Abstract

Providing legal protection for buyers condotel as consumers from developers so legal aspects transition trading should be understood by the buyers as consumers. In the process of the buying and selling of fixed objects such as land, the house, apartment or other property often do we hear terms of agreement? How legal protection for buyers through a binding agreement trading condotel? Methods used in in writing this is normative, referring to act- act which is, law no. 1 year 2020 about flat. In general the contents of a binding agreement trading is the agreement a seller to fastens self will sell them to buyer and accompanied the provision of a sign so or money the based on the agreement. Abstract

Abstract

The policy of implementing Law Number 5 of 1960 concerning Basic Agrarian Regulations (UUPA) is centered on services for the people, especially the peasantry, which is the largest part of the Indonesian people whose economic conditions are weak. Abstract

Berkembang atau matinya usaha kecil menengah dalam era perdagangan bebas tergantung dari kemampuan bersaing dan peningkatan efisiensi serta membentuk jaringan bisnis dengan lembaga lainnya. Dengan demikian permasalahan yang terjadi bagaimanakah tata kelola usaha UKM sistem syariah dijalankan. Tujuan dalam kegiatan bisnis UKM tidak lepas dari sistem keuangan karena bagaimanapun antara pasar uang dan pasar riil saling terkait dan saling membutuhkan. Akan terjadi transaksi baik sebagai penabung maupun sebagai yang membutuhkan dana untuk mengembangkan bisnis UKM). Bisnis UKM bergerak dalam pembiayaan dalam setiap transaksi kredit tidak mengenal bunga, baik dalam menghimpun tabungan investasi masyarakat ataupun dalam pembiayaan bagi dunia usaha yang membutuhkannya. Motode dengan mengkaji berbagai peraturan, literatur yang berhubungan dengan pemasalahan penelitian guna mendapatkan bahan hukum. Data yang diperoleh dianalisis secara yuridis kualitatif untuk mencapai kepastian hukum, dengan memperhatikan hierarki peraturan perundangan sehingga tidak tumpang -tindih serta menggali nilai yang hidup dalam masyarakat baik hukum tertulis maupun hukum tidak tertulis. Abstract

In encouraging the business world to run well, bank institutions must be able to provide more extreme strategies, that if banks want to get out of a slump, then banks should not use old methods or ways of marketing their products and services. Corona has deconstructed the banking order/system that has been running so far the Covid-19 pandemic has forced individuals/groups/institutions/countries to change their lifestyle and behavior so far. If an individual / group / institution / country does not make changes, then the changes will automatically crush them, without exception in the banking business sector. Several business sectors have been affected by the coronavirus (Covid-19) pandemic, including the banking sector. Therefore, in order for the banking sector to continue to exist in the midst of the corona virus pandemic, banks must carry out risk mitigation carefully, and use creative strategies to deal with current uncertain conditions. Banks must immediately adapt to the conditions of the Corona virus pandemic by implementing new strategies, and returning to the path of good performance. Abstract

The residential property sector in Indonesia remains attractive even though there are several factors that have hampered growth over the past two years. The ownership for singles related to property refers to Government Regulation Number 40 of 1996 concerning Building Use Rights, Business Use and Use Rights to Land; Government Regulation Number 41 of 1996 concerning Housing or Residential Houses by Foreigners Domiciled in Indonesia; Law Number 25 of 2007 concerning Investment. Secondly, foreigners can buy or own a house in Indonesia above usufructuary rights, but the maximum time period given is 10 years for land under 2000 square meters. At present, more than 50% of Indonesia's population lives in urban areas. This means that there will be more houses, apartments and condominiums to be built in Indonesian urban areas to meet growing demand. This situation also implies that due to lack of land availability in urban areas, prices tend to rise rapidly, while developers need to increasingly focus on vertical property development such as apartments and condominiums.

Abstract

The important role in the simple patent of technology-based development is absolutely necessary to support the success of economic sector development. The functions and roles of such patents are important in supporting technological development in supporting the success in the field of technology. It is necessary to have a legal field that regulates legal protection if an invention in the field of technology is misused by another person who is not entitled to use it. The legal instruments are in the form of a patent law contained in Law Number 6 Year 1998 as amended and refined by Law Number 13 of 1997. The number of patent applications originating from within the country is 229 pieces or 1.82 percent of all patent applications. While the number of simple patent requests originating from within the country is 153 pieces or 41.02 percent of all simple patent requests. Looking at the numbers above, in the period of approximately five years since the entry into force of the UUP, it turns out that this patent registration request is still widely used by technology inventors (inventory originating from abroad (WNA), while those from within the country (Indonesian citizens) ) fewer numbers both in the field of patents and simple patents.

