Abstract

Criminal law policy about criminal punishment is one of the most important substances in Criminal law making and reform. Even, the regulation of criminal punishment is assumed as one of indicators in measuring the development and civilization of a nation.  The current Penal Code of Indonesia (PCI) or KUHP that is the heritage of Dutch colonial is much influenced by Classical School and placed imprisonment as priority.  The consequence is that in one hand the high rate of imprisonment and over-capacity in the prison on the other hand. Such a condition will result in problems such as the diffulties conducting rehabilitation and providing the budgeting.  In its development, modern criminal law, especially from the the idea of utilitariansme, tries to find various alternatives to imprisonment, especially Monetary Punishment.  Even though PCI has adopted regulation on monetary punishment, the existing system still places imprisonment very dominant.  The Indonesian legislator which is currently hearing the Bill of PCI to replace the current PCI should foster the function of monetary punishment so that it results in the utility for the people. This article is discussing about how criminal law policy   about the monetary punishment regulated in Bill of PCI.  This study applies normative legal research and put stressing in (content analysis). The result of this study shoes that Bill of PCI has not yet placed monetary punishment as first priority in criminal punishment. There are some regulations that make it is not possible for monetary punishment is more selected in criminal enforcement. Therefore, Bill of PCI should be more accommodative in optimizing financial punishment in   realizing criminal punishment for the benefit of the people.

Abstract

Promoting for betere Human Rights Protection is one of the primary trigger factors that had led the reform movement in 1998. Unfortunately the movement itself must have been occured along with manyseriuously vioiating of human rights. One of them is the enforced disappearance of persons (activist) in 1997-1998 early in the beginning of reform movement. National Commission on Human Rights (Komnas HAM) has investigated the case in 2006 and found that there was a gross violation of human rights. The Commission submitted the report both to the legislative board and to the Attorney General Office. Abstract

Stollen assets recovery is one of the main purpose of eradicating corruption policy in Indonesia. Private lawsuit is one of the mechanisms that can be used to achieve this purpose. This mechanism has been regulated in Law Number. 31 of 1999 as amended by Law Number. 20 of 2001 Concerning the Eradication of Crimes of Corruption. This article analyses the extent to which private lawsuits mechanism in that Law can normatively accommodate the efforts to recover state financial losses due to corruption and the problems faced by State Attorneys in implementing these rules. This study uses both normative and empirical legal research methods. Primary data in this research was carried out by purposive sampling method in several District Attorney offices in West Sumatra. From what has been done, it can be said that the rules regarding private lawsuits in Law no. 31 of 1999 and Law No. 20 of 2001 concerning The Eradication of Crime of Corruption has opened a fairly flexible space for state attorneys to submit private action to recover state financial losses. However, the space provided by these laws and regulations has not been fully utilized by the Attorney General's Office, especially the District Attorney's Office in West Sumatra. There are several problems, both juridical and non-juridical in nature, such as: the problem of proof in the civil case, the misunderstanding of the attorney officer about the rules of private lawsuits in that Law, the problem of tracking assets, and the problem concerning the benefits or profits. In fact, the profits obtained from this private lawsuit do not have a significant impact on efforts to recover state losses.

