Abstract

The existence of Border Crossing Area Agreement (BCA) in 1975 regulating the border agreement between Miangas Island of North Celebes and the Philippines created positive and negative impacts on border people in Miangas Island. The legal aspects, BCA is a legal regulation regulating the border crossing and commerce in that area; economic aspects; BCA has not accommodated border people’s interests maximally yet and it has a limiting impression rather than facilitating people’s interests, thus, illegal trades occur at the border of Miangas Island; social aspects, BCA is hard to implement in this area because it has limited the tradition practicing from generations to generations; political aspects, BCA causes frequent migrations by border people of Miangas Island to the Philippines because of the strong historical and kinship factors, economic factors, to get better education, facilities and infrastructures in health, and communication and transportation that in the Philippines are considered better. These situations made the regional government to use its authority in Act No. 22 of 1999 concerning International Covenant and Act 32 of 2004 concerning Regional Government to empower the Border Crossing Area Agreement in Miangas Island by revising that agreement. The efforts conducted by the government were by issuing the Regional Ordinance No. 1 of 2001 concerning the development of Sangihe and Talaud Islands area and Regional Ordinance No. 2 of 2001 concerning the Spatial Arrangement of Sangihe and Talaud Mainstay Area. It is expected that the Border Trade Area (BTA) will pay attention to the Declaration of Liberal Democration Principles concerning Ethnoculture and National Minority and Native Tribes suggesting the local government to accept, with domestic laws and with the covenant legalized internationally concerning the principles of minority rights implementation, equal in its interests with the classical Human Rights.

Abstract

The prominent issue in globalization era is the emergence of great attention to the issues of the law enforcement of consumer protection and the distribution of the incoming imported goods freely to Indonesia. The impact of open economic embraced by Indonesia causes the swift flow of goods and service into Indonesian territory. The effect of Indonesia in international economy is insignificant, but in contrary, the effect of International economy to Indonesian economy is highly significant. Consequently, the insignificant Indonesian effect on international economy causes Indonesia is having difficulty to compete in international trade. Therefore, Consumer Protection Act becomes public needs for protection and promotion of human interest as the consequence of the selling and purchase transaction of imported goods. The After Sale Service for imported goods is one of aspects covered by consumer protection as sellers have obligations to deliver the goods and is responsible for losses incurred by consumers due to use of the goods. This article would examine how law enforcement of consumer protection can be against after-sales service issues.

Abstract

ABSTRACT The relation between bank as a creditor and housing debtor can be seen as a system that consists of several sub-systems which configured in a certain way. Each sub-system carries another specific task beside it prior task in special position. Demand and requirement in stability make the related parties in credit agreement are not completely free, instead they already bound with the structure of Housing Loans Agreement. Determination of Housing Loans Agreement (KPR) as banking agreement standard based on the theory of structural functional emphasizes regularity and avoids conflict. Basic assumption of this theory is the configuration of Housing Loans Agreement system as banking agreement standard which is structural functional will lead to stability that will be dynamic if it meets cultural, social, structural/politics and economic dimensions and hopefully they can create regularity and stability among bank and debtor in Housing Loans Agreement system. Key words: Credit Agreement, Configuration, Economy, Politics, Social, Culture. Abstrak Hubungan Bank sebagai Kreditur dan Debitur Perumahan dapat dilihat sebagai sebuah sistem yang di dalamnya terdapat sub-sub sistem yang terkonfigurasi secara tertentu, tiap-tiap sub sistem selain terpasang dalam posisi tertentu, juga mengemban tugas tertentu. Tuntutan dan kebutuhan akan keseimbangan inilah yang membuat para pihak yang terkait dalam Perjanjian Kredit tidak sepenuhnya dalam keadaan bebas, tetapi sebaliknya terkondisi untuk terikat pada struktur Perjanjian Kredit Pemilikan Rumah. Determinasi Perjanjian Kredit Pemilikan Rumah (KPR) sebagai perjanjian standar perbankan menurut Teori Struktural Fungsional, menekankan pada keteraturan dan mengabaikan konflik. Asumsi dasar teori ini, yaitu konfigurasi suatu sistem Perjanjian Kredit Pemilikan Rumah sebagai Perjanjian Standar Perbankan yang bersifat struktural fungsional akan bergerak ke arah keseimbangan yang bersifat dinamis apabila memenuhi dimensi budaya, sosial, struktur/politik, dan ekonomi yang niscaya akan menciptakan keteraturan dan keseimbangan antar pihak Bank dan Debitur dalam sistem Perjanjian Kredit Pemilikan Rumah.   Kata Kunci : Perjanjian Kredit, Konfigurasi, Ekomomi, Politik, Sosial, Budaya.

