Abstract

Education plays an important role in improving the quality of life of a person, including women. In pre-Islamic times, women in the world are only used as sexual exploits of men’s sexual desires, and are under male power. There is no education or knowledge, except as a devotee for men. Modernization has not been able to reduce the equal rights of women with men. Discrimination against women has spawned struggles against women’s rights, and encourages the birth of feminism. But these movements do not always have a positive impact but also generate perceptions and build a paradigm that corners Islam. The purpose of this study is to describe women’s education and its role in feminist and Islamic perspectives. This research tries to interpret the thoughts of feminist figures, Alquran, Hadith, and thoughts of Islamic leaders on women’s education. Interpretation is done by considering the values contained in the thoughts of feminism figures (from the western or Indonesian aspect), and connecting with the concept of Islam (in the Qur’an, Hadith, and the thinking of Islamic figures). The Western Feminist Movement gave birth to lesbian, heterosexual, and androgynous groups, as well as the demands of equality in terms of wages, and types of work in all fields. The demand for educational equality is used for “liberation of women”, interpreted as the liberation of the role of mother and wife, and dominates the demands of public roles, even women’s education is oriented to economic improvement, as well as sex. Islam as a universal religion has provided a happy life, whose achievements depend on the educational process it undergoes, because education is the key to opening the path of human life. Women’s education is needed to equip women with wide knowledge both worldly and ukhrawi. The more knowledgeable, the women will be able to perform their roles both as mothers, and wives, and Islam gives women the right to play a role in the public, meaning that women as members of the community have the potential to participate actively in the development of community life.

Abstract

Some socio cultural development phenomenon in Indonesia recently is very contrast with modernity dynamic. A numbers of Islamic group in Indonesia are not become more modern, progressive, tolerance and peaceful, but more become stodgy, conservative, intolerance and radical. The Islamic in Indonesia today, especially in some urban area filled advent with various extreme Islamic organizations that anti paced with religious minority, non-Muslim, other religious sect, others Islamic sect, and other local religious belief. Are those many social cultural phenomenons that very contrast in Muslim majority state shows that Islamic Society become more modern or euphoria to become classic even primitive community? Especially for those, who likes to acts barbarous and violence’s. In this essay, I am eager to interpretation this phenomenon by observing community structure, where in the beginning religious community are built as an effort from community to support all individual remain intact and develop in the middle of cultural atmosphere. This community develop in to organization with religious cultural and inequality social aspiration background. And today have developed in to institution and intellectual group that related to educated Muslim middle economic class growth in Indonesia as a whole .I attempt to have dialogist approach on what is happen in the past and what is happen in the present, in to Islamic thought which more less may analyse why this violence phenomenon appears. I am attempt to rewind what is happen in the past, it is impossible that anything might happen without any causes. Taufik Abdullah, Geertz, Kuntowijoyo, Sumanto Al-Qurtuby, Kersten, Nurcholis Madjid, Nico Kaptein, and many others authors are very relevant in perceive this situation. I am also observing the role Islamic intellectual in international arena. I imagine this social phenomenon in form of sketch where Islamic idea still an evolve process. This essay is not meant to prescribe truth to be reconstructed, but to embrace historical fairness that may disclosed. At least in this discourse become initiation to move forward. Like Kersten have suggested, Indonesia Islamic contemporary idea may calls in postmodern stages. He seen Indonesia as unique sites that being mark with struggled to unify norms and value that the sources are from Islam, local culture and international public life’ John Bowen (2003),’transforming Indonesia as one major sites in earth to review social diversity, political idea and religious commitment. Meanwhile tradition institution in traditional view may formulate as channel in process of Islamic domestication and Islamic transition or traditions become indigenous channel. In my point of view, diversity will become complement in Indonesia full colour spectrum of community life. Tug, struggle and dispute in Indonesian Islamic idea will continue in the future. It may become good tradition if this dispute not based on prejudice and hostility, but conversely with mutual respect even though disagree with certain pattern of ideas.

