Abstract

Since the establishment of Republic of Ireland, their foreign policy is neutral. For examplein world war II, when most of the European country at war (either as allied force, or axispower), Ireland prefer not favoring any side. However, in the Israel-Palestine conflict IrishGovernment doesn’t look as a neutral country, Ireland seems against with Israel. Ireland isa supporters of Israel previously, but soon after Israel independence Ireland changed theirsupport to Palestine. This research aim to analyze Irish respond after Israel independence,with case study: Israel-Palestine conflict. To analyze Ireland foreign policy in Israel-Palestine conflict, this research using neo-realist theory and interest group theory. Themethod that is used in this research is qualitative method with descriptive-analytical typethrough interviews and literature technics. Outcomes from this research is: there is anational interest that Ireland want to accomplished from this conflict. Other than that thereis two factors that influencing Ireland policy in this conflict, that is internal and externalfactor. In internal factor, Nationalist group is influencing Ireland foreign policy. In externalfactor, there is “Vatican factor” that influencing Ireland policy in this conflict.

Abstract

The dynamics of international politics in the era of globalization are faced with variousimportant issues such as environmental conservation. One of the issues that arises is illegaltrading of Sumateran tiger in Riau Province. In this study the authors will describe moreabout the involvement of International Organizations namely World Wide Fund (WWF) tohandle the endangered species trade issues. This study used several approaches such as theNeoliberal institutional theory, the Transnational crime theory, the theory of Internationalcooperation, and the International organization theory. While the method used in this studyis descriptive qualitative with secondary method data collecting. This study concluded thatthe role of WWF to handle the Sumateran tiger illegal trading issues is realized throughinformational / promotional activity, collaboration, and cooperation with Goverment,implementation of collaboration program at home and abroad, formation ofcommunication channel and monitoring. These efforts have made progress in supportingthe conservation of endangered species, although they cannot be the fundamental solution.

Abstract

This research aims to explain the efforts of the Government of India in implementingTRIPS so as to produce generic ARV drugs under the TRIPS regime. The idea ofregulating patent protection on the health aspects of TRIPS has fueled cynical responsesfrom developing countries that view TRIPS as a form of knowledge commodification andfeudalization of information. This research is based on concerns about developingcountries access to Antiretroviral (ARV) due to price increases as a consequence of TRIPS.In response to this problem, India as the world's largest generic ARV producer has becomethe most massive state opposing patent regulation on health aspects. This research seesIndia's efforts in implementing TRIPS in order to achieve its interests through the patternof health diplomacy with the principle that health is the aspect that is interpreted ascommon goods. Periodically, India is advocating the importance of generic ARVaccessibility that is used as an antidote to the HIV / AIDS epidemic in developingcountries. Using the Critical Theory approach, India is able to encourage emancipation andsucceed in protecting the interests of developing countries with serious problems in theHIV / AIDS epidemic.

Abstract

Biopiracy is a crime that generally involves multinational corporations with indigenouscommunity regarding the copyright of over the natural resources. This crime often escapesattention while the effects are very dangerous for the survival of a country’s indigenouscommunity. This study aims to find out how biopiracy actually becomes a dangeroustransnational crime and how developed and developing countries represented by theUnited States and India deal with this crime from the perspective of their respectivecountries under the international regime. The author uses the theory of Cultural Relativismand Social Planning to analyze the handling done by the United States and India. Thisstudy will analyze the history of the two countries, how the two countries understand themeaning of biopiracy, and the position of the two countries under the international regimerelated to the handling of transnational biopiracy crime cases

Abstract

The flows of Indonesian immigrants in United States experienced significant growth,especially in the 1980s until the beginning of the 21st century. Starting from the 2000sthere was a growing trend among Indonesian immigrants to obtain United Statespermanent resident status through seeking asylum. This study will explain the crime in theform of document fraud committed by Indonesian immigrants in the United States in orderof obtaining asylum. This study uses the transnational crime theory to explain analyze theeffort of Indonesian immigrants who uses document fraud during process of gettingasylum as a form of transnational crime. The data collected in this study varied rangingfrom primary sources which obtained through interviews, and from secondary sourceswhich obtained from literature reviews, official government documents, and media inwhich were then analyzed through content analysis. The results of this study indicate thatmajority of Indonesian immigrants who seek asylum from the United States uses documentfraud during the process of applying the status.

