Abstract

Why is the law that has the purpose to regulate social order, would lead to chaos in the community? There are two things that need to be observed, first, because the law narrowly conceived, which in turn tend to be formalistic, involutive, slow and lack of the capacity to adapt and anticipate the development of complex aspects of community life and progressive. This is the failure of positive law that could not see far ahead. Second, the attitude of law enforcement officials often ignore the public sense of justice with controversial and discriminative decisions.The implication of this phenomenon is the number of resistance legal product in the community. Laws experiencing poverty of Indonesian ideology substantively have lost the "spirit", which should be entailed by the law itself has gained fresh air when present progressive legal thought  presents in the middle of dialectical thinking in Indonesia law.

Abstract

Objective: This article aims to discuss the enforcement of customary law in North Maluku, the deliberation value in the BMA Sultanate of Ternate, and the implementation of customary criminal sanctions by the Badan Musyawarah Adat.Methodology: The methodology used in this study was legal research conducted in a non-doctrinal qualitative approach. In this study, the law is not only conceptualized as all the principles and rules that regulate human life in society but also includes institutions and processes that actualize the validity of these rules in society.Findings: Law enforcement of fisheries crimes is based on the provisions of Indonesian Law No. 45 of 2009 concerning Fisheries. Criminal provisions are regulated by Articles 84 to 104. One of them is about sinking the ship used to commit fishing crimes. Sanctions given to the fish theft (illegal fishing) perpetrators in territorial waters that have been determined by the local customary head are 1) warning; (2) monetary charges according to the agreement of the local customary community; and (3) boat (pajeko in Ternate) or motorboat seized by the sultanate to be used by the community through profit sharing.Utility: Customary Institute of Ternate Sultanate in 2018 has decided on three cases in the Kao bay area concerning fish catching. Besides the traditional law enforcement that is implemented by the Sultanate, North Maluku recognizes Sasi Customs (Adat Sasi), which is regulation of tradition that limits people for catching fish or taking other sources in a certain type and particular period. Thus, the ecological balance is still maintained.Novelty/Originality: The concept of transcendental law enforcement is substantially in line with the values in the Segulaha tradition that has been applied for a long time in North Maluku. In Segulaha customary law, there is a traditional element in a person who has the same soul with transcendental values by positioning revelation as the source of the law. Keywords: Law Enforcement, Fisheries Crimes, Transcendental Approach

Abstract

Tujuan dari penelitian ini adalah untuk menentukan pola perkembangan hukum adat di Bima dan keberadaannya setelah reformasi, sehingga kecenderungan dikenal. Jenis penelitian ini adalah non-doktrinal, atau sosial hukum (kualitatif), dengan pendekatan historis, data yang digunakan terdiri dari data primer dan data sekunder. Hasil dari penelitian ini adalah; (1) pola perkembangan hukum adat Bima ada, a) hukum Sintesis, yaitu ketika hukum adat dan hukum Islam bertemu dan saling melengkapi, dan tidak ada konfrontasi antara mereka, b) hukum Transplantasi, terjadi ketika sistem hukum kolonial didorong ke pengaturan lokal dengan batas kewenangan peradilan Islam, yang menyebabkan kekosongan hukum, c) Integrasi hukum, ketika pemerintah pusat untuk membangun keseragaman politik hukum melalui kodifikasi dan unifikasi, d) hukum positif, yaitu pada saat reformasi bertiup, semangat lokal dibentuk melalui peraturan, (2) adanya hukum adat yang ada kerugian lengkap, dan yang masih hidup, yang masih hidup hukum adat ditemukan di masyarakat Donggo, dengan semua fleksibilitas dan berbagai bentuk sanksi.

