Abstract

Pajak mempunyai peran yang sangat penting bagi keuangan negara. Melalui reformasi perpajakan, Indonesia melakukan pembaruan hukum pajak yang diperkuat dengan sanksi administratif dan pidana. Untuk mengoptimalkan pemasukan keuangan negara melalui pajak, penyelesaian pelanggaran hukum pajak lebih mengedepankan penyelesaian secara administratif, dari pada melalui sistem peradilan pidana. Tulisan ini mengkaji bagaiman wujud tindak pidana perpajakan dan bagaimana pengaturan fungsi sekunder hukum pidana dalam penanggulangan tindak pidana perpajakan. Penelitian dilakukan dengan metode penelitian hukum normatif dengan mengkaji dan menganalisis undang-undang perpajakan. Hasil penelitian menunjukkan bahwa tindak pidana perpajakan ditujukan baik kepada wajib pajak, petugas pajak atau pihak terkait dengan pajak seperti konsultan pajak. Sanksi pidana perpajakan yang lebih mengedepankan denda serta dengan melipatgandakan dendanya. Pengaturan fungsi sekunder hukum pidana tercermin dari dimungkinkannya penyampingan perkara berupa penghentian penyidikan, sepanjang kerugian negara telah dipulihkan dengan membayar kewajiban pajak disertai dendanya. Oleh sebab itu, penyelesaian tindak pidana perpajakan harus tetap lebih mengedepankan kepentingan pemasukan keuangan negara, melalui penyampingan perkara serta penerapan sanksi administratif. Penyelesaian melalui peradilan pidana baru dilaksanakan apabila kerugian negara tidak dapat dipulihkan.  Dengan demikian bila kerugian negara tidak dapat dipulihkan, penyelesaian melalui peradilan pidana harus tetap dilaksanakan untuk menjamin menegakan hukum perpajakan dan kepatuhan wajib pajak

Abstract

Criminal law policy about criminal punishment is one of the most important substances in Criminal law making and reform. Even, the regulation of criminal punishment is assumed as one of indicators in measuring the development and civilization of a nation.  The current Penal Code of Indonesia (PCI) or KUHP that is the heritage of Dutch colonial is much influenced by Classical School and placed imprisonment as priority.  The consequence is that in one hand the high rate of imprisonment and over-capacity in the prison on the other hand. Such a condition will result in problems such as the diffulties conducting rehabilitation and providing the budgeting.  In its development, modern criminal law, especially from the the idea of utilitariansme, tries to find various alternatives to imprisonment, especially Monetary Punishment.  Even though PCI has adopted regulation on monetary punishment, the existing system still places imprisonment very dominant.  The Indonesian legislator which is currently hearing the Bill of PCI to replace the current PCI should foster the function of monetary punishment so that it results in the utility for the people. This article is discussing about how criminal law policy   about the monetary punishment regulated in Bill of PCI.  This study applies normative legal research and put stressing in (content analysis). The result of this study shoes that Bill of PCI has not yet placed monetary punishment as first priority in criminal punishment. There are some regulations that make it is not possible for monetary punishment is more selected in criminal enforcement. Therefore, Bill of PCI should be more accommodative in optimizing financial punishment in   realizing criminal punishment for the benefit of the people.

Abstract

Permasalahan penelitian ini adalah unsur seperti apa yang menjadi bahan pertimbangan  penuntut umum dalam membuktikan tuntutannya terhadap tindak pidana penipuan online dengan menerapkan Pasal 378 KUHP dalam Putusan Nomor 89/Pid.B/2017/Pn.Spn. Metode dalam penelitian ini menggunakan pendekatan yurudis normatif, serta didukung juga dengan pendekatan yuridis empiris dikarenakan penulis melakukan penelitian hukum terhadap perkara pidana  putusan (No:89/Pid.B/2017/N.Spn). Jenis data dalam penelitian ini menggunakan data primer juga data sekunder. Analisis data yang penulis gunakan juga menggunakan analisis kualitatif. Hasil penelitian dapat disimpulkan bahwa: penuntut umum  mempertimbangan alat-alat bukti, fakta persidangan, kronologi kasus tindak pidana, serta berkas perkara yang dari awal telah disangkakan oleh penyidik dengan menerapkan Pasal 378 KUHP. Penuntut umum berkeyakinan bahwa unsur yang diperbuat oleh terdakwa terdapat dalam Pasal 378 KUHP. Namun, tuntutan tersebut merupakan kekeliruan karena tidak sesuai dengan aturan khusus (lex specialis) yaitu Undang-Undang Nomor 19 Tahun 2016 tentang Informasi dan Trnsaksi Elektronik.

