Abstract

Organ and Tissue Transplantation Is a practice that shows successful developments in the medical world, Organ Transplantation activities are closely related to the fulfillment of human rights for living and dead donors, understanding the concept of human rights protection needs to be carried out with a biomedical approach in order to create legal protection for donors and donor recipients. This research is a normative juridical research method with library research (Library Research) in practice by examining legal concepts and legal sources that will be a reference in analyzing human rights and biomedicine. The results that can be found that the rule of law in Indonesia lacks the rights of donors and recipients of donors, reviewing the human rights of donors and accepting transplant donors in the medical aspect, so you can see the concept of Human Rights and Biomedicine.

Abstract

Abstrak : Tujuan penelitian ini adalah untuk mengetahui Peran Ilmu Falak dalam Menentukan Arah Kiblat. Jenis penelitan ini adalah penelitian kualitatif dengan teknik field research (Observasi, studi pustaka dan dokumentasi). Sumber data yaitu data primer dan data sekunder. Teknik analisis data dalam penelitian ini adalah miles and huberman, yaitu : reduksi data, penyajian data dan penarikan kesimpulan. Pembahasan pada penelitian ini adalah. Penentuan arah kiblat yang dilakukan oleh umat Islam di Indonesia mengalami perkembangan dari waktu ke waktu sejalan dengan perkembangan ilmu pengetahuan yang ada. Pertama kali, mereka menentukan arah kiblatnya ke barat dengan alasan Saudi Arabia tempat dimana Ka’bah berada terletak di sebelah barat Indonesia. Hal ini dilakukan dengan kira-kira saja tanpa perhitungan dan pengukuran terlebih dahulu. Oleh karena itu, arah qiblat sama persis dengan tempat matahari terbenam. Dengan demikian, arah kiblat itu identik dengan arah barat.Kata Kunci: Ilmu Falak, Kiblat

Abstract

Illegal marriage is a strange phenomenon that is still intense in the Acehnese community. In fact, Islam has very clearly forbade any form of marriage that is carried out in secret in order to produce a harmonious family and social community. The occurrence of illegal marriages when the condition of the bride still has a nasab guardian is a practice that is allegedly in bad faith, one of which is because the husband still has a legal wife who does not agree to polygamy. There are also those who do illegal marriages because they want to find an alternative to their work which prohibits polygamy status. This reality is a reality that can harm many parties, both for family members and society. In response to this, the Lhoksukon KUA has implemented various policies so that the problem of illegal marriages can be minimized. This article belongs to field research with a qualitative approach. The methodology used is a phenomenological study of the actions of KUA Lhoksukon North Aceh. The results of the study concluded that the KUA Lhoksukon North Aceh carried out various activities to prevent illegal marriage by way of socialization and guidance to the community regarding the negative impact of illegal marriage.

Abstract

Penetapan waktu dan juga penanggalan adalah hal yang paling penting dalam keberlangsungan hidup manusia selain sebagai pengingat kejadian peristiwa besar berlangsung juga sebagai acuan dalam mengatur kehidupan, apalagi dalam hal beribadah. Dalam agama Islam hal yang menjadi pondasi utama yang hendaknya dijalankan oleh umat Muslim adalah beribadah kepada Allah Sang Maha Pencipta, dalam melaksanakan ibada tersebut umat Muslim sangat memerlukan penetapan waktu terlebih pada ibadah yang sifatnya tahunan seperti puasa, haji dan lainnya. Dalam islam penetapan waktu dan penanggalan ini disebut dengan Hijriah karena dilatbelakangi diambil dari pertama sekali kejadian Rasulullah melaksanakan hijrah. Namun, penanggalan dalam islam masih memilki beberapa problematika karena dalam menetapkannya terdapat dua metode yaitu dengan metode hitungan atau hisab dan metode rukyat. Kedua hal ini jika tidak dipahami akan mudah menimbulkan perpecahan karena sesungguhnya kedua metode ini mempunyai landasan yang sama-sama berasal dari Allah dan disampaikan oleh rasulullah kepada umatnya. Kedua metode ini diadopsi oleh organisasi sosial masyarakat yang terkenal dan berada di Indonesia yaitu Muhammadiyah dan nahdatul Ulama. Muhammadiyah dikenal dengan metode hisabnya sedangkan nahdatul Ulama dikenal dengan metode rukyatnya. Perrbedaan pemahaman akan penetapan kalender hijriah ini setiap tahunnya diperbincangkan dan ditakutkan berdampak pada perpecahan umat Muslim. Hal inilah yang melatar belakangi peneliti dalam menulis pembahasan diantara keduanya dalam menggunakan metode yang diadopsi oleh masing-masing. Penelitian ini dilakukan dengan menggunakan metode kepustakaan atau liberary research dengan mengumpulkan data-data melalui artikel, buu, jurnal dan literatur lainnya. Dalam atulisan ini akan dibahas mengenai bangaimana penetapan kalender hijriah menurut ulam Muhammadiyah dan ulama Nahdatul Ulama, agar membuka wawasan masyarakat bahwa keduanya mempunyai landasan hukumnya masing-masing dalam agama Islam.

