Abstract

Presidential term limit according to Article 7 of the 1945 Constitution (UUD) before the amendment should not be interpreted as only one measure namely in terms of quantity (limits on the term of office and the maximum period of office in office), but must regulate in terms of quality (legal norms and political ethics in commitment creating a democratic and competent government). As a result, every President in power will endeavor to presidential continuation by changing, avoiding, reinterpreting, amending the constitution or even presidential term limit in article 7 of the 1945 Constitution before the amendment. In the constitutional order, it will have implications for every President in power to form an authoritarian government and reduce democracy, abuse of the President's power to hold office continuously, give birth to an elected president who is incompetence in government administration, and creates stagnation of political regeneration.

Abstract

ABSTRAK Putusan Kasasi Mahkamah Agung Nomor 446 K/TUN/2017 mengabulkan permohonan pemohon, di mana putusan kasasi tersebut membatalkan Putusan Pengadilan Tinggi Tata Usaha Negara Medan Nomor 85/B/2017/PT.TUN.MDN (PT TUN Medan) dan Putusan Pengadilan Tata Usaha Negara Jambi Nomor 20/G/2016/PTUN.JBI (PTUN Jambi). Putusan kasasi menyatakan bahwa objek sengketa berupa Laporan Hasil Pemeriksaan Badan Pemeriksa Keuangan bukan merupakan putusan pengadilan tata usaha negara. Sedangkan pada Putusan PTUN Jambi dan Putusan PT TUN Medan tidak mempermasalahkan hal tersebut. Hasil Putusan PTUN Jambi dan PT TUN Medan dicabut oleh Mahkamah Agung. Hal ini tentu merupakan akibat dari ketidakjelasan rumusan mengenai kementerian/lembaga yang mengeluarkan keputusan berupa Keputusan Tata Usaha Negara. Untuk itu rumusan masalah pada penelitian ini yaitu: bagaimanakah urgensi kejelasan rumusan mengenai kementerian/lembaga yang mengeluarkan Keputusan Tata Usaha Negara? Bentuk penelitian yang digunakan adalah yuridis normatif, yaitu dengan menganalisis Putusan Kasasi Mahkamah Agung Nomor 446 K/TUN/2017. Kesimpulan yang didapat adalah merupakan suatu hal yang urgen untuk membuat kejelasan rumusan mengenai kementerian/lembaga yang mengeluarkan Keputusan Tata Usaha Negara pada peraturan perundang-undangan, agar tidak ditemui kembali pencabutan putusan judex facti oleh Mahkamah Agung karena perbedaan penafsiran mengenai kementerian/lembaga yang mengeluarkan Keputusan Tata Usaha Negara. Selama belum ada pengaturan tersebut, permasalahan mengenai objek pemeriksaan pengadilan tata usaha negara akan selalu menjadi bahan perdebatan yang tidak akan pernah berhenti.Kata kunci: keputusan tata usaha negara; laporan hasil pemeriksaan Badan Pemeriksa Keuangan; teori spannungsverhaltnis; asas kejelasan rumusan; peraturan perundang-undangan. ABSTRACT The Supreme Court Decision Number 446 K/TUN/2017 granted the Petitioner’s request in which the Decision annulled the Medan State Administrative High Court (PT TUN Medan) Decision Number 85/B/2017/PT.TUN. MDN and the Jambi State Administrative Court Decision Number 20/G/2016/PTUN.JBI (PTUN Jambi). The Decision rules that the object of the dispute in the form of the Supreme Audit Agency Audit Report is not a state administrative court decision. Meanwhile, the PTUN Jambi Decision and the PT TUN Medan Decision do not discuss that issue. The PTUN Jambi and the PT TUN Medan Decisions were revoked by the Supreme Court. Obviously, this is a result of vague regulations regarding a ministry/agency that issues decisions in the form of State Administrative Decision. Accordingly, the formulation of the problem in this study is: how is the urgency the clarity of the formula regarding a ministry/agency that issues State Administrative Decision? This research uses normative juridical method, namely by analyzing the Supreme Court’s Cassation Decision Number 446 K/ TUN/2017. The study concludes that it is urgent to compose the clarity of the formula regarding a ministry/agency that issues State Administrative Decision, so that the Supreme Court will not annul a judex facti decision on the ground of different interpretation about a ministry/agency that issues State Administrative Decision. As long as such regulation does not exist, the issue related to the object of examination by the state administrative courts will always be debatable. Abstract

