Abstract

Abstract: This study aims to analyze the policy of the Village Head of Lesten as the head of a disadvantaged village in Gayo Lues Regency, Aceh Province in managing village fund budgets. The method used is the descriptive analysis by collecting information directly from the Lesten Village apparatus and reviewing regulations related to village management. The results showed that the policy of the Village Head of Lesten in managing the village fund budget based on information obtained by researchers from interviews with several village officials revealed some mismanagement in the management of village government by the village head. This is related to the principles that must be present in the village government as regulated in the Village Law and Permendagri Number 1 of 2016 concerning Village Asset Management, the policy of managing village fund budgets by the village head of Lesten has not complied with the regulations that have been outlined. Abstrak: Penelitian ini bertujuan untuk menganalisis kebijakan Kepala Desa Lesten sebagai kepala desa tertinggal di Kabupaten Gayo Lues Provinsi Aceh dalam pengelolaan anggaran dana desa. Metode yang digunakan adalah deskriptif analisis dengan mengumpulkan informasi langsung dari perangkat Desa Lesten dan mengkaji peraturan-peraturan terkait pengelolaan desa. Hasil penelitian menunjukkan kebijakan Kepala Desa Lesten dalam pengelolaan anggaran dana desa berdasarkan informasi yang didapatkan peneliti dari wawancara sejumlah perangkat desa mengemuka beberapa mismanagement dalam pengelolaan pemerintahan desa oleh kepala desa. Hal ini bila dikaitkan dengan prinsip yang wajib hadir dalam pemerintahan desa yang diatur dalam Undang-Undang Desa dan Permendagri Nomor 1 Tahun 2016 Tentang Pengelolaan Aset Desa maka kebijakan pengelolaan anggaran dana desa oleh kepala Desa Lesten belum memenuhi peraturan-peraturan yang telah digariskan.

Abstract

The Employment Social Security Administration (BPJS) is the responsibility and obligation of the State that focuses on social security and labor protection in Indonesia to provide socio-economic protection to the community by organizing Work Accident Insurance (JKK), Death Insurance (JKM), Old Age Security programs (JHT), and Retirement. In accordance with the state's financial capacity. With the existence of BPJS for Employment, it is proper to help workers who are at risk and get the compensation or services that should be obtained. In this case the Gampong apparatus is required to become a participant of BPJS Employment in accordance with the Gampong's financial capacity. Riseh Tunong Village apparatus, Sawang District, North Aceh Regency, participated in two social security programs, namely the JKK and JKM programs. The contribution is calculated based on the percentage of wages/salaries per month, representatives from the Gampong apparatus will pay all other village equipment fees to the Lhokseumawe BPJS Employment office, the contributions are taken from the Gampong Revenue and Expenditure Budget (APBG). The purpose of this study was to determine the system of agreement and BPJS employment insurance benefits for the Gampong Riseh Tunong apparatus, Sawang District, North Aceh Regency. And to find out the review of the kafalah contract in the insurance agreement on BPJS employment on the Riseh Tunong Village apparatus, Sawang District, North Aceh Regency. This research is qualitative with descriptive analysis research type, namely the author uses field research methods and library research methods. The results of the study show that the substance of BPJS Employment is the same as conventional insurance. This is because there are two things that are not in accordance with sharia in the scheme that occurs in BPJS Employment, namely the element of transfer of risk (uncertainty) and interest-bearing loans in the determination of contributions.

Abstract

The inadequacy of the contract principle is included in the category of non-fulfillment of objective conditions, therefore with this opinion financing has been null and void by law. In the context of sharia this is not very good because it has consequences which are incompatible with the rules in religion. The Government has regulated through Bank Indonesia Regulation No.7 / 35 / PBI / 2005 dated September 29, 2005 concerning Commercial Banks conducting business activities based on Sharia Principles that regulate the Duties, Authorities and Responsibilities of the Sharia Supervisory Board (DPS), among others in the first point ensure and supervise the suitability of the Bank's operational activities against the fatwa stipulated by the DSN-MUI. Cases of contract cancellations have occurred, one of which at the Bukit Tinggi Court shows the control of the passive Sharia Supervisory Board (DPS). This study aims to determine the perceptions of Islamic bank managers on the decision to cancelation of financing contracts, especially murabahah and the function or role of the Sharia Supervisory Board of the Islamic bank. The Manager's perception of the cancellation of the murabahah financing contract by the Religious Court is very good and the Perception Manager of the Sharia Supervisory Board regarding the function of financing supervision in sharia banking is good.

