Abstract

One important thing that must be considered in the use of nuclear and other radioactive materials is the process of transporting radioactive substances through the sea. This paper will analyze the optimization of the supervisory authority of BAPETEN in the transportation of radioactive substances, especially in the process of transporting radioactive substances by sea. Option to choose the sea because most of Indonesia's territory is the sea. If it has the authority, Bapeten's supervisory authority will then be analyzed in the process of transporting radioactive substances via the sea lane. Recommendations from this article are a form of juridical liability if an error occurs, which causes a loss in the process of transporting radioactive substances by sea. Because the process of transporting radioactive substances is essential in preventing the occurrence of radiation, the regulatory authority in the transportation process must be regulated in detail based on the precautionary principle, as well as the form of juridical accountability.

Abstract

This study aimed to analyze changes in the provisions for registering limited partnership after enacting the Minister of Law and Human Rights Regulation Number 17 of 2018 and the position of Minister of Law and Human Rights Regulation Number 17 of 2018 on the hierarchy of laws and regulations in Indonesia. The type of research used was normative juridical law with a conceptual, historical, and statutory approach. After the enactment of Minister of Law and Human Rights Number 17 of 2018, the authority to register limited partnerships, which was previously the authority of the Minister of Trade, was transferred to the Minister of Law and Human Rights. The position of Minister of Law and Human Rights Regulation Number 17 of 2018 is seen from the procedure for forming ministerial regulations that do not meet the requirements as implementing regulations and are contrary to the principle of business certainty.

Abstract

Melihat ketimpangan antara jumlah kasus korupsi pejabat pemerintahan dengan jumlah permohonan pengujian penyalahgunaan wewenang pada pengadilan yang memiliki selisih cukup signifikan, maka perlu adanya perhatian serius dari berbagai kalangan. Hak mengajukan permohonan pengujian penyalahgunaan wewenang sebagaimana pasal 21 ayat (1) Undang-Undang Nomor 30 Tahun 2014 tentang Administrasi Pemerintahan, ternyata belum sepenuhnya dimanfaatkan oleh para pejabat pemerintahan. Tujuan dari penelitian ini adalah untuk menjelaskan aspek yuridis empiris terhadap implementasi hak pengujian penyalahgunaan wewenang oleh pejabat pemerintahan di lingkungan pemerintah Kota Malang guna mewujudkan good governance. Metode pendekatan pada penelitian ini adalah pendekatan analisis kualitatif yang berdasar pada data primer berupa wawancara dan observasi serta data sekunder berupa dokumen resmi dari lokasi penelitian, internet dan regulasi yang berlaku. Hasil penelitian menunjukan bahwa secara yuridis empiris, kurangnya pengetahuan dan pemahaman para pejabat pemerintahan akan eksistensi hak pengujian penyalahgunaan wewenang sebagaimana pasal 21 ayat (1) Undang-Undang Administrasi Pemerintahan berpengaruh terhadap tidak dimanfaatkannya sarana perlindungan hukum secara optimal.

Abstract

ABSTRAKPemerintah pada hakekatnya menyelenggarakan fungsi pelayanan publik kepada masyarakat. Karena itu pemerintah berkewajiban dan bertanggungjawab untuk memberikan pelayanan publik yang baik dan professional, namun pelayanan publik yang diberikan oleh penyelenggara pelayanan publik di rasa masih belum maksimal, hal ini di tandai dengan masih banyaknya praktik-praktik Maladministrasi dan pengaduan dari masyarakat. Ombudsman Republik Indonesia yang dibentuk dan disahkan dalam Undang-Undang Nomor 37 Tahun 2008 Tentang Ombudsman Republik Indonesia, yang memiliki tugas dan fungsi untuk mengawal proses pelayanan publik yang efisien, efektif, dan terlepas dari kolusi, korupsi, dan nepotisme (KKN). Selain itu Ombudsman juga memiliki wewenang dalam menyelesaikan sengketa pelayanan publik dengan cara mediasi, konsiliasi dan ajudikasi khusus atau ganti rugi yang dapat di putus oleh Ombudsman. Kenyataannya Ombudsman hanya mampu memberikan rekomendasi kepada terlapor, untuk tindakan selanjutnya tergantung dari itikad baik terlapor, karna rekomendasi yang di berikan oleh Ombudsman tidak bersifat mengikat. Selain itu terdapat ketidak relevasian antara Undang-Undang Pelayanan Publik dan Undang-Undang Ombudsman sehingga perlu adanya pembaharuan dalam kedua Undang-Undang tersebut, dan perlu di atur lebih lanjut terkait Peraturan Presiden Tentang mekanisme dan tata cara pembayaran ganti rugi ajudikasi khusus.Kata kunci: ajudikasi khusus; ombudsman; pelayanan publik; urgensi. ABSTRACTThe government is essentially carrying out the function of public services to the community. Therefore the government is obliged and responsible to provide good and professional public services. However, the public services provided by the public service providers are felt still not optimal, this is marked by the many practices of maladministration and complaints from the community. The Ombudsman of the Republic Indonesia which was formed and approved in UUD (Indonesian constitution) Number 37 of 2008 concerning of the Ombudsman of the Republic Indonesia, which has the duty and function to oversee the process of public services that is efficient, effective, and free from collusion, corruption and nepotism. In addition, the Ombudsman also has the authority to resolve public service disputes by means of mediation, conciliation and special adjudication or compensation that can be decided by the Ombudsman. In reality the Ombudsman is only able to provide recommendations to the reported, for further action depends on the reported good faith, because the recommendations given by the Ombudsman are not binding. In addition, there is an irrelevance between the Public Service Act and the Ombudsman Law, so there is a need for reforms in both of these Laws, and it needs a renewal to the both of the Act, and also needs to be regulated further related to the Presidential Regulation concerning the mechanism and procedures for paying special adjudication compensation.Keywords: ombudsman; public services; special adjudication; urgency.