Abstract

Indonesia, as a member of CCSBT since 2008, is obliged to comply with the amount ofTAC granted annually to safeguard southern bluefin tuna population. Indonesia is one ofthe important members of CCSBT because Indonesia is the only breeding ground forsouthern bluefin tuna, precisely at Java Sea. In an effort to implement TAC, Indonesia isnoted to have difficulties to comply with the number determined by CCSBT. From 2008 to2014, Indonesia only adhered to TAC in 2009 and 2010. The author uses regimecompliance concepts in analyzing factors affecting Indonesia's non-compliance with TACimplemented by CCSBT. The research method used by the author in this study isqualitative method. In addition, this study is an explanatory study. After analyzing the data,it was concluded that Indonesia's non-compliance with TAC implemented by CCSBT canbe explained by factors such as ambiguity, capacity limitations and temporal dimension.

Abstract

This study aims to determine the persistence of counterfeiting in China which is also calledshanzhai in Hu Jintao regime. This study also provides an overview of the factors thataffect the persistence of counterfeiting or shanzhai in China. This study uses the theory ofconstructivism, which draws conclusions and from the data collected in the field. Theresults of this study indicate that in the regime of Hu Jintao, a change in the role of newidentity in China is a capitalist communist who will create a policy that gave birth shanzhaiin China. And the norm adopted by the Chinese community is Confucianism which latercan affect the counterfeiting in China. In the norms of Confucianism adopted by thisChinese society, do not prohibit the existence of counterfeiting due to counterfeiting issomething that does not violate the norm. Thus, both of these have an effect on the lessefficient and less effective enforcement of intellectual property rights in China.

Abstract

Australia is a country that has ratified the 1951 Refugee Convention. However, during the regime of Prime Minister Kevin Rudd in 2013, Kevin Rudd released a tough policy against refugees and asylum seekers who came to Australia called the PNG Solution policy. PNG Solution is a policy provide that every refugee and asylum seeker arriving without a passport or visa, using a ship, will not resettle in Australia. They will be resettled in Papua New Guinea. This research will explain, the reasons of Australia, create the PNG Solutions policy, against refugees and asylum seekers in Australia. Qualitative research method, with explanative type, used in this research to discuss the policy of PNG Solution and the factors drive in determining the policy. Meanwhile, the concept used to explain in this research is concept of Foreign Policy Analysis, that is Internal and External Setting from Richard Synder, Bruck and Sapin. Data were collected using official government literature and archive studies. The results show that, internal factors are Labors Party, the situational characteristics of Australia, and public opinion is more dominant in Australian foreign policy. Meanwhile, the external factors, have no influence in decision making.

Abstract

Jordan is a host country for Syrian refugees despite the fact that they have not ratified the1951 Refugee Convention. The high cost of living and the difficulty of obtaininglegitimate employment in Jordan encouraging of child labor cases from Syrian refugeeswho are vulnerable to exploitation. In this case, Jordan has actually ratified the ILOConvention on child labor, but there are still many illegal displaced child laborers. Thisstudy aims to describe the attitude of non-compliance Jordan in adopting ILO convention.In this study, the authors use the concept of non-compliance of the theory of theinternational regime to explain that the state is not always willing to comply withinternational instruments that have been agreed. The research method used is qualitativewhich is done by collecting and analysing data, to find out the reason behind Jordaniannon-compliance even though the government has ratified ILO Conventions. In this study,factors that resulted in the attitude of non-compliance of Jordan, such as the ambiguity ofthe interpretation of the ILO's Conventions by the Jordanian government, the limitedcapability of the state, and the influence of the temporal dimension in the country.

Abstract

Italian food product is a very popular product in the world and this fact leads to a largenumber of counterfeiting cases to these products. This can be seen from the large amountof profit reaching 30 billion Euro and ascend to 60 billion Euro. This research aim todetermine the cause of the increasing case of food piracy in the Italian Soundingphenomena in spite of the Italy’s numerous effort in handling this case. This research usesTransnational Organized Crime theory which will then be continued by usingneoliberalism view in the form of International Cooperation theory, InternationalInstitution theory, and International Regime theory. The method used for this research isqualitative with explanative research type. This research proves that the cause of this casecontinues to increase is the lack of awareness from Italy and other countries regarding thiscase which leads to the lack of international cooperation initiative in respond to foodpiracy in the Italian Sounding phenomena case.