Abstract

The development of a residential property in business so attractive to operators property so that growth is very fast. Accompanied the population growth of it so dwelling that is required quite big so very interesting to handle market by developers because it very promising the property business.The purpose of this study is how the legal protection for condotel buyers using PPJB. This research method uses a normative legal study method that includes writing through the norms published in laws and regulations relating to regulations in the legal process and costs that lead to the implementation of buying and selling through PPJB. with the provisions of the Constitution number 20 of 2011 is expected to be in accordance with the applicable provisions. Results The responsibility of the payment of scope to make good the loss for business operators, namely a. demands based on defaults; and b. demands by all accounts unlawfully if it is associated Loss to the scope of their responsibilities, so any change to the hotel operator in the sphere of responsibility.

Abstract

Abstrak Terjadinya pelanggaran hukum yang dilakukan developer dalam perjanjian yang dibuat tidak mampu membangunnya condotel sesuai yang diperjanjikan pada para pembeli selaku konsumen. Atas tindakan tersebut terjadi jika salah satu pihak tidak melakukan kewajibannya sehingga ada pihak lain yang merasa di rugikan maka pihak yang merasa di rugikan atau di langgar hak-haknya harus mendapatkan perlindungan hukum. Dampak bagi pelaku usaha di antaranya dibidang property khususnya pengembang  atau developer yang mengalami kesulitan didalam merealisasi kan bangunannya sehingga lepas tanggungjawabnya berujung pada tindakan wanprestasi. Bagaimana perlindungan hukumnya bagi pembeli condotel atas tindakan wanprestasi developer ? Metode yang digunakan didalam penulisan ini adalah Normatif yang mengacu pada Undang-Undang yang ada yaitu Undang-Undang Nomor 20 tahun 2011 tentang Rusun sebagai akibatnya maka partum buhan disector property khususnya hunian condotel terjadi penurunan hal itu juga terjadi pada sector lain. Bagi konsumen agar memperoleh proteksi dan keamanan maka sangat dibutuhkan perlindungan hukum itu sendiri perlindungan hukum disebut proventif dan perlindungan hukum represif Dari perlindungan hukum preventif maka konsumen yang di rugikan diberikan kesem patan untuk mengajukan keberatan terhadap hak - haknya sebelum suatu keputusan Pemerintah mendapat bentuk yang devinitif. Setiap warga Negara ataupun segenap orang sebagai warga negara dapat mengaktualisasikan hak dan kewajiban mereka secara optimal dengan tertib dan optimal. Maka sangat diperlukan adanya perlindungan konsumen bagi pembeli condotel untuk memperoleh kepastian hukum sehingga akan memperoleh hak yang adil dimata hukum. Kata Kunci  :  Tindak wanprestasi serta perlindungan hukum

Abstract

AbstrakPerkembangan dalam dunia usaha property sangat menarik minat palaku usaha sehingga dengan konsep market yang menjajikan maka developer selaku pengembang secara aspek hukum memiliki tanggungjawab hukum yang sangat penting untuk itu bagi para calon pembeli. Selaku konsumen harus jeli dan paham terhadap pemberlakukan aturan hukum dalam perjanjian yang dibuat agar memperoleh kepastian hukum agar tidak terjadi konflik dikemudian hari. Jual beli hunian atau rumah secara umum diawali dengan sebuah PPJB sebagai pengikat antara developer dan konsumen rendahnya kesadaran dan pengetahuan konsumen sehingga memiliki resiko yang lebih besar mengenai hak-hak konsumen. Bagaimana tanggung jawab developer terhadap konsumen atas perjanjian jual beli hunian rumah dengan mekanisme perjanjian perikatan jual beli (PPJB). Metode  yang di gunakan Normatif yang mengacu pada undang - undang yang ada yaitu Undang-Undang Nomor 20 tahun 2011 tentang Rusun. Tujuan penelitian guna memperoleh tanggungjawab hukum  bagi pengembang pada para pembeli selaku konsumen sehingga ada kepastian hukum bagi masyarakat selaku pembeli dengan sistem PPJB yang diterapkan developer selaku pengembang harus bertanggungjawab kepada konsumen adalah menanggung kerugian yang dialami konsumen sebagai mana diatur didalam Pasal 19 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan Konsumen.Developer juga bertanggung jawab terhadap informasi yang benar serta jaminan kualitas bangunan. Tanggung jawab developer tidak hanya sampai disitu, saat pembangunanya hingga pada masa pemeliharaan developer juga bertanggungjawab atas kualitas bangunan hingga berakhirnya semua perjanjian pengikatan jual beli selesai. Kata Kunci : Tanggungjawab, Developer, Sistem PPJB