Abstract

Abstract: Nowdays the disaster and anomaly of ecology are quite difficult to avoid. Concequently, nature has become  a real threat to the survival of human. It occurs due to industrial activity, mining, transportation and  agriculture as the mechine of capitalist ideology. The research employed the nomative-descriptive, and philosopy approach. This paper aims to (1) explore the spirit of theological  and moral-ethical which are a bucker the capitalism or materialism ideology. (2) How is perspective and bid of moral-ethical of islam (prophetic) toward the meaning and management of the environment. The result shows that first, the desire for natural exploitation which is become a characteristic of capitalism or materialism ideology underpinned by a certain theological spirit that encourages domination and human exploitation on the nature. Moreover, the exploitation desire also underpinned by moral-ethical philosopy of hedonism or utilitarianism (pragmatism), which measures the highest kindness by accumulating the material as much as possible. Second, in the Islam perspective (prophetic), the nature interpreted as a something sacred, created by Allah, as one of the object  for seeking knowledge of the greatest of Allah. And in the end it makes human closed to faithfulness (trancendence). In the prophetic ethical, the universum (nature) utilized for human prosperity. And it directed to humanization, liberation and trancendence in order to create a fair society and egalitarian. الملخص: ستكون الأضرار البيئية والشذوذ في المستقبل إنتشرت في هذا العالم، ولذلك أصبحت الطبيعة تهديدا حقيقيا لبقاء الحياة البشرية, وأسباب هذه المصيبة هي كثرة  النشاط الصناعي، والتعدين، وعملية النقل، والزراعة التي تعتمد على روح وفلسفة رأسمالية. وبطريقة البحث الوصفي الديني وبالمدخل الفلسفي هدف هذا البحث إلى أولا: كشف الأرواح اللاهوتية والأخلاقية التي تقوم عليها الرأسمالية.  ثانيا: ما رأي الإسلام والأخلاقية (النبوية) عن الإدارة البيئية ومعانيها. ونتائج هذا البحث أولا: رغبات الاستغلال الطبيعي التي تكون عادة وحجة لإيديولوجي الرأسمالية المادية، وبالإضافة إلى ذلك، فإن رغبة الاستغلال الطبيعي قد تكون معتمدة أيضا بفلسفة مذهب التحليلية المتعة والنفعية المادية التي تقيس الخيرات من خلال المواد الكثيرة العظيمة. ثانيا: وفي نظر الإسلام (النبوي) أن العالم هو شيء مقدس، الذي أنشأه الله للناس جميعا ليأخذه عبرة وتدبرا في عظمة الله، وأخيرا ليكون العالم وسيلة لتقريب الناس إلي الإيمان بالله. وفي رأي الأخلاق النبوية، أن العالم (الطبيعة) يستخدم لأجل الرحمة أو الرفاهية للناس جميعا, ليكون العالم يدور على طبيعته الإنسانية والتحررية والتجاوزية لتحقيق مجتمع عادل ومتكافيء.Abstrak: Dewasa ini bencana dan anomali ekologis semakin sulit terelakkan, akibatnya alam telah menjadi ancaman nyata bagi kelangsungan kehidupan umat manusia. Hal ini disebabkan oleh aktifitas industri, pertambangan, transportasi, dan pertanian sebagai mesin idiologi kapitalis. Dengan menggunakan metode normatif-deksriptif, dan pedekatan filosofis, tulisan ini bertujuan; pertama, mengungkap spirit teologis dan moral-etik yang menjadi penyokong ideologi kapitalisme/materialisme; kedua, bagaimanakah perspektif dan tawaran moral-etik Islam (profetik) terhadap makna dan pengelolaan lingkungan hidup. Dalam pembahasan dan analisis, tulisan ini menyimpulkan bahwa pertama, hasrat eksploitasi Alam yang menjadi karakteristik ideologi kapitalisme-materialisme,  didukung oleh spirit teologis tertentu yang mendorng dominasi dan eksploitas manusia atas Alam. Selain itu, hasrat eksploitasi itu juga didukung oleh filsafat moral-etik hedonis-utilitarianisme (pragmatis), yang mengukur kebaikan tertinggi dengan mengakumulasi materi sebanyak mungkin. Kedua, dalam sudut pandang Islam (profetik), Alam dimaknai sebagai sesuatu yang sakral, diciptakan Allah, sebagai salah satu objek menggali ilmu-kebesaran Allah, dan pada akhirnya semakin mendekatkan diri manusia pada keimanan (transedensi). Dalam etik profetik, universum (Alam)  di manfaatkan untuk kesejahteraan manusia, serta diarahkan dalam rangka untuk melakukan humanisasi, liberasi, transendensi, agar tercipta masyarakat adil dan egaliter.

