Abstract

Salah satu tujuan dari perubahan UUD Tahun 1945 adalah membatasi kewenangan Presidenyang sangat besar. Dimana Presiden mempunyai kedudukan sebagai kepala negara dan kepalapemerintahan. Adapun inti dari pengaturan kewenangan Presiden dalam UUD Tahun 1945adalah mekanisme pemilihan, masa jabatan, hak prerogatif, pengisian jabatan Presiden bilaberhalangan dan mekanisme pemakzulan Presiden dan/atau Wakil Presiden. Dalam sistempemerintahan Presidentil, dalam menjalankan kewenangannya Presiden dibantu oleh WakilPresiden dan juga para Menteri. Apabila Presiden berhalangan tetap maka segalakewenangannya dilakukan oleh Wakil Presiden dan Menteri Negara menurut UUD Tahun1945. Perspektif hukum yang dapat dikaji yaitu mengenai posisi Wakil Presiden dalammenggantikan tugas Presiden selaku kepala negara dan kepala pemerintahan, dimana banyakyang mempertanyakan elektabilitas Wakil Presiden apakah dapat bertindak secara hukumseperti halnya seorang Presiden dalam menjalankan kewenangan Presiden. Selain itu, terjadipermasalah hukum lainnya yaitu apabila Presiden dan Wakil Presiden berhalangan tetap,dimana pelaksana tugas Presiden diserahkan kepada beberapa Menteri Negara untukmenjalankan roda pemerintahan.

Abstract

Pembentukan KKR di Aceh didasarkan pada Pasal 229 Undang-Undang No. 11 Tahun 2006, kemudian dilegalkan dalam Qanun No. 17 Tahun 2013. Keberadaan KKR Aceh makin menimbulkan polemik setelah Gubernur Aceh mengangkat beberapa anggota KKR Aceh berdasarkan pada Surat Keputusan Gubernur Aceh Nomor 162/796/2016. Pro dan kontra mengenai pembubaran KKR Aceh berkembang akibat penilaian KKR Aceh dibentuk setelah dihapuskannya ketentuan KKR Nasional oleh Mahkamah Konstitusi. Tulisan ini hendak mengkaji mengenai legalitas KKR Aceh ditinjau dari aspek politik hukum dan formulasi hukum mengenai keberadaan KKR Aceh menurut peraturan perundang-undangan.

Abstract

Baitul Mal is an institution that is authorized as property manager religion formed on the basis of specificity Aceh in implementing Islamic law. Baitul Mal authority in managing the wealth of religion stipulated in Qanun No. 10 of 2007 about Baitul Mal, where one authority Baitul Mal is managing the property / land owners and their heirs abandoned. Abandoned land owners and their Heirs applicable reference to the provisions referred to as a wasteland controlled by the state. In deed the management of abandoned land intended to improve the welfare of the community, which can be managed by the Baitul Mal. This is certainly in line with the mandate of Act No. 2 of 2012. However, the exercise of powers Baitul Mal becomes constrained due to the lack of clear regulations and cons of authority by the National Land Agency. If the Baitul Mal authority to manage wastelands clear with innovative concepts will realize expectations better for public welfare.

Abstract

Talak di bawah tangan tidak mendapat pengakuan dan perlindungan oleh hukum beserta akibat-akibatnya. Sebagaimana Pasal 115 Intruksi Presiden Nomor 1 Tahun 1991 tentang KHI menegaskan bahwa perceraian harus dilaksanakan di depan pengadilan. Adapun kasus yang terjadi di Gampong Keumuneng Hulu telah terjadi perceraian di bawah tangan. Dimana suami mengatakan talak secara berulang-ulang kepada istrinya setiap terjadi perceraian. Metode yang digunakan dalam peneltiian ini adalah yuridis empiris. Perlindungan hukum terhadap istri yang diceraikan di bawah tangan di gampong Keumuneng Hulu Perceraian tidak ada karena perceraian di bawah tangan akan sangat merugikan bagi pihak perempuan yang diceraikan. Faktor penyebab terjadinya perceraian di bawah tangan di Gampong Keumuneng Hulu karena Faktor ekonomi, Masih ada keraguan untuk berpisah, Lokasi yang jauh dari Pengadilan atau mahkamah syar’iah untuk mengurus perceraian, Kurangnya pemahaman masyarakat dan sebagian ulama tentang perceraian di bawah tangan. Mahkamah Syar’iyah untuk melakukan sosialisasi kepada masyarakat untuk melakukan perceraian Mahkamah Syar’iyah bukan bercerai di bawah tangan, Kepada Aparatur gampong dan pemuka agama di Gampong untuk memberikan pengarahan masyarakat dalam bidang agama khususnya bagi pasangan yang telah menikah.  Dan kepada pasangan yang ingin bercerai untuk mendaftarkan perceraiannya di Mahkamah Syar’iyah agar memiliki kekuatan hukum baik secara agama dan negara serta mempertimbangkan akibat atau dampak yang akan terjadi apabila perceraian dilakukan terutama perceraian di bawah tangan