Abstract

The presence of Sharia banks offers customers with various banking products. It is just different from conventional banks in terms of pricing, both the selling price and the buying price. As for the types of products offered by Sharia banks are: Al-wadi’ah (savings), Financing with profit sharing, Bai’al- Murabahah, Bai’as-salam, Bai’Al-istihna, Al-Ijarah (Leasing), Al-Wakalah (Mandate), Al-Kafalah (warranty), Al-Hawalah, Ar-Rahn. The aim of this paper is: to find out the position of Sharia Banks in the Indonesian banking system, and to determine the role of Sharia Banks in the provision of banking services. The research method in this research is normative juridical approach. Based on the results and discussion of Sharia Bank position in the Indonesian banking system, the targets of Sharia banking development are: enhancing the benefits of Sharia banking for the public welfare; realizing a healthy, competitive, and efficient Sharia banking; assuring the compliance of Sharia principles consistently based on mudaraba (partnership); and assuring the precautionary principles. Furthermore, the role of Sharia Banks in the provision of banking services, which is based The Bank of Indonesia Regulation 6/ 17/PBI/2004 on Rural Banks based on Sharia principles and The Bank of Indonesia Regulation 6/24/PBI/2004 on Commercial Banks Conducting Business Based on Sharia Principles: Sharia Monitoring and Reporting Procedures for Monitoring Results to Sharia Supervisory Board.

Abstract

Indonesia banking based on Article 4 of Act No.10, 1998, aims at supporting the implementation of national development in order to improve equity, economic growth and national stability in the direction of improving people’s welfare. Therefore, to show how important is banking role in supporting the implementation of development, the 6 (six) Strategic Dimensions as the foundation of Banking Standards Contract are: (1). Prudent Banking Supervision and Good Corporate Governance (GCG) in banking activities, (2). Refunctionalization the principle of Contract Law in Banking Standards Contract, (3). Ethics Value in Business, (4). The Act No. 8, 1999 on Consumer Protection, (5). Enforcement of Human Rights Principles in banking activities, (6). Abuse of Circumstances implementations (Misbruik van Omstandigheden) in banking Contract. Based on the 6 (six) Strategic Dimension as the foundation of Banking Standard Contract, it will undoubtedly create justice, equity and assurance of the rights and obligations of the parties framed in the contractual and law bonds.

Abstract

Katsuwonus Pelamis is a fishery commodity originating from the waters of the bay in Indonesia, Cakalang Fufu is a popular culinary dish with processed fish that is processed quickly, served fresh, frozen, canned or dried, which has become the object of fishing for fishermen because it is considered profitable. The reality of management that does not have adequate quality control, while the paradigm of entrance market is skipjack tuna management as soon as possible has been carefully tested for safety aspects before the product is released to the market. This action is a legal event that causes harm to consumers who are accommodated by legal protection. This study aims to describe the process of catching, storing and marketing skipjack tuna as a safe food product from the perspective of consumer law protection, and to describe the forms of law enforcement against the circulation of unsafe food products. This research uses the type of research socio legal research. The description of the research results shows that the process of catching, storing and marketing skipjack tuna specifically in North Sulawesi still uses traditional methods, but the urgency and safety aspects of catching results cannot be guaranteed, including the process of storing and marketing skipjack tuna does not comply with the provisions. Standard procedures are ignored so that the impact of the expected information is given to consumers from the capture process to the final consumer.

Abstract

Tujuan penelitian ialah untuk mengetahui dan memahami perlindungan hukum yang diperoleh konsumen atas pengiriman barang tidak sesuai pesanan melalui aplikasi TikTok Shop dan pertanggungjawaban serta pengenaan sanksi hukum dari pihak aplikasi TikTok Shop atas kerugian yang dialami oleh konsumen akibat pengiriman barang tidak sesuai pesanan. Metode penelitian yang digunakan ialah metode penelitian yuridis normatif, sehingga dapat disimpulkan: 1. Pengiriman barang tidak sesuai pesanan dalam transaksi jual beli online telah melanggar hak konsumen dalam pasal 4 Undang-Undang Nomor 8 Tahun 1999 tentang Perlindungan konsumen, yakni hak untuk mendapatkan barang sesuai dengan yang diperjanjikan. Akibat dari pelanggaran hak tersebut menimbulkan hak untuk menuntut ganti kerugian ataupun kompensasi kepada pelaku usaha sebagai bentuk perlindungan hukum kepada konsumen. 2. Bentuk pertanggungjawaban terhadap perbuatan pengiriman barang tidak sesuai pesanan yang mengakibatkan kerugian konsumen ialah pemberian ganti rugi ataupun kompensasi kepada konsumen, berupa pengembalian barang (retur) dan/atau pengembalian dana (refund). Apabila pihak pelaku usaha yang diwajibkan untuk memberikan ganti kerugian menolak untuk memberi ganti rugi, maka dapat dikenakan sanksi perdata, sanksi pidana ataupun sanksi administratif berdasarkan peraturan yang berlaku. Kata kunci: Perlindungan Hukum, Hak Konsumen, Transaksi Jual Beli Online.