Abstract

Research The problem of inheritance seems to never end to be discussed, although the rules regarding Islamic inheritance have been very detailed and regulated in the Qur’an, but there are still problems caused in social life. This paper wants to explain how the development of inheritance law in Indonesia, this paper itself directs Hazairin's thoughts in bringing about the renewal of the concept of Islamic inheritance in Indonesia. This research is literature research or often referred to as normative juridical, because this research does not use primary data sources, but only uses secondary data sources in the form of primary legal materials and secondary legal materials and if necessary also uses tertiary legal materials. The research shows that Hazairin believes the inheritance law system desired by the Qur’an is bilateral, this belief is extracted from the interpretation of the inheritance verses contained in the Qur’an itself. The influence of Hazairin's thought has very implications for the national legal system, this can be marked by the application of successor heirs in the Compilation of Islamic Law which is the main reference of religious courts in Indonesia (;).Permasalahan waris seperti tidak pernah habis untuk dibahas, walaupun aturan tentang waris Islam sudah sangat detail diatur dalam Alquran namun tetap saja ada permasalahan yang ditimbulkan dalam kehidupan sosial. Tulisan ini ingin menjelaskan bagaimana perkembangan hukum waris di Indonesia, tulisan ini sendiri mengarahkan pemikiran Hazairin dalam membawa pembaharuan konsep waris Islam di Indonesia. Penelitian ini adalah penelitian kepustakaan atau sering disebut dengan yuridis normatif, karena penelitian ini tidak memakai sumber data primer, melainkan hanya memakai sumber data sekunder yang berupa bahan hukum primer dan bahan hukum sekunder serta jika diperlukan juga memakai bahan hukum tersier. Hasli penelitian menunjukkan bahwa Hazairin berkeyakinan sistem hukum waris yang diinginkan oleh Alquran adalah sistem bilateral, keyakinan ini digali dari penafsiran ayat-ayat waris yang terdapat dalam Alquran sendiri. Pengaruh dari pemikiran Hazairin tersebut sangat berimplikasi dalam tata hukum nasional, hal ini bisa ditandai diterapannya ahli waris pengganti dalam Kompilasi Hukum Islam yang merupakan rujukan utama Pengadilan Agama di Indonesia

Abstract

According to the Civil Code, a marriage agreement is an agreement made by the prospective husband and wife before the marriage takes place, containing the consequences of the marriage on property. There are three forms of the agreement, namely: togetherness of profit and loss, togetherness of results and elimination of togetherness of assets. The marriage agreement must be drawn up by a notary and its contents cannot be changed. While the concept of a marriage agreement in Islamic law states that there are two forms of agreement in a marriage, namely divorce suspension and other agreements that are not contrary to Islamic law, divorce suspension is an agreement pronounced by the groom after the contract is stated in the marriage certificate in the form of a promise of divorce hanging on a certain situation. The marriage agreement in Islamic Law must be ratified by the Marriage Registrar. The results is Marriage agreements that are still taboo in the general public have now become a trend among artists, officials, businessmen, or people with money. They are generally of the view that with the existence of a marriage agreement, the property of each partner is still safe and belongs to them. Even they are not willing if their property is mixed with their partner.

Abstract

The concept of a sakinah family is a conception offered by Muhammadiyah as a solution to form an ideal family in accordance with Islamic law. The concept of a sakinah family indirectly supports the development of government legal policies in an effort to build a more harmonious and prosperous Indonesian family. This study aims to analyze the application of the sakinah family conception to the Muhammadiyah family in Medan City. This research is an empirical legal research with descriptive qualitative data analysis. Primary data were obtained from interviews and secondary data in this study included laws and regulations, the Fatwa of the Tarjih Council, as well as relevant books and journal articles. The results of the study confirm that the implementation of the sakinah family conception is carried out by focusing on the implementation of the three main functions of the family, namely on the religious aspects, affection and legal protection. Even though it has been implemented, the implementation of the Muhammadiyah/Aisyiyah organization in Medan City can be said to be not optimal because there is no comprehensive understanding due to the lack of optimal socialization related to the conception of the sakinah family to Muhammadiyah/Aisyiyah members in Medan City. The contribution and active participation of Muhammadiyah/Aisyiyah members in Medan City is the most important element as emphasized by Chambliss and Seidman that the implementation of law is influenced by non-legal aspects which in this context, religious (religious) aspects occupy an important aspect in realizing family development through the application of the family conception. sakinah proclaimed by Muhammadiyah.

  Abstract                                                                          Based on article 22 of PP Number 9 of 1975, article 76 of Law Number 7 of 1989 and article 134 of Presidential Instruction Number 1 of 1991, Divorce (syiqaq) where disputes and quarrels are continuous must be proven by witness testimony, so The position of the witness is an important thing in deciding a divorce case. Witnesses who are present in court must materially see, hear and experience directly the legal events that occur, this must be in accordance with article 172 HIR/308 Rbg in conjunction with article 76 Law Number 7 of 1989. Meanwhile, in Islamic law, the position of deaf witnesses is that the majority of ulama seemed to have absolutely no tolerance for their opportunity to be witnesses. They agreed that hearing what the parties said and understanding what they meant was an absolute requirement for witnesses. The argument is because something that is the object of the witness is words.
