Abstract

The territory of the Republic of Indonesia is very wide covering many large and small islands, so it is not possible if everything will be managed entirely by the Government which is domiciled in the State Capital, to manage the administration of state government to all corners of the country, it is necessary to form a regional government. Local governments and village governments have shifted from a centralized system of government to a decentralized one so that providing services to the public is closer and can be done optimally. This implementation brings a lot of hope to the improvement, management, and quality of local performance. This study aims to examine the role of the Village Consultative Body (BPD) in the Village Government and what factors hinder the role of the Village Consultative Body (BPD) in the Village Government in Karang Jaya Village. This research is a descriptive type of research, namely a study that describes the phenomena of a BPD cooperation management with the village head, thus the approach used is the normative approach. The results show that the BPD in Karang Jaya village has not been able to carry out its role optimally because the human resources of BPD members are still low, especially in the education sector so that in carrying out its roles and functions the BPD does not understand what to do concerning the control and supervisory functions. becomes its authority in controlling and supervising the performance of the Village Government / Village Head.

Abstract

In principle, forest and forestry management is a management process for all components of the ecosystem, including humans. Utilization of forests to facilitate economic growth has eliminated the interests of customary forest communities, the rights of indigenous peoples have been protected as human rights, as stated in Law Number 39 of 1999 concerning the basic provisions of human rights. The people of Buru District, Grandeng Village, have an area of forest area for other uses of around 600 hectares which can be used for the benefit of local communities, but there are often problems between the Transmigration Community and Indigenous People who have unresolved ownership of land areas based on customary law, as well as the involvement of the local government Buru Regency in providing solutions to problem-solving, the method used is descriptive qualitative with interview instruments and a review of legal documents related to the research theme. The results that can be conveyed are the utilization of Customary forest products and their management by the community in Lolongguba sub-district, often in coordination with Hinolong Baman or the Head of Soa, which means that legally the implementation of the Constitutional Court Decision, No.35 / PUU-X / 2012 concerning the Existence of Community Customary Forests has been implemented in the community, however, the institutionality of the Waeapo Plains Indigenous Peoples has not been maximized, both in the implementation of customary law norms, as a result of factors, human resources, economy, social and Indigenous institutions themselves. Based on legal research, it is necessary to formulate a legal umbrella both government regulations and regional regulations regarding ownership of forests and forest products.

Abstract

The aims of the study are as follows: (a) What factors influence early marriage? b) What are the effects of early marriage on the rights of children? This is normative legal study, i.e., legal research that seeks to identify procedures, standards, or das sollen. This research was undertaken through library research in order to gather secondary data, including primary and secondary legal texts. Primary legal materials are binding legal documents, such as marriage and children's rights legislation. Comparatively, secondary legal materials are those that provide an explanation of the primary legal resources. The findings of the study indicate that marriages done below the legal age restriction are prevalent. Marriage demands psychological maturity, thus age restrictions are extremely crucial. Multiple factors, including environmental factors, health considerations, family parenting factors, and economic aspects, contribute to the occurrence of early marriage. Early marriage will have an effect on the non-fulfillment of statutory children's rights, such as the child's right not to be separated from his parents, the child's right to receive an appropriate education, and the child's right to obtain protection.
