Abstract

Soil is one part of the earth that has a close relationship with human life, it can even be said that every human being is related to land. Article 33 paragraph 3 of the 1945 Constitution of the Republic of Indonesia stipulates that: Earth, air and the natural resources contained therein are controlled by the State and used for the greatest prosperity of the people. However, land disputes still arise in the community, therefore this thesis takes the title of land ownership dispute resolution at the Solok City Land Office (a case study of land disputes between PT Gelora Ganto Sejahtera and Syamsu Tulus). In this writing, the problem formulation is 1. How to settle land disputes at the Solok City Land Office. 2 How is the authority of the Solok City land office in resolving land disputes. 3. What are the results of land dispute resolution at the Solok City Land Office. In writing this research, the method used is empirical juridical. Empirical juridical research is an approach by looking at a legal reality in society. The research conducted in this paper is descriptive analytical in nature, namely a form of research that aims to describe the applicable laws and regulations, associated with legal theories and the practice of implementing positive law. Disputes are situations and conditions in which people experience factual conflict or release according to their warnings. Land disputes can be resolved in 3 (three) ways, namely: a) Settlement by deliberation. b) Settlement through the judiciary, namely submitted to the general court in a civil or criminal manner. Based on this research, there is a land rights dispute that has been issued with a building use rights certificate in the name of PT. GGS entered. Then Samsyu Tulus objected that the settlement was carried out at the Solok City Land Office, then the settlement was not reached so that it entered the litigation route or went to court, from this research it was concluded that the Land Dispute Settlement in Solok City could be carried out on the basis of public complaints. The results of the mediation that have been agreed upon will result in changes to data, which can be in the form of a decision to cancel land rights, cancel certificates and also change data on certificates, measurement papers, land books and/or other public registers.

Abstract

The doctor's service at a hospital, becomes the future cycle of the hospital itself in the middle of society. The impact of a service and the acceleration of services performed by doctors and other medical personnel will have an impact, both positive and negative, on the image of the hospital. Legal questions that may arise from the hospital service when the medical action that should be performed by the doctor responsible for the patient but carried out by the general practitioner. Medical action carried out by a caregiver against a patient will be a legal issue for doctors and hospitals when such action is detrimental to the patient, while such an action is a fulfilment of the duty that should be performed by the Patient Responsible Doctor.

Abstract

Notaries in carrying out their duties for the general public are required to be under the supervision of an institution that is neutral, impartial, and independent. The purpose of this supervision is so that the Notary seriously carries out the duties of his office in accordance with applicable rules and codes of ethics in order to maintain the security of the public who make deeds to the public. Notary Public. Another aim is to avoid Notaries who are irresponsible and do not comply with the Notary's code of ethics. The establishment of a supervisory institution is referred to in Article 1 point 6 of the UUJN which states that the Notary Supervisory Council, hereinafter referred to as the Supervisory Council, is a body that has the authority and obligation to carry out guidance and supervision of Notaries. In Solok City in 2022 there will be eight Notaries, whereas in the examination carried out by the Solok City Regional Supervisory Council in 2022 only four Notaries were examined. Based on this, researchers are interested in conducting further research by analyzing: 1) the implementation of the authority of the Regional Notary Supervisory Council in examining Notary Protocols in Solok City. 2) the obstacles and efforts of the Regional Notary Supervisory Council in carrying out inspections of Notary Protocols in Solok City. This research is descriptive analytical, using an empirical juridical approach. Using primary data as the main material with a study of secondary legal materials. Based on research, it was found that: the implementation of the authority of the Solok City MPD in examining Notary protocols has carried out guidance and supervision related to the implementation which was carried out in 2022, there were around four out of eight Notaries who were not examined. The problem with MPD is that when MPD carries out inspections, several Notaries are not in their offices at the time of the inspection. Which results in Notaries not being checked by the MPD. Efforts made by the MPD were to summon the Notary concerned to appear at the Regional Office of the Ministry of Law and Human Rights to have the protocol checked by the Chair of the MPD and notaries who were not examined were made a priority in the examination for the following year.