Abstract

In order to overcome crime in economy, there have been several related statues. The success of a statue to reach the goals, it really depends on the criminal law policy contained in the statues. In fact criminal law policy in the statues relates to economic crime is not consistent, synchronized and harmonized with each others. It is proved in the formulating a crime, elements of crime, criminal liability and the punishment. Inconsistency and inharmonic also exist in formulating of its criminal law procedure such as coordination among related law enforcement agencies. In order to support the success of law enforcement of economic criminal law, there should be consistency synchronization and harmonization of regulation related to economic crime. Abstract

In the consideration of Law No. 23 of 2003 regarding Child Protection, it is stipulated that a child is bud, potential and young generation who will become the successor for aspiration of nation struggling and hold strategic value in securing the existence of this nation in the future. That why this law obligates the state and government to provide special protection for child in any condition. In Law No. 11 of 2012 regarding Juvenile Criminal Justice System, the protection is given by establishing special court for children who are committing a crime, which is separated from adult court. This law also mandates as a mandatory that the law enforcement agencies in each stage of criminal justice should apply diversion in solving any child crime or child in conflicting with law. For the police, which stand in the first row of criminal justice system, diversion process is actually can be applied by some procedures available. Those procedures are through the implementation of police discretion, penal mediation, and restorative justice or by solving trough adat law process. The implementation of those procedures in one hand will provide strong protection for child’s rights and on the other hand will secure the best interest of child.

Abstract

The illegal circulation and drug abuse crime are one of the crimes that endangers to the life of the nation and state. The National Narcotics Agency (BNN) report an increase in drug abuse victims and its prevalence. This condition requires an effort to overcome both through the penal and non-penal policy. West Sumatera with its Minangkabau Adat (customary) Society has its own Adat Law as traditional values ​​specifically in the form of the nagari government system and the nagari customs. This paper discusses how the values ​​of adat law can be functioned as a non-penal policy in fighting drug abuse crime. The study applied empirical legal research with several villages as samples. The result of the study reveals that the role of the nagari in combating drugs abuse just supports the programs carried out by other government agencies. Nagari does not have a special program in the prevention and eradication of drugs. Only some Nagaris that have their own rules in the form of nagari regulations that specifically regulate the prevention and eradicating drug abuse. Nagari as a government institution has the authority and mission to carry out governance based on customary law in addition national law. Minangkabau customary law contains with philosophical values ​​that can play a role and be utilized as a basis for making nagari regulations and a basis for implementing governance, especially in efforts to eradicate drug crime. These various values willn ​​strongly support efforts to prevent and overcome the problem of drug abuse such as, strengthening religious values, strengthening the values ​​of togetherness and solidarity between and among each other and strengthening leadership values

Abstract

Secondary function of criminal law indicates that criminal law will only be needed if other legal norms cannot protect the society. However, the reality shows that more criminal laws enacted and more criminal sanction are applied, especially in Economic Criminal Law. That phenomenon may lead to over-criminalization. The research concludes that there is no synchronization in the implementation of secondary function of criminal law both in formulation and implementation of criminal law. Therefore, there should be synchronization in implementing the secondary function of criminal law, and in turn it will support synchronization among law enforcement official.

Abstract

Corruption has penetrated into all aspects of people’s life in Indonesia as nation and state, as well as to the communities in rural areas. Corruption occurs in all fields, such as politics, education, religion, and social affairs, including in the distribution of earthquake relief fund in West Sumatra. One of the Corruption Court’s decisions in Padang, has sentenced several chairmans of Community Group, which has been formed to coordinate the distribution of the fund, due to corruption. Corruption by the low level people in the countryside is very different from the the corruption’s shape by state officials. They often happened due to lack of information that it is a form of corruption rather than habbits in community practices. This fact is precisely found in the distribution of reliefs fund in Kenagarian Pakandangan, the province of Padang Pariaman. Debriefing Program conducted by the lecturers from the faculty of law, Andalas University, brings substantial benefits to citizens in Pakandangan, in understanding the shape and behaviors of corruption. In general, people want this program to be continued in the following years, and given not only to adult but also to students, ranging from elementary to higher education.