ABSTRAKPrinsip adanya peradilan TUN, untuk menempatkan kontrol yudisial dalam penyelenggaraan pemerintahan yang baik menjadi bias dalam sistem ketatanegaraan Indonesia. Bila suatu putusan PTUN tidak memiliki kekuatan eksekutorial, bagaimana mungkin hukum dan masyarakat dapat mengawasi jalannya pemerintah yang dilaksanakan oleh pejabat-pejabat TUN. Masalah ketidakpatuhan Badan atau Pejabat Tata Usaha Negara dalam melaksanakan putusan Pengadilan Tata Usaha Negara dikemukakan pula oleh Supandi dalam penelitian disertasinya, masih sering terjadi putusan Pengadilan Tata Usaha Negara yang tidak dilaksanakan/dipatuhi oleh Pejabat Tata Usaha Negara yang bersangkutan, sehingga dapat menimbulkan ketidakpastian hukum dalam pelaksanaan pemerintahan dan pembangunan. beberapa faktor yang menyebabkan lemahnya eksekusi putusan Pengadilan Tata Usaha Negara yang telah berkekuatan hukum tetap, yaitu: Pertama, ketiadaan aturan hukum yang memaksa bagi Pejabat TUN untuk melaksanakan putusan Pengadilan yang telah berkekuatan hukum tetap. Kedua, faktor amar putusan hakim yang tidak berani mencantumkan pembayaran uang paksa apabila pejabat TUN yang bersangkuan tidak melaksanakan putusan Pengadilan dikarenakan belum adanya peraturan pelaksana yang jelas, dan Ketiga, adalah faktor kepatuhan Pejabat TUN dalam menjalankan putusan Pengadilan yang telah berkekuatan hukum tetap. Kata Kunci : Keputusan Tata Usaha Negara, Pejabat Negara, Pemerintahan, administrasi, Peradilan Tata Usaha Negara ABSTRAKThe principle of a state administrative court, to place judicial control in good governance is biased in the Indonesian constitutional system. If a state administration court decision does not have an executive power, how can the law and the public be able to oversee the administration of the government carried out by state administration officials. The problem of non-compliance of the State Administration Agency or Official in implementing the decision of the State Administrative Court was also raised by Supandi in his dissertation research, there were still frequent decisions of the State Administrative Court that were not implemented / obeyed by the relevant State Administration Officer, so that it could lead to legal uncertainty in governance and development. Several factors cause the weak execution of the decisions of the State Administrative Court that have permanent legal force,namely: First, the absence of legal rules that force the State Administrative Officer to implement the court decisions that have permanent legal force. Second, the factor of the judge's decision that does not dare to include forced payment if the state administrative officer in question does not implement the Court's decision, and Third, is the compliance factor of the state administration official in carrying out the court's decision which has permanent legal force. Keywords : Decree of State Administration, State Officials, Government, Administration, State Administrative Court

