Abstract

Capital market is an activity related to public offering and trading of securities, public companies relating to the issuance of securities, institutions and professionals associated with the effects. One of the most popular financial instruments and commonly used in conventional capital market, including in Indonesia Stock Exchange (Bursa Efek Indonesia) is short-selling. In regulation of Bapepam-LK No. V.D.6, short-selling is the sale of securities in which the securities are not owned by the seller when the transaction is executed. In general, this transaction clearly violated syariah guidance, as embodied in the Fatwa of DSN-MUI No. 20 Year 2001 and No. 40 year 2003, because of short-selling synchronized with the bay' ma'dum based on the hadith "You may not sell anything which are not your belongings". Therefore, this paper aims at studying the issues surrounding the interpretation and the reality of short-selling instruments. Three main results obtained were permissibility of shares as the object of the loan contract, the issue of bay 'ma'dum can be interpreted as a collateral of delivery which can be controlled by the rules of Bapepam-LK, and thirdly, the economic benefit from the imposition of a fee in the formof the loan contract is concluded as a forbidden usury.

Abstract

As one of the Asian countries substantiating Islam as the official state religion, Malaysia always faces a dilemma in its encounter with international law, amid the dominance of municipal (national) and Islamic laws. Until now, many norms of international law seem to be apprehensively accepted. In fact, the existence of Islamic law, constitutionally recognized as having an equal position with Common Law, often works as a barrier to the influence of international norms. Here, the segregation between British Common Law and Islamic law has played a major role in building the country's behavior in facing international law. Particularly, in redressing hard cases, international legal norms (such as international human rights law) are still difficult to get in and provide a positive influence in the national legal system. This paper focuses on the interaction between these three legal traditions of international, municipal and Islam in the face of rising Islamic conservatism supported by Malaysian Islamic parties in recent decades. Because legal segregation and compartmentalization between British common law and Islamic law had been chosen as the framework of legal pluralism in this country, the redress of the hard cases involving the meeting among the three laws --such as the case of apostasy, divorce due to apostasy, purdah etc.--, more often than not has led to the marginalization of international norms. This brings the consequence of the need to review the pattern of legal pluralism in this country, where relationship between different legal traditions is analyzed using bottom-up and non-state oriented perspectives. And it can only be done if the jurisprudence of legal pluralism in Malaysia can benefit the principles of Higher Law in its legal orientation; namely, the principles of universal justice, morality, and fairness, and not in the mere proximity to the character and the logic of official state law.

Abstract

Hasbi membagi dunia menjadi dua, yaitu Darul Islam dan Darul Harbi, dengan pembagian negara menjadi dua sebagaimana tersebut di atas bukan berarti mengharuskan bahwa Darul Islam itu diperintah satu pemerintahan. Darul Islam lahir atas dasar kebangsaan (Nation ?) yang dibangun atas dasar Islam (agama) dan perjanjian. Dengan kata lain dasar kebangsaan dalam Darul Islam adalah Islam dan berjanji mengikuti hukumnya. Prinsip Hubungan Internasional dalam Islam adalah Perdamaian yang abadi, dan jia didukung dengan dasar kenyataan (fakta-fakta) yang daruri, maka Hubungan Internasional berubah menjadi Perang dan hanya bersifat sementara, tetapi tidak merubah kebijakan pokok, yaitu tetap pada dalam hubungan perdamaian.

Abstract

This article deals with one of the important concepts of u??l al-fiqh(Islamic legal theories), i.e. conflict of proofs of law, and its relation to theplurality of ways in performing Islamic worship with special reference to the case of reciting basmalahin prayer and at the same time deals with the authentication of the related prophetic traditions. There are disagreements among the u??l?s regarding the steps to be followed in settling the conflict of proofs of law: should one place the compromise method at the head or should he make the obrigation or the weighing one preced? Forwarding the compromise method enables a wider acceptance of applying principle of plurality in worship performance so that different opinions can be appreciated.

Abstract

The study of Islamic law requires a shifting paradigm from text to context and demands an inter-disciplinary approach involving various disciplines in social sciences. A text-based legal-normative approach is no longer adequate to ensure the relevance of the study of Islamic law with the current changes as a result of modernization and globalization. Perspectives of social sciences provides not only the lens to see Islamic law as a fact social, but also offers the analitical frameworks to explain how Islamic law engages with the context and receives new meanings and interpretations in its complex interaction with other forms of social practices. In tandem with growing awareness among Muslim intellectuals of the importance of actualizing Islamic law with the spirit of changes, the studies and researches at the Faculty of Sharia and Law at Sunan Kalijaga State Islamic University of Yogyakarta have thrived by utilizing and integrating social sciences into their paradigm, method and analytical construct. Within this context the so-called "mazhab Yogya? came into being. This new trend of thought pays a special attention to the effort of reactualizing fiqh as knowledge about the basic principles used as a reference in formulating Islamic law in accordance with local context.

