Abstract

Kegiatan pariwisata yang beragam menimbulkan pergerakan bisnis di berbagai daerah dan berbagai bidang, termasuk investasi. Kegiatan investasi merupakan kegiatan yang berorientasi untuk memberikan pengembalian investasi yang cepat dan aman. Investasi pada dasarnya meliputi berbagai bidang, kepariwisataan termasuk di dalamnya. Pada konstitusional, Pasal 33 Undang-Undang Dasar 1945 telah menentukan bahwa perekonomian nasional dan kesejahteraan sosial adalah untuk mewujudkan kesejahteraan umum. Investasi pada dasarnya meliputi berbagai bidang termasuk kepariwisataan. Cukup diketahui kekuatan pariwisata Indonesia terletak pada potensi alam yang besar dan seni budaya yang tinggi, sumber daya manusia yang profesional, akomodasi perhotelan yang baik, penduduk yang ramah tamah. Pariwisata tak ubahnya generator penggerak pembangunan perekonomian masyarakat seperti halnya di Bali. Dalam pengamatan empiris, tidak kurang 80% dari seluruh masyarakat Bali menggantungkan hidupnya pada pariwisata, baik secara langsung maupun tidak langsung. Permasalahan yang akan dibahas dalam tulisan ini adalah (1) Bagaimanakah pengaturan mengenai investasi asing pada bisnis jasa pariwisata dalam kerangka hukum internasional dan nasional? (2) Bagaimanakah bentuk perlindungan investasi asing pada bisnis jasa pariwisata di Indonesia? Pengaturan investasi dalam kerangka hukum nasional bersinergi dengan prinsip-prinsip kepariwisataan yang dituangkan dalam Undang-Undang Nomor 10 Tahun 2009 tentang Kepariwisataan. The diverse tourism activities bring about business movement in various regions and various fields, including investment. Investment activity is an activity oriented to provide quick and safe return of investment. Investment basically covers various fields, including tourism. In the constitutional, Article 33 of the 1945 Constitution has determined that the national economy and social welfare are to realize the common prosperity. Investment basically covers various fields including tourism. It is well known that Indonesias tourism strength lies in its great natural potential and high cultural arts, professional human resources, excellent hospitality accommodation, hospitable residents. Tourism is like a generator driving the development of the economy of society as it does in Bali. In empirical observation, no less than 80% of all Balinese people rely on tourism, either directly or indirectly. The issues to be addressed in this paper are (1) What is the regulation of foreign investment in the tourism services business within the framework of international and national law? (2) What is the form of protection of foreign investment in tourism services business in Indonesia? Investment arrangements within the framework of national law synergize with the principles of tourism as outlined in Law Number 10 Year 2009 on Tourism.

Abstract

Mediation has been a typology of civil dispute settlement through negotiation process to obtain agreement from the parties assisted by mediator. The Court implements mediation which is a process of civil disputes settlement that must be taken as an instrument to fulfill the four purposes of the Supreme Court, such as addressing the problem of the accumulation of cases; faster and cheaper dispute resolution; expanding access for the parties to a sense of justice; and strengthening and maximizing the function of the courts in dispute settlement. The focus of this study lies in the investigation of the extent to which effective mediation is applied as an alternative of civil disputes settlement at the District Court of Bali. The method used is empirical law research method. The nature of this research is descriptive. There are two types of data, namely primary data and secondary data with the location of research is the District Court in Bali Province. Data collection was done by using interview techniques; Data processing and analysis were carried out by applying qualitative data analysis method. The result of the research shows that the implementation of mediation in the District Court in Bali has been in accordance with the legislation and has been capable of decomposing cases. However, obstacles in the implemention are still other significant problems that need concern of resolution. The obstacles are those relating to legal substance, legal structure and legal culture.