Abstract

The employee safety is the responsibility of a company often ignored. The company is not optimal in doing safety effort for employees become one of its trigger. Welding garages in the sub-district of Tanah Jambo Aye is the company engaged in welding which has high level of potential hazard. In addition, the workers have to obtain the word safety that was listed in the law No. 13 year 2003 about employment. The problems will be discussed in this thesis are: (1) How is the employee safety guarantees system of welding garage in Tanah Jambo Aye sub-district? (2) How is the Islamic law perspective and the law No.13 year 2003 on the employee safety guarantees system of welding garage in Tanah Jambo Aye sub-district? . The first purpose of this research to know how is the employee safety guarantees system of welding garage in Tanah Jambo Aye. The last is to know how is the Islamic law perspective and the law No.13 year 2003 on the employee guarantees system of welding garage in Tanah Jambo Aye sub-district. The research methodology that is used in this research is descriptive analysis of Qualitative method. The result show the welding garage in Tanah Jambo Aye sub-district is less effective and not go well yet, because the welding garage company in that district do not provide perfect tool for personal protection in safety working, such as: hand protectors, masker, shoes, hat protections, and face protections. The risk happened in working or work accident can cause the employees disabled or injury, the all cases is not in full responsibility by the welding garage in Tanah Jambo Aye sub-district. This case less corresponding with Islamic concept, as intended in Maqashid Syari’ah by maintaining Al-umur al-dharuruyah that are maintaining the soul, religion, mind, descent, and treasure. Therefore, it can safety guarantee of the world and hereafter. Abstrak:Keselamatan pekerja Merupakan Tanggung jawab perusahaan yang sering diabaikan oleh perusahaan, salah satu penyebabnya adalah kurang optimalnya perusahaan dalam menyelenggarakan upaya keselamatan bagi karyawannya. Bengkel Las Kecamatan Tanah Jambo Aye merupakan perusahaan yang bergerak dibidang pengelasan yang memiliki tingkat potensi bahaya tinggi. Selain itu Keselamatan Kerja juga merupakan hak yang harus diperoleh pekerja yang sudah tercantum dalam Undang-undang No. 13 Tahun 2003 Tentang Ketenagakerjaan. Adapun Permasalahan yang di bahas dalam skripsi ini adalah: (1) Bagaimana Sistem Jaminan Keselamatan kerja Karyawan Bengkel Las Kecamatan Tanah Jambo Aye? (2) Bagaimana tinjauan Hukum Islam dan Undang-undang No.13 Tahun 2003 terhadap Sistem Jaminan Keselamatan kerja Karyawan Bengkel Las Kecamatan Tanah Aye? Tujuan Penelitian ini adalah Untuk mengetahui Bagaimana Sistem Jaminan keselamatan kerja Karyawan Bengkel Las Kecamatan Tanah Jambo Aye. Dan untuk mengetahui bagaimana tinjauan Hukum Islam dan Undang-undang No.13 Tahun 2003 terhadap Sistem Jaminan keselamatan Karyawan Bengkel Las Kecamatan Tanah Aye?. Metode yang digunakan dalam penelitian ini adalah metode Kualitatif yang berbentuk deskriptif analisis. Hasil Penelitian Menunjukkan bahwa Bengkel Las Kecamatan Tanah Jambo Aye dalam Melaksanakan Jaminan Keselamatan Kerja kurang Maksimal dan belum berjalan dengan baik karena Bengkel Las Kecamatan Tanah Jambo Aye belum sempurna dalam menyediakan alat-alat pelindung diri untuk keselamatan kerja Seperti: alat pelindung tangan, masker, sepatu, topi pelindung, alat pelindung wajah. Dan Bentuk Risiko yang terjadi dalam melakukan pekerjaan atau kecelakaan kerja yang dapat mengakibatkan para pekerja cacat ataau luka-luka, semua itu tidak di tanggung penuh oleh Bengkel Las Kecamatan Tanah Jambo Aye. Hal ini kurang sesuai dengan konsep Islam, sebagaimana yang dimaksud dalam Maqashid Syari’ah dengan memelihara Al-umur al-dharuriyah yaitu memelihara jiwa, agama, akal, keturunan dan harta sehingga dapat terjamin keselamatan dunia dan akhirat. Kata Kunci: Bengkel Las, Keselamatan Kerja, Hukum Islam, Hukum Ketenagakerjaan.