Abstract

The night tradition of tirakatan is not only seen as a tradition of Yogyakarta community routine in order to commemorate the anniversary of Indonesia, but more than that, this night of tirakatan is also loaded with symbols of Javanese society related to Javanese way of life, thought and culture as a whole. Therefore, the night tradition of tirakatan by the people of Yogyakarta this indirectly also shows how the view of life and spirituality of Java community. This paper will show how the meaning of tirakatan for the santri community of Yogyakarta which in this case is the community of Kauman and Mlangi. Based on the results of this qualitative research, there are fundamental differences in the meaning of tirakatan by the two santri in Yogyakarta that is the community of Mlangi and Kauman. This difference of meaning can be seen from several aspects as follows: first, judging from the aspect of modernity. Tirakatan for the kauman community is considered not to have significant benefits for the community in the future. Second seen from the aspect of religion, the two santri also have their own view. For the Mlangi community that the influence of religion is very strong in the implementation of the tradition of the night tirakatan and thus, the implementation of the tradition of tirakatan night is closely related even very identical with religious rituals. While the Kauman community is more meaningful tirakatan as things that are not taught in Islam, so Kauman people tend not to implement tirakatan. Third, seen from the aspect of ancestral cultures, the tradition of tirakatan night is very related to the culture of the ancestors, considering that this tradition is derived from the Javanese tradition. There is also the Kauman community, although very far with the traditions and rituals of the ancestors, but the ideology of ancestors such as harmony, a sense of solidarity is still a very important part in the life of Kauman society.

Abstract

Majlis Ulama Indonesia has issued a fatwa on interfaith marriage on June 1, 1980. The fatwa stipulates: 1. That an Islamic woman is not allowed (haram) to be married to non-Muslim men, 2. That a Muslim man is not allowed marry a non-Muslim woman. This fatwa was then reinforced by the decision of Fatwa Majlis Ulama Indonesia Number 4 / MUNAS VII / MUI / 8/2005, dated July 28, 2005, stating that the Marriage of different religions is haram and illegitimate, marriage of Muslim men with women scribes according to qaul mu’tamad is haram and illegitimate. The fatwa is interesting, because although the Qur’an clearly allows a Muslim man to marry a woman from a scribe, the fatwa does not allow it. Fatwa of such marriage ban because of its loss (mafsadah) is greater than the benefits (maslahah). Although this fatwa is specifically directed to events in Indonesia; but it is radical because it contradicts what is clearly stated in Qur’an. The fatwa is also against the classical Jurisprudence books, usually referred to by Majlis Ulama Indonesia in making other fatwas. The classical Jurisprudence texts agree to grant permission to Muslim men to marry women of the scribes. The issue of a fatwa by Majlis Ulama Indonesia which forbids Muslims and men from marrying non-Muslims, even those of the scribes, is apparently motivated by the conviction of religious rivalry and that the rivalry is considered by scholars to have reached a point of vulnerability for the interests and growth of the Muslim community. In addition, in the midst of society there have been thoughts that justify the marriage of different religions under the pretext of human rights and welfare, so that the door to the possibility of interfaith marriage should be completely closed.

Abstract

Islamic jurisprudence (fikih) in the daily life of Muslims becomes the vanguard of practical discourse of Islam. Unfortunately the epistemological islamic jurisprudence of fiqh scholarship from time to time becomes always narrowed. Such epistemological reduction or narrowmindedness epistemology in practical life often brings out dispositism, authoritarianism, and radicalism to the perpetrators. They claim their own truth while putting aside opinions differing from their excuse as the only truth of God. These truth claims are often monopolized as God’s authority. The attitude of authoritarianism and the epistemological reduction of fikih that author say as “the authority of God.” While the madzahib priests (Imam al-madzahib) and their successors are always open and tolerant in accepting and appreciating different opinions. In this paper Abou Fadl tries to re-criticize the temporality and partial discourse of fikih and tries to restore the epistemology of fukih to the syar’iah region globally. The reconstruction of the partiality and locality of legal-formal fiqh discourse toward the shari’a region becomes significant in the contemporary era. The return of fiqh discourse to the epistemology of shari’ah as a whole is a necessity for contemporary context to contruct the building of Islamic morality as a practical, tolerant and humanis praxis islamic discourse.

Abstract

The complexity of today’s contemporary world problems has an impact on the presence of new problems that are certainly waiting for the solution. Islam is a religion of rahmatan lil alamin. Consequently, Islam must be able to offer solutions to any problems that occur, one of the problems is gender. Therefore, a gender approach is needed to find the solution. Current the deviation of gender include stereotypes, subordination, marginalization, double burden, and violence. Deviation of gender is one of them caused by patriarchy-domestic culture. In addition, deviation of gender also occurs due to a false interpretation of the Qur’anic and Hadith texts related to gender. In carrying out an Islamic assessment a gender perspective should use the principle of a gender approach. First, the interpreter’s understanding sometimes becomes a subjective means of legitimacy. Second, interpretation results sometimes have the interest of the interpreter (factor of interest). Third, the general tendency in the meaning of text is literal meaning and ignores substantial meaning. The deeply rooted Patriarchal-Domestic culture within Indonesian society seems to be a major factor in deviation of gender. Therefore, the study of Qur’anic and Hadist texts needs to be done with a gender perspective.
