Abstract

Nowadays, corruption is still the most and biggest problem facing by Indonesian, due to its impacts on the nation. It caused huge loss to the state finance and even to the democratic life in this country. Various efforts have been resorted to fight corruption, but the results are unfruitful. Until recently, Indonesia is still the third most corrupt country in Asia according to the survey of Transparency International Indonesia (TII) in 2015, with the Corruption Perceptions Index of 36 points. The fight in eradicating corruption cannot be separated from the effort to deter the criminals through severe punishment. However, ICW’s most recent data shows otherwise. During the first half of 2014, there were 261 accused of corruption, with 242 of them were convicted guilty by the Corruption Courts. Among them, 193 were sentenced lenient (between 1-4 years imprisonment), 44 moderate (4-10 years), and only 4 with over 10 years imprisonment. The average length of sentence is therefore 2,9 years. The lenient sentence can also be found in criminal restitution. Only in 87 of the total cases state compensation is imposed, amounting 87.04 billion rupiahs in total. The amount is only 0.022% of the total financial loss of 3.863 trillion rupiahs. The weak penalty triggered then the idea of impoverishing corruptors as a strategic step to accelerate the eradication of corruption while restoring the loss to the state. In contrast to the criminal restitution, which is restricted only to the state loss caused by the perpetrators, criminal confiscation of assets has no limit in amount.

Abstract

Indonesia is a plural country with a lot of diversities in it. As a country that embracing positivistic in law perspective, Indonesia is applying the codification of law that has most popular maxim: the certainty of law. That maxim can reduce traditional law that believed by indigenous people. This paper talks about possibility of criminal law in traditional law perspective in Indonesian plural culture.

Abstract

Investigation of corruption, as an extra ordinary crime is granted to the three institutions, namely the Police, Attorney General and the Indonesian Corruption Eradication Commission (KPK). The granting of authority to these three institutions aims to accelerate the eradication of corruption, not only detrimental to the finances and the economy of the country but has damaged the joints of life of the nation and state. The research is descriptive and uses a normative juridical approach. Aiming to find out, and analyze qualitatively the implications of regulating investigative authority over the eradication of corruption in Indonesia. The study found that all three institutions that were given the authority to investigate corruption crimes were administratively separated, but functionally these three institutions should collaborate to accelerate the eradication of corruption, but in practice this was not the case, each institution tended to be shackled by fragmentary and institutional nature. centric that does not support the eradication of corruption. This is because the regulation of the authority of each institution has not been strictly regulated, then the arrangements are not synchronized and among the existing legislation, so that there is overlap of authority due to differences in interpretation between investigators, which results in investigations not going well.

