Abstract

Qarinah as evidence leading to a conviction has been used by judges as the consideration basis in resolving a case. Its uses as evidence is still controversial especially in Fiqh. This is not the case in positive law as positive laws are regulated by a nation. The most important part of qarinah as evidence is how the results of technological advancements such as DNA could be used as qarinah. Positive law seems to have adopted DNA as qarinah so as to use it in imposing a legal decision. In reference to the Islamic law, can a DNA technology be used as qarinah? Apparently further research regarding this topic is required. This article discusses fundamental arguments for possible adoption of DNA as qarinah evidence.

Abstract

Abstract

Dalam penetapan sanksi hukuman terhadap sekelompok orang yang telah melakukan pembunuhan terhadap satu orang saja, disyaratkan agar semua yang dilakukan oleh pelaku itu bisa mengakibatkan seseorang terbunuh. Tetapi dalam menentukan sanksi hukuman bagi salah satu pelaku pembunuhan yaitu pelaku pembantu sangatlah sulit apabila tidak melihat dari bentuk-bentuk pembantuan yang dilakukan oleh pelaku pembantu.Penelitian ini bertujuan untuk mencari jawaban dari permasalahan bagaimana pertanggungjawan dan sanksi pidana bagi pelaku pembantu tindak pidana pembunuhan serta aspek positif dan negatif dari pertanggungjawaban pidananya. Untuk memperoleh jawaban tersebut peneliti menggunakan data primer dan data sekunder. Kedua data tersebut dianalisis dengan metode deskriptif analisis komparatif. Berdasarkan metode pengumpulan data ini, maka penelitian ini dikategorikan sebagai penelitian kepustakaan (library research). Menurut hukum pidana Islam adalah turut serta secara tidak langsung (al-isytaraku bittasabbubi) merupakan suatu perbuatan yang melawan hukum dan harus dipertanggungjawabkan demi kemaslahatan manusia. Sanksi hukum terhadap pelaku pembantu tindak pidana pembunuhan, menurut hukum pidana Islam adalah hukuman ta'zir hal ini berdasarkan pendapat ulama Al-Hadawiyah, ulama Hanafiyah, dan ulama Syafi'iyah. Sedangkan Menurut Imam Malik, setiap orang yang hadir dianggap membantu, meskipun tidak langsung dan diancam dengan hukuman qishash. Sedangkan orang yang tidak hadir meskipun ia membantu terjadinya pembunuhan ia hanya dikenai sanksi ta'zir. Menurut hukum positif pembantu (medeplichtige) ialah barangsiapa yang dengan sengaja memberikan bantuan pada saat kejahatan diwujudkan oleh pembuat baik berupa kesempatan daya upaya (sarana) atau keterangan kepada pembuat untuk mewujudkan kejahatan pembunuhan.Sedangkan sanksi hukum menurut hukum pidana positif bagi pelaku pembantuan pembunuhan dapat dikenakan hukuman penjara yang dikurangi sepertiga dari pidana pokok maksimum. Dalam menentukan pidana bagi pelaku pembantu, yang diperhitungkan hanya perbuatan yang sengaja dipermudah atau diperlancar olehnya, beserta akibat-akibatnya.

Abstract

Testimony is valid evidence to obtain legal certainty. Of proof in criminal adultery with a request for information made four male witnesses as represented in the texts of the Koran. Ibnu Hazm practice texts generality arba'ati syuhada include men and women and reject hadis munqathi' basis for justification of testimony limited to the male gender only. This argument is the basis for Ibn Hazm allowing women to testify in criminal adultery while guided by the principle of equality of men and women. In addition, Ibnu Hazm also rejected the psychological condition of women as a reason for refusing the testimony of women in certain fields. This condition can be anticipated by the number of witnesses more women than men because the Qur'an clearly define terms that are fair witness is owned by men and women

Abstract

This paper aims to analyze the determination of death penalty in apostasy through modern criminal theories and human rights considerations. The approach is used to objectively view the purpose of death penalty on a criminal act in the context of religious freedom. This study is a conceptual study using the library research and descriptive-analytical  approach. Based on the analysis of punishment theories, it is found that the determination of the death penalty in apostasy takes a combined pattern of punishment theories: retributive, deterrence, and reformative theories. The combination of these theories leads to an integration, as it does not focus only on the retributive and deterrence aspects, but it also emphasizes on the reformative aspect, as a means of therapy for apostate criminals so they will not repeat the same acts. The integration of the theories seems perfect when accompanied by moral education that can provide “spiritual enlightenment”, so that criminals can be accepted back into the community. The integrity-morality theory or pulse-integrity theory is expected to neutralize the difference in views on the purpose of punishment in Islamic criminal law, which has long been considered not in line with the norms of human rights under the pretext of the sovereign system of the nation-state, where citizenship status is limited by territorial areas. The equality of rights, justice, morality, and individual accountability is a universal principle of the teachings of the Qur’an which inspire the conception of human rights norms by every citizen.AbstrakArtikel ini menganalisis penetapan hukuman mati dalam pidana murtad menggunakan pendekatan teori pemidanaan dan pertimbangan hak asasi manusia. Pendekatan ini digunakan untuk melihat secara objektif tujuan ditetapkan hukuman mati sebagai perbuatan pidana dalam konteks kebebasan beragama. Studi ini merupakan kajian konseptual, dianalisis menggunakan data kepustakaan melalui pendekatan deskriptif-analitis. Berdasarkan analisis teori pemidanan ditemukan bahwa penetapan hukuman mati dalam pidana murtad mengambil pola perpaduan teori pemidanaan; teori retributif,deterrence dan reformatif. Perpaduan ketiga teori melahirkan integritas, tidak terfokus pada aspek retributif  dan deterrence, tetapi lebih menekankan pada aspek reformatif, sebagai terapi pelaku kajahatan murtad agar tidak mengulangi perbuatan yang sama. Pengintegrasian ketiga teori ini terlihat sempurna manakala diiringi pendidikan moral yang dapat memberikan “pencerahan spiritual”, sehingga pelaku kejahatan dapat diterima kembali dalam kehidupan masyarakat. Teori integritas-moralitas atau teori integritas-plus diharapkan dapat menetralisir perbedaan pandangan tujuan pemidanaan Islam. Persamaan hak, keadilan, moralitas dan pertanggunjawaban individu merupakan prinsip universal ajaran al-Qur’an menjadi inspirasi lahirnya norma hak asasi manusia setiap warga negara.

