Abstract

Sources of collection of banking funds collected from the community are then distributed to the community in the form of credit. If the amount of funds disbursed by the bank to the community through credit are not refundable in accordance with the term has been agreed, the credit quality can be classified as non-performing loans or often referred to as Non Performing Loan (NPL). The impact of high NPL levels is disrupted by the liquidity of each banking institution.Research Objectives are: (1) To analyze the supervision of the application of prudential principles in the provision of bank credit conducted by the Financial Services Authority under the Act Number 21 of 2011 on the Financial Services Authority. (2) To analyze the inhibiting factors in supervising the application of prudential principles in the provision of bank credit by the Financial Services Authority. Furthermore, this research uses research method with normative juridical approach, that is by collecting secondary data that is literature materials, as a technique to get information through tracing legislation and other regulations in accordance with research problems and then the data is analyzed by qualitative juridical .The results of the research show that (1) Supervision of prudential principles in the provision of bank credit conducted by the Financial Services Authority under the  Act Number 21 of 2011 concerning Financial Services Authority shall be conducted by Compliance Based Supervision (CBS), that is Compliance Monitoring banks against provisions relating to the operation and management of banks in the past in order to ensure that the bank has been operating and managed properly and properly according to prudential principles. In addition, Risk Based Supervision (RBS) is implemented, ie supervision using risk-based strategies and methodologies that enable bank supervisors to detect significant risks early and take appropriate and timely monitoring actions. (2) Inhibiting factors in supervising the application of prudential principles in the provision of bank credit conducted by the Financial Services Authority is one of the most important that customers often in providing data to the Bank inaccurate and the existence of the prospective customer's delay in completing the file submission of credit.  Keywords:  Supervision, Financial Services Authority, Prudential Banking  Principles, Credit

Abstract

Seiring dengan meningkatnya kebutuhan masyarakat terutama dalam hal ini mendorong para pelaku usaha untuk mendirikan usaha depot air minum isi ulang yang dapat memberikan lapangan pekerjaan baru bagi pelaku usaha. Dalam mendirikan usaha depot air minum isi ulang pelaku usaha wajib memperhatikan legalitas kegiatan usaha, sehingga dalam menjalankan kegiatan usahanya, bagi pelaku usaha akan mendapatkan perlindungan hukum terhadap usaha yang dijalaninya. Begitupun bagi konsumen yang akan mengkonsumsi air minum isi ulang dapat terhindar dari perilaku curang atau tidak adil yang dilakukan oleh pelaku usaha. Pokok bahasan dalam penelitian ini adalah legalitas usaha yang dimiliki depot air minum isi ulang serta kaitannya pada perlindungan terhadap konsumen pengguna depot air minum isi ulang.Metode penelitian yang digunakan untuk menjawab permasalahan dalam penelitian ini adalah dengan menggunakan pendekatan Yuridis Normatif - Empiris yaitu dengan cara mempelajari serta mengkaji bahan-bahan atau teori-teori yang berkaitan dengan pemenuhan legalitas usaha depot air minum isi ulang. Data yang dipergunakan adalah data sekunder yang diperoleh dengan cara studi pustaka dan data primer sebagai penunjang data skunder dengan cara wawancara. Pengolahan data dilakukan dengan beberapa tahap, yaitu seleksi data, klasifikasi data, dan sistematika data. Selanjutnya data tersebut diolah dan dianalisis secara kualitatif.Hasil penelitian dan pembahasan menunjukan bahwa pelaku usaha depot air minum isi ulang pada umumnya belum memenuhi legalitas usaha terhadap usaha yang dijalaninya. Dokumen legalitas bentuk usaha dapat diketahui dalam akta pendirian perusahaan, nama perusahaan, serta merk perusahaan. Setiap usaha yang menjalankan kegiatan usahanya wajib memenuhi syarat legalitas operasional usaha. Setiap perusahaan yang telah memenuhi syarat legalitas operasional usaha tersebut dinyatakan sebagai usaha yang mempunyai bukti legalitas kegiatan usaha. Dokumen Legalitas kegiatan usaha yang dimaksud terdiri atas Tanda Daftar Perusahaan (TDP), Bukti Tanda Daftar Usaha Perdagangan (TDUP), Surat Izin Usaha Perdagangan (SIUP), dan Pembukuan. Depot air minum isi ulang diwajibkan memiliki sertifikat laik hygiene sebagai legalitas usaha yang khusus dari dinas kesehatan, dan depot air minum isi ulang telah memenuhi legalitas kegiatan usahanya, seperti memiliki tanda daftar usaha perusahaan, surat izin usaha perdagangan, dan surat izin  tempat usaha. Perlindungan hukum terhadap konsumen dapat ditempuh dengan cara Preventif dan Represif. Berdasarkan Pasal 19 UUPK, pelaku usaha bertanggungjawab memberi ganti kerugian, pengembalian uang ataupun pemberian santunan yang sesuai dengan ketentuan peraturan perundang-undangan yang berlaku apabila terbukti bersalah. Selain itu, menurut Pasal 23 UUPK pelaku usaha yang menolak dan/atau tidak memberi tanggapan dan/atau tidak memenuhi ganti rugi atas tuntutan konsumen sebagaimana dimaksud dalam Pasal 19 ayat (1), ayat (2), ayat (3), dan ayat (4) dapat digugat melalui badan penyelesaian sengketa konsumen atau mengajukan kebadan peradilan ditempat kedudukan konsumen. Kata Kunci : Legalitas, Usaha, Depot Air Minum, Perlindungan Konsumen.