Abstract

Abstract: The problem concerning the land boundaries is the designation of land boundaries set by the landowner. Before the measurement of the land, the landowner must install pegs at each vertex of the boundary to be measured by the party determined. The measurement should be witnessed by the head of the village, the village officials, and the parties who are bordered with the land. The research problem was that the determination of boundary markers does not include the head of the village and the related parties bordered with the land. Instead, the landowner establishes the boundary markers by himself. The results indicated that all unresolved land boundary issues were due to the unwillingness of the community to report to the authorities. The procedure of land measurement should be conducted by placing pegs in advance on the land boundaries to be measured by the responsible party with several witnesses, and between the two the bordering parties, accompanied by the head of the village. This procedure controls the land boundary issues so it will cause no harm for the owner and other parties. Abstrak: Permasalahan penetapan batas tanah merupakan penunjukan batas-batas bidang tanah yang ditetapkan oleh pribadi (pemilik tanah itu sendiri) sebelum dilaksanakan pengukuran atas bidang tanah pemilik tanah harus memasang patok pada setiap titik-titik sudut batas yang akan diukur oleh pihak yang telah ditentukan. Disaksikan oleh kepala desa, aparatur-aparatur desa, dan para pihak yang berbatasan tanah. Permasalahan yang terdapat dalam penelitian bahwa penetapan tanda batas tidak diikutserta oleh kepala desa dan para pihak yang berbatasan tanah, akan tetapi pihak pribadi tanah mendirikan tanda batas dengan sendirinya. Hasil dari penelitian menunjukkan bahwa segala bentuk permasalahan batas tanah ada yang belum terselesaikan dikarenakan masyarakat tidak ingin melaporkan kepada pihak berwajib. Prosedur penetapan pengukuran tanah seharusnya dengan cara memberi patok terlebih dahulu pada batas tanah yang akan diukur oleh pihak penanggung jawab dengan beberapa saksi dan antara kedua belah pihak yang berbatasan disertai kepala desa. Hal ini untuk pengendalian permasalahan batas tanah agar tidak terjadi hal-hal yang tidak merugikan diri sendiri dan pihak lain. Kata Kunci : Tatacara, Penetapan Batas Tanah, Konsep Mal ‘Uqar.

Abstract

Abstract: Principally, each agreement made by the parties expects the parties to conduct their performance as they should. However, there is a discrepancy between theory and practice. If one party in an agreement does not fulfil its obligations properly, then the party is said to have defaulted (breached the contract). The cases of defaults occur in the financing of ARRUM Products in Pegadaian Syariah (sharia pawnshop), the customers are delayed in repayment of the loan instalment, resulted in fines when it is due. The results of the study concluded that the customer and the sharia pawnshop determined the product financing mechanism. Defaults were subject to additional fees, especially for those who do not pay the loan instalments for three consecutive months. The sharia pawnshop had settled the defaults per sharia law by charging additional fees to the customers who can afford to pay the debts but neglect on their obligations. This process is based on the Fatwa of the National Sharia Board-MUI Number 43 of the Year 2004 concerning Compensation (Ta'widh). Abstrak: Setiap perjanjian yang dibuat oleh para pihak prinsipnya adalah menghendaki agar para pihak melaksanakan prestasinya sebagaimana mestinya, akan tetapi terdapat perbedaan antara teori dan praktiknya, ketika dalam suatu perjanjian apabila salah satu pihak tidak memenuhi kewajibannya dengan semestinya, maka pihak tersebut dikatakan telah wanprestasi (Ingkar Janji). Dalam pembiayaan Produk ARRUM di pegadaian Syariah terdapat kasus wanprestasi. Bentuk-bentuk wanprestasi yang dilakukan oleh nasabah berupa suatu keterlambatan dalam pembayaran angsuran pinjaman, yang mengakibatkan dikenakan denda ketika telah jatuh tempo. Hasil penelitian menyimpulkan bahwa mekanisme pembiayaan produk telah di tentukan oleh pihak nasabah dengan pihak pegadaian Syariah. Wanprestasi dikenakan biaya tambahan, khususnya bagi yang tidak melaksanakan pembayaran angsuran pinjaman selama 3 bulan secara berturut-turut. Sementara proses penyelesaian wanprestasi yang dilakukan oleh pihak pegadaian Syariah sudah sesuai dengan hukum Islam dimana pihak pegadaian memberikan biaya tambahan kepada nasabah yang mampu untuk membayar hutang tetapi melalaikan kewajibannya, yang sesuai dengan Fatwa Dewan Syariah Nasional-MUI No. 43 tahun 2004 tentang Ganti Rugi (Ta’widh). Abstract