Abstract

 AbstractVillage enterprise is an enterprise which whole or few part of its capital owned by village, with a direct participation that originated from the wealth of village which being separated in purpose of asset managements, services and many other industries, purely for the sake of villager's prosperity. One of Village Enterprise in Sawahlunto named "Taratak Bancah Sejahtera" which is one (1) of the first three (3) Village Enterprises that Established back in 2016, not only the establishment carved on Village Ordinance, but it is also carved on notarial deed, which is in all legislation, there is no regulation that stated the establishment of Village Enterprise require notarial deed. Regarding all of that matters, the writer concludes problems which are, 1. How is the substantive explanation  of the Taratak Bancah Sejahtera establishment deeds? 2. How the responsibilities of Notary in creating the establishment deeds of Village Enterprise? The methods to complete this project were normative-juridic According to the result of the project, 1) in the explanation of article 87 section (1) government ordinances number  43 year 2014, it was strictly stated that Village Enterprise specifically can't be compared to anything like the regular share based company, limited partnership company, or a cooperative economic enterprises. The Taratak Bancah deeds of Establishment contains constitutional rules of Taratak Bancah Sejahtera enterprise. The legal impact of the deeds of Establishment of Taratak Bancah Sejahtera causes the parties involved in this scenario aren't bonded legally, causes the obscureness of the deeds authenticity so the deeds doesn't have the power to prove anything legally completely, and can be nullified for the sake of law by the judge. 2. Notary doesn't have the authority to create the deeds of Village Enterprise establishment. But, they are privileged to create the unit of company that based on Village Enterprise. The responsibilities of the notary is the responsibility in criminals, privates, and code of ethics. AbstrakBadan Usaha Milik Desa adalah badan usaha yang seluruh atau sebagian besar modalnya dimiliki oleh Desa melalui penyertaan secara langsung yang berasal dari kekayaan Desa yang dipisahkan guna mengelola aset, jasa pelayanan, dan usaha lainnya untuk sebesar-besarnya kesejahteraan masyarakat Desa. Salah satu BUMDes di Kota Sawah Lunto yaitu BUMDes Taratak Bancah Sejahtera yang merupakan (1) satu  dari (3) tiga BUMDes yang pertama kali berdiri di tahun 2016 selain pendiriannya dengan Peraturan Desa juga dituangkan ke dalam akta notaris, yang mana didalam peraturan perundang-undangan tidak menjelaskan pendirian BUMDes dibuat dalam bentuk akta Notaril. Berdasarkan hal tersebut,maka penulis merumuskan permasalahan yaitu 1.  Bagaimana Subtansi Akta Pendirian Badan Usaha Milik Desa Taratak Bancah Sejahtera? 2. Bagaimana Tanggung Jawab Notaris Dalam Pembuatan Akta Pendirian Badan Usaha Milik Desa?. Metode penelitian dalam penelitian ini adalah yuridis normatif, Berdasarkan hasil penelitan 1) Dalam penjelasan Pasal 87 ayat (1) PP Nomor 43 tahun 2014, dinyatakan secara tegas bahwa BUMDes secara spesisifik tidak dapat disamakan dengan badan hukum seperti perseroan terbatas, cv atau koperasi. Akta Pendirian Badan Usaha Milik Desa Taratak Bacah Sejahtera memuat Anggaran Dasar Dan Anggaran Rumah Tangga Badan Usaha Milik Desa Taratak Bacah Sejahtera. 2) Notaris tidak berwenang membuat akta pendirian BUMDes, namun berwenang membuat unit usaha berbadan bukum BUMDes. Tanggung Jawab Notaris berupa tanggung jawab secara perdata, pidana dan berdasarkan kode etik.

Abstract

Criminal law policy about criminal punishment is one of the most important substances in Criminal law making and reform. Even, the regulation of criminal punishment is assumed as one of indicators in measuring the development and civilization of a nation.  The current Penal Code of Indonesia (PCI) or KUHP that is the heritage of Dutch colonial is much influenced by Classical School and placed imprisonment as priority.  The consequence is that in one hand the high rate of imprisonment and over-capacity in the prison on the other hand. Such a condition will result in problems such as the diffulties conducting rehabilitation and providing the budgeting.  In its development, modern criminal law, especially from the the idea of utilitariansme, tries to find various alternatives to imprisonment, especially Monetary Punishment.  Even though PCI has adopted regulation on monetary punishment, the existing system still places imprisonment very dominant.  The Indonesian legislator which is currently hearing the Bill of PCI to replace the current PCI should foster the function of monetary punishment so that it results in the utility for the people. This article is discussing about how criminal law policy   about the monetary punishment regulated in Bill of PCI.  This study applies normative legal research and put stressing in (content analysis). The result of this study shoes that Bill of PCI has not yet placed monetary punishment as first priority in criminal punishment. There are some regulations that make it is not possible for monetary punishment is more selected in criminal enforcement. Therefore, Bill of PCI should be more accommodative in optimizing financial punishment in   realizing criminal punishment for the benefit of the people.

