Abstract

Abstract: Islamic fundamentalism has often been accused as a source of conflict so that it should be ended immediately. And the radical movement should put forward a complete understanding of diverse religions. Likewise, in every movement, it is necessary to keep the political and economic interests away from religion, because such factors triggers inter-religious conflict. The brutal act by a group of people who claims the most righteous by displaying the most sinister and frightening face of Islam, is really far from Islamic values. Islam is rahmatan lil ‘alamin, especially towards fellow Muslims who believe in the truth of Islam based on the Koran and the Sunnah as the main and first source of Islamic teachings. If this motto is implemented seriously, the conflicts that have occurred will not be repeated. In its further development, fundamentalism undergoes a change, a shift, and is further away from its origin. The discussion of fundamentalism today is more associated with a negative impression that Islam is a religion of violence, anti-progress and establishment, conservative, antiWestern, and always takes violence to achieve its goals. This labeling and stigmatization of course has greatly marginalized Islam in international relations. This kind of stigmatization can be understood by Muslims so that they also hold counters in various ways, including counter discourse. However, the efforts made by Muslims have not been able to change the world view of Islam, especially the Western world. Islam to this day is still perceived as a violent religion. امللخص: كام يتم التعبري عنها يف كثري من األحيان يف شكل اتهامات ، بأن األصولية اإلسالمية مصدر للرصاع ويجب إنهاؤها عىل الفور. ويجب أن تعزز حركة الراديكالية الفهم الكامل ملختلف األديان. وباملثل يف كل حركة ، يجب إبعاد املحتوى السيايس واالقتصادي عن التنوع ، ألن هذا عامل يثري الرصاع باسم الدين. إن العمل الوحيش ملجموعة من األشخاص الذين يشعرون باألمان ويشعرون بالصالح من خالل إظهار الوجه األكرث رشاً وخوفاً لإلسالم بعيد كل البعد عن القيم اإلسالمية. اإلسالم هو رحمة لألمني ، وخاصة تجاه إخوانهم املسلمني الذين يؤمنون بحقيقة اإلسالم عىل أساس القرآن والسنة باعتبارها املصدر الرئييس واألول للتعاليم اإلسالمية. إذا تم طرح هذا ، فلن تتكرر النزاعات التي حدثت. يف التطورات الالحقة ، شهدت األصولية تغيريات وتحوالت وأبعدت عن أصلها. إن مناقشة األصولية يف الوقت الحايل مرتبطة أكرث باإلسالم بانطباع سلبي بأن اإلسالم دين عنيف ومعاد للتقدم ومؤسس ومحافظ ومعاد للغرب ويتخذ العنف دامئًا لتحقيق أهدافه. وبالطبع فإن هذا ً التوسيم والوصم يهمش اإلسالم حقا يف العالقات الدولية. ميكن للمسلمني أن يفهموا ويفهموا هذا النوع من الوصم حتى يتصدوا لها بطرق مختلفة ، مبا يف ذلك الخطاب املضاد. إال أن الجهود التي يبذلها املسلمون مل تكن قادرة عىل تغيري نظرة العامل اإلسالمي ، وخاصة ُنظر إىل اإلسالم عىل أنه دين عنف. العامل الغريب. حتى اآلن ، ال يزال يAbstrak: Seperti yang sering diungkapkan dalam bentuk tudingan, bahwa fundamentalisme Islam merupakan sumber konflik sehingga harus segera diakhiri. Dan gerakan radikalisme harus mengedepankan pemahaman yang utuh tentang beragam agama. Begitu pula dalam setiap gerakan, muatan politik dan ekonomi perlu dijauhkan dari keberagaman, karena inilah faktor yang memicu terjadinya konflik yang mengatasnamakan agama. Tindakan brutal sekelompok orang yang merasa paling aman dan merasa paling benar dengan menampilkan wajah Islam yang paling seram dan menakutkan, sungguh jauh dari nilai-nilai Islam. Islam adalah rahmatan lil ‘alamin, terutama terhadap sesama umat Islam yang meyakini kebenaran Islam berdasarkan Alquran dan Sunnah sebagai sumber utama dan pertama ajaran Islam. Jika ini dikedepankan maka konflik yang telah terjadi tidak akan terulang kembali. Dalam perkembangan selanjutnya, fundamentalisme mengalami perubahan, pergeseran, dan semakin jauh dari asalnya. Pembahasan fundamentalisme saat ini lebih banyak dikaitkan dengan Islam dengan kesan negatif bahwa Islam adalah agama yang kekerasan, anti kemajuan dan kemapanan, konservatif, anti Barat, dan selalu mengambil kekerasan untuk mencapai tujuannya. Pelabelan dan stigmatisasi ini tentu saja sangat memarjinalkan Islam dalam hubungan internasional. Stigmatisasi semacam ini dapat dipahami dan dipahami oleh umat Islam sehingga mereka pun mengadakan tandingan dengan berbagai cara, termasuk tandingan wacana. Namun upaya yang dilakukan oleh umat Islam belum mampu mengubah pandangan dunia Islam, khususnya dunia Barat. Islam hingga saat ini masih dipersepsikan sebagai agama kekerasan.

