Abstract

Article 1 point 2 of the Criminal Procedure Code states that investigations must be carried out based on this law (KUHAP) wherein the Criminal Procedure Code regulates evidence in the form of statements not confessions, where evidence may not be subject to violence, both physical and psychological, for this reason an examination is required with using the Due Process Model. This study uses a qualitative method with a normative juridical approach. Operationally it was carried out by library research and field studies at the Cilegon Police Station. The results of this study are that the examination of suspects carried out by investigators at the Cilegon Police Precinct before the Covid-19 pandemic was carried out professionally using the Due Process Model inspection system. Likewise, the examination of suspects during the Covid-19 pandemic, where the application of responsive law in an examination in the context of fulfilling the suspect's rights so that his case is immediately examined with a guarantee of justice which is part of the legal service or legal services.

Abstract

Jaminan Fidusia lahir karena perkembangan sosial ekonomi masyarakat atas kebutuhan modal dan menjadi salah satu solusi jaminan pinjaman bergerak yang dianggap mampu memacu pertumbuhan ekonomi kecil. Untuk menjamin kepastian hukum pemerintah mengatur dalam Undang-undang Jaminan Fidusia dan pelaksanaanya diatur didalam Peraturan Menteri Keuangan Nomor 130/PMK.010.2012 dengan Peraturan Pemerintah Nomor 21 Tahun 2015. Terkait Dengan Kewajiban Pendaftaran Jaminan Fidusia. Latar belakang lahirnya Peraturan Menteri Keuangan Nomor 130/PMK.010/2012 karena banyaknya perusahaan pembiayaan yang tidak mendaftarkan jaminan fidusia tepat waktu melainkan saat pembiayaan mulai dianggap macet, Padahal lahirnya kreditor yang memiliki hak preferen juga hak eksekutorial yaitu pada saat jaminan fidusia itu didaftarkan. karena ulah perusahaan pembiayaan itu negara juga kehilangan Pendapatan dari  Penerimaan Negera Bukan Pajak (PNBP). Sehingga Muncullah Peraturan Pemerintah Nomor 21 Tahun 2015 untuk menunjang pelaksanaan Peraturan Menteri Keuangan Nomor 130/PMK.010/2015 serta aturan pelaksana undang-undang jaminan fidusia. Kata Kunci : Kepastian Hukum, Fidusia, Pendaftaran Fidusia

Abstract

The post-Covid-19 National Economic Recovery (PEN) is carried out through the synergy of the Government's policies with the Financial Services Authority (OJK), one of which is regarding financing for the Priority Economic Sector, namely MSMEs. The government issued a PEN policy in order to protect, maintain and improve the economic capacity of business actors during the pandemic. On the other hand, OJK is committed to encouraging the development of MSMEs so that they become a buffer for the economy. OJK's steps are committed to maintaining financial system stability. In implementing the policy, of course, there will be challenges and obstacles, therefore the legal issue that will be studied is how the policy strategy can be applied in terms of developing MSMEs in order to realize a financial services ecosystem. The research method used is a normative juridical approach using secondary data in the form of primary legal materials, namely legislation, secondary legal materials, namely journal articles and the results of previous research. Primary data is the result of research conducted using a legal approach, namely through a review of all laws and regulations related to the legal issues being studied. The results of the analysis show that the empowerment of MSMEs in the context of Accelerating the Development of the Financial Services Ecosystem begins with the issuance of policies by the government, namely: the National Recovery Program, the Implementation of the Job Creation Act and its derivative regulations, as well as the Indonesian-made Proud Movement program. In addition, steps to suspend the settlement of MSME obligations or debts for both tax obligations and business loan obligations, and provide loans directly to MSME actors so that they can have sufficient capital to maintain business and encourage the digitization of MSME businesses so that they can continue to operate in conditions where there are social restrictions. Community is a step that is considered to save the existence of MSMEs during the Pandemic.

