Abstract

Amidst the rise of textual and literal approach of Islam, the spirit and the purpose of Islamic law are often overlooked. The application of Islamic law should be able to go hand in hand with the changing dynamics of the times. As many novel legal issues take place, Muslim jurists must respond with adequate solution bearing in mind the spirit and purposes of Islamic law for the welfare of human being. This article discusses Ibrahim Hosen, an Indonesia Muslim jurist of the 1980s who upheld this principle in his fatwas. As the chairman of fatwa issuing body of Indonesian Ulama council at the time, he was in the forefront of delicate situation of positioning Islamic law in the modern context. His idea of “mem-fiqh-kan yang qath’i” which means redefining the absolute aspect of Islamic jurisprudence created considerable impact on the application of Islamic law in Indonesia. It did make him a controversial muslim jurist, aspecially after he issued several controversial legal opinions (fatwa), namely the lawfulness of national lottery and lawfulness of beer on which the majority of Indonesian Muslim jurists considered as gambling and liquor.

Abstract

National jurisprudence is actually a response to the discourse on the relationship between religion and the State. Some Islamic groups who have the view of Islamic religious and political unity (al-Islam din wa daulah) that the three concepts are a complete and inseparable unity. The others said that the unity of religion and the State had ended when finally of al-Khulafa 'al-Rashidun. This matter when contextualized in Indonesia also becomes a long debate about the shape of the Indonesian state. Some want Islam to be the basis of the state and others want a nation-state. This is where national jurisprudence emerges as a way of looking at the relationship between religion and the State. Nahdlatul Ulama (NU) as an Islamic organization since the beginning of the emergence of the State has very strong national fiqh nuances. NU's acceptance of the nation-state as a form of State is evidence of this. With this manhaj fiqh siyasah, NU introduced the building of national political arguments without leaving Islamic teachings. Indonesia as a plural country is certainly the choice of the nation-state is the most ideal choice because it can minimize the potential for discrimination.   Abstrak: Fikih kebangsaan merupakan respons atas wacana hubungan agama dan Negara. Sebagian kelompok memandang bahwa agama dan politik Islam (al-Islam din wa daulah) merupakan kesatuan yang utuh tak terpisahkan. Sebagian lain menyatakan bahwa kesatuan agama dan Negara itu sudah berakhir dengan selesainya al-Khulafa’ al-Rashidun. Dan ketika dikontekstualisasi di Indonesia menjadi perdebatan yang cukup panjang tentang bentuk Negara Indonesia. Sebagian menghendaki agar Islam menjadi dasar negara dan sebagian yang lain menghendaki nation-state. Di sinilah kemudian muncul fikih kebangsaan sebagai cara pandang dalam melihat hubungan agama dan Negara. Nahdlatul Ulama (NU) sebagai organisasi Islam sejak awal munculnya Negara sudah sangat kental nuansa fikih kebangsaannya. Penerimaan NU atas nation-state sebagai bentuk Negara menjadi bukti akan hal itu. Melalui manhaj fiqh siyasah ini, NU mengenalkan bangunan argumentasi politik kebangsaan tanpa meninggalkan ajaran Islam. Indonesia sebagai Negara yang plural tentu pilihan nation-state merupakan pilihan yang paling ideal karena dapat meminimalisasi potensi diskriminasi.

Abstract

Modernization to deliver the process in diversifying the socio-economic role of pesantren is undeniable things. Consequently, pesantren must take immediate action if they want to maintain their role and function. In this context, this article wants to describe the widespread mandate of a pesantren in Jember, namely Pesantren Nurul Qornain (PNQ), those takes part –not only empowerment in the field of education- but also play role in the development of economic enterprises. This is then reviewed in the perspective of maqashid al-shari’ah (the purpose of shari’a). Throughout qualitative study, this article explains that pesantren alumni and local society involved in the management of PNQ economic enterprises. Some of developed business unit in the area of agriculture, trading, animal farm, plantation, and mining. Furthermore, the main factor behind PNQ in managing economic enterprises is pesantren sovereignty. It is initiated by kiai (the leader of pesantren). According to him, pesantren can develop rapidly if they sovereign in all aspects. This sovereignty is interpreted as economic sovereignty. However, economic development is as determining factor in supporting the existence of pesantren. Additionally, the development of economic enterprises carries out by PNQ in line with the value of hifdhul maal (the maintenance of property). Hence, it is prospective benefits if it can be replicated by Islamic educational institution nowadays.

Abstract

Abstract:This research aims to elaborate on tax amnesty according to the provision set forth in Law Number 11 of 2016 seen from the perspective of fiqh al-ḍarībah or Islamic taxation. This library research studied secondary data sourced from books, journals, or other references. All the data were analyzed based on a content analysis technique. The research results reveal that tax amnesty is a breakthrough established by the government to expedite economic growth and restructure the economy by transferring assets, considering that this measure can increase domestic liquidity, increase exchange rate, decrease interest rate, and increase investment. Tax amnesty is part of the taxation reform paving into more just taxation and a more valid, comprehensive, and integrated taxation database. The values obtained from this tax collection should contribute to national development. From the perspective of fiqh al-ḍarībah, tax amnesty is within the study of mu'āmalah ijtihādiyyah, where the government is authorized to make laws concerning taxation and adheres to the principles of welfare and justice for citizens. The government is also responsible to decide the amounts of taxes to be paid by taxpayers. Ulama, however, suggested that there should not be any likelihood that taxation is perceived as a burden by people and that the collected taxes are intended for immoral conduct. Moreover, taxation is decided in deliberation. If all these requirements are not fulfilled, taxes collected may represent sinful conduct or injustice.

Abstract

The flow of digital developments has a positive impact on education. Therefore, teachers and students can collaborate in presenting creative and innovative learning that encourages the realization of critical thinking skills in students. This applies to every subject, including the subject of Islamic Religious Education (PAI). This study aims to explain the effectiveness of applying the flipped classroom learning model to increasing students' critical thinking skills in PAI subjects in class XII MIPA SMA Negeri 1 Krembung Sidoarjo. The research method used is the experimental method with the One Group Pretest-Posttest design to explain students' critical thinking skills after applying the flipped classroom learning model. The results of the study show that the application of the flipped classroom learning model has effectiveness in increasing the critical thinking skills of class XII MIPA students in PAI subjects. This is evidenced by the results of the Sig. (2-tailed) which is equal to 0.000. This value indicates (less than) <0.05 of the significance level in the Paired Sample T-Test. Therefore, the flipped classroom learning model can be recommended for its application to improve students' critical thinking skills in PAI subjects at school.