Abstract

The Indonesian Criminal Code regulates as a legal subject is a natural person. The development of criminal law in Indonesia has made the perpetrators not only individuals but also corporations. Where corporations are legalised by the state through legislation. One of the Indonesian laws that regulates corporations as offenders is Law of the Republic of Indonesia No. 32 of 2009 on Environmental Protection and Management. The companies in environmental management can control community land with the status of Cultivation Rights Title and Building Rights Title. In reality, however, the regulation of companies as perpetrators of crimes is still weak and there is no uniformity of regulation to have a deterrent effect. The method used in this paper is normative jurisprudential legal research, focusing on the identification of criminal sanctions against corporate environmental offenders, with a legal approach. The results of the research showed that the criminal regulation against the perpetrators of criminal acts has been regulated as an ultimum remedium for certain cases, but it is less assertive towards the victims of criminal acts and requires a firm and fair regulation and binds all parties involved in the legalisation of the corporation and the protection of its victims. The legal regulation of corporate criminal offences in the Criminal Code has not been clearly regulated, but in the Law of the Republic of Indonesia No. 32 of 2009 on Environmental Protection and Management, as one of the sectoral laws, the regulation has been carried out, but has not adopted the legal wisdom prevailing in the community, although it has been established.

Abstract

Corruption is a special crime that is very detrimental to the country. Corruption management has been upheld by law enforcement in the framework of guaranteeing the state’s stability. Changes to the regulation on corruption eradication does not reduce the number of corruption penalties and compensation for assistance that is free from the snares of the law. This is what drives the government to make an extradition treaty with Singapore and ensnare corruption protection that can be done in Indonesia. This study discusses and examines the level of urgency of the extradition treaty in efforts to commit corruption between Indonesia and Singapore. And, challenges and efforts in realizing the extradition agreement between Indonesia and Singapore in the approval of the implementation of corruption

Abstract

Abstrak: Urgensi Pengabdian kepada Masyarakat dilakukan disebabkan Panglima laot desa Matang Rayeuk, dalam menyelesaikan sengketa/perselisihan antar nelayan dan pelanggaran terhadap hukum adat laut, selama ini masih terdapat kebingungan dalam penerapannya. Pedoman Peradilan Adat di Aceh yang telah ada, dianggap masih sangat umum dalam pembahasannya dengan pembahasan proritas tentang Peradilan Adat Gampong/desa. Sedangkan peradilan adat laot belum spesifik mekanisme pelaksanaannya. Padahal penyelesaian peradilan adat laot dan peradilan adat gampong itu berbeda, serta lembaga adat yang menyelesaikan juga berbeda. Sehingga berpotensi akan bertentangan dengan hukum positif. Metode pelaksanaan kegiatan dilakukan menetapkan mitra kegiatan yaitu Geuchik Matang Rayeuk PP, Dinas Perikanan Aceh Timur, Majelis Adat Aceh Kabupaten Aceh Timur. Kegiatan dilakukan dengan cara menginventarisasi masalah dilapangan, menentukan program, pembinaan dan pelatihan. Hasil yang dicapai dalam kegiatan ini yaitu peningkatan pemahaman masyarakat berkaitan penyelesaian sengketa adat laut melalui kelembagaan panglima laot meningkat. Dari 20 orang nelayan,18 orang menyatakan bahwa keberadaan panglima laot sangat penting dan perlu ditingkat agar selaras dengan ketentuan Qanun Aceh No. 10 Tahun 2008 tentang Lembaga Adat.Abstract: The urgency of the Community Service was carried out because the Panglima laot of Matang Rayeuk village, in resolving disputes between fishermen and violations of marine customary law, so far there is still confusion in its application. The existing Guidelines for Customary Courts in Aceh are considered to be very general in their discussion with a priority discussion on Gampong/village Customary Courts. Meanwhile, the laot customary court has not yet specified its implementation mechanism. Whereas the settlement of laot customary courts and gampong customary courts are different, and the customary institutions that resolve them are also different. So that it has the potential to conflict with positive law. The method of implementing the activity was to establish activity partners, namely Geuchik Matang Rayeuk PP, East Aceh Fisheries Service, East Aceh District Aceh Customary Council. Activities are carried out by inventorying problems in the field, determining programmes, coaching and training. The results achieved in this activity are an increase in community understanding regarding the settlement of customary marine disputes through panglima laot institutions. Of the 20 fishermen, 18 stated that the existence of panglima laot is very important and needs to be improved to be in line with the provisions of Aceh Qanun No. 10 of 2008 concerning Customary Institutions.