Abstract

ABSTRAKSalah satu produk yang diterapkan oleh lembaga perbankan adalah adanya sistem payment secara online. Dalam sistem payment online point, bank berfungsi sebagai lembaga penyedia jasa dalam lalu lintas pembayaran. Kedudukan hukum konsumen/nasabah sistem payment yang menggunakan jasa perbankan dalam melakukan tagihan pembayaran kepada pelaku usaha. Peraturan perundang-undangan, khususnya di bidang perbankan maupun peraturan di bidang perlindungan konsumen telah mengatur secara jelas tentang perlindungan terhadap hak-hak para konsumen/pelanggan yang terlibat dalam sistem payment  online bank, khususnya dalam hal terjadinya keluhan terhadap pihak bank maupun nasabah pengguna. Metode yang digunakan dalam penelitian ini adalah dengan cara yuridis normatif. Dalam penelitian ini, ada dua pendekatan pokok yang digunakan yaitu: Pendekatan Perundang-undangan (statute approach), serta Pendekatan Konsep (conceptual approach). Penelitian hukum normatif didasarkan data sekunder dan menekankan pada langkah-langkah spekulatif-teoritis dan analisis normatif-kualitatif. Perlindungan hukum terhadap konsumen yang telah menggunakan jasa perbankan yang menggunakan Sistem Online Payment Point dapat dilihat dalam POJK Nomor 1 Tahun 2013 tentang Perlindungan Konsumen Sektor Jasa Keuangan dimana dalam POJK tersebut tertuang perlindungan hukum kepada nasabah pengguna jasa perbankan yang melindungi nasabah dalam menggunakan produk dan jasa perbankan khususnya dalam sistem pembayaran yang menggunakan sistem online dalam perkembangan teknologi saat ini.Kata kunci: bank; hukum; konsumen; payment; perlindungan. ABSTRACTOne of the product used by banking institutions is online payment system. In the online point payment system, the bank becomes service provider under a payment traffic. Legal standing of the consumer in such customer payment system is the user of banking services in billing payments to business actors. Laws and regulations, especially in the banking sector and regulations in the field of consumer protection, have clearly regulated the protection of the rights of consumers or customers involved in the bank’s online payment system, especially in the presence of complaints against the bank. The method used in this study is a normative juridical method. There are two main approaches that are used in this research, namely: Legislation, and Concept Approach. Normative legal research is based on secondary data and emphasizes speculative-theoretical steps and normative-qualitative analysis. Legal protection for consumers who have used banking services in the Online Payment Point system can be seen in the Financial Services Authority Regulation Number 1 of 2013 concerning Consumer Protection in the Financial Services Sector where legal protection is provided to customers who use banking services that protect customers in using banking products and services especially in payment systems.Keywords: bank; costumer; law; payment; protection. DOI:  https://doi.org/10.23920/jbmh.v3n1.8

Abstract

Banks are institutions that channel credit as much as possible and serves to increase the need for services for banking services to the community. Banking competition is increasingly stringent, banks are required to proactively provide credit products that can meet the needs of diverse communities with innovative product design, competitive, responsive to the needs of customers and profitable.To anticipate and review the competition between one bank with another bank, the funds collected must be planned properly and maximally so that it can be channeled to the community through a credit loan. In connection with the application of prudential banking principles or known as prudential banking. The problem of this research is how to apply prudential principles in lending to customers. The method used in this study  is the normative juridical approach, the examination of the rules, norms, rules and further analysis of the data used is qualitative jurisdiction. Based on the results of the research shows that the application of prudential principles in the provision of credit to customers conducted by banking institutions to minimize the occurrence of bad loans. Implementation of several rules before giving credit to customers has been done, by implementing the basic principles of crediting and carrying out prudential principles such as Principle 5C which is character, capacity, capital, collateral, and condition of economy.

Abstract

The capital market is a very dynamic industry, attractive, constantly changing, which is one element that is a benchmark for economic progress of a country in which traits - traits industrialized countries as well as new industry is the capital market has been growing and developing well. Characteristics is a consequence of the need for an independent regulator and ready to face the dynamics of these changes. Based on Law No. 8 of 1995 on Capital Markets, guidance, regulation, and daily supervision conducted by Bapepam Capital Market which aims to achieve capital market activities orderly, fair and efficient and protect the interests of investors and the public. After the establishment of the Financial Services Authority in which the passing of Law No. 21 Year 2011 on the Financial Services Authority, the agency is an independent body replacing the oversight function performed by BAPEPAM.

