Abstract

Traffic signs are part of road equipment that contains symbols, letters, numbers, as well as sentences and combinations in them and serves to provide warnings, prohibitions, orders, and instructions for road users. The color and shape of a traffic sign contain meanings that are not understood by everyone. The problem in this study is "How is the semiotics of traffic signs in the lateral flare buoy system and cardinal beacon buoy?" This study aims to identify and describe the lateral and cardinal flare buoy systems. The method used by the author in this study is a qualitative method. The results of the color research on the cardinal and lateral buoys show the function and position of the buoy, such as the color on the pole which is yellow on the bottom and black on the bottom or the placement of various colors. The green and red colors on the lateral buoy indicate the position of the sign such as the left or the starboard position of the ship. Likewise with the lateral cardinal shape, if it is pointed at the top, it means that the buoy is on the right, if the lateral buoy is blunt, it means that the buoy is on the left. Abstract

This official school was first established with the FTA 170 Project agreement between the Government of the Kingdom of Belgium and the Government of the Republic of Indonesia on December 19, 1979. In an effort to meet the qualification needs in the field of river and lake transportation traffic, the River and Lake Transportation Training Center was formed (BPL LLASD) based on MENPAN Decree No. 537/5/MENPAN/10/87 dated October 5, 1987 and MENHUB Decree No. 231/HK.602/Phb-87 dated October 21, 1987 which only held short courses for students. In 1990, he received the Diploma III program in River, Lake, and Ferry Transport Traffic (LLASDP). Education and training as well as counseling are held through various training and counseling programs according to needs so that the programs implemented can run efficiently, optimally and effectively. One thing that is very important to realize the development of human resources is through the maximum participation of educational institutions, especially in the field of transportation. With the determination of the organizational structure, of course, we refer to the Regulation of the Minister of Education and Culture of the Republic of Indonesia No. 3 of 2020 concerning National Higher Education Standards. The progress of Polytechnics has increased from year to year so that we have recruited cadets from one study program to 3 study programs, namely the D-III MTPD Study Program, the D-III Ship Engineering Study Program and the D-III Nautical Study Program. From the results of this increase, there is still a lack of infrastructure in the placement of cadets, especially in terms of class facilities with an imbalance between students and cadet facilities.

Abstract

Musi River is a river placed in South Sumatra, Indonesia. The Musi River is also the biggest river with a median width of 504 meters (the widest is 1350 meters round Kemaro Island, and the shortest 250 meters is positioned around the Musi II River Bridge).The only means of transportation that can reach the area is by boat via the Musi River. People use the Musi River as a transportation route to travel from one place to another around Palembang City or to areas far from Palembang City and use ships to travel in order to shop for daily needs, work and others. However, in the operation of the ship on its way there are still accidents, which often occur are accidents caused by human error, besides that there are often obstacles with natural conditions. For example, waves and on every bank of the Musi river, there are lots of tree plants that interfere with the smooth flow of traffic. Recently, in the Musi River there was an accident other than in Akibarka, the natural condition of the accident was caused by human negligence Two speedboats with the brand Rahendi Putra and Five Brothers collided while in the waters of the Musi River, Palembang, South Sumatra (South Sumatra), Wednesday (30/5/2018). Accidents in the Last Two Years Tuesday on the Awet Muda speedboat revealed new facts. In the last two years, the fast boat company has had two accidents that claimed lives.