Abstract

Pengadaan barang/jasa bagi keperluan Pemerintah yang menyerap dana APBN/APBD hampir sebesar 60 % akan menciptakan lapangan pekerjaan yang direbut oleh para pengusaha baik pengusaha dalam negeri maupun pengusaha luar negeri karena bangsa Indonesia telah memasuki era globalisasi dan leberalisme perdagangan. Untuk mengantisipasi hal tersebut dengan menerbitkan Peraturan Presiden (Perpres) Nomor 16 Tahun 2018 tentang Pengadaan Barang/Jasa Pemerintah. Pengadaan barang/jasa pada dasarnya melibatkan dua pihak, yaitu pihak pengguna barang/jasa (pemerintah) dan pihak penyedia barang/jasa (pengusaha), dengan kepentingan yang berbeda yang sulit dipertemukan kalau tidak ada saling pengertian dan kemauan untuk mencapai kesepakatan. Pengadaan barang/jasa dilakukan dengan melalui tahapan proses pengadaan, yang akhirnya penyedia barang/jasa yang terpilih akan menandatangani kontrak dengan pengguna barang/jasa. Kontrak tersebut memuat kesepakatan antara pengguna barang/jasa sebagai Pihak Pertama dan penyedia barang/jasa sebagai Pihak Kedua. Dalam pembuatan suatu kontrak, para pihak seharusnya memiliki kedudukan yang seimbang, karena apabila tidak memiliki kedudukan yang seimbang, maka dimungkinkan terjadinya salah satu pihak akan mendominasi pihak lain. Bagaimana prinsip keseimbangan diimplementasikan dalam kontrak yang telah ditandatangani kedua belah pihak dibidang pengadaan barang/jasa bagi keperluan Pemerintah di Kabupaten Badung ? Dari hasil penelitian diketahui bahwa; pada kontrak pengadaan barang / jasa bagi keperluan pemerintah di Kabupaten Badung, pada awal kontrak (pra kontrak) memang terlihat bahwa posisi tawar para pihak adalah seimbang. Tetapi jika dicermati pada isi kontrak terlihat ada ketidakseimbangan kedudukan. Asas keseimbangan belum diimplementasikan secara baik di Kabupaten Badung. Procurement of goods / services basically involves two parties, namely the user of goods / services (government) and the provider of goods / services (entrepreneurs), with different interests that are difficult to meet if there is no mutual understanding and willingness to reach an agreement. Procurement of goods / services is done by going through the stages of the procurement process, which ultimately providers of goods / services selected will sign a contract with the user goods / services. The contract contains an agreement between the user of the goods / services as the First Party and the provider of goods / services as the Second Party. In making a contract, the parties should have a balanced position, because if it does not have a balanced position, then it is possible that one party will dominate the other. How is the principle of balance implemented in contracts signed by both parties in the field of procurement of goods / services for the purposes of the Government in Badung regency? From result of research known that; in the contract of procurement of goods / services for government purposes in Badung regency, at the beginning of the contract (pre contract) it is seen that the bargaining position of the parties is balanced. But if you look at the content of the contract there is an unbalanced position. The principle of balance has not been well implemented in Badung regency.

