Abstract

Most people with disabilities do not have a decent life because they do not have the opportunity to work. This fact contradicts the provisions of Law Number 8 of 2016 concerning Persons with Disabilities, which states that persons with disabilities are entitled to equal opportunities and treatment to work in accordance with Janis and their level of disability, education and abilities. The problem is, the provisions regarding workers with disabilities are not regulated in the main Manpower Act, namely Law Number 13 of 2003 concerning Manpower. The type of research used is normative legal research using a statute approach and a conceptual approach. And it can be concluded that there has been an inconsistency between laws and regulations and a legal vacuum regarding the right to work for workers with disabilities in the Manpower Act.

Abstract

Penelitian ini bertujuan untuk mengetahui pelaksanaan perjanjian kerja waktu tertentu dan faktor-faktor yang mempengaruhi pelaksaaan perjanjian kerja waktu tertentu di PT. Indocare Pacific cabang Lombok.Jenis penelitian ini adalah penelitian hukum empiris dengan menggunakan metode pendekatan perundang-undangan, pendekatan koseptual, pendekatan sosiologis.Teknik pengumpulan data menggunakan data kepustakaan dan data lapangan dari hasil wawancara yang dianalisis secara deskriptif-kualitatif. Hasil penelitian setelah dianalisis bahwa pelaksanaan perjanjian kerja waktu tertentu di PT. Indocare Pacific cabang Lombok tidak sesuai dengan Undang-Undang Cipta Kerja.Dan faktor-faktor yang mempengaruhi pelaksanaan perjanjian kerja waktu tertentu di PT. Indocare Pacific cabang Lombok yaitu faktor yuridis dan faktor non yuridis.

Abstract

Penelitian ini bertujuan untuk mengetahui sejauh mana pelaksanaan perlindungan hukum bagi pekerja kurir dan apa saja faktor-faktor yang mempengaruhi pelaksanaan perlindungan hukum bagi pekerja kurir di Ginta Cargo Logistik. Jenis penelitian yang digunakan dalam melakukan penelitian ini adalah jenis penelitian hukum normatif-empiris. Dari hasil penelitian yang telah dilakukan diperoleh hasil penerapan pelaksanaan peraturan terkait waktu kerja, mengaso, cuti, upah dan jaminan sosial tenaga kerja terhadap pekerja kurir di Ginta Cargo Logistik dan terdapat beberapa faktor yang mempengaruhi pelaksanaan perlindungan hukum bagi pekerja kurir baik itu faktor pendukung dan faktor penghambat.

Abstract

This research aims to study the legal protection against the portersin climbing National Park of Rinjani Mountain as well as the factors that affect such legal protection.This study is an empirical legal research that uses facts taken from human behavior.This research shows that: there are still many portersdo not have a licence as a porter from the Office of National Park of Rinjani Mountain which results in lack of legal protection which can be provided by trekking organizers, whereas working as a porter is a high-risk job for the reason that the terrain traversed is very steep, namely the mountain.

Abstract

Itsbat nikah adalah suatu ketetapan yang dibuat berdasarkan keyakinan dalam ikatan pertalian atau hubungan antara laki-laki dan perempuan untuk membentuk suatu rumah tangga atau keluarga yang bahagia berdasarkan Ketuhanan yang Maha Esa. Proses pengajuan permohonan itsbat nikah ini khusus bagi yang beragama Islam, terutama bagi mereka yang tidak dapat membuktikan terjadinya pernikahan dengan akte nikah, dapat mengajukan permohonannya (penetapan/pengesahan nikah) kepada Pengadilan Agama sebagaimana diatur dalam pasal 7 Kompilasi Hukum Islam, namun itsbat nikah ini hanya dimungkinkan bila berkenan dengan: a) Dalam rangka penyelesaian perceraian; b) Hilangnya aktanikah; c) Adanya keraguan tentang sah atau tidaknya salah satu syarat pernikahan; d) Pernikahan terjadi sebelum berlakunya UU No. 1 Tahun 1974 tentang perkawinan; e) Perkawinan yang dilakukan oleh mereka yang tidak mempunyai halangan perkawinan menurt UU No. 1 Tahun 1974 (Pasal 7 Kompilasi Hukum Islam). Berdasarkan hal tersebut apabila terdapat salah satu dari kelima alasan di atas yang dapat dipergunakan, maka dapat mengajukan permohonan itsbat nikah ke Pengadilan Agama. Sebaliknya, akan sulit apabila tidak memenuhi salah satu alasan yang ditetapkan, akan tetapi Hakim Pengadilan Agama harus merespon dan menjawab segala macam permohonan dan gugatan yang diajukan. Oleh karena itu dalam pelaksanaan pengabdian ini kami bersama tim telah memberikan informasi dan pengetahuan tentang prosedur Itsbat Nikah serta tujuan pentingnya dilaksanakan Itsbat Nikah pada masyarakat yang perkawinanya belum tercatatkan sesuai dengan ketentuan peraturan per-undang-undangan. Itsbat nikah sangat bermanfaat bagi warga masyarakat khususnya umat Islam untuk mengurus dan mendapatkan hak-haknya yang berupa surat-surat atau dokumen pribadi yang dibutuhkan dari instansi yang berwenang serta memberikan jaminan perlindungan kepastian hukum terhadap masing-masing pasangan suami istri, termasuk perlindungan terhadap status anak yang lahir dari perkawinan itu, dan perlindungan terhadap akibat hukum yang akan muncul kemudian.

