Abstract

In order to eliminate corruption, Indonesia has made various Efforts through the establishment of laws and development of commissions. However, corruption still occurs with all tactics and ways behind politics, economics and power. Moreover, corruption is organized crime or white-collar crime. That why it is difficult to determine the main actor who knows much about it because corruptions Also Involved in that. To reveal corruption, then there must be a whistleblower as a witness, who is willing to reveal the corruption that has occurred because they saw, heard, and had experienced it by themselves, later practically called as a crown witness or key witness. Act No. 13/2006 and the Supreme Court Circular Letter No. 4/2011 have not been fully able to provide protection to whistleblowers from investigation, prosecution and examination. Since now, there are no laws that specifically against whistleblowers. It is the caused whistleblower remains silent against the corruption.

Abstract

Constitution of the Republic of Indonesia 1945 on Regional Government, especially in Article 18 and paragraph (2) states that "the state recognizes and respects units of customary law communities along with their traditional rights as long as they still live, and in accordance with the development of society and the principles of the Republic of Indonesia, which is regulated by law ". In response to these provisions, the Bali provincial government released Regional Law 3 of 2003 on Pakraman and Customs Agency by sticking to the philosophy of "Tri Hita Karana". In maintaining security and public order Pakraman in Bali, a task force was formed traditionally called "pecalang", which means "celang" (the sharpness of the senses). Pecalang becomes one device of Pakraman, due to the formation through village Paruman (meeting) based on the teachings of Hinduism. Not all citizens can be pecalang of Pakraman, but the election is carried out by village prajuru based on Paruman stated in the villages "awig awig" (law). Therefore, based on the concept of "ngayah" (not  paid), a pecalang in any activities is related to customs, religion, and other activities with  national and international scope, are required to participate in maintaining security and order of Pakraman, the area where pecalang domiciled. Especially on Nyepi, pecalang in maintaining security and order in each Pakraman both the physical environment, socio-cultural environment, including the behavior of the villagers, still do a good cooperation with the police of state and the entire community in Pakraman with coordination on any activities carried out.

Abstract

The purpose of this paper is to examine the customary law sanctions that are threatened against perpetrators of sexual violence against children, for example in the people of Tenganan Village, Karangasem-Bali, which are Balinese customary law communities who still adhere to their traditions in the era of modernization and globalization that is developing in Bali. Whether the customary sanctions for perpetrators of sexual violence against children in Tenganan Village, Karangasem-Bali are in accordance with the principle of fulfilling children's rights. This research is a type of normative legal research or what is often called doctrinal research. The approach used in this research is the Legislative Approach, the Conceptual Approach and the Comparative Approach. The result of this paper is that customary sanctions against sexual violence against children that occur in Tenganan Village do not position children as victims of sexual violence. On the other hand, children are placed in a position to participate as perpetrators. The customary sanctions do not provide legal protection and fulfillment of children's rights for child victims of sexual violence. Penelitian ini bertujuan untuk mengkaji sanksi hukum adat yang diancamkan kepada pelaku kekerasan seksual terhadap anak, contohnya pada masyarakat Desa Tenganan, Karangasem-Bali yang merupakan masyarakat hukum adat Bali yang masih memegang teguh tradisinya di era modernisasi dan globalisasi yang berkembang di Bali. Apakah sanksi adat bagi pelaku kekerasan seksual terhadap anak di Desa Tenganan, Karangasem-Bali telah sesuai dengan prinsip pemenuhan hak anak.Penelitian ini merupakan jenis penelitian hukum normative yang menggunakan tiga jenis pendekatanantara lain pendekatan Perundang-undangan, Pedekatan Konseptual dan Pendekatan Perbandingan. Berdasarkan hasil penelitian diketahui bahwa sanksi adat terhadap kekerasan seksual terhadap anak yang terjadi di Desa Tenganan tidak memposisikan anak sebagai korban kekerasan seksual. Sebaliknya anak ditempatkan pada posisi turut serta sebagai pelaku. Dalam sanksi adat tersebut tidak memberikan perlindungan hukum dan pemenuhan hak anak bagi anak korban kekerasan seksual.

