Abstract

The study on the supervision of the DPR RI on the performance of BPJS Health is important at least for several reasons: First, the lack of optimal oversight of the DPR's supervisory function has resulted in many violations of the implementation of the laws that have been formed. Second, it is important to find out where the role of the House of Representatives (DPR) is as a state institution that has a supervisory function over the policies that have been taken through Law No. it influences the performance of BPJS. The formulation of the problem in this research is: First, how is the implementation of the supervisory function of the House of Representatives of the Republic of Indonesia on the Social Security Administering Body (BPJS) for Health? Second, What is the obstacles to the implementation of the DPR RI's supervisory function on the performance of the Health Social Security Administering Body (BPJS)? The theoretical framework used in this research is Monitoring Theory. The research method used in this study uses empirical legal research methods. The conclusion of the study: the inability of the DPR-RI in carrying out its function to question various government policies that are deemed less popular or suspected of having no major benefits for the community.

Abstract

Currently, investigations into criminal acts of corruption in Indonesia are carried out by the Corruption Eradication Commission (KPK), the Police and the Attorney General's Office. The three institutions have the authority to investigate corruption. This is regulated in Article 3 paragraph (1) Memorandum of Understanding Between the Corruption Eradication Commission, the Attorney General's Office, and the Police Number: SPS-97/01-55/03/2017, Number: KEP-087/A/JA/03/2017, Number : B/27/III/2017 dated 29 March 2017 However, in practice, these provisions do not work as they should, such as overlapping duties and authorities. There are 3 discussions of issues that are focused on in this study, namely how is the system for eradicating corruption in Indonesia's current positive law? what is the concept of a synergy system carried out by law enforcement officials (KPK, Police and Prosecutors' Office) in eradicating criminal acts of corruption in Indonesia? And what is the strategy of the Indonesian government in eradicating criminal acts of corruption in the future? The conclusion in this study is that the government together with the legislature has created a legal instrument that is used to eradicate criminal acts of corruption which is embodied by Law Number 31 of 1999 as amended by Law Number 20 of 2001 concerning Amendments to Laws -Law No. 31 of 1999 concerning Eradication of Corruption Crimes. Several integration systems that can be carried out by the Attorney, Police and Corruption Eradication Commission in eradicating corruption include establishing an inter-institutional interaction system, establishing an operational work system and mechanism as well as establishing a monitoring and development system. The Indonesian government's strategy to prevent corruption in the future can be carried out through the integrity system within the scope of the KPK, the Police and the Attorney General's Office. Besides that, the KPK also has a special strategy in Corruption Eradication for the vision of Indonesia free from corruption, this strategy is known as the Trisula strategy, namely law of enforcement, law of prevention and law of education.

Abstract

Indonesia's economic growth is still centered on the island of Java, thus demanding the Government to conduct development outside Java. PT Hutama Karya (Persero) received a mandate from the Government to develop and build the Trans Sumatra Toll Road through Presidential Regulation No. 100/2014 was then amended through Presidential Regulation No. 117/2015. With the construction of toll roads on the island of Sumatra, economic growth there is hoped to increase. With the Trans Sumatra Toll Road, a rest area is needed to support road users when traveling. PT Hutama Karya entered into a lease agreement with tenants in the managed Toll Road rest area to rent out rental space in the rest area. This study aims to determine whether the laws and regulations regarding the PT Hutama Karya (Persero) OPT Division Rest Area Agreement have fulfilled the Legal Aspects of the Agreement and the Legal Aspects of Justice.

Abstract

Infrastruktur jalan tol di Pulau Sumatera merupakan salah satu infrastruktur yang diprioritaskan pembangunannya. Disebabkan proyeknya yang layak secara ekonomi namun tidak layak secara finansial, pengusahaan jalan tol dilakukan oleh pemerintah melalui penugasan kepada PT Hutama Karya (Persero). Tentunya, penugasan ini akan membebani perusahaan dan bahkan merugikan perusahaan, karena proyeknya tidak layak secara finansial. Sepatutnya proyek penugasan dijamin oleh pemerintah, baik dari segi keuntungan maupun pinjaman, sehingga tidak merugikan perusahaan, karena perusahaan perseroan memiliki tujuan umum untuk mendapatkan keuntungan. Tujuan penelitian ini ialah untuk mengetahui dasar-dasar hukum mengenai penugasan pemerintah untuk pembangunan infrastruktur dan kompensasinya bagi perusahaan perseroan, dan untuk melihat apakah dasar hukum tersebut sesuai dengan proses bisnis pengusahaan jalan tol. Metode yang digunakan dalam penelitian ini adalah penelitian hukum normatif. Pendekatan yang dilakukan adalah yuridis konseptual, dengan cara menelaah konsep kelayakan investasi pengusahaan jalan tol, arus suntikan dana segar dari pemerintah untuk BUMN, dan peraturan perundang-undangan terkait penugasan pemerintah kepada BUMN. Hasil penelitian ini menunjukkan bahwa hukum yang ada belum sesuai dengan kondisi bisnis pengusahaan jalan tol. Dalam peraturan yang mengatur kompensasi kerugian akibat penugasan, belum dijelaskan kondisi-kondisi kerugian, dan dalam praktek hukum tersebut, masih dirasa hanya sesuai untuk penugasan penyediaan barang publik, seperti listrik dan bahan bakar minyak (BBM). Sehingga, perlu adanya penyesuaian peraturan atau peraturan baru yang menjelaskan tata cara atau pedoman kompensasi kerugian akibat penugasan pengusahaan jalan tol yang tidak layak secara finansial.