Abstract

AbstractThe Job Creation Law passed and enacted in 2020 is a momentual result with the expectation that the Law will create jobs. But after the passage of the Job Creation Law with the use of the omnibus law method, it produced various responses and reactions from the community so that the community also among academics produced pros and cons to the Law. In addition, after the Uncang-Cipta Kerja Law was passed, it has had an impact on the elimination of industries included in the negative investment list, triggering an increase in foreign investment in Indonesia. Based on the description, a problem was formulated: what is the legal politics behind the change in licensing norms and the investment climate in the Job Creation Law using the omnibus law method. The research method used in the writing of this article is the use of legal normative research. The source of legal materials used includes 3 (three) types of legal materials, namely primary legal materials, secondary legal materials, and tertiary legal materials. Legal data collection techniques use a literature research model that analyzes the legal data studied in the form of qualitative and descriptive content analysis. The results showed that the government’s efforts to reduce duplication of regulations through comprehensive legislation are expected to accelerate licensing.Keywords: Omnibus Law; UU Cipta Kerja; Licensing; Investment. AbstrakUndang-Undang Cipta Kerja yang disahkan dan diundangkan pada tahun 2020 merupakan suatu hasil momentual dengan harapan dari Undang-Undang tersebut ialah menciptakan lapangan kerja. Tetapi pasca pengesahan Undang-Undang Cipta Kerja dengan penggunaan metode omnibus law tersebut menghasilkan berbagai tanggapan dan reaksi dari lapisan masyarakat sehingga masyarakat pun juga dikalangan akademisi menghasilkan pro kontra terhadap Undang-undang tersebut. Selain itu, pasca Undang-Undang Cipta Kerja disahkan telah berdampak pada penghapusan industri yang masuk dalam daftar negatif investasi sehingga memicu peningkatan investasi asing di Indonesia. Berdasarkan uraian tersebut, dirumuskan masalah: apa politik hukum dibalik perubahan norma perizinan dan iklim investasi dalam UU Cipta kerja menggunakan metode omnibus law. Metode penelitian yang dipakai pada penulisan artikel ini ialah penggunaan penelitian normatif hukum. Sumber bahan hukum yang digunakan meliputi 3 (tiga) jenis bahan hukum, yakni materi hukum primer, materi hukum sekunder, serta materi hukum tersier. Teknik pengumpulan data hukum menggunakan model penelitian kepustakaan yang menganalisis data hukum yang diteliti berupa analisis isi kualitatif dan deskriptif. Hasil penelitian menunjukkan bahwa upaya pemerintah untuk mengurangi duplikasi regulasi melalui undang-undang yang komprehensif diharapkan dapat mempercepat perizinan.Kata Kunci: Omnibus Law; UU Cipta Kerja; Perizinan; Investasi.

Abstract

Tulisan ini bertujuan untuk mengkaji bagaimana prosedur yang ideal dalam penyerahan protokol notaris yang telah berumur 25 tahun atau lebih kepada MPD serta bagaimana konsep sanksi yang ideal terhadap MPD atas tidak diserahkannya protokol notaris tersebut. Guna mendekati masalah ini dipergunakan pendekatan konseptual (conceptual approach) dan pendekatan perundang-undangan (statute-approach). Data-data dikumpulkan melalui pengkajian peraturan perundang-undangan yang berlaku atau yang diterapkan terhadap suatu permasalahan hukum tertentu dan dianalisis secara kualitatif. Kajian ini menyimpulkan bahwa perlu adanya sosialisasi mengenai protokol notaris yang berumur 25 tahun atau lebih oleh MPD kepada notaris, memberikan jangka waktu 30 hari dalam penyerahan protokol tersebut yang kemudian MPD mencatat dalam database dan menyimpannya di kantor yang representatif agar memudahkan jika suatu saat notaris perlu mengeluarkan salinan akta ataupun grosse.