Abstract

This research is based on an initial survey of the distribution of subsidized 3-kg LPG which I think is not right on target because it is full of fraudulent practices. In distributing LPG, it was found that many rich people still buy subsidized 3-kg LPG. In fact, according to government regulations, 3-kg LPG is intended for the poor economic community or small business owners. The problem that is the focus of this research is how the mechanism for distributing 3-kg LPG is in Sajad Regency, and how is the law on selling 3-kg LPG for the rich when viewed according to Islamic law. To answer these questions, data collection techniques were carried out through observation and interviews. The results of this study are 1) the distribution of 3-kg LPG is not in accordance with government regulations, namely the distribution of LPG prioritizes people who can afford it above the official price, while the poor can only get a small part of the official government price/national subsidy price, so there are more stock for sale at more expensive than the official price. 2) If viewed from Islamic law, the distribution of 3-kg LPG is not in accordance with the sharia business method because it is carried out by ignoring government regulations, namely traders are considered to have broken an agreement with the government regarding price determination. In addition, this buying and selling practice also lacks supervision, no sanctions and no law enforcement to maintain subsidy prices so that many sellers dare to violate contracts with the government and violate government regulations.

Abstract

This study aims to determine the application of the Dharûriyâ concept among Muslim food traders at Pemangkat Market, Kambas Regency. This research is qualitative descriptive using a socio-religious approach. Data were obtained through observations and interviews with shop owners/grocers of Muslims at the locations which were then analyzed using inductive analysis techniques. This study concludes that the majority of Muslim traders in Pemangkat Market have applied five aspects of the Dharûriyât concept, namely: (i) Hifz al-Din (maintaining religion), which is marked by their obedience in carrying out worship, (ii) Hifz an-Nafs (maintaining the soul), their patience to avoid conflicts between fellow traders, (iii) Hifz al-Aql (maintaining reason), which is characterized by the tendency of traders not to consume/sell liquor; (iv) Hifz al-Mal (maintaining wealth), which is indicated by a penchant for saving/investing and spending their wealth in the way of goodness; (v) and Hifz an-Nasl (maintaining offspring) which is shown by the enthusiasm of the actors to provide good education to children and feed them from lawful assets.