Abstract

AbstrakPandemi Covid-19 telah melanda lebih dari 200 negara sehingga mengancam perekonomian global dan nasional tak terkecuali Indonesia. Sebagai negara hukum formil (rechtstaat), Indonesia memerlukan peraturan perundang-undangan sebagai dasar bertindak untuk mengatasinya. Pada bulan Maret 2020, presiden mengeluarkan Perppu No. 1 Tahun 2020 tentang Kebijakan Keuangan Negara dan Stabilitas Sistem Keuangan Untuk Penanganan Pandemi COVID-19 yang kemudian disahkan oleh DPR menjadi undang-undang, banyak pihak mengkritik Perppu tersebut karena dianggap memberikan absolutisme penguasa, namun sesungguhnya Perppu tersebut memberikan kepastian hukum guna mencapai tujuan dan kemanfaatan yang lebih luas yakni pemulihan dari krisis ekonomi akibat Covid-19. Permasalahan yang dibahas dalam tulisan ini adalah, bagaimana penggunaan serta pengawasan diskresi yang dikeluarkan untuk penanganan pandemi Covid-19 dan bagaimana perlindungan terhadap diskresi yang dilaksanakan Pemerintah berdasarkan Perppu No. 1 Tahun 2020 dalam rangka penanganan Covid-19. Metode pendekatan yang digunakan dalam tulisan ini adalah pendekatan konseptual, berdasarkan pada asas kepastian dan kemanfaatan hukum, serta menjelaskan penggunaan diskresi berdasarkan Undang-Undang No. 30 Tahun 2014.Kata Kunci: Peraturan Perundang-undangan, Kepastian Hukum, Covid-19AbstractCovid-19 pandemic has affect more than 200 countries so that it is threatening global and national economic, including Indonesia. As a formal legal state (rechtstaat), Indonesia need laws and regulation as a basis for handle it. In March 2020, the president issued Perppu No. 1 of 2020 concerning State Financial Policy and Financial System Stability for Handling the COVID-19 Pandemic which was then passed by the House of Representative into law, many parties criticized the Law providing leadership absolutism, but in fact this Law provides legal certainty to recovery from the economic crisis caused by Covid-19. The problem discussed in this paper is about how to protect the implementation of the release of discretion issued for handling the Covid-19 pandemic and protection against discretion by the Government based on Perppu No. 1 of 2020 in the context of handling Covid-19 and. The method used in this paper is about conceptual, based on the legal certainty and utilities, and explains the use of discretion based on Law No. 30 of 2014 concerning Government Administration.Keywords: Laws and Regulations, Legal Certainty, COVID-19

Abstract

AbstrakSalah satu poros kekuasaan dalam konsep trias politica adalah kekuasaan eksekutif yang pada dasarnya merupakan cabang kekuasaan yang memegang kewenangan administrasi pemerintahan negara tertinggi. Salah satu kewenangan Presiden dalam menjalankan kekuasaan eksekutif adalah pemberian atau penolakan grasi yang diartikulasikan dalam bentuk Keputusan Presiden. Tulisan ini bertujuan untuk mendiskursuskan Keputusan Presiden tentang pemberian grasi dalam sistem pemerintahan presidensiil di Indonesia dalam kaitannya dengan kedudukan Presiden sebagai Kepala Negara dan Kepala Pemerintahan serta kemungkinan Keputusan Presiden a quo dijadikan Objek Sengketa Tata Usaha Negara. Hasil dari diskursus tulisan ini memperlihatkan bahwa dalam sistem pemerintahan presidensiil seperti yang dianut oleh Negara Republik Indonesia dimana tidak terdapat perbedaan atau dikotomi antara kedudukan Presiden sebagai Kepala Negara dan Kepala Pemerintahan, maka tidak dimungkinkan pula adanya pembedaan jenis Keputusan Presiden selaku Kepala Negara dan Keputusan Presiden selaku Kepala Pemerintahan, yang ada hanyalah Keputusan Presiden saja. Selain itu, mengingat semua unsur-unsur Keputusan Tata Usaha Negara dalam Pasal 1 Angka 3 Undang-Undang tentang Peradilan Tata Usaha Negara telah terpenuhi, serta tidak terdapatnya pengecualian terhadap Keputusan Presiden tentang pemberian atau penolakan grasi dalam Pasal 2 Undang-Undang a quo, maka sejatinya Keputusan Presiden tentang pemberian atau penolakan grasi dalam sistem pemerintahan presidensiil di Indonesia merupakan Keputusan Tata Usaha Negara sehingga seharusnya dapat menjadi Objek Sengketa Tata Usaha Negara, mengingat mekanisme pengujian suatu Keputusan Tata Usaha Negara adalah melalui Pengadilan Tata Usaha Negara.Kata Kunci: Grasi, Keputusan Presiden, Kepala Negara, Kepala Pemerintahan, Sistem Pemerintahan Presidensiil, Keputusan Tata Usaha Negara. AbstractOne of power in the concept of trias politica is executive power which is basically a branch of power that holds the highest administrative authority of the country. One of the President's authorities in exercising executive power is the granting or rejection of clemency articulated in the form of a Presidential Decree. This writing aims to examine the Presidential Decree regarding granting clemency in a presidential governmental system in Indonesia in relation to the position of the President as Head of State and Head of Government and the possibility of the Presidential Decree being the object of State Administrative Dispute. The results of this writing show that in a presidential governmental system as adopted by the State of the Republic of Indonesia where there is no difference or dichotomy between the position of the President as the Head of State and the Head of Government, it is also not possible to distinguish the types of Presidential Decrees as Head of State and Presidential Decrees as Head of Government, there is only a Presidential Decree. In addition, considering that all elements of the State Administrative Decree in Article 1 Number 3 of the Law on State Administrative Courts have been fulfilled, and there are no exceptions to the Presidential Decree on granting or rejecting clemency in Article 2 of the Act a quo, then the Presidential Decree on granting or rejecting clemency in the presidential governmental system in Indonesia is a State Administrative Decree so that it should be the object of State Administrative Dispute considering the mechanism of examining a State Administrative Decree is through the State Administrative Courts.Keywords:   Clemency, Presidential Decree, Head of State, Head of Government, Presidential Governmental System, State Administrative Decree.