Abstract

Penelitian ini bertujuan untuk Untuk mengetahui Pengaturan Hukum tentang penyelenggaraan pelabuhan berdasarkan sistem hukum di Indonesia dan untuk mengetetahui kewenangan Pemerintah Daerah dalam penyelenggaraan pelabuhan Berdasarkan sistem Hukum di Indonesia. Metode yang digunakan dalam penelitian ini adalah hukum normatif yang merupakan prosedur penelitian ilmiah untuk menemukan kebenaran berdasarkan logika keilmuan hukum dari sisi normatifnya yang berkaitan dengan implikasi pemberlakuan asas Cabotage dalam pelayaran Indonesia terhadap eksistensi perusahaan angkutan laut nasional dalam kegiatan perdagangan bebas. Hasil penelitian menunjukan bahwa pengaturan hukum penyelenggaraan pelabuhan secara diatur dalam Peraturan Pemerintah No. 61 Tahun 2009 tentang Kepelabuhanan. Peraturan tersebut dibentuk untuk melaksanakan ketentuan Pasal 78, Pasal 89, Pasal 95, Pasal 99, Pasal 108, Pasal 112 ayat (2), Pasal 113, dan Pasal 210 ayat (2) Undang-Undang Nomor 17 Tahun 2008 tentang Pelayaran, yang mengatur mengenai Tatanan Kepelabuhanan Nasional, Rencana Induk Pelabuhan serta Daerah Lingkungan Kerja dan Daerah Lingkungan Kepentingan pelabuhan, penyelenggaraan kegiatan di pelabuhan, pembangunan dan pengoperasian pelabuhan, terminal khusus dan terminal untuk kepentingan sendiri, penarifan, pelabuhan dan terminal khusus yang terbuka bagi perdagangan luar negeri, dan sistem informasi pelabuhan Penerapan UU No. 23 Tahun 2014, pada dasarnya bahwa pemerintah daerah menjalankan aturannya yaitu untuk mengatur dan mengurus rumah tangganya sendiri.

Abstract

Kejahatan perang merupakan suatu istilah yang lebih tepat diartikan sebagai pelanggaran terhadap hukum humaniter. Dikatakan sebagai kejahatan karena tindakan tersebut melanggar hukum perang atau hukum humaniter internasional yang menimbulkan adanya tanggungjawab individu. Kejahatan perang dapat terjadi pada konflik bersenjata, hal tersebut dapat diakui dan dinyatakan dalam berbagai kasus yang terjadi dan telah memiliki suatu putusan dengan kekuatan hukum tetap maupun yang sedang dalam proses pemeriksaan di pengadilan internasional. Penelitian ini bertujuan untuk mengkaji dan menganalisis lebih dalam lagi mengenai kriteria kejahatan perang di tinjau dari hokum internasional. Penelitian ini menggunakan metode metode analisis data yang dipergunakan adalah metode analisis kualitatif dengan menggunakan pendekatan normatif (yuridis normatif) yaitu pendekatan penelitian hukum (approach) yang digunakan dalam penelitian ini yaitu pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), pendekatan perbandingan (comparative approach). Hukum Perang (Humaniter) tidak bertujuan untuk melarang perang, atau untuk mengadakan undang-undang yang menentukan aturan permainan dalam perang, tetapi demi alasan kemanusian untuk mengurangi atau membatasi penderitaan individu-individu dan untuk membatasi wilayah dimana kekuasaan konflik bersenjata diperbolehkan. Melalui alasan-alasan ini hukum humaniter disebut sebagai “peraturan tentang perang berperikemanusiaan”. Kesimpulan pada pembahasan di atas adalah hukum humaniter mencoba untuk mengatur agar suatu perang dapat dilakukan dengan lebih memperhatikan prinsip-prinsip kemanusiaan. Adapun dasar hukum yang dipakai dalam penulisan ini adalah Konvensi Den Haag 1907, Konvensi Jenewa 1949 dan Pasal 8 Statuta Roma 1998.

Abstract

Berlakunya KUHAP telah menimbulkan perubahan mendasar baik secara langsung dan konsepsional maupun secara implementasi terhadap tata cara penyelesaian perkara pidana Indonesia. Salah satu persoalan yang muncul adalah permohonan Peninjauan Kembali (PK) yang diajukan oleh Jaksa Penuntut Umum (JPU). Penelitian ini bertujuan untuk mengetahui permohonan peninjauan kembali (PK) oleh jaksa penuntut umum (JPU) dalam perspektif hukum progresif. Penelitian ini menggunakan metode analisis data yang dipergunakan adalah metode analisis kualitatif dengan menggunakan pendekatan normatif (yuridis normatif) yaitu pendekatan penelitian hukum (approach) yang digunakan dalam penelitian ini yaitu pendekatan perundang-undangan (statute approach), pendekatan konseptual (conceptual approach), pendekatan perbandingan (comparative approach). Berdasarkan uraian di atas, Subtansi Peninjauan Kembali (PK) berpijak pada dasar, bahwa negara telah salah mempidana penduduk yang tidak berdosa dan tidak dapat lagi diperbaiki dengan upaya hukum biasa melainkan harus dengan upaya hukum luar biasa yaitu Peninjauan Kembali (PK). Demikian Peninjauan Kembali (PK) bukan saja dipertuntukan kepada terpidana atau ahli warisnya melainkan juga dapat diberikan kepada Jaksa Penuntut Umum, atas dasar keadilan dan asas keseimbangan. Urgensi untuk memberikan ruang kepada Jaksa Penuntut Umum mengajukan permohoan Peninjauan Kembali (PK) adalah untuk mewujudkan keadilan substantif. Memperluas pihak-pihak yang dapat mengajukan Peninjauan Kembali (PK) dalam Pasal 263 KUHAP sebagai terobosan hukum (rule breaking) untuk mendapatkan tujuan hukum yang maksimal. Kesimpulan dalam penelitian ini bahwa permohonan upaya hukum luar biasa Peninjauan Kembali (PK) oleh Jaksa Penuntut Umum (JPU) dalam perspektif Hukum Progresif adalah sebagai terobosan hukum (rule breaking) terhadap KUHAP.