Abstract

The case of a land dispute with the object of the dispute being a certificate of land rights issued using a fake document is the Decision of the Class II Batusangkar District Court Number 67/Pid.B/2021/PN Bsk which has obtained permanent legal force. The dispute in this case is located in Jorong Baruah, Nagari Padang Magek, Rangkat District, Tanah Datar Regency. The research method used is normative juridical with a case approach. The findings in this research, namely that certificates of land rights issued using fake documents, certainly do not provide legal certainty. This certificate can be categorized as a genuine but fake certificate. This kind of certificate must of course be canceled and declared invalid and withdrawn from circulation after being proven through a process in the District Court. To prevent the occurrence of genuine but fake certificates, this is by increasing the accuracy of the authorities who process the creation and issuance of land title certificates. The consideration of the Panel of Judges in the Decision of the Batusangkar District Court Number 67/Pid.B/2021/PN Bsk is that the Defendant was legally and convincingly proven at trial to fulfill the criminal elements charged by the Public Prosecutor, namely Article 263 paragraph (1) of the Criminal Code. So the Panel of Judges sentenced the Defendant to imprisonment for 1 (one) year and 6 (six) months.

Abstract

To support the implementation of the implementation of political party activities cannot be separated from the existence of large financial support. In the process of traveling political parties, political party funds come from contributions from party politicians, legitimate contributions in accordance with legal provisions; as well as financial assistance from the APBN and APBD from the government. Through the funds generated, an accountable and transparent report is needed to the public in order to create legal certainty and prevent acts of corruption originating from the party's funds. So through this research the authors underline the 2 (two) formulation of the problem that is important to be discussed. First, what is the urgency of disclosing political party financial information in preventing cultural practices of corruption in Indonesia? And Second, how is the accountability of political party financial funds sourced from APBN and APBD funds in Indonesia? This research uses the type of normative juridical research. The data used in the research comes from primary legal materials, secondary legal materials and literature studies from various literatures. The results of this study note that the form of political party financial reporting must record all sources of receipt of funds for the party and not only be accountable for funds originating from the APBN and APBD, then with regard to sanctions there must be strict action taken by the government not only the imposition of administrative sanctions imposed against a party.

Abstract

The pattern of medical rehabilitation carried out by countries that legalize the use of medical marijuana, and the process of healing users from narcotic dependence varies, so various strategies and therapies for marijuana use are needed in various countries with emphasis on several indicators, such as: religion, form, and/or the basis of a country, what legal system is adopted by a country, what institutions exist in a country, which really focuses on the values ​​that live and grow in that country, which are feared will affect the aspects of national and state life , undermines the stability of the nation's economy, which of course affects a country's efforts to realize the welfare elements of a country, one of which can be obtained through legal development in general, as well as health development in particular.

Abstract

Today's the advancements of technology have an impact on many aspects of life, including health, education, transportation, business, information communication, and government administration. Nonetheless, given the strong relationship between technology and the military, technology advancements could lead to a war. The sheer proliferation of technologies implemented in military operations spawned technology-based warfare called cyber warfare. Cyber warfare refers to wars carried out through the virtual world and is coordinated with conventional warfare. In cyber warfare, opposing countries perform cyber operations through cyberspace as the latest weapon of warfare launched to destabilize the national security and stability of the target state. The current cyber warfare is in the international armed conflict between Russia and Ukraine. This article analyses the deployment of cyber warfare in international armed conflict from the international humanitarian law perspective, and it also investigates Russia's use of cyber warfare against Ukraine. The purpose of this article is to understand how international humanitarian law rules the use of cyber warfare in international armed conflicts, in addition to the way Russia employs cyber warfare against Ukraine. This article is normative law research which uses the statute approach with juridical-normative research method. The findings found that cyber warfare carried out within the framework of international armed conflict is subject to international humanitarian law and that its use is also restricted by the fundamental principles of international humanitarian law. The research also found that Russia's cyber warfare against Ukraine in an international armed conflict is against the principles of differentiation and proportionality.