Abstract

Every child has the rights to survive, grow and develop and protection from violence and discrimination. The protection of children's rights still has not got attention from various parties, such as the case of the junior high school student of class 9 in Jehem Village, Tembuku sub-district, Bangli regency, who had to drop out of school due to pregnancy as a result of the sexual violence. The sexual violence shows that women are still placed in a marginal position because of their gentle nature exploited by men to vent their desires. It can occur in the domestic and public sectors. The sexual violence in children can occur in their environment like the cases in which the parents raping the biological or stepchild and the sibling brother raping his sister. This position makes the children powerless in facing the unprotected treatments. Bali which has increasing number of children violence every year in each regency positions the government to work on the protection in the form of regulations and the involvement of customary institutions which will stated in awig-awig or perarem in each  pakraman village.

Abstract

Misogyny is the behavior of someone hating women, both from men and fellow women. This behavior often places and views women as the cause of blame in a problem, even for something that is not really a problem. Misogyny causes a person tends to hate, look down on, blame, label and discriminate against women. This behavior is often associated with male privilege, patriarchal customs, and gender discrimination. In practice, this behavior will place men in a superior position, while women in an inferior position. In certain cases, misogynism can even increase the risk of physical, psychological and sexual harassment of women. There are two problems discussed in this study: 1) misogyny in the perspective of gender-based violence and 2) the relationship between misogyny and violence against women. This research is normative juridical research supported by empirical data on gender-based violence against women. Primary and secondary legal materials were collected through literature study. The research approach used is the statutory regulation, the legal concept, and the legal argumentation approach. Analysis of the collected data was carried out qualitatively.

Abstract

The child needs to be protected both physically and spiritually, especially when the child is a criminal. Children to be accountable for their actions, not separated from the imposition of criminal punishment of imprisonment. The imposition of imprisonment on children is irrelevant compared to the crime rate, and it seems that imprisonment does not deter the perpetrator. It can be attributed to a child's crime similar to that of an adult whether in quantity or quality. This situation certainly raises issues both philosophically, juridically and sociologically. It is deemed necessary to reform the criminal law in the face of children as perpetrators of crime, deprivation of liberty by placing children in prison, unable to provide protection from the deprivation of the rights of children as opposed to the values of Pancasila as stipulated in the second precept " humanitarian "so it is necessary to replace it with alternative criminal (alternative sanction) one of them in the form of criminal supervision as regulated in Article 71 of Law No.11 Year 2012 About Child Criminal Justice System. Characteristics of the imposition of criminal surveillance of the child, perpetrators are still given the opportunity to improve themselves, and supervision is made in accordance with the personal needs of children who promote human coaching, by upholding the dignity of children based on the principle of "humanity". This is certainly in accordance with the idea or ideals of law and the reality of society that is upholding a democratic, social and humane life, which became the basic color of Indonesian law based on Pancasila.Keywords :Legal reform, children of perpetrators of crime, imposition of sanctions

Abstract

Penelitian ini meneliti mengenai kejahatan-kejahatan terkait dengan kartu kredit dan upaya perlindungan hukum bagi nasabah pengguna kartu kredit dengan dikeluarkannya Surat Edaran Bank Indonesia No. 16/25/DKSP Tahun 2014 Tentang Penyelenggaraan Kegiatan Alat Pembayaran Menggunakan Kartu. Permasalahan yang terjadi yaitu Bagaimana Perlindungan Hukum terhadap Pemegang Kartu Kredit sebelum keluarnya Surat Edaran Bank Indonesia No. 16/25/DKSP Tahun 2014 Tentang Penyelenggaraan Kegiatan Alat Pembayaran Menggunakan Kartu? Dan Bagaimana Perlindungan Hukum terhadap Pemegang Kartu Kredit sebelum keluarnya Surat Edaran Bank Indonesia No. 16/25/DKSP Tahun 2014 Tentang Penyelenggaraan Kegiatan Alat Pembayaran Menggunakan Kartu? Metode penelitian yang dipergunakan yaitu penelitian normatif.Hasil pembahasan dapat diketahui bahwa (1) Perlindungan terhadap nasabah pengguna kartu kredit dengan dikeluarkannya Surat Edaran Bank Indonesia No. 16/25/DKSP Tahun 2014 tentang Penyelenggaraan Kegiatan Alat Pembayaran Menggunakan Kartu adalah termasuk upaya hukum pencegahan (preventif) dengan mengimplementasikan mengenai PIN 6 digit sebagai sarana autentifikasi dan verifikasi. (2) Kartu kredit dalam prakteknya sering terjadi penyalahgunaan, dalam menggunakan sarana kartu kredit yang kemudian popular dengan istilah cybercrime. Untuk itu diperlukan sebuah aturan hukum baru dalam bentuk Undang-undang yang secara khusus mengatur tentang transaksi Electronic Transfer Fund khususnya kartu kredit yang sebagai dasar perlindungan hukum terhadap nasabah pengguna kartu kredit.Kata Kunci : Perlindungan, kartu, kredit, pembayaran.