Abstract

Undang-Undang Nomor 20 Tahun 2016 tentang Merek dan Indikasi Geografis, Pasal 1 ayat (1) dan (2) menjelaskan tentang Merek dan Merek Dagang tujuannya untuk mendeskripsikan maksud dan unsur yang terdapat dalam merek. Penelitian hukum ini bertujuan untuk menganalisa implikasi peraturan merek dalam pendaftaran produk rumah makan yakni makanan yang ditawarkan oleh rumah makan dan ditinjau dari kelas pendaftaran merek. Metode penelitian yakni melalui pendekatan yuridis empiris. Hasil penelitian menunjukan bahwa pendaftaran merek rumah makan dalam mendaftarkan merek tidak menyertakan produknya sebagai bagian dari merek kemudian perlindungan preventif atas pendaftaran merek ternyata menghiraukan unsur pada merek sebagai nama dan melanjutkan unsurnya ke tahap kelas pendaftaran. Hal tersebut diupayahkan agar persaingan usaha dapat berjalan baik namun keterbatasan pengaturan tersebut mengakibatkan perlindungan preventif tidak berjalan baik. Abstract

Badan Pengawas Obat dan Makanan (Badan POM) memiliki peran yang sangat penting dalam pengawasan perdagangan obat tradisional sebagai upaya perlindungan kesehatan masyarakat, terutama di era pandemi COVID-19. Dalam era pandemi COVID-19, peran Badan POM menjadi lebih krusial dalam mengawasi obat tradisional, karena masyarakat dapat cenderung mencari alternatif pengobatan, termasuk obat tradisional, untuk meningkatkan daya tahan tubuh atau meredakan gejala. Dengan melakukan pengawasan yang ketat, Badan POM dapat memastikan bahwa obat tradisional yang beredar aman, efektif, dan sesuai dengan standar kualitas yang ditetapkan, sehingga dapat memberikan perlindungan kesehatan bagi masyarakat di tengah pandemi.Hukum perdagangan obat tradisional berkaitan dengan peraturan dan aturan yang mengatur aktivitas perdagangan, produksi, distribusi, dan penggunaan obat tradisional di suatu negara. Hukum ini bertujuan untuk melindungi kesehatan dan keselamatan masyarakat, memastikan bahwa obat tradisional yang beredar di pasaran aman, efektif, dan sesuai dengan standar yang ditetapkan.

Abstract

Tren makanan beku (frozen food) di kalangan masyarakat semakin meluaskarena gaya hidup masyarakat modern saat ini yang serba sibuk sehingga lebih memilih makanan yang praktis, cepat saji, dan sekaligus enak. Fenomena ini terlihat dengan banyaknya dijumpai makanan olahan yang berasal dari frozen food sejak masa pandemi hingga sesudahnya. Ketentuan izin edar bagi pelaku usaha didasarkan untuk melindungi masyarakat dari risiko produk pangan yang tidak aman, tidak bermutu, dan tidak bergizi agar tidak merugikan konsumen. Akan tetapi, masih terdapat beberapa konsumen yang tidak memperhatikan mengenai izin edar pangan, serta masih adanya pelaku usaha yang bersikap tidak bertanggung jawab dengan tidak mencantumkan izin edar produk pangan. Bentuk pengawasan terhadap makanan olahan ini, dipertanyakan pengawasannya karena menyangkut dengan perlindungan konsumen. Sehingga pada penelitian ini, berfokus pada Upaya pemerintah dalam mengawasi makanan olahan. Penelitian ini menitik beratkan pada Undang-undang Nomor 8 Tahun 1999 Perlindungan Konsumen, Metode penelitian yang digunakan yakni metode pendekatan yuridis normative untuk menemukan Upaya pemerintah dalam mengawasi makanan olahan sehingga aman sampai pada konsumen atau masyarakat. Hasil penelitian menujukan Ijin edar makanan dan minuman beku merupakan kewenangan kementerian Kesehatan dan kementerian perdagangan dan semua kewenangan itu telah dilimpakan kepada BPOM untuk memeriksa produk makanan dan minuman beku yang layak diedarkan kepasar ditengah masa pandemi dan penegakan hukum harus dilakukan terhadap pelaku usaha produsen makanan dan minuman beku yang melanggar aturan dan standart mutu Kesehatan.