Abstract

Through the pure legal theory, within the thesis of normativity (without the thesis of morality) and the thesis of separation (without the thesis of reductive), Hans Kelsen proposes an object of legal science that is different from the one proposed by the philosophy schools of natural law and empirical-positivistic law. The idea transforms the legal science into a unique and distinctive science. Based on the philosophical research method, a legal norm, according to Hans Kelsen, must have two characters: the meaning of actions that want legal norm; and the relative moral norms with normative characteristics.Ontologi Ilmu Hukum: Tawaran Hans Kelsen dalam ‘Pure Theory of Law' AbstrakDi dalam pure theory of law, melalui tesis normativitas (tanpa tesis moralitas) dan tesis keterpisahan (tanpa tesis reduktif), Hans kelsen menawarkan objek ilmu hukum yang berbeda dengan madzhab filsafat hukum alam, dan madzhab filsafat hukum empiris–positivistik, sehingga ilmu hukum memiliki objek ilmu yang khas. Berdasarkan metode penelitian filsafat, dapat diketahui bahwa norma yang dapat menjadi norma hukum menurut Hans Kelsen, harus memiliki dua karakter yaitu norma hukum sebagai makna tindakan berkehendak norma hukum, sebagai norma moral relatif yang berkarakter normatif.DOI: https://doi.org/10.22304/pjih.v5n3.a8

Abstract

Neglect of rape victims in the Indonesian Criminal Justice System implicates at least two things; first, the victim does not receive legal protection, and second, the decisions of judges do not fulfill the sense of justice. Neglect of victims in the Criminal Justice System cannot be separated from the theory, doctrine and legislation, especially criminal law or the Penal Code, Criminal Procedure Code and the Corrections Act, which is oriented merely to the perpetrators (criminal oriented) instead of victims (victim oriented). Regarding the conditions above, this study was intended to provide a solution of the problems so that victims in the Criminal Justice System obtain legal protection and the decision of judges could fulfill the sense of justice.

Abstract

Lombok is one of the islands of West Nusa Tenggara province with enormous tourism potential, from nature, beaches and culture. So that if this is developed properly it will bring prosperity to the Lombok people in particular and NTB in general. Tourism development policies have not been widely felt to bring effects to welfare to the community. The purpose of this study is to provide an overview of policies and implementation of tourism development policies on tourism on the island of Lombok. Data was collected by observation and interviews. From these data, then analyzed descriptively qualitatively, the data formed becomes a description that describes a situation or event described. Based on the results of the analysis of tourism development policies in Lombok island, it is inseparable from the four tourism pillars contained in regional regulations, namely tourism, marketing, industry and institutional development. The implementation of the policy has not maximally affected the welfare of the people on the island of Lombok, and has even caused new problems in the lower classes.

Abstract

The legal paradigm of halal tourism which is being built by the government West Nusa Tenggara Province is based on oriental characters, civilization, and culture with the main scheme to attract the world Muslim tourists. The development of legal paradigm of character-and-civilized-based tourism is important in order to establish local identity of a particular area, which is now declining. This paper aimed to discus legal concept of halal tourism based on Islamic prophetic through social historical inference of Sasak, Samawa, and Mbojo ethnic groups. This research used legal analysis method of sociological jurisprudence and prophetic legal method with integrated-interconnected approach through the procedure of social historical interference. The finding revealed there is a convergence of Islamic prophetic values and social historical values of Sasak, Samawa, and Mbojo reflected in the patterns of halal food, social relation, clothes, economy, and the like. Common philosophy of Sasak, Samawa, and Mbojo, that is “adat bersendi syara’, syara’ bersendi kitabullah” (tradition is based upon sharia, sharia is based upon the Book of Allah) supports the Islamic identity that has provided a foundation for the issuance of halal regulation and the accommodation of character and civilized based local identities through local friendly entities.

Abstract

Rape can be occured in all women from all side of life, occupations, age, and marital status, which was done alone or abuzz. The perpetrators of violence also come from various circles, work, age, social class and marital status. In this case, the number of women violence against in Atambua is quite high. Sexual abuse cases and sexual harassment turned out most of the perpetrators are still related to blood with victims, such as biological father, siblings, uncle and neighbors. The cases of sexual assault against women in Atambua are resolved in customary. However, any form of resolution, the act of violence of rape against viewed from various aspects still must be responded as a criminal act, for example the custom settlement of tallitan tafani still apply penal sanction in the form of penalty as one of the effort of restoration of good name, and also dignity for the victim.