Abstract

AbstrakSalah satu larangan   yang dapat dikualifikasikan sebagai pelanggaranUUPU adalah melakukan tindakan praktik monopoli. Ketentuan Pasal 17UUPU menjadi parameter yuridis untuk mengkualifikasikan suatu tindakan termasuk praktik monopoli atau bukan.  Pertimbangan hakim (ratio deciden- di) komisioner   untuk menetapkan pelanggaran terhadap prinsip larangan praktik monopoli jika terdapat unsur-unsur  pasal 17 ayat (2) UUPU yang meliputi: a) non substitution; b) barrier to entry; c) dan market share. Imple- metasi   prinsip larangan praktik monopoli dalam putusan KPPU harus didasarkan pada ada tidaknya kepentingan umum (public interest) yang diru- gikan oleh pelaku usaha.Kata Kunci : Putusan KPPU,  Larangan Praktik Monopoli, Persaingan Usaha.

Abstract

Artikel ini menganalisis tentang harmonisasi hukum terkait perlindungan logo sebagai suatu karya intelektual menurut hukum merek dan hak cipta dalam perspektif perbandingan dengan hukum di thailand. Banyaknya kesalahpahaman terhadap tumpang tindih terkait pengaturan logo dalam perspektif rezim hukum merek dan hak cipta di Indonesia dan Thailand sehingga diperlukan penelitian mendalam yang mengkaji bagaimana pengaturan logo dalam perspektif hukum merek dan hak cipta di negara Indonesia dan Thailand serta bagaimana pengaturan kasus logo “MIFFY” di Thailand dalam perspektif hukum di Indonesia sebagai salah satu representasi dari kasus logo/lukisan hak cipta yang dicatatkan atas dasar tiruan/jiplakan dari lukisan yang dilindungi dalam merek dagang. Dalam penelitian ini, bentuk penelitian yang digunakan adalah penelitian hukum normatif yang didasarkan pada data pustaka atau data sekunder, yang mungkin mencakup bahan hukum primer, sekunder dan tertier. Data yang akan diperoleh selanjutnya dianalisis dengan menggunakan metode penelitian yuridis normatif-kualitatif. Dari contoh kasus-kasus merek dalam penelitian ini, benang merah atas pengaturan perlindungan logo ditinjau dari hukum merek dan hak cipta di Indonesia dan Thailand adalah,  dapat dilindungi oleh hukum hak merek dan hak cipta di masing-masing negara. Namun, masih memerlukan adanya harmonisasi pengaturan yang lebih jelas mengenai batasan makna logo dalam kedua rezim hukum tersebut.

Abstract

Pencatatan perkawinan merupakan kewajiban administratif berdasarkan peraturan perundang-undangan yang bertujuan untuk memberikan jaminan perlindungan, danuhan hak asasi manusia jika di kemudian hari timbul perbuatan hukum yang berimplikasi terjadinya akibat hukum sehingga dapat dibuktikan dengan bukti yang sempurna dengan suatu akta otentik sebagai suatu bentuk kepastian hukum. Penelitian ini bertujuan menemukan dan menganalisa serta memberikan pemahaman mengenai pentingnya pencatatan perkawinan dalam hukum positif Indonesia.. Hasil dari penelitian yang menggunakan metode yuridis normatif dengan pendekatan perundang-undangan, dan teori utilities (teori kemanfaatan) ini memberikan penjelasan bahwa pencatatan perkawinan dilakukan guna memberi kemanfaatan yang sebesar-besarnya demi terciptanya kebahagiaan bagi banyak orang. Kata Kunci : Pencatatan, Perkawinan, Teori Utilities.