Abstrak Bagian Hubungan Masyarakat Badan Kepegawaian Negara menjelaskan melalui media bahwa pembagian gaji pegawai negeri sipil kepada anak dan istri pasca perceraian biasanya hanya terjadi saat awal perceraian saja tapi setelahnya ada yang tidak berlanjut. Seperti kasus yang terjadi pada Pengadilan Agama Kuta Cane Aceh Tenggara dengan putusan Nomor 0034/Pdt.G/2014/MS.KC telah memutus perkara nafkah anak yang hasil putusan tersebut tidak dijalankan sepenuhnya oleh pihak laki-laki (bekas suami yang PNS). Sebagaimana diketahui juga bahwa pembayaran gaji pegawai negeri sipil dilakukan dengan cara langsung ke rekening pegawai negeri oleh bendahara. Tujuan dari penelitian ilmiah ini adalah untuk mengetahui peran dan tugas pegawai pranata keuangan dalam menghadapi putusan pengadilan agama khususnya perintah eksekusi nafkah anak pegawai Negeri Sipil yang telah bercerai. Penelitian ini berbasiskan pada library research dengan teknik menggali sumber-sumber referensi yang menjelaskan konsep, aturan atau dasar hukum tugas bendahara dan jabatan pranata keuangan. Kesimpulan penelitian ini, dengan mempertimbangkan mekanisme pembayaran gaji pegawai negeri sipil, bahwa peran pranata keuangan dilakukan dengan landasan Permenpan Nomor 54 Tahun 2018 menyebutkan bahwa tugas dan wewenang lainnya dari pranata keuangan adalah memastikan telah terpenuhinya kewajiban pembayaran kepada Negara oleh pihak yang mempunyai hak tagih kepada Negara. Pada pasal yang sama, bendahara pengeluaran juga mempunyai tugas dan wewenang untuk melaksanakan pemotongan/pemungutan dari pembayaran yang dilakukannya atas kewajiban kepada Negara.

Abstract

AbstractThis study aims to determine how the perspective of Islamic law on special protection for whistleblowers and witnesses is regulated in existing law in Indonesia, especially in Government Regulation No.57 of 2003 concerning Special Protection Procedures for Reporters and Witnesses to the Crime of Money Laundering. As normative juridical law research and is analyzed using descriptive-analytical methods, namely by analyzing the data under study by describing these data, then the conclusion is drawn. Special protection is a form of protection provided by the state to guarantee a sense of security for Reporting Parties or Witnesses from possible threats that endanger themselves, their lives, and/or their assets including their families. Criminal provisions in positive law, namely those regulated in Legislation Number 31 of 1999, for perpetrators who threaten and intimidate witnesses and whistleblowers can be subject to imprisonment and fines. In Islam, giving testimony is ordered directly in the Koran so that maintaining the safety of witnesses is also very important. The perspective of Islamic law on the form of special protection for whistleblowers and witnesses in criminal acts, in particular, the Crime of Money Laundering in positive law in Indonesia has met the values in the objectives of Islamic law (maqashid al-shari'ah). This is regulated in the Positive Law in Indonesia which regulates sufficiently the rights of a witness and also a whistleblower of a crime.AbstrakPenelitian ini bertujuan untuk mengetahui bagaimana perspektif hukum Islam terhadap perlindungan khusus bagi saksi dan pelapor yang diatur dalam hukum positif di Indonesia, khususnya Peraturan Pemerintah No.57 Tahun 2003 tentang Tatacara Perlindungan Khusus Bagi Pelapor dan Saksi Tindak Pidana Pencucian Uang. Penelitian ini termasuk penelitian hukum yuridis normative dan dianalisis dengan menggunakan metode deskriptif analitik yaitu dengan cara menganalisa data yang diteliti dengan memaparkan data-data tersebut, kemudian diperoleh kesimpulan. Perlindungan khusus adalah suatu bentuk perlindungan yang diberikan oleh negara untuk memberikan jaminan rasa aman terhadap Pelapor atau Saksi dari kemungkinan ancaman yang membahayakan diri, jiwa dan/atau hartanya termasuk keluarganya. Ketentuan pidana secara eksplisit diatur dalam Undang-Undang No.31 Tahun 1999, bagi pelaku yang melakukan ancaman dan intimidasi terhadap saksi dan pelapor dapat dikenakan pidana penjara dan denda. Perspektif hukum Islam terhadap bentuk perlindungan khusus terhadap pelapor dan saksi dalam tindak pidana, khususnya Tindak Pidana Pencucian Uang dalam hukum positif di Indonesia telah memenuhi nilai-nilai dalam tujuan syariat Islam (maqashid al-syari’ah). Hal ini secara terang diatur dalam Hukum Positif di Indonesia yang mengatur secara cukup hak daripada seorang saksi dan juga pelapor tindak pidana.