Abstract

Kekerasan seksual merupakan bentuk kontak seksual atau bentuk lain yang tidak diinginkan secara seksual. Kekerasan seksual biasanya disertai dengan tekanan psikologis atau fisik yang dialami oleh korban. Dibentuknya P2TP2A sebagai lembaga pemerintah yang secara khusus sebagai tempat pendampingan terhadap anak-anak dan perempuan yang mengalami permasalahan sosial utamanya mengenai pelanggaran hak asasi atau kekerasan seksual. Tujuan penulisan ini untuk mengetahui faktor-faktor yang menyebabkan terjadinya kekerasan seksual terhadap anak dan peranan P2TP2A dalam memberikan perlindungan hukum terhadap anak. Metode dalam penulisan ini menggunakan metode penelitian hukum empiris dan menggunakan jenis data primer dan data sekunder, data primer yaitu data yang bersumber langsung dari sumber pertama sedangkan data sekunder berupa buku-buku, jurnal, teknik pengumpulan data dengan cara wawancara dan dokumentasi, teknik analisis data yang digunakan adalah teknik analisis deskriptif kualitatif. Faktor yang menyebabkan terjadinya kekerasan seksual terhadap anak ada dua, faktor internal dan faktor eksternal. Pada faktor internal hal yang paling berpengaruh adalah faktor keluarga dan dari faktor eksternal hal yang paling berpengaruh adalah faktor media sosial. Peranan P2TP2A dalam memberikan perlindungan hukum terhadap anak sebagai korban kekerasan seksual adalah menerima pengaduan dari korban dan mendampingi korban sampai ke persidangan dan menyediakan rumah aman bagi korban serta memberikan konseling psikologi akan mental korban. Abstract

Anak yang menjadi pelaku tindak pidana anak yang belum berumur 18 tahun telah diduga melakukan tindak pidana. Pelecehan seksual merupakan tindak pidana yang sering dilakukan oleh anak dibawah umur dalam bentuk ungkapan, tindakan, hingga melakukan hubungan fisik. Sehingga dalam hal ini konsep Amicus Curiae dapat membantu memeriksa dan mengklarifikasi kasus anak pelaku pelecehan seksual. Metode penelitian yang digunakan dalam kajian penelitian ini metode penelitian normatif dengan mengkaji studi kepustakaan dengan memperoleh data sekunder dari bahan hukum primer, bahan hukum sekunder dan bahan hukum tersier. Sehingga hasil penelitian ini diperoleh bahwa kedudukan Amicus Curiae dalam tindak pidana sebagai alat bukti dapat pembuktiannya secara tertulis dan tidak tertulis. Amicus Curiae, jika dikaitkan dengan pasal 184 KUHAP, Amicus Curiae dapat digolongkan dengan alat bukti surat dan petunjuk secara materiil tetapi tidak secara formil. Serta Amicus Curiae dapat memberikan dasar pertimbangan hakim dalam memutus perkara pelecehan seksual yang dikaji dari sisi filosofis, sosiologis, dan yuridis, dengan hal tersebut hakim dapat menggunakan dasar pertimbangan dalam memutus perkara anak tanpa harus mengkorban hak-hak anak.

Abstract

The negative impact of the development of the tourism industry, information technology and communication and transportation in addition to problems of poverty, unemployment, dropping out of school, and limited employment is still an unresolved problem, thus further encouraging the Commercial Sex Exploitation of Children. Through strengthening Desa Adat and regulating child protection in awig-awig or pararem regarding strengthening the position of children in Bali by incorporating the concept of local wisdom will certainly be able to reduce the number of sexual violence and child exploitation in Bali, so that synergy in solving positive legal cases will be easier effective, because if a case occurs, it will be resolved first within the scope of the village through prevailing customary law before continuing into the realm of positive law. Arranging and determining Awig-awig who adopt local wisdom concepts and values including Tri Hita Karana, Tri Kaya Parisudha, and Tat Twam Asi are able to reflect religious, ritual and upakara elements in preventing sexual violence and exploitation of children.