Abstract

The definition of person and non-person always change through legal history. Long time ago, law did not recognize the personality of slaves. Recently, it accepted non-human legal subject as legitimate person before the law. This article examines sufficient conditions for being person in the eye of law according to its particular purposes, and then, analyses the meaning of legal person in criminal law. In order to do that, scientific methodology that is adopted in this research is doctrinal legal research combined with philosophical approach. Some theories regarding person and legal person were analysed, and then the concept of person was associated with the accepted definition of legal person that is adopted in the latest Indonesian drafted criminal code. From the study that has been done, can be construed that person in criminal law concerned with norm adressat of the rule, as the author of the acts or omissions, and not merely the holder of rights. It has to be someone or something with the ability to think rationally and the ability to be responsible for the choices he/she made. Drafted penal code embraces human and corporation as its norm adressat. Corporation defined with broad meaning of collectives. Consequently, it will include not only entities with legal personality, but also associations without legal personality. Furthermore, it may also hold all kind of collective namely states, states bodies, political parties, state’s corporation, be criminally liable.

Abstract

Corruption has penetrated into all aspects of people’s life in Indonesia as nation and state, as well as to the communities in rural areas. Corruption occurs in all fields, such as politics, education, religion, and social affairs, including in the distribution of earthquake relief fund in West Sumatra. One of the Corruption Court’s decisions in Padang, has sentenced several chairmans of Community Group, which has been formed to coordinate the distribution of the fund, due to corruption. Corruption by the low level people in the countryside is very different from the the corruption’s shape by state officials. They often happened due to lack of information that it is a form of corruption rather than habbits in community practices. This fact is precisely found in the distribution of reliefs fund in Kenagarian Pakandangan, the province of Padang Pariaman. Debriefing Program conducted by the lecturers from the faculty of law, Andalas University, brings substantial benefits to citizens in Pakandangan, in understanding the shape and behaviors of corruption. In general, people want this program to be continued in the following years, and given not only to adult but also to students, ranging from elementary to higher education.

Abstract

Karakteristik perkembangan hukum pidana Indonesia ditandai oleh semakin “massive”nya pertumbuhan undang-undang hukum administrasi yang mengandung sanksi pidana,sehingga melahirkan konsep “administrative criminal law”. Hukum administrasi dipertautkandengan hukum pidana disebabkan kurangnya “kepercayaan” kepada sanksi administratif untukmempertahankan norma hukum administrasi, sehingga perlu bantuan hukum pidana. Namunpertumbuhan yang demikian pesat menjadi beban tersendiri bagi hukum pidana yang memilikikemampuan terbatas, sehingga menimbulkan “overcriminalizatin”. Karenanya penggunaandoktrin “ultimum remedium” adalah solusi yang ditawarkan. Doktrin ultimum remedium telahmengalami perluasan makna yang tidak lagi hanya terbatas pada leval kebijakan legislatif;melainkan juga telah memasuki tataran implementasi dalam penegakan hukum. Di Indonesia,doktrin ultimum remedium telah digunakan secara sangat terbatas dalam undang-undang hukumpidana administrasi, seperti UU Lingkungan Hidup. Praktik penegakan hukum secara implisittelah menggunakan doktrin ini sebagaimana tergambar dalam beberapa putusan hakim.Mengingat demikian penting dan strategisnya posisi doktrin ultimum remedium, maka sudahsangat mendesak diterapkan terhadap pelanggaran hukum administrasi. Tidak saja untukmengatasi “overcriminalization”; melainkan juga untuk mengatasi “overcapasity” LembagaPemasyarakatan, sehingga secara ekonomis mengurangi beban negara dan masyarakat. Tapidoktrin ini tidak boleh digunakan secara general dan membabibuta untuk semua jenispelanggaran pidana administratif; melainkan hanya diterapkan secara kasuistis terhadap tindakpidana administrasi yang tingkat kesalahan pelakunya relatif ringan, dan perbuatan relatif tidakmenimbulkan bahaya atau keresahan masyarakat.