Abstract

Penelitian ini di lakukan untuk menganalisa keteraturan hukum di masyarakat, Permasalahan Hak milik dalam Hal memiliki tempat tinggal serta lingkungan hidup yang baik dan sehat, adalah merupakan hak dasar setiap warga negara Indonesia. hakikatnyastrata title terdapat gabungan kepemilikan bersama dan kepemilikan individu. Hal ini tidak dikenal dalam kepemilikan tanah dan rumah pada kawasan horizontal seperti komplek perumahan (real estate) atau pemukiman lainnya baik di perkotaan maupun perkampungan. Penelitian ini menggunakan metode hukum yuridis Normatif untuk melakukan studi pustaka karena ciri khas dan tradisi ilmu hukumPendekatan yang digunakan didalam penelitian hukum adalah pendekatan peraturan perundang-undangan (statue opprach), pendekatan kasus (case opprach) dan pendekatan konseptual (conceptual opprach). Hasil penelitian menunjukan bahwa rumah susun di atas tanah Hak Guna Bangunan yang berdiri diatas tanah Hak Milik sebagai tempat hunian dan jenis pembebanan hak atas satuan rumah susun di atas tanah Hak Guna Bangunan yang berdiri diatas tanah Hak Milik dapat serta memperbaiki akses masyarakat kepada sumber-sumber ekonomi, terutama tanah atas penguasaan pemilikan, penggunaan dan pemanfaatan tanah dan sumber-sumber pertanahan untuk meminimalisir sengketa Pertanahan untuk meningkatkan kesejahteraan masyarakat. This research is done to analyze the legal regulation in the community. The issue of property rights in terms of having a good and healthy living place and environment is the basic right of every Indonesian citizen. the essence of the title is that of joint ownership and individual ownership. It is not known in the ownership of land and houses in the horizontal area such as housing complex (real estate) or other settlements in both urban and settlement areas. This research uses Normative juridical legal method to conduct literature study because of the characteristic and traditions of law. The approach used in legal research is the approach of legislation (statue opprach), case approach (case opprach) and conceptual approach (conceptual opprach). The result of the research shows that the flats on the land of Hak Guna Bangunan which stands on the land of Hak Milik as the dwelling place and the type of imposition of the right to the unit of flats on the land of Hak Guna Bangunan which stands on the land of Hak Milik can also improve the public access to the sources economic, especially land over ownership, use and utilization of land and land resources to minimize land disputes to improve peoples welfare.

Abstract

Pada akhir-akhir ini, untuk bertransaksi atas hak atas tanah yang tanda bukti haknya berupa sertipikat pengganti karena hilang, banyak pihak yang meragukan kekuatan hukum dan kepastian hukum dari serpikat pengganti karena hilang tersebut, maka perlu dilakukian analisis dengan cara diskripsi komparatif, yakni dengan mengetengahkan prosedur penerbitan sertipikat pengganti karena hilang, dengan segala karakteristiknya.Dari hasil analisis dengan metode diskripsi komparatif dari ketentuan-ketentuan perundangan yang terkait nampak bahwa kedudukan hukum serpikat pengganti karena hilang sama halnya sertipikat originer, dan mempunyai kekuatan hukum yang sama pula, serta bagi pihak-pihak yang mengadakan transaksi terhadap hak atas tanah yang tanda bukti haknya berupa sertipikat pengganti karena hilang tidak perlu ragu-ragu, karana ia memperoleh perlindungan hukum baik perdata, pidana maupun tata usaha negara. In recent years, to transact land rights whose proof of rights is in the form of a replacement certificate due to disappearance, there are many who doubt the legal power and legal certainty of the successors replacement because it is missing, it is necessary to conduct an analysis by means of a comparative description, the procedure of issuance of the replacement certificate because it is lost, with all its characteristics. From the results of the analysis with the comparative description method of the relevant provisions of the law it appears that the status of the substitute law as a lost due to the originer certificate, and has the same legal force, as well as for the parties who entered into the transaction of land rights which the evidence his right in the form of a substitute certificate because of missing need not hesitate, because he obtained legal protection both civil, criminal and state administration.

Abstract

Since the establishment of the Corruption Eradication Commission (KPK) in 2002, corruption eradication agency in Indonesia is authorized to a three sections), namely police agency, prosecutor’s office and KPK. Among the three institutions, the KPK has an extraordinary authority, which is not granted to the police agency or the prosecutors office by the legislators. The authority includes the authority to take over the investigation of criminal act of corruption being perpetrated by the police officers or the prosecutors. In time police institution or prosecutors office begins a graft investigation of a criminal act of corruption, it shall be reported to KPK within a period of time no later than 14 working days and shall continuously be coordinated with the KPK. Even if at the same time the police, prosecutors, and KPK are investigating the same corruption, the involvement of the police or the prosecutors must be discontinued immediately. With regard to this fact, this paper reviews descriptively what and how exactly KPK with its extraordinary authority was originally formed. This paper uses secondary data in the form of literature and minutes of the meeting on the establishment of law on KPK in the House of Representatives of the Republic of Indonesia (DPR-RI). The result of the study shows that the establishment of the KPK according to Law No. 30 of 2002 was designed to form an independent and super-agency of corruption eradication, with some authorities previously never granted to the police or the prosecutors, but by not eliminating the authority of the police and prosecutors as a part of corruption eradication institutions that have been already existed. In such a position, KPK functioned as a trigger mechanism holder over the police and prosecutors who are considered do not effectively and efficiently execute the action of eradication on corruption.

