers. Teenagers are the future residents of a nation that is expected to embody the values of Pancasila in public life. These values are inculcated through education at school, and could result in the creation of a sense of citizenship in teenagers. This study uses quantitative methods involving 297 high school students from the country, religious-affiliated schools and boarding school in West Java. Pearson correlation test showed a positive correlation and significant at all values of Pancasila and a sense of citizenship, which is the first principle, the second principle, third, fourth, and fifth. Thus, the higher the values of Pancasila individual then come high sense of citizenship. In particular, the strongest relationships arise from values of social justice and citizenship. http://dx.doi.org/10.17977/um019v1i12016p012

Abstract

Euthanasia problem has existed since the health system faces an incurable disease, while the patient is dying and torture. In such situations, it is not uncommon patient begged to be released from this suffering and did not want an extended life again or in other circumstances in patients who are not aware, families of patients who did not have the heart to see patients suffering deathbed ask the doctor or nurse not to continue treatment or if necessary, provide drugs to hasten death. From this emerged the term euthanasia, which took off a person’s life to be free from suffering or dying well. From the study of this thesis can be concluded that the lethal injection, or more commonly called euthanasia if viewed from the aspect of criminal law and human rights in Indonesia are still having a debate that has not found the end, because of the provision of human rights by the opposition national laws, especially the Criminal Code in force in Indonesia, but basically that the act of euthanasia is still Brazilians is prohibited in the criminal justice system and health laws that exist in Indonesia, whatever and however excuse used and anyone who filed either personally want themselves or family everything is still forbidden to do anything syringe the dead, even the health workers are still prohibited from lethal injection for any reason. http://dx.doi.org/10.17977/um019v1i12016p056

Abstract

It should be recognized the draft Penal Code or the Criminal Code applied in Indonesia was a legacy of Netherland colonialism and imperialism regime which had colonized this country for 350 years. Badly, the book which is used as criminal law guidelines is still applicable in Indonesia, although the life and traditions of society are far different from those in the Netherlands. Even though, there are a few additions and subtractions to the Criminal Code provisions, but the nature of imperialism and capitalism remains rooted in the Penal Code. Therefore, in order to revise the Penal Code voiced intensively by various elements of society lately, it is highly recommended inserting appropriate norms to the values of Pancasila as the implementation of national ideology which is complex and civilized into the criminal law system in Indonesia. http://dx.doi.org/10.17977/um019v1i12016p023

Abstract

The purpose of The Role of Social Institutions Toward Moral Guidance Teeangers at SMA district  west wesisir research is to understand how the role of social institutions at SMA district  west pesisir in moral guidance teenagers. The method that is used in this research is qualitative descriptive with the subject of research are social institutions such as institute of family, institute of education, institute of religion, and institute of law. The data collecting technique was using interview guidance, observation, and documentation whereas the data analysis was using credibility experiment and triangulation. The result of this reasearch is showed that social institutions is comprehended and understood their duty as social institutions which is has assignment to make moral teenagers to be good. Based on the result, it can be concluded that social institutions such as institute of family, institute of education, institute of religion, and institute of law has a role but not yet maximal toward moral guidance teenagers. http://dx.doi.org/10.17977/um017v21i22016p064