Abstract

Proses peradilan tindak pidana korupsi yang berlangsung di beberapa pengadilan tipikor, memperlihatkan bahwa korupsi tidak hanya dilakukan oleh individu (perseorangan) melainkan juga oleh korporasi. Dalam beberapa putusan perkara korupsi, indikasi tersebut bahkan tersurat pada pernyataan bahwa kerugian negara dalam kasus tersebut dinikmati oleh korporasi, sehingga korporasilah yang seharusnya dihukum untuk mengganti kerugian negara tersebut (putusan perkara IM2 dan Asian Agri). Namun praktik penegakan hukum terhadap pelaku tindak pidana korupsi hingga saat ini, mencatat hanya sedikit kasus dimana korporasi diadili dan kemudian dihukum sebagai pelaku tindak pidana korupsi, yaitu perkara PT. Giri Jaladhi Wana di PN Banjarmasin dan perkara PT NKE di Pengadilan Tipikor Jakarta. Padahal UU Pemberantasan Tindak Pidana Korupsi telah mengatur pertanggungjawaban pidana korporasi sebagai salah satu upaya luar biasa. Hasil penelitian memperlihatkan adanya kelemahan pada subtansi hukum, yaitu tidak jelasnya indikator menentukan tindak pidana korupsi yang dilakukan oleh korporasi, serta menentukan pihak yang dipertanggungjawabkan. Kelemahan pada subtansi hukum, menjadi salah satu faktor penyebab jarangnya diterapkan pertanggungjawaban pidana korupsi pada korporasi, disamping faktor pada struktur hukum dan budaya hukum internal. Penegak hukum belum memiliki persepsi yang sama tentang pentingnya menerapkan pertanggungjawaban pidana korporasi dalam tindak pidana korupsi dan batasan-batasan dalam menerapkan pertanggungjawaban pidana korporasi dalam perkara korupsi, sebagai bagian dari upaya percepatan pemberantasan korupsi. Pengaturan pertanggungjawaban pidana korporasi dalam UU Pemberantasan Pencucian Uang dapat dijadikan model dalam menentukan pertanggungjawaban korporasi. Proses peradilan terhadap individu dan korporasi dilakukan sekaligus dalam satu berkas. Ini disebabkan terbuktinya perbuatan pelaku sekaligus juga membuktikan perbuatan korporasi, karena korporasi bertindak melalui pengurusnya. Model ini tidak hanya akan mewujudkan asas peradilan cepat, sederhana dan biaya murah, tapi juga menghindari humiliation ganda pada pelaku individu, karena harus mewakili korporasi dalam proses tersebut. Guna meningkatkan penegakan hukum terhadap korporasi korup, perlu dilakukan revisi terhadap UU P-TPK yang dilakukan secara sinergis dengan aturan-aturan dalam UU Nomor 1 Tahun 2023 Tentang KUHP, khususnya pengaturan tentang kriteria penentuan tindak pidana dilakukan oleh korporasi, kriteria pertanggungjawaban korporasi, serta alternatif sanksi pidana yang lebih memenuhi rasa keadilan.

Abstract

Rehabilitasi medis dapat dijatuhkan dalam putusan hakim terhadap terdakwa penyalahgunaan narkotika. Meskipun hal tersebut telah diatur dan diberi ruang dalam Undang - Undang Narkotika, namun terbatas dalam penerapannya. Hal itu tidak hanya tergantung hakim, Penuntut Umum untuk menempatkan rehabilitasi sebagai prioritas dalam dakwaan dan tuntutan. Metode penelitian yang digunakan adalah yuridis sosiologis dan bersifat deskriptif analisis. Hasil penelitian menunjukkan bahwa bentuk dan perumusan dakwaan dalam perkara penyalahgunaan narkotika tergantung kepada kualifikasi pelaku berdasarkan hasil penyidikan dan hasil asesmen terpadu. Dalam hal terdakwa merupakan pecandu dan korban penyalahgunaan narkotika, maka dakwaan tunggal menjadi pilihan dengan tuntutan berupa rehabilitasi. Bentuk dakwaan yang sering digunakan dalam perkara ini adalah dakwaan subsider atau dakwaan alternatif. Dalam bentuk dakwaan ini rehabilitasi medis tidak ditempatkan pada pilihan utama sebagai dakwaan primer pada bentuk dakwaan subsider atau alternatif terakhir pada dakwaan alternatif. Hal tersebut menutup kemungkinan tuntutan rehabilitasi karena Penuntut Umum lebih mengejar pembuktian terhadap pasal dengan ancaman pidananya

Abstract

The objective of this research is to understand the implementation of partial delegation of Regency Head's authority to.Sub-District Head in providing license on Health Affairs in the Margahayu Sub-District, Regency of Bandung, particularlyfor licensing on depot for mineral water replenishment. Based on the research result, it is known that the licensing service on.the depot for mineral water replenishment has not been able to be implemented yet, therefore it has no impact on goal.attainment of authority delegation which is to bring nearer the service access and to improve the quality of service and.working performance marked by the absence of capacity enhancement of the sub-district personnel. Meanwhile, the existing problems can be categorized as follow: 1) Lack of technical support; 2) The unavailability of financial resources and 3) Limitation on Administrative Capacity.