Abstract

Various regulations have been issued by the government to develop the village since 1948 by Law No. 22 on Local Government. The final rule is Law No. 6 of 2014 on the Village. The genesis of Law No. 6 of 2014 is the embodiment of a decentralized system. This paper intends  to  explain  how  the  decentralization  system  provided  by  Law No. 6 of 2014 gives effect to undertake rural development as a whole. Through this legislation anyway been delegated from thecentral state to local governments to lead to the village government can be realized. With the delegation of authority from the central government to village government,  the  village  government  has  the  power  to  manage  all matters  relating  to  his  village  and  ended  up  giving  a  significant influence in the development  of the  village. Nevertheless,  the overall rural development may occur when leader and staff of the village can create policies that impact on rural development which is determined according to the priorities in the Minister of Rural No.5 of 2015.

Abstract

The purpose of this paper was to find out the effectiveness of Judicial Commission in supervising judges in Indonesia. The research method used was a normative legal/juridical-normative method. Data obtained was analyzed by a descriptive-qualitative method. From the research results it was found that the role of Judicial Commission in supervising the judges was not implemented effectively. The reasons were, among others, the Judicial Commission has neither an authority to impose itself any administrative punishment nor an investigatory authority over those judges who allegedly have committed a crime.

Abstract

Tulisan ini memberikan sedikit gambaran tentang perbedaan antara pendukung dan penentang istihsan yang pada hakikatnya hanya berupa perbedaaan redaksional. Sebagai sebuah metode penetapan hukum yang tetap berpegang pada dalil, istihsan disepakati penggunaannya oleh semua ulama. Istihsan juga tidak terbatas menggunakan qiyas khafi sebagai lawan dari qiyas jali, akan tetapi juga bisa dengan berdasar pada nash, ijma, urf, dan dharurah. Bila melihat bahwa tujuan utama penggunaan istihsan adalah menghilangkan kesulitan dan mencapai kemaslahatan maka istihsan merupakan salah satu metode penetapan hukum yang sangat mungkin untuk dilakukan pengembangan dan modifikasi agar bisa menjadi salah satu metode penetapan hukum yang dinamis, berkembang sesuai dengan perkembangan waktu.

Abstract

Since the enactment of Law Number 28 Year 2009 voting Land and Building Tax (PBB), which is the authority of the central government turning to local authorities. So that local governments can levy the PBB must have a local regulation as its legal basis. Actually it is very potential to be able to provide improvements to the original income (PAD). Unfortunately, not all areas are ready to implement. From 492 existing local government, only about 245 local governments that already have a regulation of PBB, 64 local governments are still in the process and 183 local governments have not compiled at all. Local governments are already doing PBB since in 2011 only Surabaya City Government, then in 2012 increased 17 local governments (including the City of Yogyakarta), and in 2013 there are 113 local governments plan, and in 2014 there will be 117 local governments. To be able to pick up PBB Yogyakarta Government issued Regulation Number 2 of 2011, but the contents of this legislation still needs to be improved because there are chapters that give rise to many interpretations, there is also the use of the word/term is confusing and unclear, the inclusion of legislation as a basis law is no longer valid, and there is a conflict with the legislation higher. The articles need to be improved such as in the section 3 Given the points, then Article 1 paragraph 15, Article 1 paragraph 16, Article 1 paragraph 17, and Article 1 paragraph 18, Article 4, Article 16, Article 29, Article 34 , and Article 36.

Abstract

Genealogy relationship to every aspect of life is a link for a generation to the next one. The continuity of generation needs the preparation and supply, materially or immaterially, in order to be able to exist and survive. Al-Quran even suggested Moslem not to leave the weak generation. Therefore, genealogy relationship was believed as a main cause of inheritance transition from the dead to the heir. The problem appears when the Moslem has to bequeath to non Moslem. Al-Quran does not explain it, even the tradition forbade the interreligious inheritance, whereas the social context demands to treat the other way. The dialectic between law and social demand became a big problem to the Islamic law of inheritance. The problem of interreligious inheritance appeared when the relationship between Moslem and non Moslem was re-discussed by some social groups. Moreover, it became attention of Moslem thinkers since its formation, such as Mua? bin Jabal. His decision to share the inheritance from Moslem to non Moslem is an innovation that is needed to appreciate. He braves to find another way by ignoring the textual law towards the contextual law without leaving the essence of shariah. Besides it is for human benefit, it is also for implementing uptodate Islamic law.
