Abstract

Oral Agreement in verdict number 106 / pdt.g / 2017 / pn.plk explain concerning the matter between Ahinny as a plaintiff and Lucia as one of a defendant . These problems starts with mutual agreement do online social gathering  that contained in facebook messenger, When the defendant won the online social gathering , the defendant as participant of that would no longer make the online social gathering contributions they were due to pay. The methodology of the research is normative method. The problem arises in this research is how the legal force of oral online social gathering  that using media application facebook messenger in proof in court in terms of the law of information and technology electronic number 11 years 2008. The online arisan oral agreement in this case is an oral agreement with mutual trust between one another and will give rise to rights and obligations among the participants. This agreement will have legal force if the parties have agreed to hold an arisan with a value of money or certain goods and within a certain period of time, then actually an agreement has occurred among the participants of the social gathering. Facebook is intermediary and Facebook is not a responsible for disputes or defaults that occur between the online arisan parties. Based on technological advances and the rapid development of information techniques, the Government should immediately recognize that electronic evidence must be recognized and used as evidence in court.

Abstract

Forests have significant function related biological diversity, habitat protection of flora fauna such as orangutan, tiger, elephant; climate-related functions such as carbon sequestration, air pollution; human settlements, human health, school activities, habitat for people, rural livelihoods; state defense as natural resources such as commercial industrial wood,  non-wood forest products, international and national trade; ecotourism, recreation. However the problem in Indonesia is forest fires. In order to maintain  its  functions, all the famers, forestry-concession owners, government, local government and private enterprise should prevent and suppress the forest fires through the existing law and regulations such as Constitution Law of 1945, Act Number 5 Year 1990, Act Number 22 Year 1999, Act Number 41 Year 1999, Act Number 1 Year 2009, Act Number 6 Year 1994 and Act Number 17 Year 2004 and aircraft operation conducted by foreign aircraft such as Australia, Canada, Malaysia, Russia and Singapore to assist Indonesian’s forest fires.Keywords: aircraft operation; forest fires; legal ground; liability; responsibility

Abstract

As a result of the influence of world globalization, with the rapid development of international relations and the development of information technology, the need to know about the law of other legal systems in the world is increasingly felt high so that lately the development of knowledge about comparative law is very fast. That is what is felt closely related to PT XYZ with PT ABC Sdn. Bhd. in Malaysia. So that in the end raises the problem of how the legal construction of digital product sales cooperation agreements with the Multi-Level Marketing (MLM) system between the two companies and what the implementation of the partnership between the two companies is like. Therefore, the purpose of the problem is to find out and describe in detail the model of the digital product sales agreement with the MLM system and how the implementation of the cooperation agreement should be carried out in the perspective of rules in Indonesia and Malaysia. If the existing law does not explicitly determine the cancellation of the prohibited agreement, it is not necessary and will be confusing to find the cause of the cancellation of the agreement (because of the prohibited cause). The agreement was canceled not based on the provisions of Article 1335 and 1337 of the Indonesian Criminal Code, but on the basis of the provisions of the law which stated it. The cause of the agreement is the purpose of the agreement made by the parties. However, it cannot be said that if the parties enter into an agreement means the purpose of the parties is to do the action (which is without a false or prohibited cause).

Abstract

President Jokowi signed the Law of the Republic of Indonesia No. 11 of 2020 on Job Creation (UU Cipta Kerja), but the Constitutional Court (MK) decided to conduct a judicial review. According to the Constitutional Court, the government must revise the Job Creation Law within two years. Two of the five petitioners for judicial review express concern about the Job Creation Law's inclusion of Specific Time Employee Agreements (PKWT). A Specific Time Employee Agreement is a contract between a business/employer and its employees for a specified period. The purpose of this study is to examine Specific Time Employee Agreements. This study employs a normative judicial methodology. The research is unique in discussing Specific Time Employee Agreements from two perspectives: the worker and the employer. Additionally, this research examines how Specific Time Employee Agreements have been implemented in practice thus far. The research concludes that workers lack understanding of Specific Time Employee Agreements, raising concerns about the Job Creation Law. The absence of a formulation regarding precarious work creates legal uncertainty for workers. Ineffective communication between the employer and employees has raised suspicions regarding the Specific Time Employee Agreement between the two parties. The Job Creation Law's socialization of labor cluster legislation requires improvement. To avoid misinterpretation, the definition of non-permanent work must be clarified

