Abstract

Penelitian ini bertujuan untuk mendeskripsikan ketentuan implementasi Prinsip Subrogasi di dalam Perjanjian Asuransi Kendaraan Bermotor; hal-hal yang menjadi hambatan pihak tertanggung dalam pengajuan klaim; serta tanggungjawab PT Pan Pacific Insurance mengenai prinsip subrogasi atas kerugian yang disebabkan oleh keterlibatan pihak ketiga. Untuk mencapai tujuan tersebut, penelitian ini menggunakan pendekatan yuridis-normatif yang dilaksanakan dengan berdasar pada tinjauan bahan pustaka atau data sekunder. Selain itu, penelitian ini juga dipertajam dengan metode penelitian studi empiris yang biasa pula disebut dengan penelitian hukum sosiologis. Adapun jenis penelitian ini adalah deskriptif analisis, dengan jenis data yang terdiri dari 2 (dua), yakni data primer dan data sekunder. Sedangkan teknik analisis data yang digunakan dalam penelitian ini adalah teknik analisis data kualitatif. Hasil penelitian menunjukan bahwa PT Pan Pacific Insurance sama halnya dengan perusahaan asuransi pada umumnya dalam pengaplikasian asuransi, dimana menawarkan prinsip subrogasi sebagai salah satu dasar dalam pengaplikasian asuransi. Dalam pelaksanaannya, terdapat berbagai hambatan yang berasal dari perusahaan asuransi sendiri maupun pihak tertanggung. Tanggung jawab perusahaan asuransi atas klaim ganti rugi, sesuai dengan nilai limit nominal pertanggung. Dengan demikian, maka sisa kekurangan dari biaya perbaikan terhadap objek asuransi ditanggung oleh pihak ketiga sesuai dengan kesepakatannya bersama pihak tertanggung.

Abstract

Fire Insurance protects against the danger of property loss or damage. Parties with an interest in the insured object accept the risk of loss. Indemnity (or the principle of loss) plays a role in ensuring equitable compensation. Subrogation will apply against the insured to ensure that the insurance policy runs properly and without loss between the insurer and the insured. The goal of this study is to discuss and explain the Indemnity Principles and Insurable Interest in relation with Fire Insurance. The descriptive qualitative method was employed in the research. Primary and secondary sources of data were gathered. Data analysis techniques included data collection, data reduction, data presentation, and data verification. The study's findings show that PT. Tokio Marine merely recovers the insured's financial condition to its pre-incident state. PT. Tokio Marine will not face risk adjustments as a result of an occurrence because the company only accepts risks that are uncertain and occur suddenly. Subrogation does not occur when the insurer pays the insured a balanced loss (indemnity principle). However, if the insurance covers only a portion of the loss, the subrogation principle applies.

Abstract

The development of information and communication technology has had a significant impact on various sectors of life, including the banking sector. The legal system has made essential safeguards to protect bank and customer data security. The latest information regarding developments in the Indonesian Kapital data leak case must be sought through trusted news sources or contacting authorities such as the OJK or Bank Indonesia to obtain accurate and up-to-date information. The Consumer Protection Law seeks to protect bank customers by limiting standard clauses that cannot be avoided in today's banking business world. The method in this research uses normative legal research. Issues that occur in the banking world relate to the legal position of banking in cases of leakage of Indonesian Sharia Bank customer data and banking legal protection efforts that have been carried out by the legal system to protect the security of bank data and customer data. There are two factors that cause leaks of customer personal data, namely internal and external factors. Cases of customer data leakage are serious violations of privacy and information security. Banks, including Islamic banks, have a big responsibility in maintaining the confidentiality of customer data and protecting their personal information. If a data leak occurs, the bank could face legal and regulatory consequences, and could potentially harm their reputation. The method in this research uses normative legal research.

Abstract

Ideally, legal protection for children born out of wedlock should ensure that they receive civil rights equivalent to those of legitimate children without discrimination. In reality, there are still differences in treatment between positive law in Indonesia, especially after the Constitutional Court Decision No. 46/PUU-VIII/2010, and Islamic law, which holds differing views on the status of children born out of wedlock. The challenge lies in how to harmonize legal protection for these children amidst the differing perspectives between positive law and Islamic law, ensuring that their civil rights are upheld while also minimizing negative social impacts, such as fornication. The purpose of this study is to analyze and compare legal protection for children born out of wedlock according to the Constitutional Court Decision and Islamic law and to seek solutions that can integrate both perspectives to create fair and dignified legal protection. The methodology used in this study is a normative juridical approach, examining various laws, court decisions, and related Islamic legal literature. The results of the research indicate that although there are differences in views between the Constitutional Court's decision and Islamic law, the integration of both approaches can provide more comprehensive legal protection for children born out of wedlock. By balancing both perspectives, it is hoped that it will guarantee the civil rights of these children while also preserving societal morality by minimizing the practice of fornication.

Abstract

Purpose: of the study is to provide knowledge and comparative analysis of witness rules in the burgerlijk wetboek/civil procedural law in Indonesia and Islamic civil procedural law as well as to provide a comparison of witness arrangements in the burgerlijk wetboek/civil procedural law in Indonesia and the burgerlijk wetboek/Islamic civil procedure law. Result: Civil procedural law makes witnesses not perfect evidence. However, for the religious court in the case of divorce, the witness seems to have the same power as a letter, even thought in principle it is different. Contribution: This condition seems to make civil procedural law in the Islamic religious court the same as the law stipulated in the Quran&Hadith. Where as civil procedural law in Indonesia is the same between state and religious courts.

Abstract

This research can be categorized as a type of observational legal research with a survey method. In observational research, the author makes direct observations in the field to collect information and data relevant to this research topic. Further, in terms of the nature of the research, it is descriptive in nature. This research was carried out in the PTPN III Medan environment, with the center of research attention being at PT. Nusantara Plantation III (PTPN III) Medan. The location of PTPN III Medan is located in the Medan area, and this company has become the focus of research because of its involvement in the implementation of the SOE Minister's regulations regarding partnerships with Small and Medium Enterprises (UKM) actors in the region. The data collected will be processed and grouped based on findings from research, interviews and questionnaires. Data analysis will involve interpreting the results, comparing them with the views of experts, as well as comparing them with applicable laws and regulations. The results of this analysis will help identify the implementation of the Minister of BUMN's regulations in the context of SME partnerships within PTPN III Medan based on dignified justice. Based on the conclusions, although the BUMN Ministerial Regulation provides an important framework, the weaknesses identified in the context of SME partnerships within PT. Perkebunan Nusantara III Medan needs to be addressed. Efforts to overcome these obstacles need to be carried out strategically, involving related parties including PTPN III and the government, to ensure that SME partnerships can run optimally according to the expected goals. The construction of BUMN Ministerial Regulation Number Per-05/Mbu/04/2021 regarding SME partnerships plays a vital role in ensuring partnerships that are based on fair, dignified and sustainable principles.