Abstract

This writing discusses ta’abbudi and ta’aqquli in Islamic jurisprudence, aiming to provide comprehensive insight into both of these terms. Positioning oneself as a mukallaf (a responsible and accountable individual), on one hand, acknowledges that acts of worship (ta’abbudi) must be fully accepted, whether or not one comprehends their meanings, as they are divine commands. Similarly, on the other hand, a mukallaf is granted the authority and capability to employ reason in dealings with worldly matters (mu’amalah), enabling the development of laws in accordance with the changing times. In the context of Law Number 33 of 2014 on Halal Product Assurance, at-Ta’abbud and at-Ta’aqqul hold significant relevance. Article 10, paragraphs (1) and (2), regulate the requirements for halal products, encompassing raw materials, production processes, storage, as well as processing, handling, and packaging procedures. This indicates that at-Ta’abbud plays a crucial role in ensuring compliance with halal product requirements. Furthermore, Article 10, paragraph (3), emphasizes that halal products must be verified by accredited halal certification bodies. This underscores the importance of at-Ta’aqqul in analyzing and verifying the halal status of products.

Abstract

Tanah terlantar adalah tanah yang tidak digunakan, tidak dimanfaatkan. Tanah terlantar berada di Desa Pasar Melayu Sambas yang memiliki lebar 12 m dengan panjang 60 m. Tanah tersebut terlantar selama kurang lebih 17 tahun. Tanah tersebut terlantar dikarenakan pada waktu itu tanah tersebut dibangun sebuah bangunan namun terbakar bersama surat-surat, sehingga sampai sekarang tanah tersebut tidak di perhatikan dalam artian terlantar. Adapun fokus masalah dalam penelitian ini yaitu bagaimana status tanah Eks Dinas Perkebunan Provinsi Kalimantan Barat di Desa Pasar Melayu Sambas dan apa faktor yang mempengaruhi Tanah Terlantar Dinas Perkebunan Provinsi Kalimantan Barat yang ada di Desa Pasar Melayu Kecamatan Sambas tersebut. Selain itu, jenis penelitian yang digunakan dalam penelitian ini adalah kualitatif deskriptif dengan konteks melalui pengumpul data dari lapangan serta berinteraksi secara langsung dengan para informan dan Pendekatan Normatif Empiris. Sumber data penelitian utama yaitu Informan yang terdiri dari pihak Kepala Desa, Ketua BPD, dan Ketua RT serta PP Nomor 20 Tahun 2021 tentang Penertiban Kawasan dan Tanah Terlantar. Tidak hanya itu,teknik analisis data berupa Observasi, Wawancara, dan Dokumentasi. Berdasarkan hasil penelitian yang dilakukan oleh peneliti, dapat disimpulkan bahwa, Pertama, bahwa berdasarkan PP Nomor 20 Tahun 2021 tentang Penertiban Kawasan dan Tanah terlantar maka status tanah di Desa Pasar Melayu merupakan tanah yang terlantar yang harus ditertibkan dan secara lansung dapat dikuasai oleh Negara menjadi Aset Bank Tanah /TCUN, Kedua, Faktor yang menyebabkan tanah tersebut terlantar adalah kebakaran yang terjadi pada bangunan di atas tanah tersebut sehingga dari pasca kebakaran tanah tesebut terbengkalai selama kurang lebih 17 tahun dan faktor lain yaitu dari pihak pemerintah yang dengan sengaja tidak mempergunakan tanah tersebut.