Abstract

AbstrakKebijakan hukum pidana mengenai pidana dan pemidanaan merupakan salah satu bagian penting dalam  pembaruan hukum pidana, bahkan dipandang sebagai salah satu indikator dari kemajuan kemajuan suatu bangsa. KUHP sekarang sebagai warisan Belanda, masih sangat dipengaruhi oleh aliran klasik dan menempatkan pidana penjara sebagai primadona. Akibatnya adalah tingginya tingkat pemenjaraan, sekaligus berdampak kepada terjadinya kelebihkan kapasitas di lembaga pemasyarakatan, sekaligus pada masalah pendanaan dan pembinaan terhadap narapidana. Oleh sebab itu, hukum pidana modern, berupaya untuk mencari berbagai alternatif bagi pidana penjara, salah satunya adalah pidana  harta kekayaan (monetary sanction). Walaupun KUHP telah memuat ketentuan mengenai pidana harta kekayaan, yakni pidana denda, namun umumnya masih sebagai alternatif dari pidana penjara. Artikel ini membahas kebijakan hukum pidana mengenai pidana harta kekayaan dalam Rancangan Undang-Undang (RUU) KUHP. Penelitian dilakukan  dengan menggunakan metode penelitian hukum normative yakni melalui content analysis. Hasil kajian menunjukkan bahwa kebijakan hukum pidana mengenai pidana harta kekayaan masih berperan sebagaialternatif dari pidana penjara pada sebagian tindak pidana, sehingga tidak akan berdampak kepada pengurangan kelebihan kapasitas di lembaga pemasyarakatan. Oleh sebab itu RUU KUHP harus lebih menempatkan pidana harta kekayaan sebagai pidana pokok yang mandiri tidak sebagai pengganti pidana penjara, sehingga dapat membantu mengatasi kelebihan kapasitas di lembaga pemasyarakatan. Kata Kunci:  kebijakan hukum pidana, pidana dan pemidanaan, pidana harta kekayaan AbstractCriminal law policy regarding sentence and sentencing is an important part in the criminal law reform. The result is that a high level of imprisonment and then caused over-capacity in the prison, as well as problems with funding and rehabilitation for the prisoners. Therefore, modern criminal law, seeks to find various alternatives to imprisonment, one of which is that monetary sanction. Although the Criminal Code has included provisions regarding monetary sanction, namely fines, it is generally still as an alternative to imprisonment. This article is discussing the criminal law policy regarding monetary sanction in the bill of Criminal Code. The study was conducted using normative legal research methods namely through content analysis. The results of the study indicate that the criminal law policy regarding monetary sanction still acts as an alternative to imprisonment in most of criminal acts, so that it will not have an impact on reducing excess capacity in the prison. Therefore, the bill of Criminal Code should place the monetary sanction as an independent main punishment, not as a substitute for imprisonment, so that it can help overcome over capacity in the prison. Keywords: Criminal Law Policy, sentence and sentencing, monetary sanction

Abstract

AbstrakSalah satu kebijakan pemerintah dalam pemerataan pembangunan adalah program dana desa yang dikelola langsung oleh pemerintahan desa. Namun  menurut Indonesia Corruption Watch (ICW) Dana Desa sangat rawan penyalahgunaan. Selama tahun 2021 terdapat 154  dan nilai kerugian sebesar Rp.233. Oleh sebab itu perlu upaya untuk pencegahan terjadinya tindak pidana korupsi dalam pengelolaan dana desa. Dalam upaya pemberantasan  korupsi Perserikatan Bangsa-Bangsa (PBB), melalui  United Nation Convention Against Corruption (UNCAC) Tahun 2003 mengamanatkan perlunya mengebangkan kebijakan kontrol sosial yang melibatkan peranserta masyarakat. Di Sumatera Barat, pengelolaan dana desa sebagian besarnya dilasanakan oleh pemerintahan nagari sesuai dengan otonomi yang dimiliki. Penelitian ini dilaksanakan dengan metode penelitian hukum sosiologis yakni untuk melihat penerapan hukum secara konkrit (in conctreto) di tengah masyarakat. Penelitian menghimpun data primer di pemerintahan nagari. Data yang terkumpul akan diolah secara kualitatif. Wawancara dilakukan dengan narasumber yang ada di nagari yakni dengan pemuka masyarakat. Hasil penelitian menunjukkan bahwa partisipasi masyarakat dalam pengelolaan dana desa dilaksanakan di semua tahapan, baik dalam perencanaan melalui Musrembang, dan dalam pelaksanan. Partisipasi dalam pengawasan dilaksanakan sesuai dengan aturan negara dan aturan hukum adat yang ada di nagari melibatkan semu komponen nagari. Partisipasi masyarakat dalam pengelolaan nagari sangat urgen dalam keberhasil pengelolaan dana desa karena perencanaannya sesuai dengan aspirasi masyarakat. Partisipasi masyarakat perlu dioptimalkan melalui suatu sistem partisipasi masyarakat secara lebih komprehensif.