Abstract

This community engagement activity was held to give entrepreneurial assistance for SMEs in Belitung as an effort to enhance sustainable tourism. Partners in this activity are the Belitung Regency Government or more precisely 100 SMEs assisted by the Center for Integrated Service of Small Medium Enterprises and Cooperatives in Belitung. This mentoring activity is part of the Funding Assistance for the Independent Learning Policy Research Program on the Independent Campus, and Community Service Based on Research Results for Private Higher Education in 2021, organized by the Directorate General of Higher Education Research and Technology, Indonesian Ministry of Education, Culture, Research and Technology. In this community engagement activity, the Tarumanagara University team consisting of lecturers and students from the Faculty of Economics and Business, the Faculty of Law and the Faculty of Fine Arts and Design provides assistance that results in improving the marketing quality of SMEs products. Methods of implementation of activities include the analysis stage, the mentoring stage, and the reporting stage. Mentoring activities are divided into four sessions with each session followed by twenty-five SMEs. In each session, activities are also carried out in parallel in three small groups. During the assistance, the PKM team conducted an interview to find out the strengths, weaknesses and potentials possessed by each SMEs. The output of this activity is in the form of works in the form of logos, banners (physical and digital), packaging labels, packaging and digital advertising for SMEs. Broadly speaking, the results of this activities are able to provide direct benefits for partners to promote their products and expand market share.ABSTRAK:Kegiatan PKM ini diselenggarakan untuk memberikan pendampingan kewirausahaan bagi UMKM di Belitung sebagai upaya mendukung sustainable tourism. Mitra dalam kegiatan ini adalah UMKM binaan Pusat Layanan Usaha Terpadu Koperasi dan Usaha Mikro, Kecil dan Menengah Kabupaten Belitung. Kegiatan pendampingan ini merupakan bagian dari kegiatan Bantuan Pendanaan Program Penelitian Kebijakan Merdeka Belajar Kampus Merdeka, dan Pengabdian Kepada Masyarakat Berbasis Hasil Penelitian Perguruan Tinggi Swasta Tahun 2021, yang diselenggarakan Ditjen Dikti Ristek, Kemdikbud Ristek. Dalam PKM ini, tim Universitas Tarumanagara yang terdiri dari dosen dan mahasiswa dari Fakultas Ekonomi dan Bisnis, Fakultas Hukum dan Fakultas Seni Rupa dan Desain memberikan pendampingan yang menghasilkan peningkatan kualitas pemasaran produk UMKM. Metode pelaksanaan kegiatan meliputi tahap analisis, tahap pendampingan, dan tahap pelaporan. Kegiatan pendampingan terbagi ke dalam empat sesi dengan masing-masing sesi diikuti oleh dua puluh lima UMKM. Dalam setiap sesinya, kegiatan juga dilakukan secara paralel dalam tiga kelompok kecil. Selama pendampingan, tim PKM melakukan wawancara untuk mengetahui kekuatan, kelemahan serta potensi yang dimiliki dari masing-masing UMKM. Luaran dari kegiatan ini adalah berupa karya dalam bentuk logo, banner (fisik dan digital), label kemasan, kemasan serta iklan digital bagi UMKM. Secara garis besar, hasil kegiatan PKM mampu memberikan manfaat langsung bagi mitra untuk mempromosikan produknya dan memperluas pangsa pasar.