Abstract

Tulisan ringkas ini focus pada analisis pengertian asas-asas hukum, perbedaan asas hukum dengan norma/kaidah hukum, kedudukan asas hukum, fungsi dan jenis asas-asas hukum dalam sistem hukum. Bahasnnya merupakan rangkuman dari beberapa literatur yang penulis simak pada perpustakaan pribadi. Hasil yang di harapkan dapat membantu para mahasiswa hukum untuk mengenal dan memahami pentingnya asas-asas hukum berkaitan dengan arahan agar aturan hukum niscaya dalam perilaku subyek-subyek hukum. This paper focuses on the analysis of the understanding of legal principles, differences in legal principles with legal norms, legal status, functions and types of legal principles in the legal system. The bahasnnya is a summary of some literature that authors refer to the private library. The expected results can help law students to recognize and understand the importance of legal principles with regard to the directive that the rule of law is inevitable in the behavior of legal subjects.

Abstract

The ease of transactions through bank financial institutions increasingly perceived by the entire nation with the development of sophisticated technology that allows it to be completed in a short time. Technological sophistication in the variety of bank services is utilized by various parties as a means to commit various crimes. Crimes involving banks as a means of criminal banking and criminal offenses in the banking sector. This paper reveals various cases in the field of banking with legal juridical normative review by describing several cases that have been processed by law. The specific objective is to examine the banks potentials to become a vehicle for crime from the point of view and rule of law of Indonesia. To achieve this goal, in the design of the study, conceptual and statute approaches to legislation are used by collecting and reviewing banking laws. The main data were obtained from the field, namely in the form of criminal cases that have been processed through law. The results of data analysis show that banking crime and criminal offense in banking involves banks as a means of crime. This has a tremendous negative impact for the country that is making a loss in the field of Indonesian economy. For that, steps to revise or amend the regulation on banking is urgently required because ternya he has a significant deficiency. Banks as trust agencies should have strict security in preventing any opportunity to commit crimes.

Abstract

Bali as one of the target areas of urbanization and mobilization is inseparable to the issues of immigrants. Sanur area, particularly the one that is known as a tourist area, has been most the target of the visits of immigrants seeking to improve the economy. Sanur Desa Pakraman Intaran of Denpasar has undergone transformation from a fishing village into a village that relies on tourism sector. Ideally, the immigrants or called as tamiu are obliged to report themselves to the head of the neighborhood or local prajuru adat/banjar for the creation of an orderly administration. However, in practice there are immigrants who have not cared to work on the rules. To overcome the problem, it is necessary to the efforts in the form of structuring the immigrants. Structuring the immigrants necessarily requires synergy between the village of service with pakraman in order to create the same understanding, vision and mission in order to control the immigrants.

Abstract

In human life, inheritance, especially in the form of land, is a very important asset because it is a very basic need for human beings. There are various ways to get inheritance, especially property rights on land. One of the ways in question is by being an heir. This research intends to answer the question of how the status of the estate inherited by the heirs but leaves his obligation as heir when examined from the perspective of Balinese customary law is. The type of research used in this study is empirical law study. Data analysis were done by using qualitative data analysis technique. The processed data were presented using systematic description techniques. The results of the present study indicate that the status of inheritance in any form, especially in the form of land controlled by the heir who leaves his obligation, in Balinese customary law, is illegitimate. This means that the inheritance of the heirs must be returned to those who are deemed to have the right. The technique of solving the problem of the illegality of acquisition of inheritance by the heirs who neglect their obligations, namely through non-litigation or through deliberation to reach consensus by mediation by Kerta of CustomaryVillage. If through the path of consensus can not be reached, settlement can be through litigation or legal efforts can be taken, that is by making a civil suit to the court based on the provisions of committing the act against the law.
