Abstract

Abstract: Indonesianization of Islamic law contains two tendencies; first, is the ideal of building Islamic law that characterizes Indonesia by freeing itself from Arab culture and making Indonesian custom as one of the sources of Islamic law. The peak is marked by the emergence of the concept of Jurisprudence of Indonesia. The second tendency is constitutional-oriented Indonesianness, which is to formulate Islamic law in the form of legislation through consensus (Ijma`) of Indonesian clerics. The author argues that such a process of Islamic law becomes a national law. Given Indonesia is a country with a population of bhinneka (Plurality). In this article the author analyzes with the theory of differentiation in unification that is paying attention to diversity (plurality), in the form of a codification of law that contains legal unification as well as legal differentiation. And in the process of enactment toward the Indonesianization of the law it is necessary to note the existence of the national guidance principles, namely: the law in Indonesia must guarantee the integration or the integrity of the nation, the law must be created democratically, the law must encourage the creation of social justice and must pay attention to the principles of humanity, principles of human rights, and the principle of equality before the law.Abstrak: Indonesianisasi hukum Islam mengandung dua kecenderungan; pertama, adalah cita-cita membangun hukum Islam yang berciri khas Indonesia dengan membebaskan diri dari budaya Arab dan menjadikan adat Indonesia sebagai salah satu sumber hukum Islam. Puncaknya ditandai dengan munculnya konsep fikih Indonesia. Kecenderungan kedua adalah keindonesiaan yang berorientasi konstitusional, yakni memformulasikan hukum Islam dalam bentuk peraturan perundang-undangan melalui konsensus (Ijma`) ulama Indonesia. Penulis berpendapat bahwa proses demikian menjadikan hukum Islam sebagai hukum nasional. Mengingat Indonesia adalah negara dengan penduduk yang plural. Dalam artikel ini penulis menganalisis dengan teori diferensiasi dalam unifikasi yaitu memperhatikan pluralitas, dalam bentuk satu kodifikasi hukum yang mengandung unifikasi hukum sekaligus diferensiasi hukum. Dalam proses pemberlakuan menuju Indonesianisasi hukum perlu diperhatikan adanya kaedah-kaedah penuntun nasional, yaitu: hukum di Indonesia harus menjamin integrasi bangsa, hukum harus diciptakan secara demokratis, hukum harus mendorong terciptanya keadilan sosial, dan harus memperhatikan prinsip kemanusiaan, prinsip hak asasi manusia, dan prinsip persamaan di depan hukum.

Abstract

Pemikiran Hukum Islam Abdullahi Ahmed an-Na`im meliputi spektrum yang luas, mulai hukum keluarga, isu permurtadan di Afrika, konstitusionalisme, hukum pidana, hukum internasional, HAM, hingganegara sekular. Dari banyak pemikirannya itu, isu HAM dan negara sekular yang paling banyak mendapat tanggapan dari pemikir lain. Kemudian HAM dalam perhatian an-Na`im dapat ditekankan pada isu-isu: perbudakan, gender, dan kebebasan beragama. Dilihat dari sociology of knowledge, pemikiran an-Na`im dimaksud tentu tidak bisa dilepaskan dari konteks sosial dimana an-Na`im hidup, belajar, dan bekerja. Sociology of knowledgemengandaikan bahwa pengetahuan seseorang sesungguhnya merupakan konstruksi sosial, bermotif dan berkepentingan, serta berkemungkinan ideologis atau utopis.

Abstract

Law both Islamic law and positive law has been more textual normative. This viewpoint is believed to occur because the law must have the principle of legality postscript found in the text (statutory law). To borrow a phrase in the study of Islamic Emirate of Muhammad, Islam is a divine source- oriented Insaniah (ilahiyul masdar insaniyul maudlu'). Sui generis- positivistic paradigm is considered by legal experts postmodernists are not sufficient to understand and find the law in the contemporary era. One of the legal experts Indonesia, Satjipto Raharjo also provide strong criticism against the way of thinking of positivistic-normative. According to this paradigm precisely the legal handcuff themselves to find substantive justice, especially in the absence of the text. Hence judges (mujtahid) required to be more creative and progressive thinking in the interpretation/ijtihad. The notion of progressive legal paradigm is actually trying to understand and find maqasid sharia-based law (legal purposes) to achieve the objectives of the law. Integration and interconnection of scientific disciplines become keywords in this paradigm, as a new form of legal epistimologi bid that is sui generis-cum empirisuntuk find solutions to the problems of contemporary law.

Abstract

The process to one-roof the Religious Court system is not as smooth as the one-roof process of other court institutions. It is full of obstacles and faces pros and cons. Nevertheless, in the early 2004, Religious Court had been made beneath Supreme Court as the executor of the highest judicial power. Therefore, Religious Court as the executor has been authentically experiencing escalating reformation, moreover when the of Law No. 3 of 2006 concerning the Amendment of Law No. 7 of 1989 concerning Religious Court was isseud. This paper is tryingto explain some factors that influence the one-roof process of Indonesian Courts especially Religious Court as well as the effects of one-roof court implementation towards the existence of ReligiousCourt in Indonesia.