Abstract

Perjanjian sewa dalam hukum Islam disebut ijarah. Pemerintah Kabupaten Sambas menerbitkan sebuah Peraturan Nomor 58 Tahun 2019 Tentang Tata Cara Sewa Barang Milik Pemerintah Daerah. Hal ini menjadi menarik ketika terdapat lahan kosong yang dimanfaatkan masyarakat sekitar untuk bercocok tanam. peneliti tertarik untuk membahas terkait sistem sewa menyewa barang milik daerah dan akan ditinjau dari sudut pandang Hukum Islam karena peraturan tersebut tidak diikuti dengan eksekusi secara efisien oleh Pemerintah Daerah. Adapun fokus masalah dalam penelitian ini yaitu Bagaimana Praktik Sewa Barang Milik Daerah berdasarkan Peraturan Daerah Kabupaten Sambas Nomor 58 Tahun 2019 dan Bagaimana Implementasi Peraturan Daerah Kabupaten Sambas Nomor 58 Tahun 2019 Tentang Tatacara Sewa Barang Milik Pemerintah Daerah Pada Praktik Sewa - Menyewa Lahan Pertanian Perspektif Hukum Islam? Penelitian ini menggunakan metode penelitian kualitatif yaitu penelitian yang dilakukan di lapangan dengan mendeskripsikan hasil penelitian, jenis penelitian ini juga dapat dilakukan dengan cara mengadakan identifikasi hukum bagaimana efektifitas hukum ini berlaku. Utuk memperoleh data, peneliti menggunakan wawancara dan observasi. Berdasarkan hasil penelitian dan pembahasan di atas bahwa Peraturan Daerah Kabupaten Sambas nomor 58 tahun 2019 yang terjadi dapat membantu seseorang mewujudkan keinginannya untuk memiliki lahan meskipun dengan menyewa yaitu dengan menanami lahan pertanian tersebut, dalam hal ini dapat melestarikan nilai-nilai kebersamaan, saling menolong dan membantu program pemerintah, dan kedua belah pihak memperoleh keuntungan, akad yang dilakukan oleh pemilik lahan pertanian dan penyewa, dan kesepakatan yang dilakukan adalah kerelaan antara kedua belah pihak.

Abstract

Studies on women from time to time continue to emerge. Recently, with the proliferation of discourses on feminism in various parts of the world, women and their existence have returned to the lips of our society. Feminism with its idea of equality, in theory and practice, is not uniform. Even though the word equality is often discussed and studied in depth, there has been no satisfactory media formula, which is generally agreed upon. West and Islam, for example, have their own formulations and interpretations regarding women's equality. More cautious and far-sighted striving for women's equality on the one hand without eliminating that womanly nature, on the other hand, in contrast to the west, equality is interpreted as broadly as possible so that women who initially feel happy with the freedom offered, in turn, are trapped in the form of equality This journal that exploits and eliminates its female nature is one of the moral messages of this journal that in responding to an offer of freedom we should consider and examine more deeply. It is certain that Muslims themselves in carrying out these considerations must be based on the rules and laws of Allah stated in the Al Quran. and Sunnah. Abstract

This study aims to understand the contextualization of hadith regarding tolerance to religious and cultural diversity with a focus on the meaning of the text, the historical context of tolerance at the time of the Prophet and the contextualization of hadiths . Data analysis was in the form of content analysis. It was found that first, there were six editorials of hadith tolerance using the word samaha which means compassion, generosity and is equated with the word patient. Second, the historical context of the prophet's tolerance attitude was recorded in building a pluralist society in the form of forgiveness, good prejudice, recognizing other religions and cooperate with each other. Third, the contextualization of the hadith that the basic concept of Islam in a pluralist society must be based on the principles of living in harmony, peace and prioritizing spirituality and humanity and ignoring group subjectivity. Departing from this finding, the universality of Islamic teachings is able to respond to the social reality of Indonesian society through religious tolerance in cultural and religious diversity

Abstract

This research is based on the National Program for Community Empowerment in Semparuk sub-district, which was previously conventional, has now switched to Sharia using the wakalah contract. This study aims to determine the effectiveness and analysis of Islamic law on the wakalah contract in the Sharia-based National Community Empowerment Program in the Semparuk Activity Management Unit. The type of this research is field research, using a descriptive qualitative approach. The collection techniques used in this study were interviews, documentation based on primary sources, namely the management of the Semparuk Activities Management Unit and groups of women (customers) who borrowed from the Sharia-based National Community Empowerment Program. Based on the research results, it is concluded that the effectiveness of the National Community Empowerment Program is good. Semparuk Activities Management Unit has carried out business activities based on sharia principles or Islamic legal principles which are regulated in the fatwas of the Indonesian Ulema Council such as the principles of justice and balance, and do not contain gharar, maysir, usury, zalim and haram objects.