Abstract

Perkembangan ekonomi dan perdagangan menyebabkan timbulnya banyak permasalahan utang-piutang di dalam masyarakat dengan diikuti krisis moneter yang terjadi di Indonesia memberikan dampak negatif terhadap perekonomian nasional. Undang-Undang Nomor 37 Tahun 2004 tentang Kepailitan dan PKPU dibentuk guna memenuhi kepentingan dunia usaha dalam memenuhi kepentingan dunia usaha dalam menyelesaikan masalah-masalah utang-piutang secara adil, cepat, terbuka dan efeketif. Problematik terhadap tujuan UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU terdapat dalam ketentuan kreditor separatis yang dilakukan oleh sebuah bank, dimana kedudukan bank sebagai kreditor separatis masih belum berjalan secara optimal terutama perlindungan hukumnya yang belum secara tegas diberlakukan. Permasalahan yang timbul adalah bagaimana kedudukan bank sebagai kreditor separatis beserta perlindungan hukumnya di dalam Kepailitan berdasarkan UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU. Tujuan yang ingin dicapai adalah untuk mengetahui kedudukan dan perlindungan hukum bank sebagai kreditor separatis berdasarkan UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU. Metode penelitian yang digunakan adalah yuridis empiris dengan menggunakan data primer sebagai data utama selain data sekunder, melalui teknik observasi dan wawancara, dianalisis secara kualitatif dan disimpulkan secara induktif. Hasil penelitian diketahui bahwa dalam kepailitan, kedudukan bank sebagai kreditor separatis adalah bank sebagai kreditor yang istimewa, dikarenakan bank sebagai kreditor pemegang hak jaminan kebendaan yang dapat mengeksekusi jaminannya sewaktu-waktu apabila debitor cidera janji atau wanprestasi, Wujud perlindungan hukum terhadap bank adalah hak mengeksekusi jaminannya yang dapat dilakukan seolah-olah tidak terjadi kepailitan sebagaimana diatur dalam ketentuan pasal 55 UU No. 37 Tahun 2004 tentang Kepailitan dan PKPU.

Abstract

The Social Security Administering Body (BPJS) is a public legal entity formed to organize a social security program. Social Security Agency can alleviate the burden of society in obtaining health services in hospitals or clinics. This is in accordance with Article 5 Paragraph (1) and Paragraph (2) of Law No.36 Year 2009 on Health. and Article 47 Regulation of Health BPJS No.1 Year 2014 on the implementation of Health Insurance. As an insurance company BPJS health ensures the implementation of health programsHospitals and Clinics as health service providers in demand by the government to play an active role in providing good health services to the community according to its function, in accordance with Law Number 44 Year 2009 on Hospital. But even if the hospital or health service supports the social health insurance program or BPJS is proved by the poster that the Hospital or Clinic receive BPJS patients, does not mean that the service received by the community is in line with expectations.

Abstract

Introduction to The Problem: Symmetric information is an essential factor in the capital market. Symmetric information will create an efficient capital market. Insider trading is one of the things that makes asymmetric information. The regulations on the capital market determine the criteria for insider trading. Insider trading is people who have non-public information on the company and earn financial benefits from non-public information.Purpose/Objective Study: This research aims to determine the insider trading criteria on the Indonesian Capital Market Law Number 8 of 1995.Design/Methodology/Approach: This research uses the normative juridical method. The study utilizes several cases that occur in countries as a discussion.Findings: This research concludes that the definition of insider trading consists of stakeholders who have interests and non-public information on public companies. The scope of insider trading is also extended to family members of stakeholders. Stakeholders include management, related companies' employees, officials, suppliers, shareholders, and their family members. The definition of family members is the spouse, children, and parents. The definition of insider trading should be extended to the current regulations. The related individuals must carry out the obligation to report share ownership.Paper Type: Research Article

Abstract

The legal protection of Indonesian capital market investors is still very weak because they are unable to recover losses suffered due to violations of capital market laws and regulations by irresponsible persons. Although the government, both through laws and through the OJK with its regulations, has tried to accommodate investors' financial losses, in fact there is still a regulatory vacuum that is unable to cover losses due to violations that occur. In addition, the procedures that must be followed by investors as victims tend to make it difficult for investors in various aspects and do not even guarantee the certainty that investors can obtain compensation for their lost funds. Things like this encourage the government to innovate in optimizing investor legal protection until OJK adopts the United States' disgorgement concept to be applied in Indonesia by institutionalizing it into PKTS and DKKI supported by POJK Number 65/POJK.04/2020. The research method used is normative legal research with a statutory approach and a conceptual approach. From the research conducted, it is found that PKTS and DKKI are appropriate and relevant steps taken by OJK to achieve corrective justice for both investors and violators. However, the implementation of disgorgement in Indonesia is still not able to provide optimal protection so that it needs to be reviewed, especially with regard to the principles and mechanisms of its implementation.