Abstract

This study aims to investigate the strategies used by Islamic Religious Education (PAI) teachers in learning the Qur'an in public elementary schools in Subulussalam City. This study involved PAI teachers as participants and elementary school students as research subjects. The method used is qualitative research with a case study approach. This study involved data collection through classroom observation, interviews with Islamic Religious Education teachers, and analysis of documents related to learning the Qur'an. The data collected was then analyzed using an inductive approach, by identifying the learning strategies used by PAI teachers and exploring their effectiveness in facilitating students' understanding and appreciation of the Qur'an. The results of the study show that there are various strategies used by PAI teachers in learning the Qur'an at SD Negeri Sekota Subulussalam. These strategies include using a variety of teaching materials, using interesting learning media, using information technology, using interactive discussion and question-and-answer methods, and giving assignments and projects related to the Qur'an. These strategies aim to facilitate students' understanding, appreciation, and practical application of the teachings of the Qur'an. Nevertheless, this study also identified several obstacles faced by Islamic Religious Education teachers in implementing Al-Qur'an learning strategies. These obstacles include limited time for learning, limited quality learning resources, and challenges in motivating students to study the Qur'an seriously.

Abstract

This study aims to determine the role of Da'i in fostering Community Morals in Danau Paris, Aceh Singkil District. To what extent is the role of the da'i, what are the beliefs of the minority Muslim community, what are the supporting and inhibiting factors faced by the preacher at the research location. The method used in this research is qualitative. This method is carried out in relation to existing phenomena in the field by collecting data, especially from research informants. The data collection techniques used were interviews and documentation, the research subject was the role of the preacher in Danau Paris District, Aceh Singkil Regency. The results showed that the role of the preacher used was to invite and persuade the community to do good by filling in recitations, sermons Friday, educating children by reading Al-Qur’an, delivering religious lectures based on the Al-Qur’an and Hadits, which is a foundation from Allah SWT. The results achieved by the da'i in Danau Paris District in improving and fostering community morals have progressed and given drastic changes so that the da'i is declared successful in achieving da'wah by using this role.

Abstract

This study aims to examine the application of the demonstration model in learning Islamic Religious Education (PAI) with a focus on Fardhu Kifayah material and its impact on improving student learning outcomes in class XI Science at SMAS Plus Muhammadiyah in Subulussalam. The research method used is Classroom Action Research (CAR) with three cycles. The research data were obtained through observation, written tests, and document analysis. The demonstration model is applied in each cycle with structured steps and actively involves students in the practice of Fardhu Kifayah. The results showed a significant increase in student learning outcomes after the implementation of the demonstration model. The conclusion of this study is that the application of the demonstration model in PAI learning Fardhu Kifayah material can provide positive benefits in improving student learning outcomes. This model allows students to see and experience Fardhu Kifayah's practice firsthand, which helps increase students' understanding, skills, and motivation in carrying out the ritual.

Abstract

This article aims to 1) find out what parenting patterns are applied in the family of converts in fostering the practice of worship in children at the Mualaf Center Foundation, Subulussalam City. 2) what are the obstacles of the converts family in fostering children's worship practices at the Mualaf Center Foundation in Subulussalam City This research uses field research with a qualitative approach, the instruments used are interviews and documentation The Mualaf Foundation of the Mualaf Center of Subulussalam City has conducted routine studies in fortifying Aqidah and deepening religious knowledge every two times a week, In this process, parents have done their best to teach their children to provide religious understanding, some teach their own children and some give it to the Koran teacher/ustadpola parenting of converts in increasing understanding of the values of worship at the Mualaf Center Foundation in Subulussalam City in the families of converts is different, some are successful and some are not successful. The obstacle that muallaf families face is the lack of knowledge about Islamic teachings so that it is difficult to apply parenting patterns for children to understand the values of worship according to Islamic teachings.

Abstract

This article aims to describe the contribution of the values of Tariqat Naqshabandiyah in fostering the morals of students at the Darul Muta'allimin Islamic Boarding School, Aceh Singkil District. To describe the problem in depth and thoroughly, the researcher used a qualitative descriptive method, then the data was described, analyzed and discussed to answer the problem. From the results of the study it was found that students and congregations from the community who had attended khalwat suluk argued that practicing the Naqsayabandiyah Order could change their behavior in a better direction and welcomed the khalwat suluk worship held at the Darul Muta'allimin Islamic Boarding School in Aceh Singkil, where the goal is to get closer to Allah, is good and does not interfere, because the social relations of the khalwat congregation with the community are maintained, because the purpose of suluk activities in the Naqsyabandiyah Tariqat is noble to get the pleasure of Allah swt. so the benefits are peace of mind, always remembering Allah's commands and all His prohibitions, so that students and residents consider this activity very positive, because all things that have a good purpose to get closer to Allah will get good results too.
