Abstract

Permasalahan dalam penelitian ini berangkat dari peran Dinas Pengendalian Penduduk dan Keluarga Berencana (DPPKB) Kota Palembang yang menargetkan pada Tahun 2024 Kota Palembang bebas dari kasus stunting / gizi buruk. Penelitian ini bertujuan untuk menganalisis faktor pendukung peran DPPKB Kota Palembang dalam mewujudkan ketahanan keluarga bebas stunting serta tinjauan hukum Islam terhadap Peran DPPKB Kota Palembang Dalam Mewujudkan Ketahanan Keluarga Bebas Stunting. Penelitian ini berjenis penelitian lapangan/ field research, menggunakan jenis data kualitatif, yang bersumber data primer, sekunder dan tersier. Teknis pengumpulan data melalui wawancara dan dokumentasi. Teknis analisis data deskriptif kualitatif. Hasil penelitian menunjukkan bahwa faktor yang mendukung peran DPPKB dalam mewujudkan ketahanan keluarga bebas stunting yaitu pendidikan dan informasi, ketersediaan sumber daya, pemberdayaan perempuan, pemantauan dan evaluasi, dan kolaborasi lintas sektor. Perspektif Islam terhadap peran Dinas Pengendalian Penduduk dan Keluarga Berencana Kota Palembang dalam mewujudkan ketahanan keluarga bebas stunting diharapkan dapat memberikan kontribusi positif yang sejalan dengan nilai-nilai dan prinsip-prinsip Islam tentang kesejahteraan keluarga dan perlindungan terhadap kesehatan ibu dan anak. Abstract

This research investigates the legal protection of children in underage divorce cases in the context of Indramayu, Indonesia. Using a mixed methods approach, the research analyzed the legal framework, reviewed existing literature, and gathered insights through surveys with legal professionals, social workers, and individuals who have direct experience in underage divorce cases. The findings revealed nuances in the legal landscape, challenges in implementation, and the importance of cultural sensitivity. Recommendations emphasize alignment of legal standards, improved support services, interdisciplinary collaboration, compassionate legal processes, and community engagement.

Abstract

This article aims to analyze the methodology for understanding hadīth according to Yūsuf Qaraḍāwī. This study uses library research methods to analyze data. The primary data are Qaraḍāwī's work, while the secondary data are books and journal articles relevant to the topic of this study. The results of this study indicate that Qaraḍāwī offers eight steps to understanding hadīth, namely defining hadīth based on the Qur'ān, collecting hadīth thematically, compromising contradictory hadīths, identifying asbāb al-wurūd of the hadīth, distinguishing changing and unchanging means, differentiating between the literal and figurative language (majāz), recognizing the unseen and the real, and confirming the meaning of the words in the hadīth. Some points that must be avoided in interacting with ṣunnāh are the interpretation of the ignorant, the deviation of the extremes, and the manipulation of the heretics. Furthermore, the basic principles in interacting with ṣunnāh are examining the validity of hadīth based on the scientific principles established by hadīth experts, understanding the editorial hadīth properly according to the language instructions and the context of the hadīth, and ensuring that the matān of the hadīth does not conflict with the nāsh of the Qur'an or other hadīth with a more powerful position

Abstract

This study aims to analyze the status of hadiths that serve as the basis for the imposition of sanctions on individuals who convert from Islam to other beliefs (apostasy) and the views of Muslim scholars in understanding the legal messages behind hadiths on apostasy. This study addresses questions regarding the wording, transmission, and status of hadiths on apostasy, as well as how Muslim scholars define apostasy and interpret the legal messages of apostasy sanctions in the hadiths of the Prophet. The study utilizes the method of takhrij hadith with an analytical-descriptive approach. Both primary and secondary research data are gathered from various literary sources. The study finds that hadiths on the legal sanctions for apostasy have two forms of wording: "man baddala dinahu faqtuluhu - whoever changes his religion, kill him" and "la yahilllu damumriin muslimin illa tsalasin - no Muslim's blood is lawful except for three cases." Hadiths on apostasy sanctions fall into the category of ahad hadiths with a degree of authenticity (sahih). Furthermore, the study reveals the evolution of Muslim scholars' understanding of apostasy, wherein apostasy was initially understood solely as a departure from the Islamic faith (i'tiqad) but later came to be seen as a departure accompanied by enmity towards Islam. The scholars themselves are divided into two major groups in their interpretation of the position of hadiths on apostasy, namely the classical Muslim scholars who interpret it as a legal ruling that can be implemented against apostates. In contrast, contemporary Muslim scholars have started to criticize and reinterpret the status of these hadiths, emphasizing the need to reconsider the contextualized understanding of the legal message of apostasy sanctions. The significant contribution of this study lies in clarifying the status of hadiths on apostasy sanctions and illustrating the dynamic understanding of Muslim scholars regarding the implementation of these hadiths' messages

Abstract

The practice of polygamy is often a controversial topic and raises questions about religious and cultural identity. Although Islamic law permits polygamy under certain conditions, how this is understood and applied by the convert community in a Christian setting is complex. This study explores the dynamics of polygamy among converts (Muallaf) in the multicultural environment of Manado, Indonesia, from the perspective of Islam and society. Using an empirical normative approach, the study involved 35 informants, consisting of 25 Muallaf who were married in Islam and ten who were engaged in polygamous marriages. Data was collected through in-depth interviews, and the analysis identified common patterns and significant findings, focusing on factors influencing attitudes towards polygamy. The results revealed differences in views among Muallaf regarding polygamy; some accept this practice as part of Islamic teachings, while others reject it as contrary to their previous values. Factors such as religious interpretation, pre-conversion values, and legal and social barriers affected their attitudes toward polygamy. The problematic legal hurdles of obtaining polygamy permits in court highlight additional challenges in implementing this practice in Manado. Nevertheless, polygamy remains a controversial issue in this predominantly Christian society, reflecting the complexity of the interaction between religion and culture. This research provides important insights into how polygamy is perceived and practiced in multicultural environments and the challenges Muallaf faces in understanding and applying Islamic law in their social contexts.