Abstract

Provision of road infrastructure at local and regional level is still having a problem in financing and public private partnership (PPP) still cannot solve the problem. Project bundling for PPP is a great option to improve the financial feasibility of smaller value projects. It may be appropriate for the PPP legal framework to provide and support bundling, to make project bundling run smoothly, in order, and achieve its original purpose. This paper is trying to see if the laws and regulations for PPP can provide and support project bundling. The methods used are normative juridical by legislation approach and conceptual approach. This paper concludes that the law providing PPP cannot yet support project bundling properly, caused by the lack of law and inconsistencies in Indonesian Ministerial Regulations that regulates PPP. This calls for a law revision or at least an intervention by policies to support bundling for smaller projects.

Abstract

This study aims to describe the procedures and barriers associated with compensating disease sufferers who are not eligible to receive the COVID-19 vaccine. The research method used is normative research, which focuses on analyzing legal aspects based on legal regulations, including Presidential Regulation Number 99 of 2020, concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Overcoming the 2019 Coronavirus Disease (COVID-19) Pandemic, as well as regulations other relevant matters. Research data was obtained through literature study and document analysis, including primary and secondary legal materials. Data analysis was carried out descriptively and qualitatively with a deductive approach, which refers to general legal principles. The research results identified various obstacles, including technical problems such as a lack of public discipline in undergoing health checks before receiving vaccination and a lack of compliance from medical personnel who manage vaccination procedures per established guidelines. As a result, some groups of people who should not receive the COVID-19 vaccine still receive vaccination, which can ultimately cause side effects. The research also highlights Presidential Regulation Number 14 of 2021 concerning Procurement of Vaccines and Implementation of Vaccinations in the Context of Overcoming the COVID-19 Pandemic, which provides compensation guarantees following applicable regulations if a Post-Vaccination Adverse Event (AEFI) occurs which has the potential to cause disability or death in sufferers of the disease who are not eligible to receive the COVID-19 vaccine. The results of this research provide a deeper understanding of the challenges and obstacles in implementing COVID-19 vaccination, especially in the context of disease sufferers who do not meet the requirements to receive the vaccine, as well as the importance of guaranteeing compensation in AEFI situations that have the potential to have profound impacts.

Abstract

Abstrak- Krisis ekonomi dan moneter yang terjadi di Indonesia pada kurun waktu 1997-1998 merupakan pukulan yang sangat berat bagi sistem perekonomian Indonesia. Dalam periode tersebut banyak lembaga-lembaga keuangan, termasuk perbankan mengalami kesulitan keuangan. Seiring dengan diberlakukannya dual banking system oleh Undang-Undang Nomor 10 Tahun 1998 Tentang PerbankanBerdasarkan. Undang – Undang Nomor 21 tahun 2008 tentang Perbankkan Syariah, pengertian Perbankkan Syariah adalah segala sesuatu yang menyangkut tentang Bank Syariah dan Unit Usaha Syariah., mencakup kelembagaan, kegiatan usaha, serta cara dan proses dalam melaksanakan kegiatan usahanya (pasal 1 angka 1). Sedangkan yang dimaksud dengan bank adalah badan usaha yang menghimpun dana dari masyarkaat dalam bentuk kredit dan/atau bentuk lainnya dalam rangka meningkatkan taraf hidup rakyat (pasal 1 angka 2) Dengan demikian, lembaga perbankan yang kegiatan usahanya berdasarkan pada prinsip-prinsip syariah maka dapat dikatakan sebagai perbankan syariah. Kerangka hukum pengembangan industri perbankan syariah diwadahi dalam Undang-Undang Nomor 7 Tahun 1992 tentang Perbankan yang memperkenalkan “sistem bagi hasil” atau “prinsip bagi hasil” dalam kegiatan perbankan nasional. Setelah lahirnya UndangUndang Nomor 10 Tahun 1998 tentang Perubahan atas Undang-Undang Nomor 7 Tahun 1992 tentang Perbankan, bank Islam tersebut tidak lagi dinamakan dengan “bank berdasarkan prinsip bagi hasil”, tetapi dengan nama baru, yakni “Bank Berdasarkan Prinsip Syariah”.Kata Kunci: Kasus, Perbankkan, Hukum, .