Abstract

Indonesia as a state of law, it is not surprising that the issuance of new laws is often carried out, either through laws, regulations, regional regulations or other things. One of the hotly discussed regulations is the Job Creation Act. The existence of the job creation law certainly provides changes to the previously applicable regulations so that the government must be able to adapt quickly. For this reason, this research was conducted to determine the implications of the implementation of the Job Creation Act on the implementation of government administration. The research approach used is qualitative with a normative juridical type, namely through a literature review. In addition, data collection techniques are also through interviews, observation and distributing questionnaires to selected respondents through purpose sampling techniques. The result of this research is that the implementation of the Job Creation Act has implications for the implementation of government administration, specifically in the areas of authority, discretion, electronic decisions, and positive fictitious.

Abstract

The president as an executive agency can make regulations called presidential regulations (Perpres). The formation of the Presidential Regulation is used as a guideline by citizens in carrying out their daily lives. Unfortunately, not all presidential regulations are in line with religion and moral law so that they get pros and cons from the public, as is the case with Presidential Decree No. 10 of 2021 concerning the Investment Business Sector, to be precise in appendix 2 regarding liquor investment. This study was conducted to analyze the presidential regulation from the perspective of moral and religious law. This research was conducted with a qualitative approach through the type of normative juridical research and delivered descriptively. The technique of collecting data is through literature review, interviews, observation and distributing questionnaires through the g-form. Based on the results of the study, it is known that Presidential Decree No. 10 of 2021 concerning the Investment Business Sector, precisely in Appendix 2 regarding investment in liquor is contrary to Islamic religious law. Whereas in the moral law there are pros and cons, the cons are more than the pros. This is proven by the repeal of this Presidential Regulation and the issuance of Government Regulation No. 49 of 2021 regarding Amendments to Presidential Regulation No. 10 of 2021 concerning the Investment Business Sector.

Abstract

North Maluku province that thousands Kota Ternate is located at the foot of Mount Gamalama for 11 (eleven) years and after 11 (eleven) years of transition and preparation of infrastructure, capital of North Maluku province was transferred to the City of Sofifi located on Halmahera Island is an island greatest. Abstract

Transportation needs in an area caused by the interaction between social and political activities, as well as tourism in the area. Transportation plays a very important role in the success of the development of an area, which has a role as a liaison between one region and another separated by the presence of water, the role of transportation is also very closely related to development, and stimulates new activities in the development of the transportation system into a very important and very useful role in the smooth development of the wheel, strengthening unity and unity that affects all aspects of life. The conditions of West Lombok Regency which is close to Bali Island which is separated by the Lombok Strait, this causes crossing transportation is the main transportation of goods or passengers that can be reached by the community in supporting equitable development. Crossing transportation has an important role to provide support for economic growth, especially crossing. The position of transportation becomes one of the decisive elements in order to guarantee the economic development of the community. As the economy progresses, the role of transportation increases. This is due to the economic dependence on transportation to be greater because it must always be guaranteed smoothness in the flow of goods and passengers quickly, cheaply and safely from Padangbai Port to Lembar Harbor or vice versa. Lembar Crossing Port is one of the Crossing Ports located in West Lombok Regency which serves the Lembar - Padangbai Crossing. At the Crossing Port Lembar there is a ferry transportation company operated by PT. Indonesia Ferry ASDP Branch of Lembar.