Abstract

This study aims to determine how the rights and obligations of workers/laborers in PT. Semen Indonesia Distributor Lombok in terms of Law Number 13 of 2003 concerning Manpower and Law Number 11 of 2020 concerning Job Creation and to find out factors that hinder the implementation of the rights and obligations of workers/ laborers who work at PT. Semen Indonesia Distributor Lombok. This research is an empirical normative legal research. This study concludes that the implementation of workers' rights has been carried out well. However, there are also workers' rights that are still not maximized, namely the right to social security for non-permanent workers, and regarding occupational health and safety (K3), it is necessary to have stricter regulations and supervision. from related parties in order to achieve a balance between the rights and obligations of workers.

Abstract

The purpose of this study is to find out the judge’s legal consideration when deciding on the termination of work agreement based on positive law in Indonesia and to find out the right of workers after the termination of work contract with the company. The research method in this research uses the juridical-normative research method. The result of this study showed that the judges in the court had decided on the termination of the work contract between PT. Amman Mineral Nusa Tenggara (PT. AMNT with their six workers based on Article 1 paragraph 15 and Article 164 paragraph 3 Act Number 13 of 2003 concerning Manpower. The implementation of Article 1 Number 15, in this case, is correct, whereas the implementation of Article 164 paragraph 4 is rather not correct, because the Indonesia Constitution Court had decided this article contrary to Indonesia National Constitution in the Case Number: 19/PUU-IX/2011 20 June 2012. The workers’ rights that they have after the termination of the work contract are in the form of severance pay, service pay, and compensation for workers’ rights based on Industrial Work relation Court in Mataram National Court Number 15/Pdt.Sus-PHI/2018/PN.Mtr. This court decision is according to Article 156 Act Number 13 of 2003 concerning Manpower.

Abstract

This research purposes are to know the implementation of economical protection for Indonesian migrant worker in Mataram, which discuss how its implementation and what is inhibiting factors in implementation. Method of this study is empirical legal research. Based on research’s result, it can be known that economical protections are in the form of providing social security, wages protection and also socialization on the wages. The provision of social security and also the socialization carried out for Indonesian Migrant Workers from an economic, social and technical perspective has been carried out well. The factors that hinder the implementation of economic protection for Indonesian Migrant Workers are the lack of information from the relevant apparatus, the illegal status of Indonesian Migrant Workers, and the lack of knowledge of Indonesian Migrant Workers in managing the wages earned during their work.

Abstract

This study aims to determine the factors and implementation of occupational safety and health programs for health workers during the Covid-19 pandemic based on Law No. 13 of 2003 at the Anugerah Ibu Mataram Clinic. The method used is an empirical normative legal research method. Based on the study results, the Anugerah Ibu Mataram Clinic does not have specific guidelines regarding occupational safety and health programs. However, based on Law Number 13 of 2003, the Anugerah Ibu Mataram Clinic has implemented occupational safety and health regulations, especially during this pandemic, well performed. This occupational safety and health program influenced by several factors, namely juridical factors and non-juridical factors.

Abstract

This research has the purpose to analyze the rights of the PKWT workers who get work termination and how the judge’s legal consideration when giving court decision in the Industrial court Decision Number 15/Pdt.Sus-PHI/2020/PN Mtr. This research uses normative-legal research. The approach method uses the statute approach, the conceptual approach, and the cases approach. The type of legal materials in this study uses primary legal materials, secondary legal materials, and tertiary legal materials. The legal materials are collected by a library study. The research analysis in this study uses qualitative legal analysis. Based on this research, the right of PKWT workers who get termination is based on the Industrial Court Decision Number 15/Pdt.Sus-PHI/2020/PN Mtr is not according to the positive law in Indonesia. In this case, Judges are only considering the juridical factors without considering the non-juridical factors.