Abstract

In criminal justice system, the impact of crime suffered by victims is less considered. In international sphere, the consideration of impact suffered by the victim is known as the Victim Impact Statement (VIS).  It is geared to determine the importance of VIS in the criminal justice system in Indonesia. This research is a normative legal research with statutory and conceptual approaches. All of the data are collected by using library and online search. Based on the research results, the urgency of VIS regulation is seen from 4 (four) basis, namely: (1) philosophical basis, the value of justice is the right of all people in equal treatment before the law; (2) the juridical basis, the limitations of the rules that explicitly regulate the rights of victims in the trial; (3) the political basis, the government has accommodated the Basic Principles of justice for victims of crime and abuse power 1985; (4) sociological basis, victims often experience injustice, VIS must be regulated to provide opportunities for victims to voice the impact of crimes suffered by them. The regulation of VIS will give space for victim involvement  in the judicial process and gaining satisfaction with the judge's decision.

Abstract

AbstrakDalam Hukum   Adat, pertunangan tidaklah sama dengan perkawinan, tujuannya tidaklah  melegalkan hubungan suami istri, melainkan perjanjian awal untuk melakukan perkawinan. Terlepas dari itu semua, ternyata di Desa Sitiarjo, yang mayoritas penduduknya beragama Kristen, ada fenomena yang menarik, yaitu pada masa pertunangan masyarakat desa tersebut sudah mem- bolehkan pasangan tinggal serumah.  Permasalahan yang dikaji dalam pene- litian ini adalah apakah faktor dominan penyebab terjadinya penyimpangan karakteristik sosio religius hukum adat dalam pelaksanaan pertunangan relevansinya dengan agama Kristen di Desa Sitiarjo Kecamatan Sumber Manjing Kabupaten Malang dan apakah upaya yang telah dan akan dilaku- kan oleh pemuka agama Kristen dan pemangku kepentingan untuk mengu- rangi angka kehamilan sebelum perkawinan. Penelitian ini merupakan pene- litian yuridis antropologis, yaitu penelitian hukum yang dikaitkan dengan budaya masyarakat setempat. Hasil penelitian menunjukkan bahwa  faktor dominan terjadinya penyimpangan adalah adanya diskriminasi dalam perto- batan. Upaya yang dilakukan untuk mengurangi angka kehamilan sebelum perkawinan adalah pemberian hadiah bagi pasangan yang belum hamil saat nikah.Kata Kunci : pertunangan, penyimpangan, sosio religius, hukum adat

Abstract

The Constitutional Court carrying out its duties regarding the constitutional review acts as a negative legislator which canceling laws that are contrary to the 1945 Constitution. This study examines the political shift of constitutional review law where the Constitutional Court only acts as a negative legislator, but nowadays Constitutional Court acts as a positive legislator. The research method used is normative research. The results of this study conclude that the Constitutional Court Ruling reflects the role of a positive legislator is a progressive and responsive decision to avoid legal chaos due to legal vacuum in society. However, it does not mean that the decision of the Constitutional Court can always be a positive legislator. Only in circumstances based on 3 (three) indicators, namely: a) Justice and benefit of the community; b) An urgent situation; c) Filling out legal vacancies (rechtvacuum) to avoid chaos or legal chaos in the community, then the Constitutional Court Decision can be a positive legislator so that there is still a balance in the check and balances system. Keywords: Constitutional Review, Positive Legislator, Negative Legislator

Abstract

This study aims to analyze the basis for authority division of notary and Official Certifer of Title Deed in land sector and to examine whether Article 15 Paragraph 2 letter (f) of Law Number 2 year 2014 concerning notary is contrary to Article 2 of Government Regulation Number 37 year 1998 on the rule of position for Official Certifer of Title Deed. This research is legal research normative by design with statute and historical approaches employed. The legal materials obtained were analized and assessed to reveal the correlation between them. The findings of the study show that the authority of the notary comes from Notary Regulation (Stb. 1860 : 3) and the authority of the Official Certifer of Title Deed is generated from Government Regulation number 37 year 1998 on the rule of position for Official Certifer of Title Deed. Article 15 paragraph (2) letter (f) about notary position does not contradict Article 2 of Government Regulation number 37 year 1998 because the land deed such as lease deed, sale and purchase agreement, deed of land right release, the authority to sell, statement of inheritance, will, and deed of grant of mortgage is the authority of the notary and not the Official Certifer of Title Deed.