Abstract

As a country of the largest Muslim population in the world, Indonesia is not an Islamic state. However, Indonesian government still accommodates the aspiration of Muslims to practice their belief and even to implement some aspect of Islamic law (sharia). Political situation in Indonesia and the aspiration of Muslim society have given the opportunity for sharia to be implemented formally. Therefore, it is essential for the ruler in a new democratic environment to accommodate Muslim aspiration to implement sharia law, especially in national levels.This essay concludes that mutual influences between local traditions and Islam has formed a distinct characteristic of social structure of Muslim society in Indonesia. The fact of this characteristic has made some Indonesian Muslim intellectuals realized that the classical imported sharia was not suitable to Indonesian context. Therefore, contextualizing and reinterpreting Islamic law for Indonesian Muslims is actually the best effort to implement sharia in Indonesia amongst many demands of re-installment of sharia law.

Abstract

Effect of busy parents often neglected duty towards their children. So in this paper a problem concerning maintenance obligations hadanah and rada'ah for children. The method used is the approach to library research with content analysis of the various references relevant to the subject matter covered. Parents are obliged to provide a living hadanah against children because a child needs someone who can nurture, guide and educate well. Obligations of parents towards children has been started from the time the fetus until the baby where the mother is obliged to provide a living rada'ah (feeding the baby) in addition to the health of the baby also for the health of the mother. In Islam keeping the kemaslahatan and survival of a child is a parental responsibility, which should not be ignored either by the mother or father.

Abstract

Religion and religious organizations actually carrying the mission of salvation, peace, happiness, and life for the good of mankind. Hence a paradox if in fact religious life religious violence. The religious violence often occurs in the sacred and complex dimensions, both rooted in the aspect of religion and other dimensions of understanding of the dynamics of the life of this beragama.Studi tried to examine the roots and dimensions of the religious violence in the lives of the people of Indonesia to date, which often happens quite hard and complicated , By using a sociological perspective, this study tries mencandra complex relationships between the dimensions of understanding inherent in the system of belief (belief system) in every religion with economic interests and political and social plurality reality in people's lives beragama.Kajian dynamics of religious violence is sociologically be very important and relevant as the case often occurs repeatedly. At the same time the study is also important in order to obtain the understanding and solving solutions in religious violence in the country.

Abstract

Khawarij adalah identifikasi kesejarahan yang secara minor dinisbatkan untuk menyebut kelompok teroris, dimana dalam sejarah politik Islam selalu bersanding dengan Sunni sebagai kelompok penguasa dan Syiah sebagai kelompok oposisi. Khawarij mempunyai doktrin yang khas, diantaranya adalah konsep al-takfir dan konsep hakimiyyah. Khawarij awal Islam telah mengkafirkan Khalifah Ali b. Abi Thalib sebagai penguasa yang sah dan kemudian memfatwakan untuk membunuhnya karena dianggap mendustakan hukum Allah. Khawarij modern juga mengkafirkan lalu memerangi terhadap individu, masyarakat dan juga negara yang tidak menegakkan hakimiyyah (kedaulatan hukum Alla) di muka bumi. Bahkan diantara kelompok khawarij modern ada yang memfatwakan untuk membunuh Amerika dan sekutunya baik sipil maupun militer kapan pun dan di mana pun menemukan mereka. Inilah khawarij hadza al-ashr.

Abstract

Often excessive if Muslims presupposes a past glory rests only on thecaliphate system as Khulaf?u ar-r?syid?n and then refer to it as (the only) areaideal representation of the Islamic state without going through the lengthy studyand adequate correction. One important note that the formulation of systemleadership be after the Prophet has inspired the formulation of a long and contentious in the Islamic system of government with reference to the spirit that they built through the first three principles, namely, emphasizing deliberationin solving political and social issues. Secondly, giving priority to be a leader tothe people who have and are accepted by most people, and the Third, by thepublic statements of loyalty in following their leadership expressed in the formof initiation.

Abstract

The substance of issue in this study is how many (degrees) the minimum standardized angle still be considered feasible and how the application which is raised in the title The Minimum Standardized Angle of the Kiblah Direction of Mosques in Gorontalo City, with the aims on trying to find the minimum standardize referred to and to be used as guidelines by the community (Jamaah) whether or not to make row adjustments in the mosques that experienced irregularities of kiblah direction. Based on early studies showed that mostly the mosques of Gorontalo city deviate from 1 to 15 degrees from the true direction of Kiblah. With the approach of science and technology especially in the field of astronomy (falak), then what is desired by the provisions of Islamic law ( syari) above can be well realized. Deviations of Kiblah direction of mosques in Gorontalo City today still can be find the solution to make rows improvements / adjustments in the mosques to the true direction of Kiblah or at least meet the minimum standardized angle which can be considered feasible in terms of the direction of kiblah in the mosques has not been out of boundary areas of the city of Mecca.