Abstract

Topik baru di dalam ilmu kesehatan Indonesia melahirkan pertanyaan terhadap kedudukan rumah sakit untuk bertanggungjawab secara pidana terhadap penerapan sistem patient safety dalam menyelenggarakan asuhan keperawatan. Patient safety atau dikenal dengan keselamatan pasien menjadi topik penting dalam menghindari bahaya atau kemungkinan cedera pada pasien selama masa rawatan inap di rumah sakit. Rumah sakit sebagai korporasi bertanggungjawab atas kelalaian yang dilakukan oleh stafnya berdasarkan hubungan kerja yang terjalin di antara keduanya. Saat ini, dalam menetepkan tanggung jawab pidana rumah sakit dilakukan dengan melakukan proses penemuan hukum berdasarkan ketentuan Undang-Undang Kesehatan, Undang-Undang Rumah Sakit, Kitab Undang-Undang Hukum Pidana dan kebijakan hukum lainnya yang memiliki relevansi. Dalam penerapannya, patient safety sudah diatur secara hukum dalam Peraturan Menteri Kesehatan Republik Indonesia 1691/VIII/2011 tentang Keselamatan Pasien yang diperbaharui dalam Peraturan Menteri Kesehatan Nomor 11 Tahun 2017 tentang Keselamatan Pasien. Perawat dalam melaksanakan praktik keperawatannya dilakuaan dengan pemberian asuhan keperawatan yang telah diatur dalam Undang-Undang Keperawatan.

Abstract

Setiap anak mempunyai harkat dan martabat yang patut dijunjung tinggi Hak-haknya, anak harus mendapat kesempatan seluasnya untuk tumbuh dan berkembang secara optimal baik fisik, mental, sosial, maupun sipiritual, termasuk dalam hal ini anak yang berhadapan dengan Hukum juga memilik hak yang harus dilindungi oleh Negara, untuk mewujudkan perlindungan hak asasi anak Balai Pemasyarakatan memiliki peranan strategis dalam melindung hak-hak anak berhadapan dengan hukum, salah satu perlindungan hak anak adalah adanya pendampingan pada saat anak dihadapkan dalam persidangan anak di pengadilan sehingga anak terjamin hak-haknya selama persidangan berlangsung. Prapenelitian yang dilakukan di Balai Pemasyarakatan Kota Padang ditemukan bahwa tidak semua anak yang berhadapan dengan hukum pada proses Persidangan di Pengadilan Negeri Kelas 1A Padang di dampingi oleh Pembimbing Kemasyarakantan padahal, setiap anak yang berhadapan dengan hukum wajib di dampingi oleh Pembimbing Kemasyarakatan sehingga dalam hal ini penulis fokus untuk melihat proses pelaksanan pendampingan tersebut.

Abstract

Forcible transfers or forced displacements due to an international or non-international war often happen and cause suffering to those who become displaced by loss of their homes and livelihoods and survival resources. As an example of the current situation, there are many civilians from Gaza, especially Palestinians, who have had to leave their homes and have to seek shelter. Alarmingly, some of them have fled to refugee camps that have been housing Palestinian refugees since the 1948 and 1967 conflicts with limited conditions. While, it is commonly known that evacuation should only be temporary. This fact invites us to discuss and answer the following questions: 1) How is the rule of international humanitarian law or the law of war regarding the transfer of population and civilians in time of war?; 2) How could the displacement of civil population and civilian in time of war amount to genocide or ethnic cleansing?; and 3) How is the law enforcement against the violations of international humanitarian law on the transfer of civilian population? It is expected that the answers of these questions could be a reference to comment any news of displacement due to armed conflict. To answer these questions, normative research is conducted by literature study for collecting secondary data from international treaties and other sources of international law such as customary international law, court rulings, expert opinions and information or news from the field, including the implementation of international law in Indonesian national legislation. Analysis of data for taking conclusion is carried out qualitatively, and the reporting is made in an explanatory descriptive manner. The results showed that the international humanitarian law system has contained sufficient rules containing certain prohibitions and obligations for parties to the conflict. There are several prohibitions against deportation and forcible transfer of population. There are several obligations to prevent the forcible transfer or forced displacement of population. There are several obligations to strive for the safety and fulfillment of basic needs of civilians in the event of evacuation and to ensure that the displaced civilians can immediately return to their places of origin. In circumstances, acts that cause forcible transfers or forced displaced civilians might be categorized as war crimes, crimes against humanity and/or genocide. Concerning the violations of the international humanitarian law relating the forcible transfer of civilian population due to war, the state is obliged to carry out the law enforcement against the persons involved who are under its jurisdiction. In addition, no State shall be allowed to absolve itself of any liability incurred by itself in respect of breaches referred to the rules discussed