Abstract

Abstrak-Pengertian Hak Paten atau definisi hak paten adalah hak ekslusif yang diberikan oleh negara kepada inventor atas hasil invensinya di bidang teknologi, yg untuk selama waktu tertentu melaksanakan sendiri invensinya tersebut atau memberikan persetujuannya kepada pihak lain untuk melaksanakannya. Pengertian Hak Paten atau definisi hak paten merupakan bentuk perlindungan hak kekayaan intelektual yang sangat efektif karena dapat mencegah pelaksanaan invensi oleh pihak lain tanpa seizin pemegang hak paten, walaupun pihak lain tersebut memperoleh teknologinya secara mandiri (bukan meniru). Menurut UU hak paten No. 14 Tahun 2001 (UU hak paten 2001), hak paten diberikan untuk invensi yang memenuhi syarat kebaruan, mengandung langkah inventif & dapat diterapkan dalam industri selama 20 tahun.Kata Kunci: Hak, Paten, Indonesia

Abstract

AbstrakDokumen rencana tata ruang di Indonesia bersifat hierarkis komplementer. Ditetapkan dalam bentuk produk peraturan perundang-undangan. Dokumen-dokumen Rencana Tata Ruang pada saat disusun haruslah melibatkan peran masyarakat. tahap pelibatan peran Masyarakat dalam penyusunan Rencana Tata Ruang ini sebagai upaya untuk mengakomodasi kebutuhan Masyarakat dalam Penyelenggaraan Penataan Ruang, serta tahap penetapan Rencana Tata Ruang. Dokumen rencana tata ruang merupakan instrumen yang sangat penting karena menyangkut semua remcama pemanfaatan ruang yang menentukan untuk apa dan bagaimana sumber daya dimanfaatkan dalam upaya mewujudkan pembangunan berkelanjutan. Namun di sisi lain terdapat Putusan Mahkamah Agung yang menyatakan beberapa pasal yang mengatur peruntukan ruang dalam rencana tata ruang tidak sah dan tidak berlaku umum. Tulisan ini disusun dengan cara meneliti bahan kepustakan atau data sekunder sebagai bahan dasar untuk diteliti dengan cara mengadakan penelusuran terhadap peraturan-peraturan dan literatur-literatur yang berkaitan dengan pemanfaatan ruang, pengaturan komposisi Ruang Terbuka Hijau, dan terkait permohonan uji materiil peraturan perundang-undangan di Indonesia.Kata Kunci: Rencana Tata Ruang, Ruang Terbuka Hijau, Uji Materiil.AbstractSpatial planning documents in Indonesia are complementary and hierarchical. As we known as a one of laws and regulations. Spatial Planning Documents at the time of preparation must involve the role of the community. The Stage of involving the community's role in the preparation of this Spatial Plan as an effort to accommodate the needs of the Community in the Implementation of Spatial Planning, as well as the stage of determining the Spatial Plan. The spatial planning document is a very important instrument because it involves all types of spatial use that determine what and how resources are used in an effort to realize sustainable development. However, on the other hand, there is a Supreme Court Decision which states that several articles governing the allocation of space in spatial plans are invalid and not generally applicable. This paper by examining library materials or secondary data as the basic material to be researched by conducting a search on regulations and literature related to space utilization, setting the composition of Green Openspace, and related application for judicial review of laws and regulations in Indonesia.Keywords: Spatial Planning, Green Openspace, Judicial Review.

Abstract

Abstrak-Persaingan usaha dalam zona ekonomi dimanapun merupakan sebuah kewajaran.Dalam dunia ekonomi yang mencakup perdagangan tentu kata "persaingan" menjadi halyang sangat familiar. Persaingan dalam perdagangan atau dalam jenis dunia usaha apapunmerupakan sebuah hal yang wajar terjadi, atau dalam dunia hukum merupakan sebuahconditio sine qua non, sesuatu yang mutlak terjadi dan tidak mungkin terjadi. RumusanMasalah penelitian ini yaitu: Pertama, bagaimana kontruksi nilai-nilai anti monopolidalam UU Cipta kerja ?Kedua, apakah nilai-nilai yang mendasari kontruksi hukum UU Cipta kerja dalampersaingan usaha sesuai semangat ekonomi Pancasila? Metode penelitian yang digunakanadalah metode penelitian hukum normative. Teori yang digunakan adalah Teori KeadilanJohn Rawls. Kesimpulan penelitian: Pertama, bahwa UU Cipta Kerja adalahpenggabungan beberapa produk perundang-undangan yang secara khusus ingin menarikinvestasi demi perkembangan usaha dan pertumbuhan ekonomi Indonesia. Kedua, bahwabahwa nilai-nilai yang digunakan sebagai pondasi penyusunan Undang-Undang CiptaKerja beserta peraturan turunannya yang terkait persaingan usaha ini sudah sesuaisemangat ekonomi Pancasila. Kata Kunci: Keadilan, Persaingan Usaha, Ekonomi Pancasila