Abstract

AbstractThis research article discusses about the Tax Amnesty in the Context of Tax Law Reform in Indonesia. The problems discussed was associated with remission of taxes in the tax law in Indonesia. The purpose are to analyze the tax amnesty in the context of the reform of tax law in Indonesia. The author uses the normative legal method. The result show that the treatment received by the receiving facility from tax amnesty is reporting assets that have not been reported and do a random payment in accordance with applicable regulations.Sunset Policy is a program provided by the government to remover sanctions taxation in accordance with Law Number 28 in 2007 on General Provisions and Tax Procedures policy.  AbstrakTulisan ini membahas mengenai konseptualisasi pemberlakuan Tax Amnesty dalam Konteks Reformasi Hukum Pajak di Indonesia. Permasalahan yang dibahas dalam penelitian ini adalah terkait dengan pemberlakuan pengampunan pajak dalam hukum pajak di Indonesia. Tujuan penulisan ini adalah untuk menganalisis pengampunan pajak dalam konteks reformasi hukum pajak di Indonesia. Penulis menggunakan metode yuridis normatif. Hasil penelitian menunjukkan bahwa pemberlakuan tax amnesty yang diterima oleh penerima fasilitas pengampunan pajak adalah pelaporan aset yang belum dilaporkan dan melakukan pembayaran uang tebusan sesuai dengan peraturan yang berlaku. Sunset Policy merupakan program yang diberikan oleh pemerintah untuk menghapus sanksi dibidang perpajakan sesuai dengan Undang-Undang Nomor 28 Tahun 2007 tentang Ketentuan Umum dan Tata Cara Perpajakan.

Abstract

The research analyses whether the regulations concerning the mechanisms of control and evaluation of regional regulations on taxes and levies, as outlined in Law No.1 of 2022, comply with the concept of regional autonomy in Indonesia. With normative juridical approach, this research found that the mechanisms of control and evaluation of regional regulations on taxes and levies do not comply with the concept of regional autonomy. However, such mechanisms are required in Indonesia as a unitary state that is based on autonomy, since no system of autonomy works in the absence of control. Nonetheless, in this case, the supervisory authority given to the central government, in the form of preventive and repressive supervision, tends to cause too much interference in the process of shaping policies regarding regional taxes and levies, which should be within the authority of regional governments. Therefore, assertive and specific provisions should be made to prevent intervention by the central government that goes beyond what is required

Abstract

This study aims to analyze the validity of the designation of acting regional heads as an implication of the postponement of the 2022 and 2023 regional elections. This research is normative, with a statutory and analytical approach. The primary legal material is Law Number 10 of 2016 concerning  Regional Head Elections. Secondary legal materials are articles, books, and research findings gathered through normative research and analyzed using a research methodology. The results showed that the implication of postponing the 2022 and 2023 regional elections caused a vacancy in the position of the regional head, which had implications for the appointment of the TNI/Polri as acting regional head, which deviated from the state rule of law. Based on the decision of the Constitutional Court, the TNI/ Polri can occupy civilian positions if they retire or resign from active service and have gone through the process openly and competitively. Meanwhile, the mechanism for appointing acting regional heads from the TNI/ Polri who are still active has been contrary to the principle of the procedure for the validity of the actions of government officials. So that the government needs to immediately issue a government regulation related to the mechanism for appointing acting regional heads due to the postponement of technical regional elections so that the appointment can have a basis in the selection mechanism and qualification of acting regional heads democraticallyThis study aims to analyze the validity of the designation of acting regional heads as an implication of the postponement of the 2022 and 2023 regional elections. Abstract

Judicial decisions must have legal implications for relevant parties. PMK No. 2/PUU-XIX/2021 remains debatable between creditors and debtors because it seemingly weakens the protection of creditors' rights. Creditors cannot immediately carry out enforcement procedures that cut off the creditor's business flow because the position of the subject of fiduciary obligations is in the debtor's control, making it possible for disputes between debtors and creditors. This normative legal research was conducted using a philosophical, juridical approach covering statutory policies, conceptual and case approaches. PMK No. 2/PUU-XIX/2021 does not regulate creditor legal provisions in enforcing fiduciary securities, making it difficult for creditors to execute them. The Constitutional Court should decide to guarantee justice for all parties and provide a decision with clear content and sentence structure, so multiple interpretations will not occur. The execution of fiduciary securities during the Covid-19 pandemic should not be immediately carried out because the creditor had to follow the predetermined procedures.