Abstract

Banking is one of the institutions that have an important and strategic role in various fields, among others in community activities, especially in the field of financial and economic activities to meet the needs of any particular individual. The continued development of the banking business is currently pushing the more the likelihood of disputes between bank customers and banks which could reduce public confidence in the Bank. As from January 2014 the functions, duties and powers of regulation and supervision of banking mediation activities previously carried out by Bank Indonesia (BI), which has now been transferred to the Financial Services Authority (FSA). Then, after the FSA has a role in dispute resolution, including out of court dispute resolution conducted by the FSA through the Institute of Alternative Dispute Resolution (LAPS).

Abstract

Handling of troubled banks currently carried out has been carried out coordinated by related institutions including the Ministry of Finance, Bank Indonesia, the Financial Services Authority and the Deposit Insurance Corporation, as mandated by Law Number 9 of 2016 concerning Prevention and Handling of the Financial System Crisis. Where the handling of troubled banks can be more complex and integrated not only the impact of micro and macro. So that the community can maintain its trust in banking institutions and greatly help economic activities, especially banking entrepreneurs. The problems in this research are as follows: 1) How is the Application of the Precautionary Principle in Minimizing the occurrence of Problematic Banks in Indonesia? and; 2) How is Legal Certainty in the Settlement of Problem Banks in Indonesia?The research method used to answer the problems in this study is to use a normative legal research approach which is also called theoretical legal research or dogmatic legal research because it does not review the implementation of legal implementation. The results of the research and discussion show that the application of the precautionary principle carried out by these banking institutions can make a very impactful contribution, especially in order to minimize the occurrence of good problem banks that have systemic or non-systematic impacts. In addition, legal certainty in the context of handling this troubled bank has been stated in the PPKSK Law as an attempt to resolve troubled banks.

Abstract

Micro-business is one of the activities that is currently almost 90% the share of business in Indonesia, considering the micro business is an informal business, and not many micro-businesses have been touched by the financing sector so that micro-businesses are not affected in the economic crisis. In addition, micro-businesses are complicated to develop their businesses due to the lack of requirements to get funding and guidance that is still not effective, resulting in the lack of information for businesses to take advantage of existing market share. Moreover, micro-businesses must also be able to adapt to continue and grow amidst the current difficult conditions. The problems in this study are 1. Growth of Micro Businesses and the Concept of Development and Funding amid Technology-Based Business Competition 2. Legal Aspects of Micro-Business Development in the Welfare State's Goals. Results of this Research As the goal of the welfare state is one of them to improve the social welfare of the community. Micro-businesses participate in the purpose of the welfare state because remembering micro business as one of the fundamental pillars of driving the economy in Indonesia. It is necessary to have an active role of government and society to participate in building micro-businesses to be more developed so that the increase of the economy both in the region and nationally. So that the government must be able to facilitate businesses so that micro businesses can develop as the objectives of the welfare state.

Abstract

Micro-businesses have an essential role in driving an economic revival in Indonesia. However, they are particularly vulnerable during the pandemic. The COVID-19 pandemic has significantly impacted the long-term viability of micro, small, and medium-sized enterprises (MSMEs) in the financing, production, distribution, and market demand. This paper argues that an assistance policy model for micro-businesses accelerating the economy during a pandemic is needed. It also raises the question of how government policies in developing micro-businesses. The library method, which relied on secondary data, was used to conduct the research. The result suggests that the ideal assistance model policy for MSMEs in accelerating the regional economy is by using platform-based digital technology so that the flexibility of purchasing raw materials to sales can be integrated into one and reach all consumers around the world. Government policies in developing MSMEs in the new normal era include launching the National Economic Recovery Program, as mandated by Government Regulation Number 23 of 2020, implementing stimulus programs for MSMEs such as interest subsidies and restructuring.

Abstract

The act of destruction of goods in this case is a motorcycle is one form of lawlessness, which is regulated in Article 406 paragraph (1) of the Criminal Code. The problem is how criminal accountability for the perpetrators of motorcycle destruction and how the judge's consideration in the enforcement of the verdict against the perpetrator of the motorcycle destruction crime. Data collection is based on literature studies and field studies, while data processing is done by editing methods, classification and systematization of data, then analyzed using qualitative analysis. The results of the study showed that criminal liability against the perpetrators of motorcycle destruction crimes has been proven legitimately and convinced guilty of committing criminal acts of destruction and criminally convicted defendants therefore with a prison sentence of 1 (one) year each and the basis of the judge's consideration in the enforcement of the verdict against the perpetrator of the crime of bicycle destruction, among others, evidence,  Witness statements, expert testimony, indictments and demands of the Public Prosecutor, elements that meet in the Prosecutor's Indictment, as well as incriminating and mitigating matters in the accused