Abstract

The promulgation of Article 27 paragraph (3) of Law Number 2 of 2020 adds to the precarious atmosphere of the pandemic that has occurred since 2020. The law that was present with the aim of providing procedures for implementing government actions in dealing with this pandemic turned out to have brought many questions from the general public regarding the interests of the general public. The political party that accompanies the promulgation of the law is because it is considered to provide immunity to state administrative officials against policies that will be issued as an effort to handle the COVID-19 pandemic because it is not an object of state administration. This research comes with several fundamental questions such as why the law legitimizes the existence of state administrative decisions that cannot be the object of a lawsuit at the state administrative court and how the general principles of good governance can be guaranteed to be implemented if the transformation of state administrative policies into the object of the state administrative dispute is removed. This research is based on normative juridical research methods

Abstract

Salah satu tujuan negara adalah untuk melindungi masyarakat termasuk memastikan kesejahteraan tercapai secara merata dan berkeadilan. Tingkat pembangunan juga harus didukung dengan pelayanan kesehatan sebagai pelayanan publik dasar untuk mewujudkan sumber daya manusia yang dapat menopang pembangunan dan kemajuan suatu negara. Pelayanan kesehatan menjadi isu demokrasi dan juga hukum serta erat kaitannya dengan Hak Asasi Manusia, sehingga diatur dalam konstitusi serta memastikan perlindungan masyarakat yang dilakukan oleh negara. Penyelenggaran pelayanan publik adalah pelaksanaan kewenangan serta menjadi ruang lingkup hukum administrasi negara. Pelayanan kesehatan di Indonesia dan Kuba yang memiliki kesamaan dalam perwujudan transisi demokrasi serta upaya pemenuhan hak kesehatan bagi masyarakatnya. Hal tersebut akan disajikan dalam penelitian perbandingan hukum administrasi negara dengan metode penulisan analisis normatif dengan menggunakan teori hukum progresif. Dengan demikian akan didapatkan informasi dan analisis yang ilmiah yang menunjukan keunggulan dan kelemahan penyelenggaraan kesehatan di Indonesia dan Kuba sehingga dapat dipergunakan dalam pembaharuan hukum dan pemenuhan terhadap HAM sebagai bentuk penghormatan terhadap demokrasi dan supremasi hukum.

Abstract

In addition to serving as the legality of spatial utilization and urban control, the Building Permit for Places of Worship (IMB Rumah Ibadah) also functions as an assurance of religious harmony as stated in Article 2 and Article 3 of the Joint Regulations of the Minister of Religious Affairs and the Minister of Home Affairs of the Republic of Indonesia Number 8 of 2006/Number 9 of 2006 on Guidelines for the Implementation of the Duties of Regional Head/Vice Regional Head in Maintaining Religious Harmony, Empowering the People's Forum for Religious Harmony, and Establishing Houses of Worship. Ideally, the establishment of a house of worship that complies with applicable procedures and rules can help avoid conflicts among religious adherents. In reality, there are issues during the establishment of churches that have led to lawsuits in the Administrative Court, such as the rejection of the building permit (IMB) for the Catholic Church of St. Stanislaus Kostka Kranggan and the suspension of the building permit for GKI BaPos Taman Yasmin. The purpose of this article is to examine the function and role of the Administrative Court in resolving disputes related to church permits. The research method used in this study is juridical normative, and the article is analyzed descriptively based on secondary data, namely literature review. The results of this study indicate that the Administrative Court has carried out its function and role in resolving disputes over church permits. However, some decisions cannot be properly executed.