Abstract

ABSTRACTNowadays the development of technology gave us a new civilization. Technology is closely related to the development of science, which its progress can be achieved by a rich reading culture. Reading duration of Indonesian people only 30- 59 minute per a day (less than one hour), meanwhile developed countries have 6-8 hours per a day. Most of Indonesians people more interested on their gadgets than books, they can spend 5,5 hours per a day just to play their gadget. It is really ironic when technology is getting more advanced but our literacy culture is getting lower. Literacy culture can be improved through the mini library enrichment. Garut Regency has similar program to improve its literacy culture. Mini library enrichment which is supporting by PkM program of Politeknik STIA LAN Bandung is expected to more campaigning and improving of village’s literacy culture.ABSTRAKSaat ini perkembangan teknologi telah menghasilkan peradaban baru bagi manusia. Dalam hal ini teknologi berkaitan erat dengan perkembangan ilmu pengetahuan. Ilmu pengetahuan dapat berkembang pesat salah satunya melalui budaya membaca. Durasi waktu masyarakat Indonesia untuk membaca rata-rata hanya 30-59 menit per hari (kurang satu jam), sementara di negara maju rata-rata mencapai 6-8 jam per hari. Sebagian besar orang Indonesia mampu menghabiskan waktu 5,5 jam sehari untuk bermain gawai atau gadget. Hal ini sungguh ironis manakala teknologi semakin maju tetapi budaya literasi semakin rendah. Oleh karena itu budaya literasi perlu ditingkatkan kembali, yang salah satu caranya melalui pengadaan sarana literasi berupa taman bacaan atau perpustakaan. Kabupaten Garut sudah mengembangkan konsep taman bacaan dalam upaya meningkatkan budaya literasi di kalangan masyarakat. Kegiatan Pengabdian kepada Masyarakat yang dilakukan oleh Politeknik STIA LAN Bandung diharapkan dapat mengkampanyekan dan meningkatkan budaya literasi kepada warga desa.

Abstract

Based on the 1945 Constitution, 3 institutions are authorized to appoint constitutional judges, including the Representative Council, Supreme Court, and the President. In the event that the dismissal of constitutional judges can be carried out if they have fulfilled the criteria contained in article 23 of Law No.7/2020. Paragraph (4) of the same article confirms that those with authority to dismiss a constitutional judge are the Chief Justices of the Constitutional Court and the President. However, in 2022 there is a polemic, namely the form of intervention against the dismissal of constitutional judges carried out by one of the legislative bodies, namely the Representative Council of Indonesia, which is a big question mark. What kind of authority does the Representative Council have as a legislature over the CC? Is this action justifiable and in accordance with applicable law? This legal research with a normative juridical approach examines secondary data in books, journals, and legislation as a reference. The result of this study indicates that the Representative Council’s over CC as contained in the 1945 Constitutions is very limited in proposing 3 candidates for constitutional judges and has no authority at all to dismiss them. The Representative Counsil’'s decision to dismiss constitutional judges is an act of offending the principle of the independence of the Constitutional Court and has no legal basis.

Abstract

Hybrid turbine is a combination of two different types of turbines which are still in one axis. This research used a propeller turbine with a 2 meters diameter of an S833 blade profile and combined with a 0.5 meters diameter of venturi turbine (Energy Ball Wind Turbine) with a total of 5 blades. This venturi turbine is placed in front of the propeller turbine. This research varies the number of propeller turbine blades, that are 3.4 and 5 blades. The first test is data retrieval on propeller turbines, then the retrieval of data is carried out on hybrid turbines and the two tests can be compared to the result of performance. From this research, it can be seen that hybrid turbines with 5 propeller blades produce greater generator power than other variations of 1.16 watts at 5 m/s wind speed. However, the energy wind turbine ball produces the largest average increase in generator power that is 28.55% by using 5 propeller blades. Abstract

The Biogas Power Plant comes with a form of alternative energy handling efforts originating from POME Because of the engine is continuously operated without stopping, it requires maintenance so that the engine's performance is maintained properly. The decrease in engine performance produces wasted energy so that engine efficiency is not optimal. In addition, the maintenance process takes a long time until the engine can be operatedagain. This is a problem because the maintenance process is carried out on all cylinder engines. The purpose of this study is to calculate and analyze the energy on the left and right exhaust on the gas engine Guascor SFGM 560 Miller Cycle. From the analysis, the biggest energy efficiency is in the left cylinder in the first period which was59.82% at 15.00 PM. and as a comparison in second period the highest efficiency is at 12.00 that was equal to 66.45%.Keywords: miller cycle, biogas, gas engine, energy, effisiensi energy