Abstract

The purpose of this study is to describe these two opinions and the points of their study of the final legal status of investment activities using zakat funds. As a type of library research, this research uses the literature data which concluded two perspectives of ulama that allow and reject investment by using funds from zakat. Results reveal considerations of the view that permits the investment of zakat funds is to take hadith values from Zaid bin Aslam, namely the practice of Rasulullah SAW and Caliph Umar Bin Khattab who made use of the zakat wealth before it was delivered to his mustahik. This opinion also paid attention to the ijtihad or law policy of the caliph Umar bin Khattab who sought the property of orphans, stopped paying zakat for muallaf, and replaced fa'i for the soldiers by giving monthly salaries from Baitul Maal. Opinions that do not allow the investment of zakat funds stand on a hadith from Aisha RA, "Whoever practices a charity that my orders are not given to him, he is rejected". Investing zakat’s assets is considered to inhibit the ownership of zakat by mustahik individually. Whereas zakat has been linked to mustahik ownership rights. Investing zakat funds is considered to have no references and it is feared that this will eliminate the spirit of worship compulsory and potentially zakat changes to be business-oriented.

Abstract

According to Law Number 6 of 2014 concerning Villages, villages have a strategic and vital role in development which is carried out using the development budget in the form of Village Fund Allocation (ADD). Villages can self-manage the use of village funds by procuring goods and services. Procurement of goods or services using village funds often experiences problems because the providers do not hand over the product to the activity execution team. This situation happens even though the provider has received a down payment for purchasing goods the village needs. As a result, development in the village is constrained. This condition gave rise to disputes between the activity execution team and the appointed goods or service provider, which may be reported to the authority. Disputes between the activity execution team and the provider in procuring goods and services using village funds are settled through administrative and civil law because the act is a default. The settlement is carried out through discussions to achieve consensus. If it fails, the settlement is carried out through discussions led by the village head. If it fails again, the procurement contract resolution service will conduct the settlement. The final way of settlement is by filing a lawsuit in court, not through criminal law. Abstrak: Undang-Undang Nomor 6 Tahun 2014 tentang Desa, menempatkan desa mempunyai peran strategis dan penting dalam pembangunan, melalui anggaran pembangunan secara dalam bentuk Alokasi Dana Desa (ADD). Desa dalam melaksanakan swakelola penggunaan Dana Desa dapat melakukan pengadaan barang dan jasa. Pelaksanaan pengadaan barang/jasa yang dilakukan dengan menggunakan dana desa yang melibatkan penyedia barang/jasa sering mengalami permasalahan yang disebabkan penyedia barang/jasa tidak menyerahkan barang yang dibutuhkan oleh desa kepada Tim Pelaksana Kegiatan (TPK). Sementara penyedia barang/jasa sudah menerima dana dalam bentuk panjar, untuk kebutuhan pembelian barang yang dibutuhkan oleh desa, sehingga pelaksanaan pembangunan di desa menjadi terkendala. Kondisi ini menimbulkan perselisihan antara Tim Pelaksana Kegiatan (TPK) di Desa dengan pihak penyedia barang/jasa yang sudah ditunjuk, bahkan sampai membuat laporan ke penegak hukum. Penyelesaian perselisihan antara Tim Pelaksana Kegiatan (TPK) dengan Penyedia dalam pengadaan barang dan jasa yang menggunakan dana desa dilakukan melalui hukum administrasi dan hukum perdata karena perbuatan tersebut adalah wanprestasi. Sehingga penyelesaian sengketa yang terjadi antara penyedia dan TPK dilakukan melalui musyawarah untuk mencapai mufakat. Apabila tidak berhasil, maka penyelesaian perselisihan dilakukan melalui musyawarah yang dipimpin oleh Kepala Desa. Apabila tidak berhasil juga maka penyelesaian perselisihan tersebut dapat dilakukan melalui Layanan Penyelesaian Sengketa Kontrak Pengadaan dan jalan terakhir penyelesaian tersebut dengan cara mengajukan gugatan ke pengadilan. Jadi bukan melalui jalur hukum pidana. Kata Kunci: Penyelesaian Sengketa, Hukum Penyedia Barang, Dana Desa, Penegakan Hukum, Gugatan Di Pengadilan
